DISCUSSION
The proposed project includes 18 separate applications for the vacation of public right-of-way segments in support of the approved Port of Long Beach (POLB) Pier B On Dock Rail Support Facility Project (Support Facility Project) that is underway. This staff report consolidates the 18 separate applications, and 18 separate actions that shall be taken by the Planning Commission.

This application is somewhat unusual in that the Planning Commission’s role is limited only to the street vacations, whereas the larger rail and cargo handling project has been approved by the Board of Harbor Commissioners and the streets vacations. Upon a Planning Commission determination of General Plan conformity for the applications, the Department of Public Works will finalize the right-of-way vacations applications by presenting them to the City Council for

4 review and decisions. The applicant requests the City of Long Beach (City) Planning Commission to review and determine that the proposed vacation of a total of 18 separate public right-of-way segments (Figure 1) are in conformity with the adopted goals and policies of the City’s General Plan. The proposed right-of-way vacations are necessary for the construction of the Support Facility Project (Figure 2), which aims to move cargo that currently leaves the port via trucks to instead move that cargo via rail. The rail expansion will streamline rail operations and minimize the increase in truck trips as cargo volume grows, reinforcing POLB’s Green Port Strategy. The Support Facility Project broke ground on July 18, 2024.

The applicant is currently pursuing street vacation application(s) with the Public Works Department (Public Works), for which the process requires the requested General Plan Conformity Finding by the Planning Commission before it may proceed further. Pursuant to California Streets and Highway Code Section 8313 and California Government Code Section 65402, before an application of a street vacation can be considered by the City Council in a jurisdiction with an adopted General Plan, the jurisdictions' Planning Commission must make a finding of conformity with the adopted General Plan maps and policies, for each street vacation.

The below findings apply to all 18 proposed projects, as they are all within the same area, and part of the same Support Facility Project.

General Plan Consistency Findings
The General Plan consists of 13 elements; each element carries the same authority concerning land use issues. City staff reviewed this proposed project’s conformance with all elements of the General Plan, with particular emphasis on the most relevant elements which are the Land Use and Mobility Elements. All 18 proposed vacations were found to be in conformance with all applicable elements. A review of the relevant elements and specific General Plan consistency findings are summarized below and further detailed in the attached findings (Attachments U).

The purpose of this analysis is to understand whether the street vacations are consistent with the overall goals and objectives of the City, for example vacations to create consolidated corridors for goods movement would be consistent with the City’s goals around economic activity and job creation but vacations that create dead-end drives and complicate mobility would not be consistent with goals around goods movement and traffic flow.

Land Use Element
The General Plan Land Use Element (LUE) divides the City into 14 land use districts, called “PlaceTypes”, which provide general guidance as to the appropriate type and density of land uses. The subject sites are located within the Regional Service Facility (RSF) PlaceType of the LUE. The proposed project sites and the surrounding areas are all within the RSF PlaceType.

The LUE states that the RSF PlaceType is intended to serve a regional need for medical and social services, education, goods movement, people movement, energy production and distribution, public utilities, and uses of a similar nature. It is important to note that this area is also governed by the PMP. Additionally, all 18 street vacations were considered as part of the Support Facility Project, which is compatible with the LUE and POLB PMP.

LU Policy 17-2 calls for maintaining adequate and sustainable infrastructure systems to protect the health and safety of all Long Beach residents, businesses, institutions and regional-serving facilities. The proposed right-of-way vacations are necessary to facilitate implementation of the Support Facility Project, a critical infrastructure improvement that supports the long-term

9 operational needs of the POLB. The proposed project is intended to enhance on-dock rail capacity, improve the efficiency and reliability of goods movement, improve traffic safety, and reduce environmental impacts associated with POLB operations. LU Policy 16-4 calls for the City to work with the Ports to improve air quality around the ports, an important goal which this project furthers. Ultimately, the proposed vacations would allow for the reconfiguration and consolidation of circulation patterns within the project area to accommodate rail infrastructure, support facilities, and related operational improvements. Accordingly, City staff concludes that the proposed vacations of all 18 street segments are consistent with and compatible with the LUE policies and the PMP.

