B26. Motion to recognize the recommendation of the Equity and Human Relations Commission (EHRC) to establish a Civil and Human Rights Investment Screening Policy, developed following community advocacy and public input, and subsequently revised in response to concerns raised by the Financial Management Department regarding fiscal impacts, feasibility, and implementation; and, consistent with the City Manager’s recommendation that further consideration occur through the FY 27 budget process, direct the City Manager to work with the Financial Management Department to amend the City Council’s Investment Policy to incorporate a civil and human rights investment screening element, inclusive of the following modifications discussed and agreed upon by the Budget Oversight Committee on August 28, 2026:
1. Evidence-Based Compliance Standard. Replace the proposed presumption of noncompliance with an evidence-based
compliance standard by revising Section 2.5 to authorize the City’s Investment Manager to make a good-faith determination of compliance based on credible, independently verifiable information from reliable third-party sources specializing in civil and human rights risk assessments and responsible
investment screening.

Expand the prohibited investment criteria to include companies that own, operate, finance, or materially support border surveillance or immigration detention facilities, including companies that materially facilitate border surveillance or immigration detention through government contracts, consistent with the Policy’s broader civil and human rights framework.

B27. Motion to clarify language from FY 26 Adopted Budget BOC motion (B44) to establish the second-to-last Budget Oversight Committee (BOC) meeting as the deadline for City Council budget
recommendations to be heard and considered by the Committee, ensuring adequate time to develop final recommendations for City Council.
As a result of a memo to the City Council on July 1, 2025, providing additional guidance and transparency regarding engagement with the BOC, this motion would require all City Council budget request memos to be submitted with sufficient time for the recommendation to be agendized and heard no later than the second-to-last BOC meeting.
The final BOC meeting would not include Council correspondence or consideration of new budget request memos and would instead be reserved for finalizing the Committee’s recommendations to City Council. Council correspondence received after the submission deadline would be included in the legislative record under non-agenda public comment; however, its inclusion would not provide an opportunity for Committee discussion.
B28. Motion to acknowledge that requests for funding from Council Districts for various programs and services have been received and reviewed.
At this time, due to fiscal challenges limiting possible funding resources, these requests cannot be recommended for incorporation into the proposed Fiscal Year 2027 Budget. This motion serves to recognize the value of these initiatives while maintaining fiscal responsibility and transparency in the budgeting process:
