• Incorporation of 7 percent fee on the sale of ground-based sparkling devices in accordance with AB1403 for funding a robust, dangerous firework community education and enforcement plan;
• Incorporate that 4 percent of post-cost revenue be designated to the Nonprofit Partnership to support grants for Long Beach community needs, determined by the City Council annually; and
• Incorporate a selection process where 501(c) 3 organizations can apply for permits to operate up to 10 stands spread across the city (excluding the coastal zone). The application should score for articulation of how the funds raised support Long Beach residents. A lottery is being utilized when more than 10 applicants are qualify.

adopt an ordinance regarding the potential sale and use within the City of Long Beach of CA State Fire Marshall-approved ground-based sparkling devices (a form of firework that does not leave the ground, does not explode, and meets all state regulations for noise). This report should include an assessment of revenue options from the sale of the sparkling devices, including a potential 7 percent fee on the sale of the devices for funding a robust, dangerous firework community education and enforcement plan and a 4 percent post-cost revenue to go to the Nonprofit Partnership to support grants for community needs as determined by the City Council annually. The report should consider how many stands would be appropriate for our city and consider how the stands spread throughout the city (excluding the coastal zone) could be operated by 501(c)(3) organizations such that the funds raised by operation of the stands would have the greatest impact on Long Beach residents. The report should consider how to determine which nonprofit entities should receive permits for stands if there are more that apply than the number of permitted stands, including consideration of a lottery system. The report should address fire risk associated with these sparkling devices as well as noise impacts, how other cities are regulating these sparkling devices, whether a 4 percent post-cost revenue percentage provided to nonprofits is appropriate or whether that number should increase, whether the 7 percent fee for an education and enforcement plan is sufficient to cover all associated costs, and what the fiscal impact would be on the city from implementation of this program. The report should include information as to how the city would track data regarding enforcement of its fireworks regulations with this change implemented. The City Manager’s team should review any and all relevant information, including any information provided by TNT Fireworks (the manufacturer of the sparkling devices), regarding these sparkling devices in preparation of the report. The report should incorporate several restrictions on the use and sale of these sparkling devices: 1) they will be prohibited (sale and use) in the coastal zone (including on the beaches) and 2) the PBID and other BIDs will not be permitted to participate in their sales. City Manager should return in 60 days with either the completed report or an update on the progress of preparation of the report and, when the report is completed, the recommendation regarding an ordinance.
