The proposed street vacations consist of the following:

The proposed summary vacation is being processed in accordance with Chapter 4 (Summary Vacation) of the Public Streets, Highways and Service Easements Vacation Law (California Streets and Highways Code). Section 8334(a) authorizes the legislative body of a local agency to summarily vacate excess public right-of-way that is no longer required for street or highway purposes. The Public Works Department has determined that the subject rights-of-way are excess public right-of-way and are unnecessary for present or future street or highway purposes. Accordingly, the Public Works Department supports the proposed vacation.

Existing public utility facilities are located within portions of the rights-of-way proposed for vacation. Public utility easements will be reserved over those areas to ensure the continued operation, maintenance, repair, replacement, and access to existing utility facilities until such facilities are abandoned, removed, or relocated. The reserved easements and conditions required by the affected utility agencies are identified in Attachment B.

The proposed vacation has been reviewed by all affected City departments, including the Fire and Police Departments, and no objections have been received. All applicable conditions requested by utility providers and other reviewing agencies have been incorporated into the proposed action.

On March 5, 2026, the Planning Commission determined that the proposed street vacation is consistent with the goals, objectives, and policies of the City's General Plan, as required by Section 8313 of the California Streets and Highways Code and Section 65402 of the California Government Code. The Planning Commission staff report and findings are included as Attachment C.

The Pier B Dock Rail Support Facility Project has been environmentally evaluated in accordance with the California Environmental Quality Act (CEQA). An Environmental Impact Report (State Clearinghouse No. 200981079) was previously certified for the project, and the proposed vacation of the eighteen public street segments was analyzed as part of that environmental review (Attachment C).

This matter was reviewed by Deputy City Attorney Vanessa S. Ibarra on September 14, 2026, and by Budget Operations Manager Nader Kaamoush on August 27, 2026.

TIMING CONSIDERATIONS
City Council action on this matter is requested on October 6, 2026, to facilitate the work of the Port of Long Beach.

FISCAL IMPACT
A vacation processing fee of $107,327 was deposited into the General Fund Group in the Public Works Department. This recommendation has no staffing impact beyond the normal budgeted scope of duties and is consistent with existing City Council priorities. This action will facilitate the future development of this site, which will, once construction has begun, have a positive impact on local jobs.
