-EXTERNALDear Council Members:

At this pivotal moment in our nation's history we are all called to do our part in standing up for democracy, which is best practiced at the local level.

Any attempt to silence the voice of the people is sabotage of democracy. As constituents in the City of Long Beach, we have an expectation that our first Ammendment rights will be upheld at the local level as well as at the national level. They are already under attack at the national level. Do not allow this trend to infect our city council by voting NO on #29.

Greater efficiency of time management in council meetings is possible without sacrificing the voice of the people.

Please consult with Councilwoman Duggan and others who are voting NO for their innovative suggestions on how to accomplish this without silencing the voices of the people who elected you to represent them.

Respectfully,
Wynn Sulc
District 3 Constituent

Subject: Tyranny is alive and well in Long Beach
-EXTERNALPlease ensure that this Op-ed ends up on the Oct 6 Agenda #29 and is given to every council member Subject: Tyranny is alive and well in Long Beach
The Long Beach (LB) tyrant mayor and seven city council members have made it abundantly clear that your opinions and potential comments are not welcome. Basically, they are proposing a draconian reduction in time for public input in pertinent matters before them. How conveniently they waited until after the June election to drop their bomb.

Firstly, this is a flagrant violation of the California Brown Act and its open meeting requirements.

Secondly, it undermines our CA state and US Constitutions.

Thirdly, while this city is in the midst of a supposed budget crisis brought on by their blatant frivolous spending, they are irresponsibly inviting a constitutional lawsuit. (Where is the city attorney?) Fourth, the LB City Code of Conduct states. "I will work to make sure that all of the people in our city have the ability to actively participate and engage, and will work to eliminate barriers to public involvement in decisions, programs, and services." All of these eight office holders were required to sign for receipt/reading of this clause.

Wake up before they try to steal anymore of your rights. Write, call, post, or better yet show up at the Oct 6 LB council meeting to voice your objection. It may be the last time you will ever be allowed.

PS. If these elected "representatives" have a problem with listening to the people whom they are supposed to represent, then they should immediately resign. 1 From: Lenore Rozner <[email protected]>

Subject: Submitting input opposing Item #29
-EXTERNALDear City Clerk,
I'm wriƟng to oppose Item 29 in this week's Council meeƟng. While no one wants to sit through hours of public comment while waiƟng for an item to be discussed, public discourse is important in our democracy.

Other ways of making the meeƟngs be more efficient and Ɵmely should be explored - this proposed method is not the way.

Hello, City Clerk and Council members.

I am submitting a partial list of signatures from the petition "Stop Long Beach City Council from Suppressing Public Comments."
The petition is still active and will continue collecting signatures until the Public Comments issue is resolved to the satisfaction of the public.

I will provide future counts at later dates. I'm happy to provide the raw data (in Excel) upon request.

In order to submit the petition as public record prior to the Oct. 6 Council meeting, I compiled signatures from the petition launch date of Sept. 27 through today at 2:00pm.

The attached lists (2 pdfs) therefore contain data from Sept. 27 - Oct. 5, 2026, 2:00pm.

One file lists the signature data from all signers. Another file lists data from signers in Long Beach only.

As the author of the petition, my position is clear. On behalf of 600 signers and myself, I ask the Council members to respect the unanimous directive to vote NO on Item 29.

If you vote in favor of Item 29, you vote in favor of suppressing public comments. The revised ordinance may fulfill legal requirements, but it does not align with the spirit of the Brown Act or the guidance of SB 707, both of which call for greater public access to legislative processes.

For more detailed input on why a growing number of people are protesting Item 29, I refer you to the emails I sent to all Council members on Oct. 2, 2026 which included a link to the petition and a link to an NBC4 article. Since then, there has been more media outreach including an NBC4 video (Oct. 4) and a Long Beach Post article (Oct. 5). Local organizations and residents have also been very active spreading the word that the City of Long Beach is trying to consolidate public comments into 2 one period, isolated from Regular Agenda Item discussion, which will result in one comment per meeting, thus restricting meaningful public participation. (Hearings not included.) For your convenience, I include the petition link here: https://c.org/zsPgqpGG56 I extend my thanks to Council members Allen, Duggan, and Kerr for protecting the people's right to participate effectively in local government.

