A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF LONG BEACH AUTHORIZING THE CITY
MANAGER OR DESIGNEE TO EXECUTE AN AGREEMENT
WITH LCPTRACKER, INC. TO PURCHASE CERTIFIED
PAYROLL REPORTING AND LABOR COMPLIANCE
MONITORING SOFTWARE, AND AS-NEEDED SUPPORT,
ON THE SAME TERMS AND CONDITIONS AFFORDED
THROUGH THE GENERAL SERVICES ADMINISTRATION
(GSA) CONTRACT, IN AN ANNUAL AMOUNT NOT TO
EXCEED $55,000, UNTIL THE GSA CONTRACT EXPIRES
ON MAY 7, 2024, WITH THE OPTION TO RENEW FOR AS
LONG AS THE GSA CONTRACT IS IN EFFECT, AT THE
DISCRETION OF THE CITY MANAGER
• WHEREAS, the Charter of the City of Long Beach, Section 1802, permits the City to purchase services, supplies, materials, equipment and labor with other government agencies by purchasing under their contracts on a voluntary and selective basis when authorized by resolution; and
WHEREAS, the City desires to purchase certified payroll reporting and labor compliance monitoring software, and as-needed support; and WHEREAS, General Services Administration has a Contract for the purchase of these certified payroll reporting and labor compliance monitoring software, Contract No.
GS-35F-364BA ("GSA"); and
WHEREAS, the City's participation in the GSA Contract will facilitate the City's ability to purchase as well as provide considerable cost benefits to the City; and WHEREAS, if the City had to utilize a formal bid process rather than EWM:ag A23-00598

1 1 participate in the GSA Contract considerably more funds would be required; 2 NOW, THEREFORE, the City Council of the City of Long Beach resolves as 3 follows:
4 Section 1. The above recitals are true and correct and are incorporated 5 herein by this reference.

Section 2. The City Manager or designee is hereby authorized to enter an agreement with LCPtracker, Inc. to purchase certified payroll reporting and labor compliance monitoring software, and as-needed support, of the same type and kind identified in the General Services Administration Contract except as modified by mutual agreement of the City and LCPtracker, Inc., and the purchase by the City shall be on the same terms and conditions afforded to General Services Administration in an amount not to exceed Fifty-Five Thousand Dollars ($55,000), until the General Services Administration contract expires on May 7, 2024, with the option to renew for as long as the General Services Administration contract is in effect, at the discretion of the City Manager.
Section 3. This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting this resolution.
