A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LONG BEACH AUTHORIZING THE CITY
MANAGER TO EXECUTE A CONTRACT WITH
COMMERCIAL RECREATION SPECIALISTS, INC.,
WITHOUT ADVERTISING FOR BIDS, TO PROVIDE A
CUSTOM WIBIT WATER PLAYGROUND CONFIGURATION
FOR THE ALAMITOS BEACH WATER PLAYGROUND
PROJECT FOR AN AMOUNT OF $126,179 PLUS A
CONTINGENCY AMOUNT OF $18,927, FOR A TOTAL NOT
TO EXCEED AMOUNT OF $145,106 FOR A PERIOD OF
FIVE YEARS
WHEREAS, the Alamitos Beach Water Playground Project (Project) includes the procurement of custom floating water playground equipment to be placed at Alamitos Beach May 15 through October 15 each year for a five-year period; and WHEREAS, Wibit equipment is currently used at the Bayshore Water Playground; and
WHEREAS, Inflatable play structure manufacturers only produce products in their brand specific materials and colors; and
WHEREAS, Wibit equipment will be used for the Project for continuity of equipment maintenance, repair materials, and colors of materials; and WHEREAS, Commercial Recreation Specialists, Inc. (CRS) is the exclusive open-water distributor for Wibit in the United States; and 26 27
WHEREAS, CRS is the only qualified vendor to provide Wibit equipment to the City of Long Beach and therefore, no useful purpose would be served by advertising 28 for bids and to do so would constitute an idle and useless act and an unnecessary 1 EWM:bg A21-05476 (12-15-2021)

2 NOW, THEREFORE, the City Council of the City of Long Beach resolves as 3 follows:

28 Section 1. The City Manager is hereby authorized to enter into a contract, without advertising for bids, with Commercial Recreation Specialists, Inc., to purchase and provide installation and maintenance for a custom Wibit Water playground configuration for the Alamitos Beach Water Playground Project in an amount of One Hundred Twenty Six Thousand One Hundred Seventy-Nine Dollars ($126, 179), with a 15 percent (15%) contingency in the amount of Eighteen Thousand Nine Hundred Twenty-Seven Dollars ($18,927), for a total contract amount not to exceed of One Hundred Forty-Five Thousand One Hundred Six Dollars ($145, 106), including tax, at the discretion of the City Manager, for a period of five (5) years. If the sole source status of Commercial Recreation Specialists, Inc. changes, City shall publicly bid instead of extending the contract.
Section 2. This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting this resolution.