Respectfully,
Leslie Goldman (District 4)

Re: Item 29, Oct. 6, 2026 Long Beach City Council Meeting Petition (full text) submitted to City Clerk and Council members, by Leslie Goldman, 10/5/2026

Stop Long Beach City Council from Suppressing Public Comments The Issue
Long Beach City Council approved a motion that will stifle public speech at Council meetings. On October 6, 2026, they will vote again on consolidating all public comments into a single period at the beginning of Council meetings. The change would ban residents from speaking DURING the Regular Agenda portion of meetings, when each Item is discussed and decisions are made.

The public has a legal right to participate in the decision making processes of all subjects discussed during Council meetings. We cannot do that if we’re removed from the discussion.

Not only will this amendment detach public comment from the discussion of Agenda Items, it will also limit each member of the public to ONE brief comment per meeting.* No longer will residents be able to step to the dais to comment on individual issues as they’re presented. Instead, all members of the public who want to address Council will be grouped together at the beginning of the meeting, given one chance to speak on all Items, in only 60 or 90 seconds. We're expected to believe that Council will remember our 60-second comments when they finally discuss the Items hours later. (3 minutes are given when 10 or less people comment, an unlikely scenario when all speakers are grouped together.) This amendment undermines the effectiveness of public comment. (*With the exception of occasional Hearings. Public comment rules are different for Hearings. Hearings do not occur at every Council meeting.) The signers of this petition are sending a unanimous directive to Long Beach City Council:

DO NOT CONSOLIDATE PUBLIC COMMENT PERIODS INTO A SINGLE PUBLIC COMMENT PERIOD AT THE BEGINNING OF COUNCIL MEETINGS.

On September 1, 2026, Long Beach City Council voted 7 - 2 in favor of consolidating all public comments into a single period at the beginning of Council meetings. The two Council members who opposed the proposed ordinance (Cindy Allen and Kristina Duggan) recognized that this change does not represent the best interest of Long Beach residents as it would ban the public from speaking to Council members DURING discussion of Agenda Items. The proposed ordinance, which was questionably tied to the City’s budget deficit, moved forward with amendments to be voted on at a later date.* That brings us to now – once again trying to convince Long Beach City Council to leave public comments as they are.

The proposed change to restrict public comments impacts all residents of Long Beach, will cause significant barriers to civic engagement, and sets a dangerous precedent by suppressing public participation and free speech.

*UPDATE 9/30/26: The redlined ordinance is attached to the Oct. 6 Council meeting Agenda, released on 9/28/26. There are several proposed changes – some that give the Mayor undefined control over public comments – not covered in this petition. Review redline changes at:

WHAT WOULD CHANGE
As the rules stand now, the public can address Council on multiple Items during “Regular Agenda,” the portion of Council meetings when Items are presented and discussed. The public gets to weigh in directly before the Council votes on any Item. This long-standing protocol protects the people’s right to engage in local legislation and “retain control over the legislative bodies they have created.” (L.A. Co.

Brown Act Requirements. (Sec 54950.))
If the City Council follows through on the proposed amendment, the public will be banned from speaking during the Regular Agenda period. All public comments will be lumped together at the start of the meeting and the time allotted to each speaker will be limited by the number of people who want to speak. It’s a recipe for failure: the public cannot provide meaningful input if their voices are isolated and cut short. The City’s proposed change devalues public engagement and insults our intelligence. It’s like the Council sending the public to the kids’ table and telling them to sit on their hands while the grown-ups talk about important things.
(Mentions of "all" public comments or "all" public speakers in this petition refer to public comments on Agenda Items and non-Agenda items. Hearings have different rules for public comments.)

TIME LIMITS
Before voting NO at the Sept. 1 Council meeting, Councilwoman Allen explained why the proposal is a “very significant change.” It removes the public’s voice from the discussion AND it limits the amount of time each person gets to speak.

Current time limits depend on the number of people that show up to speak:
1 - 10 people = 3 mins each
11 - 20 people = 90 secs each
21 or more people = 60 secs each
Long Beach City Council meetings are well attended. As Councilwoman Allen described – more than 10 people showing up for public comment is a given; more than 21 people is the norm. She explained the problematic scenario to Council: If a resident has only 90 seconds to speak and “three Items that they want to speak on, that gives them 30 seconds to speak on each Item.” She pointed out that eliminating public comment on individual Agenda Items means that residents will not be able to elaborate on each Item of their choice. Unfortunately, seven Council members voted to stifle public voices anyhow.

