Honorable Mayor and City Council
City of Long Beach
California
RECOMMENDATION:
Recommendation to find the project exempt from CEQA under State CEQA Guidelines Categorical Exemptionon, Section 15332 (Class 32. In-fill Development). Accept the filed Notice of Exemption No. CE18-054 prepared in accordance with CEQA; and, Receive supporting documentation into the record, adopt the Resolution Ordering the Summary vacation of the excess right-of-way at the dead-end portion of 14th Street located within Tract No. 9138 in the City of Long Beach and adopt the findings related thereto. (District 7)
DISCUSSION
To accommodate the development at 2111 West 14th Street, the developer Taricco Corporation, has requested to vacate a small, irregularly shaped portion of excess public right-of-way located at the dead-end portion of 14th Street located within Tract No. 9138.
The portion of 14th Street proposed for vacation lies adjacent to Lots 1 and 2 of Tract No. 9138.
This segment represents a narrow, curved section of right-of-way that no longer serves for transportation or access purposes (Attachment A). The vacation will eliminate an unused portion of the public right-of-way that is surplus to the City of Long Beach’s (City) needs.
Proceedings for this vacation are being conducted in accordance with Chapter 4, Summary Vacation, of the Public Streets, Highways and Service Easements Vacation Law of the California Streets and Highways Code. Section 8334(a) of that Chapter states that the legislative body of a local agency may summarily vacate that portion of right-of-way which is excess right-of-way not required for street or highway purposes. The Public Works Department supports this action based on the conditions and findings that the dedicated rights-of-way to be vacated are unnecessary for present or future public use.
The interested City departments, including Fire and Police, have reviewed the proposed right- of-way vacation and have not provided objections to this action.
In conformance of the California Environmental Quality Act, Categorical Exemption No. CE18- 054 was issued for this project on November 27, 2018 (Attachment B).
On August 1, 2024, the Planning Commission determined that the subject vacation action is consistent with the City’s General Plan as required in Section 8313 of the Public Streets, Public Works
