CITY COUNCIL FINDINGS

RIGHT OF WAY VACATION – West 14th Street ADJACENT TO 2111 W. 14th Street SOUTH OF X STREET AND WEST OF X

Reference Sketch No. 1038V

The subject portions of right -of-way are unnecessary for present or prospective public street purposes, and the vacation of said right -of-way would not have a significantly adverse environmental effect. This finding is supported by the following subfindings, in accordance with the summary vacation procedures outlined in Section 8334(a) of the Highways Service Easements Vacation Law of the California Streets and Highways Code:

1. Summary Vacation Eligibility: The areas to be vacated are portions of excess right-of-way not required for street or highway purposes and/or which portions lie within property under one ownership and do not continue through such ownership or end touching property of another.

2. General Plan Consistency: On August 12 , 20 24, the City of Long Beach Planning Commission determined that the subject vacation action is consistent with the General Plan, as required in Section 8313 of the Public Streets, Highways and Service Easements Vacation Law.

3. CEQA Compliance: The vacation is not a project under the California Environmental Quality Act (CEQA), per section 15332 of the CEQA guidelines.

No environmental review is required.

4. Utility Easement Reservations:

Utility easements shall be reserved over the
areas to be vacated. No buildings or any other vertical structures may be constructed over the utility facilities. 24 hr. access shall be provided for emergency access to the utility agency facility. If the vacation petitioner/developer requests the relocation of the existing utility facilities, it shall be done so that the same feeds and requirements are maintained with all cost responsibility on the developer.

5. Interdepartmental Review: The interested City Departments, including Fire and Police, have reviewed the proposed right -of-way vacation and have no objections to this action.

6. Bikeway Use: The right -of-way would not be useful for exclusive bikeway purposes.