UNINTENDED CONSEQUENCES?
If all public speakers are lumped together at the beginning of the meeting to speak on numerous Items, the result will be competition for time. The more people speaking, the less time for each person to speak.

Large turnouts for public comment have always been a gauge of the importance of hot-topic issues. If the Council forces the amendment through, the dynamic of public engagement may change. Will neighbors still rally as many people as possible to speak up if the result is only 60 seconds for each person to speak? With so many people massed together to discuss a variety of issues, there will be competition instead of unity, chaotic delivery instead of ordered input.

THE CIRCUMSTANCES
SB 707: Long Beach residents rallied and swayed the Council to drop this issue back in June. At the time, Council said public comments had to be moved to one period at the beginning of meetings because of Senate Bill 707. Council had predetermined that SB 707’s mandate to include remote public access (Zoom) would cause an influx of public comments and make Council meetings longer.

The People spoke loudly! Written comments matched the demand of the residents who showed up to speak at the June 16 meeting. The message was unanimous: we don’t want our right to comment restricted! The vote was 5 - 3 against the amendment. We won the battle! After that meeting, the Council recessed for a summer break and returned on July 21st for the first meeting with SB 707 access in place. One (1) public comment was made via Zoom. There was no influx.

As stated by Councilman Supernaw at the Sept. 1 Council meeting, the City has not experienced a significant increase in virtual public participation since the implementation of SB 707.

The Budget Nonsense: The Mayor and City Council couldn’t let the public comment issue go.

They brought it back on September 1st, this time wrapped up as a budget item. Councilman Supernaw told residents that “implementing SB 707 has required significant financial resources and staff time that could otherwise support critical city services during this challenging budget cycle.” (Apparently, public comments are not critical.) The City needed to cut $150,000 worth of staff time needed for running Zoom. The savings (roughly ¼ of 1% of the City’s $58.2 million dollar deficit) from the proposed “streamlined format” would go towards services more important than the public’s role in local democracy.

Residents of Long Beach flatly rejected the idea that public comment was being framed as a budget item. Anyone interested in reading the actual public comments can review the transcript of the Sept. 1 meeting to find words like “sneaky, underhand attempt,” “shameful,” “a new low,” “cheap shot,” and “deeply flawed.” Similar thoughts were echoed in written comments. Public voices were once again unanimous at that meeting, but the majority of Council, smoothly guided by the Mayor, ignored public input and voted 7 - 2 in favor of forcing public comments into a tidy box.

The Brown Act: Section 54950 of the California Government Code, the Brown Act, gives guidance on Meetings for Local Legislative Bodies. “The main focus of the Brown Act is the public's right to attend and participate in the decision making processes of local legislative bodies.” (L.A. Co.

Guide on Brown Act Requirements.) If Long Beach residents are locked out of participating during the discussion period, we cannot effectively be part of the decision making process.

Guidance on the Brown Act agrees that members of the public have broad constitutional rights to comment on local government business. While the City of Long Beach attempts to use statute language to technically comply, the residents of Long Beach plainly see that the Council fails to uphold the spirit of the Brown Act: that “public agencies exist to aid in the conduct of the PEOPLE’s business.” (Section 54950.) (Caps mine.) The People’s business includes having a seat at the table to speak directly to Council during discussion of Agenda Items for more than 60 seconds per meeting.

This petition reminds the Mayor and City Council that Long Beach residents are stakeholders in local government, not spectators. As public servants, the job of Council is to listen to our comments during deliberation of issues and apply public feedback when they vote.

Subject: No on Agenda Item 29 - Public Comment - Long Beach Council Meeting 10/06/26 -EXTERNALDear Mayor and Council Members
I am writing to you today to voice my opposition to the proposed Agenda Item #29 at this evening's City Council Meeting. Lumping most public comment at the beginning of the meeting is not only awkward, but will most likely curtail the time a person has to speak on any given agenda item before the council. You as elected officials need to hear us, not shut us out.

Subject: City Council Public Comment. Item Number 29. October 6 Meeting. -EXTERNALTo members of the Long Beach City Council:

I would like to state my objection to agenda item number 29 of the scheduled October 6 meeting.

I hope you know what the item entails, because as written, the item is an attempt to completely cloak the council's desire to stifle public comment.

It is my right, as a citizen of this country and city to voice my opinion on agenda items after I have heard them discussed.

