Honorable Mayor and City Council
City of Long Beach
California
RECOMMENDATION:
Recommendation to authorize the City Manager, or designee, to execute a Memorandum of Understanding, and all necessary documents including any subsequent amendments, with the California Department of Justice to foster collaboration to transmit, receive, and store information in the Federal Bureau of Investigation National Crime Information Center system of records, for a two-year period, with an option to renew for an additional three one-year periods, at the discretion of the City Manager. (Citywide)
DISCUSSION
City Council approval is requested for the Long Beach Police Department (LBPD) to execute a Memorandum of Understanding (MOU) with the California Department of Justice (DOJ) to foster collaboration to transmit, receive, and store information in the Federal Bureau of Investigation (FBI) National Crime Information Center (NCIC) system of records, via the DOJ to the requesting local law enforcement agency.
Law enforcement agencies throughout California use automated license plate screening technology at mobile and fixed locations to support public safety and investigative activities. This technology enables agencies to compare scanned license plates against authorized law enforcement databases, including information related to stolen vehicles, wanted or missing persons, court-ordered restrictions, criminal justice supervision, and other public safety designations. Under a MOU with the FBI, the State of California Criminal Justice Information Services (CJIS) Systems Agency, makes the License Plate Data File available to participating local law enforcement agencies. The information is provided directly to and maintained by individual law enforcement agencies, not the technology vendor.
The LBPD has an existing MOU that provides a longstanding framework for the use and exchange of information with the DOJ. The LBPD has been utilizing this technology under the existing MOU, and this action represents a renewal of that established agreement and continued practice. As a participating agency, the LBPD is responsible for ensuring that NCIC information is used solely for authorized law enforcement purposes and in accordance with applicable state and federal requirements. The LBPD maintains and regularly updates its local database to reflect FBI updates and deletions, verifies potential matches with the originating agency in accordance with DOJ Criminal Justice Information Services (CJIS) hit-confirmation requirements and maintains designated technical and administrative points of contact with DOJ. Consistent with the California Values Act (Government Code § 7284 et seq.), non-criminal history information obtained through the NCIC extract will not be used for immigration enforcement purposes, Police Department

subject to applicable federal law. The City will not enter information into the local database for the purpose of facilitating or supporting immigration enforcement. In addition, the City will not provide or specifically share information with the FBI for the purpose of immigration enforcement, except where disclosure is required by applicable state or federal law. The City will also comply with the Long Beach Values Act requirements through this agreement.
This matter was reviewed by Budget Management Officer Nader Kaamoush on August 12, 2026, and by Deputy City Attorney Eliezer Ben-Shmuel on August 17, 2026.
