RIGHT OF WAY VACATION – Eighteen (18) Public Right-Of-Way Segments Located within the Port-Related Industrial (IP) Zone District including segments are generally located south of the south side of West 12th Street North, extending south to the unimproved roadway north of the Southern Pacific Railroad, and are bounded by Edison Avenue on the west and Fashion Avenue on the east.
Reference Sketch No. 1050V_2A to 1068V_2S
Port of Long Beach Pier B On-Dock Rail Support Facility Project Reference Engineering Sketch Nos. 1050V_2A through 1068V_2S The City Council finds that the eighteen (18) public right-of-way segments proposed for vacation are unnecessary for present or prospective street or highway purposes and are no longer required for public travel as outlined in Section 8334(a) of the Highways Service Easements Vacation Law of the California Streets and Highways Code These findings are based on the following:
1. Summary Vacation Eligibility: The subject right-of-way segments are located within the Port of Long Beach Master Plan area. All rights-of-way proposed for vacation lie entirely within property owned by the Port of Long Beach and do not provide through access or termination at property under separate ownership qualifying it for a summary vacation procedure.
2. General Plan Consistency: On March 5, 2026, the City of Long Beach Planning Commission determined that the proposed rightof-way vacations are consistent with the City's General Plan, as required by Section 8313 of the California Streets and Highways Code.
3. CEQA Compliance: The proposed vacation of the eighteen (18) right-of-way segments was analyzed as part of the
Environmental Impact Report (EIR) prepared for the Port of Long Beach Pier B On-Dock Rail Support Facility Project (State Clearinghouse No. 2009081079).
4. Interdepartmental Review: All affected City departments, including the Fire Department and Police Department, have
EXHIBIT C
reviewed the proposed right-of-way vacations and have no objection to the proposed action.
5. Bikeway Use: The proposed right-of-way segments are not useful as nonmotorized public transportation facilities and are not needed for exclusive public bicycle path purposes.
6. Access Easement Reservations: Easements shall be reserved over the full roadway width for all vacated rights-of-way as necessary to preserve access rights or where required by a recorded instrument to facilitate the conversion of the vacated public rights-of-way into common area lots or private streets.
7. Pipeline Facilities Easement Reservations: Easements shall be reserved for existing pipeline facilities and all existing public utility infrastructure that is to remain in place following the vacation.
8. Street Light Facility Conditions: To the satisfaction of the Director of Public Works, all City-owned streetlight facilities within the vacated rights-of-way that are no longer required shall be removed and returned to the City's Street Lighting Division.
Electrical service and power supply circuits shall be modified as necessary to ensure proper service and billing.
9. Right-Of-Way Modification Conditions: All curb returns associated with streets and alleys affected by the vacation that are no longer required shall be removed and reconstructed with full-height curb, curb and gutter, and sidewalk improvements, as determined by the Director of Public Works.
10. Traffic Markings Conditions: The vacation petitioner shall install or modify all required pavement markings, traffic control devices, signs, and related improvements in accordance with the California Manual on Uniform Traffic Control Devices (CA MUTCD) and to the satisfaction of the City Traffic Engineer.
11. Drainage Modification Conditions: Existing storm drain facilities and surface drainage affected by the proposed right-ofway vacations shall be modified as necessary as part of the Pier B On-Dock Rail Support Facility Project. All drainage
improvements shall be reviewed and approved by the City and all applicable agencies in accordance with current engineering standards and applicable requirements.