You tell me, how many people would know what item 29's intention is as it is written on the agenda? You speak of transparency when the reality is that you hide your intentions and want to omit the public.

I ask why you sought the office you now hold? Was it to do as you please and leave the people of the city behind? You are there to listen to our concerns and act upon them. Your position requires that you listen to your constituents. If you do not like spending long hours in session on any given Tuesday and do not want to hear from the public, then I respectfully ask you to step down from your position.

VOTE NO ON ITEM 29.

Do not follow the example of a spineless United States congress that fears the President.

You have the power to stand up against "King Rex".

Subject: Written comment on Agenda Item 29 on tomorrow's City Council agenda -EXTERNALAgenda Item 29 represents a violation of the Ralph M. Brown Act and will immediately subject the City of Long Beach to potential litigation.

Therefore, we object in the strongest terms.

The purpose of the Long Beach Reform Coalition is to promote transparent, responsive, fiscally responsible, and accountable local government.

Severely curtailing public comment, which would be the result of Item 29, promotes precisely the opposite of all those objectives.

One of the core principals of the Brown Act is to ensure the opportunity for live participation of the public in the deliberation of local government agenda items. Hearing public comment on agenda items as they are before the Council ensures that the public’s voice is a part of the process in a way that written comment cannot ensure.

That is why Long Beach and other local government bodies have agenda item comment opportunities attached to each agenda item. The public has a right to comment on each and every agenda item under the Brown Act.

Creating a limited period of time, stripped away from the calling of the items chronologically, as a catchall for non-agenda and all agenda item public comment, strips the public of its guarantee of being afforded the opportunity to engage, live, on any item which may merit that engagement.

When a Council meeting is packed, all the catchall slots for public comment may be taken before someone interested in speaking on an agenda item drawing less attention has the opportunity to sign up to speak.

An ordinance which empowers the mayor thus is therefore a law which empowers the mayor to violate the Brown Act.

Thus the Brown Act would be twice violated, as no coincident participation would be allowed by the public during agenda items and some may be prevented even from speaking on agenda items in this novel preambulatory time-limited catchall.

Furthermore, this ordinance also deletes all bounds on the mayor’s ability to reduce speakers’ time limits purely according to whim.

It strikes out the current rule, which reads as follows in the Long Beach Municipal Code:
2 “Where less than ten (10) members of the public submit their request to the Clerk to speak on a particular agenda item, each member of the public shall have three (3) minutes to address the City Council… Where more than ten (10) members of the public submit their request to the Clerk to speak on a particular agenda item, each member of the public shall have ninety (90) seconds to address the City Council." (LBMC 2.03.040 Sec. C Public Comment for Agenda Items, Subsections 2 and 3)
And it replaces that rule with the following:
"All speakers under this Subsection 7. shall have three (3) minutes to address the City Council. The Mayor, or presiding officer, may reduce the speaking times based on the total number of speakers." (LBMC 2.03.040 Sec.

A Subsection 7b)
The careful reader will note two glaring facts tucked into this newly abbreviated language:
1) The initial sentence stating that speakers “shall have three (3) minutes” is in fact meaningless, as it affords the mayor a personal, subjective determination as to what constitutes too many speakers. Even five could be too many, if a particular mayor felt a reduction in speaking times was justified by that number. He is simply required to make his/her judgement “based on the total number of speakers”. 2) Whenever the mayor does decide to invoke this power, this language gives him or her total discretion as to the degree to which he or she reduces speaking times. Speakers, according to the mayor’s desire, could be cut to 90 seconds, 60 seconds, 30 seconds, or less. There would no longer be a lower limit protecting the public from an absurdly short time limit.

Indeed, when this came before Council on Sept. 1, 2026, Councilman Supernaw asked the City Attorney if there was caselaw at least guaranteeing the public 60 seconds. Her response was that time limitations are in the mayor’s discretion. Presumably she meant absent the time limit specifications currently in the municipal code, the very specifications she would be eliminating in drafting this ordinance.

The Ralph M. Brown Act itself does not have a specific minimum time spelled out, but does require a “reasonable” accommodation of public comment speakers. The Office of the Attorney General of California has concluded that five minutes per speaker may be “reasonable” under many circumstances, (75 Ops. Cal.

Atty. Gen. 89 (1992)).

Furthermore, the mayor’s subjective discretion would now carry over not just to agenda item public comment, but indeed to general (non-agenda item) public comment speakers.

