Written Comments to Noise Hearing on 6‐6‐23
My name is Dr. James Goodin. I am president of the Ocean Residents Community Association (ORCA) and am one of hundreds of Ocean Blvd residents that routinely have their quality of life interrupted and their health endangered from very loud amplified music adjacent to our homes that is permitted by the City. During the hearing you will hear testimony on the health aspects and of the disruptions to an ordinary life style from these concerts I will be speaking at the Noise Element/Ordinance hearing on Tuesday night, but the following comments are best written so they can be reviewed and thought about.
We are not just complainers, we have a recommendation: We propose that Special Events amplified music needs to conform to the Noise Ordinance safety standards when said music reaches residences.
Eliminate the Special Events exemption to the Noise Ordinance.
Since most of you have read the Staff Report associated with this agenda item, I need to provide some clarification:
1. The Noise Element specifies at least 6 times that the management of noise should "prioritize the health and well‐being of City residents." The Noise Element and the Staff Report profess the "equitable distribution" of noise. The revised Noise Ordinance does not support prioritizing the health of all City residents and does not offer any protections for those residents adjacent to City permitted concerts.
Ocean Blvd residents are owed the same noise protections as the other 450,000 residents of Long Beach.
2. The Staff Report refers to a "Special Events Noise Study" that compares Long Beach noise management to Pasadena, Nashville, Austin and Seattle. This is not a valid comparison since these cities conduct entertainment in a specially zoned Entertainment District. East Ocean Blvd is not in a specially zoned entertainment district, we are zoned land use District 2 and offered the same protections of all mixed use properties in the City. (Long Beach does have a Downtown Dining and Entertainment District consisting of Pine Ave from 3rd Street to the Pike. East Ocean Blvd is not within this boundary.)
3. The State of California requires all cities to manage noise emitted from Stationary Noise Sources. The City Staff gets around this requirement by asserting that Special Events are short‐term, temporary, seasonal events and, as such, do not need to be managed. Data shows otherwise. Those of us living adjacent to the downtown waterfront entertainment area have documented 73 days during 2017‐2019 where for long durations the music was at least twice the loudness as that allowed by the noise ordinance‐‐the equivalent of having a vacuum cleaner or food blender on for 8‐12 hours, several days in a row. Music this loud requires residents to leave their homes to avoid the distractive nuisance and the health repercussions of extra loud noise. Seventy‐three days is not short term and needs to be managed to protect City Residents. Special Events should not be exempt from the Noise Ordinance.
At the end of these comments see the raw data from years 2018 and 2019, highlighting the Noise Ordinance violations.
The Staff Report and oral comments from City Staff discuss the noise mitigation efforts they plan for the future. Ocean Blvd residents have been hearing this for 7 years, with no discernible improvement to our quality of life. I hate to say this, but at this point, the City Staff cannot be trusted. The law must be changed to ensure City compliance. Eliminate the Special Events exemption from the Noise Ordinance. 2018