Mobility Element
The General Plan Mobility Element aims to transform Long Beach into a city of flexible, convenient, affordable, and energy-efficient transportation options for residents and visitors alike. The Mobility Element is designed to facilitate both the movement of people and goods.

The vacation of the 18 public right-of-way segments will support the Green Port Policy project highlighted in the Mobility Element, and overall support the following goal within the Mobility Element: MOG IM-3: Support programs and projects that reduce conflicts between trucks and autos on freeways, such as dedicated freight corridors separating heavy trucks from autos. The Support Facility Project is a key, multi-year POLB initiative intended to enhance on-dock rail capacity, reduce truck trips on regional freeways, and improve overall goods movement efficiency. The proposed vacations are necessary to reconfigure and consolidate rights-of-way to accommodate rail infrastructure and associated operational improvements, thereby contributing to reduced truck-auto conflicts and improved freight mobility.

The proposed project is consistent with Mobility and Operations (MOP) Policy 1-5: “Recognize the important function of alleys in the transportation network. Consider alleys, especially continuous alleys, a valuable resource for pedestrian connectivity, access to abutting properties for loading and unloading, locate utilities, and store/dispose of waste.” The proposed project is located within a predominantly industrial area and involves the vacation of seven alleyways.

MOP Policy 1-5 recognizes the important function of alleys in the transportation network, particularly for pedestrian connectivity, access to abutting properties for loading and unloading, utility placement, and waste storage. It should be noted that four out of the seven alleyways are currently fenced off and not available for public access. Further, the proposed project plans to consolidate and refine road network in the area to facilitate and modernize goods and vehicular movements as part of the Support Facility Project. As such, the proposed alley vacations are not anticipated to impair pedestrian connectivity, property access, or utility functions.

Further, the Mobility Element outlines design criteria for local streets that are applicable to ten of the 18 proposed right-of-way vacation segments. Of these ten segments, two are at the terminus of streets and one consists of a narrowed right-of-way of approximately 30 feet in width. The Mobility Element provides that local streets should generally have a 56-foot right-ofway width, with approximately 36 to 40 feet reserved for roadway purposes. As discussed above, the proposed vacations are necessary to support implementation of the Support Facility Project, which will reconfigure and consolidate the right-of-way network within this predominantly industrial area to enhance goods movement efficiency and rail operations.

10 Based on the foregoing, the proposed right-of-way vacations are consistent with the intent and functional objectives of the General Plan Mobility Element.

Utilities
The street vacation will not directly impact utilities as the Support Facility Project includes the relocation and reorganization of various utility lines and infrastructure, including water, wastewater, storm drains, natural gas, electrical, and oil lines. To ensure continued service to affected utility users, new replacement infrastructure would be constructed. The Support Facility Project Environmental Impact Report (EIR) has comprehensively evaluated all necessary utility relocation construction activities. This analysis includes detailed plans to minimize disruptions and maintain essential services throughout the proposed project's duration.

The Support Facility Project is designed to preserve and enhance access to essential City and public utility services. By carefully planning and executing utility relocations, the proposed project will ensure that residents and businesses continue to receive uninterrupted service.

Public Hearing Notice
A General Plan Conformity Certification does not require a public hearing or public notice.

However, Public Works conducts public notification when the future street vacation is agendized to be considered by the City Council, in accordance with State law.

ENVIRONMENTAL REVIEW
This action to make a finding of conformance with the General Plan is not a project under the California Environmental Quality Act (CEQA), per Section 15378 of the CEQA Guidelines, and no environmental review is required. However, the vacations of the 18 street segments were included as part of the EIR for the POLB Support Facility Project (State Clearinghouse No. 2009081079) and the vacations are consistent with that document (Attachment V – Pier B OnDock Rail Support Facility Project EIR).