Heretofore, they have been guaranteed 3 minutes, with a maximum of ten speakers in each of two separate general comment periods, one at the beginning and one at the end of each council meeting.

Given the fact that there are few if any meetings where there are ten or fewer public comment speakers, this means that the length of each and every instance of public comment (with the sole exception of the carve out for hearings) would now be subject purely to the caprice of the mayor at every city council meeting.

Thus, even in the unlikely event that this proposed ordinance was not immediately struck down in court, every future council meeting would be an opportunity for the mayor to further test what is “reasonable” under the Brown Act and create new legal liability for the City of Long Beach.

For all the foregoing reasons we urge the City Council to reject Item 29.

Subject: Agenda Item 28, Long Beach City Council. October 6, 2026 -EXTERNALDear Councilmembers,
I am writing to respectfully ask that you vote ‘NO’ on Agenda Item 29. The proposed changes to

2.03.040 Order of Business would put into law an unreasonable restriction on public comment during Agenda Item deliberation at City Council Meetings.

Separating all public comments into a single combined time slot distances each comment from the Agenda item itself (the presentation, discussion, questions, staff opinions, substitute motions, and actual voting). This proposal diminishes the voice of the public who deserve to be relevant participants in agenda topics. The public voice is heard most clearly when Council members are focused on the topic at the same time. Public comment is how the people join with elected leaders and participate in self-governance. The proposed changes will bring a chilling effect on the public voice. Corralling every comment on every topic into one single, separated time slot leaves public comments disconnected and easily overshadowed.

Have you considered that you would never disenfranchise City staff by restricting their participation in the meeting and confining all their presentations and comments to a single, separated time slot? Would you discuss and vote at later time in the meeting, perhaps hours after City staff had given their input? It’s easy to see how that would disrupt the continuity of deciding often complex subject matter.

I ask you to consider that the public comment given with each Agenda Item is no less vital to the process of cohesive and considered decision-making.

We cannot afford to disenfranchise Public Comment. For most Long Beach residents, this is the only time they can speak to you in person before you cast a vote. This voice needs to remain relevant to the topic. Please do not support moving public comment. It needs to remain adjacent to the Council's deliberation of Agenda Items.

Thank you for the patience and wisdom to protect and preserve the public voice.

Sincerely,
Laura Sellmer

Subject: Thank you for opposing Item #29 - Limiting Public Comment

-EXTERNALDear Kristina,
Following our community meeting at ABYC regarding the Peninsula flooding and declared emergency, I want to thank you for opposing the proposal to reduce public comment. I know it is not always easy to take a position contrary to others on the Council, or conduct a heated community meeting. I appreciate your willingness to stand up for your constituents, the greater City, and democracy, that thrives on engagement, discourse, and public participation.

Regarding Limiting Public Comment
Earlier in my career, I held a production contract with the City of Los Angeles through LA CityView, Channel 35. One of my responsibilities was managing the remote Los Angeles City Council publiccomment location in San Pedro. 2 I assisted residents in preparing their comments and appearing on camera, which was televised live into the City Council chambers. As I recall, each resident was allowed three minutes to speak, with some opportunity for dialogue with Councilmembers.

This was long before COVID and Zoom. The City of Los Angeles provided this service because it recognized the very real burden of expecting residents of a large city to travel downtown during normal business hours simply to exercise their right to address their elected representatives.

For that reason, I find it troubling that Long Beach would consider moving in the opposite direction by further limiting opportunities for public comment. Meaningful public participation should be made more accessible, not less.

Thank you for supporting your constituents on this issue. Please continue to advocate on our behalf.

Residents and their elected representatives should be on the same team, working toward the same goal: an informed, engaged community and better government.

Kind regards,
Kellie Canning

Subject: Vote NO on Agenda Item 29
-EXTERNALDear City of Long Beach Councilmembers, Mayor, and Elected Officials, The proposed changes to public input at Council meetings threaten to diminish public participation and undermine our local democracy. I urge you to vote NO on Agenda Item 29.

Limiting public comment or consolidating it to the beginning of meetings poses a significant obstacle to transparency and public engagement. When residents are required to speak prior to staff presentations and Council deliberations, they are unable to address new information, counterarguments, or discussions that emerge during the meeting. Permitting public comment on specific agenda items as they are introduced ensures real-time accountability and encourages active community participation. Furthermore, restricting public speech risks lengthening speaker queues and reducing individual speaking times, preventing constituents from fully articulating their positions.

