RECOMMENDATION;
Recommendation toauthorizethe CityAttorneytosubmitStipulationswith Request for Award forapprovalby theWorkers’Compensation AppealsBoard, and ifso approved, authoritytopay $162,762.50forStipulationswithRequest forAward with a lifepension thereafterof$139.15 subjecttoCOLA increasesperweek in compliance with the Appeals Board Order for Richard Wharton.
DISCUSSION:
RichardWharton has made a claimforinjuriesallegedlysustained in the course of his employment with the City of Long Beach. The Government Operations and Efficiency Committee on July 18, 2023, approved the submission to the Workers’ Compensation Appeals Board ofStipulationswithRequest forAward by the Cityand Richard Wharton, based upon a 78 percentdisabilityratingwithprovisionfora lifepension at the rate of $139.15 subjectto COLA increasesper week afterthe permanent disabilityhas been paid,withprovisionforlifetimemedicalcare as may be necessary.
SUGGESTION ACTION:
Approve recommendation.