As elected representatives, your duty is to uphold democratic principles, foster open dialogue, and serve the best interests of all Long Beach residents. Restricting public comment erodes constituent trust and weakens essential democratic safeguards.

Please uphold government transparency and protect public participation by voting NO on Agenda Item 29.

Citizens should be able to address each topic individually.

Warmly,
Matthew Ortiz

SUBJECT Agenda item 29 10/6/26
The purpose of a political system is to improve the lives of the people in that area.

If the political system does not live up to that, it is “not fit for purpose.” I heard that said recently at a zoom meeting that had participants from around the world.

I’m questioning whether the Long Beach City Council believes their mission is to improve the lives of the people of Long Beach? IMHO Agenda item 29 contains one of the worst changes our City Council has ever proposed. There has been ample feedback from the community explaining what they find unacceptable. Will our council members listen to the public? There are 6 votes currently planned to pass it. Mary Zendejas District 1; Darryl Supernaw District 4; Suely Saro District 6; Roberto Uranga District 7; Tunua Thrash-Ntuk District 8; and Joni Ricks-Oddie district 9. These Council members are not listening to the public.
---------------------------------------------------------------------------------------------------------------- SB707 was intended to increase public participation in City Council meetings. This ordinance proposed under Agenda item 29 would make it useless for the public to participate by separating public testimony from agenda items. Further, the implementation of zoom meetings at Council is missing a standard feature – a photo or video of the speakers. This degrades the affect of the testimony.

This will be the 3rd time some version of this Ordinance that negatively impacts the public has been put before Council. Agenda item 46 June 9 2026 (1st reading passed) Agenda item 49 June 16 2026 (2nd reading failed). Why are we doing this again? The public provided ample feedback on the proposed changes. Agenda item 46 June 9 2026 provided 73 pages of letters from residents, the Apartment Association and the Chamber of Commerce and numerous attendees that spoke at the council meeting. 100% of the letters and testimony were against the proposal. Yet some of the same unacceptable features from that version are being proposed again. 2 When the survey was put out earlier in the year under the disingenuous heading of “increasing public participation in Council Meetings”, residents were asked what prevented them from attending Council Meetings. A favored answer was the meeting started too early. So help me understand - the proposal is to move the start time to 4:30 instead of 5:00? That doesn’t demonstrate good listening skills or a desire to solve the problem.

AGENDA ITEM 29 Oct 6 2026 - unacceptable features

1. It requires an earlier start time for any resident that wishes to speak (4:30 PM);

2. Provides only 90 minutes for all public testimony (unless the Mayor chooses to extend the time) at the beginning of the meeting; speakers may only speak one time for all agenda items AND non-agendized items, although there is provision for a second set of testimony for hearings.

3. Shortens speaking times which will most often be 60 or 90 seconds and a speaker may not speak more than one time (unless they are also speaking at a hearing).

That is not enough time to share pertinent information on what are often complex topics. If a person wishes to speak on more than one agenda item, it is clearly an unreasonable amount of time. If they also want to speak on an unagendized item, their time must be portioned to cover agendized and unagendized items all at one time. I believe this to be a Brown Act Violation.

4. The worst feature is separating the testimony from the agenda items. Requiring all public testimony at the beginning of the meeting, with sometimes 60 agenda items, the Council is supposed to try to remember who said what and relate it to the agenda items that are being considered for a Council decision hours later. This will make public testimony useless. Again, this should be reported as a Brown Act violation.

5. Para 13: There should never be an agenda item that was not available for public scrutiny before the meeting (by 12 PM Fridays). The exception rule should be stricken.

It amazes me that any council member could be enticed to vote in favor of an ordinance that so clearly damages the relationship between the public and city council.

Sincerely,
Corliss Lee

Subject: Comment to City Council Meeting October 6, 2026 Item 29 -EXTERNALMayor and Council Members
As on June 9, and June 16 and on Sept 1, I again state my vehement opposition to this unwarranted and pernicious attempt to confine all public comment on both non-agenda and agenda items to a single time period at the beginning of Council meetings, potentially hours before any agenda items will be presented.

And to also severely reduce the time a single community member may speak at a given meeting by limiting the number of comments per person to one comment. This in contrast to the rules now in force that afford community members the opportunity to offer public comment on perhaps several agenda items, as well as to additionally speak once on non-agenda matters, with each comment allowed the same amount of time allowed other speakers.

As others have pointed out this proposed restriction of public comment may be in conflict with the Brown Act. In Galbiso v Orosi Public Utility District, 167 Cal.App 4th 1063,1079 (2008), the Court of Appeals of the State of California Fifth Appellate District wrote of the Brown Act: "Section 54954.3, subdivision (a), provides: “Every agenda for regular meetings shall provide an opportunity for members of the public to directly address the legislative body on any item of interest to the public, before or during the legislative body's consideration of the item, that is within the subject matter jurisdiction of the legislative body․” This language has been construed to mean that for each agenda of a regular meeting, there must be a period of time provided for general public comment on any matter within the subject matter jurisdiction of the legislative body, as well as an opportunity for public comment on each specific agenda item as it is taken up by the body. (Chaffee v. San Francisco Library Commission (2004) 115 Cal.App.4th 461, 468-469, 9 Cal.Rptr.3d 336.)" (Emphasis mine)
And why on earth is the City Clerk propagandizing on the Clerk's Website, on social media etc. as to the content, the potential effects and the supposed benefits of what is only a proposed draft ordinance that, barring a heinous violation of the Brown Act, can not in any manner have yet been considered, let alone adopted by the City Council?
The provisions of the ordinance pertinent to public comment? Unworkable and poorly crafted. Example: 2.03.040 7a The speakers list remains open to additional speakers until the Clerk calls the last speaker on the speakers list. 2.03.040 7b All speakers are allowed three minutes, but said time may be reduced by the chair "based on the total number of speakers." How is that done? According to

2.03.040 7a, that "total number of speakers" cannot be known until the last name on the speakers list has been called. Maybe a prediction market could be helpful.

For non-agenda and agenda comment, the ordinance sets no minimum time per comment, presumably the chair could set 30 seconds, or 15?, yet the time for public comment for Hearings does set a minimum time per comment of 60 seconds. The Brown Act requires reductions in comment time to be "reasonable". Is it unreasonable to expect a revised ordinance to implement a standard for what might be reasonable?
I will note that under current rules, 2.03.040 C 2 sets the maximum time per speaker to comment on an agenda item at 3 minutes for less than 10 speakers, reduced per 2.03.040 C 3 to the minimum 2 (reasonable?) specified time of 90 seconds per speaker if more than 10 speakers. Thus the common practice of the Council now to reduce time to 60 seconds, should require a suspension of the rules, and per 2.03.110, a 2/3 vote of the Council and at least one day's notice in writing being given of the motion.

Of course details can be addressed, but as a whole this sad excursion can not be salvaged. Despite whatever tortured rationale is concocted of cost savings or of somehow providing increased public access, gaslighting is gaslighting. No one is fooled.

Indeed, perhaps it's worth it to learn the truth, that this Mayor, this Council and these City Leaders see no value in input from the community, that they view public comment as a waste of their time and seek to deprive constituents that they hold in contempt, of a voice.

Again from the Court of Appeals of California, First District Division 2 Chaffee v San Francisco Library Commission (2004) (citation above):
"The Brown Act's statement of intent provides: “In enacting this chapter, the Legislature finds and declares that the public commissions, boards and councils and the other public agencies in this State exist to aid in the conduct of the people's business. It is the intent of the law that their actions be taken openly and that their deliberations be conducted openly. [¶] The people of this State do not yield their sovereignty to the agencies which serve them. The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know. The people insist on remaining informed so that they may retain control over the instruments they have created.” (§ 54950.) The Brown Act is intended to ensure the public's right to attend public agency meetings to facilitate public participation in all phases of local government decisionmaking, and to curb misuse of the democratic process by secret legislation of public bodies. (International Longshoremen's & Warehousemen's Union v. Los Angeles Export Terminal, Inc. (1999) 69 Cal.App.4th 287, 293, 81 Cal.Rptr.2d 456.)
When the Brown Act and the Sunshine Ordinance are read in their entirety, we conclude that the lawmaking bodies clearly contemplated circumstances in which continuances and multiple sessions of meetings to consider a published agenda would be required, and thus they mandated that a single general public comment period be provided per agenda, in addition to public comment on each agenda item as it is taken up by the body."
(The Sunshine Ordinance is a City of San Francisco open meetings provision) Vote no
