Los Altos Mayor Dailey and Distinguished Council Members, Subject Council 06/24/2025 Meeting Agenda Item 5 Zoning Code Amendments I request you ask for revision to Agenda Item 5 Administrative Design Review Requirements 14.77.020 and Zoning Administrator 14.77.030 to include Code required Shoulder Improvement Policy SU20ABC for all new homes and existing homes with over 50% floor space increase. This may help to ensure that Code required SU20ABC has been considered by Applicant and Los Altos Staff.

Los Altos Council approved / added to Code, SU20ABC about 10 years ago. It has had somewhat limited impact for new and over 50% floor space increase homes on residential streets without curb and gutter. I have seen approved new home construction drawings that only have a “SU20 or SU20ABC” stamp with no detail construction plans. Contractor did not know what to do? It is possible that this construction detail was not known by applicant, part of Planning Staff reviews or construction drawing Code Check reviews.

I have not been able to find in Los Altos code a definition of SU20ABC applicability for corner lots with no curb or gutter. Recently completed new single-family home at corner of Safe Route to School Lyell and Gabilan would have improved stormwater drainage and safe place to for students to stand as cars pass if SU20ABC had been used.

Thank You for your consideration! Jim Wing, Milverton, Los Altos 5 From: Eric Muller

Dear Council members,
A few comments on the proposed text for the Municipal code, mostly editorial.

The term "electric mobility device" is used in the title, in 8.32.050 and in 8.32.100, but is not defined in the proposed text nor in the California Vehicle Code.

8.32.010
"Low speed vehicle" -> "Low-speed vehicle"

8.32.020, a)
"take all other action" -> "take all other actions"

8.32.100
"shall provide safety information and the legal use of" -> "shall provide information on safety and on the legal use of"

8.32.110, b
extra " at the end of this paragraph

8.32.110, b, 1
seems out of place.

8.32.110, d
"under the following condition" -> "under any of the following conditions"

8.32.110, d, 5
"Include traffic as a cause-" sounds like a drafting directive

8.32.110 e
is that redudant with a), or, if not, should it be merged into a) ? Thanks,

Subject: Public Comment - 06/24/2025 City Council Meeting - Not on the agenda Date: Thursday, June 19, 2025 7:13:01 PM
Dear Council members,
This comment concerns the new City website.

1. Visiting losaltosca.gov causes my browser to issue requests to the following sites:
doubleclick dot net
facebook dot com
ggpht dot com
google dot com
googleapis dot com
googletagmanager dot com
gstatic dot com
msecnd dot com
youtube dot com
ytimg dot com
An ordinary user is entirely unaware of those requests. Those requests reveal to those sites my IP address, and the fact I visited the Los Altos City website. While this is not uniquely identifying data, it is awfully close, and can be correlated with the other sites I may visit. I consider this a serious intrusion of my privacy, and entirely unacceptable from a government web site (especially in the Silicon Valley).

2. The Privacy Policy entirely fails to alert me that those requests are made. Note that those requests are made automatically, without any action on my part. The third paragraph of the policy does not seem applicable.

3. The requests to those sites result in the downloading of Javascript code, over which the City has no control and cannot possibly vet. This can easily be used by those sites to identify my browser (see the Electronic Frontier Foundation tool at coveryourtracks dot eff dot org)

4. In the Privacy Policy, shouldn't the third paragraph read "Many non-city sites, linked *from* the City Website", rather than "linked *to*"?

5. The "Notifiy Me" feature involves the creation of an account on the site civicplus dot com. I think it is entirely inappropriate to have to create an account on a private third-party web site to use this feature (or any other feature of the City website, for that matter).

6. Furthermore, creating an account involves agreeing to the Terms of Services (19 pages) and the Privacy Policy (13 pages) of civicplus dot com, the Google Privacy Policy (39 pages), and the Google Terms of Services (20 pages). This may sound like an ordinary thing to do to the lawyers on the City Council, but please remember that most of the Los Altos residents are mere mortals.
7 7. I fully appreciate that the City does not have the means of developing a web site from scratch, and that it will naturally rely on third parties (public or private). But I think it is perfectly feasible for the City to build a functional website, without the problems mentioned above.

To make an analogy: when I go to City Hall, I don't have to agree to Terms of Use dictated by the company that built it. If the roof fall on me, I expect the City to take responsibility (and possibly to go after the builder, if appropriate). I also expect that the City has not allowed Facebook to install cameras inside City Hall that point to the front door.

Thanks,
Eric Muller

PREVIOUS COUNCIL CONSIDERATION
October 22, 2024

BACKGROUND
As part of the City Council’s ongoing commitment to sustainability and fleet electrification, the City has explored opportunities to transition our vehicle fleet to electric models. This effort is aligned with broader environmental goals and the City's adopted sustainability initiatives.

While the long-term objective remains full electrification of the fleet, the transition must be implemented in phases due to current limitations in charging infrastructure and the unique operational demands of police patrol vehicles.
9 Agenda Item # 1.

DISCUSSION/ANALYSIS
The City’s goal of fleet electrification has already been initiated with the replacement of administrative and detective vehicles with fully electric models. This first step reflects our dedication to sustainability and allows us to assess electric vehicle (EV) integration in a controlled environment with minimal impact on mission-critical operations. We initially purchased a Ford Mustang Mach-E for administrative use. In 2024, we purchased three Chevrolet Blazer EV’s, two of which were planned for patrol usage and one that was planned for administrative use. One vehicle was damaged in transit and the date to receive the vehicle or a replacement is unknown.

We recently received the other two Chevrolet Blazer EV vehicles, but have been unable to upfit them yet.

After more closely examining the Chevrolet Blazer EV’s and the City’s charging infrastructure, staff has determined that moving forward with fully electric patrol vehicles at this time is not feasible for the following reasons:
 Lack of charging infrastructure: The primary limitation is the absence of sufficient EV charging infrastructure to support 24/7 patrol operations. The City’s charging infrastructure may be sufficient for administrative and detective vehicles, but not for patrol vehicles at this time. We have had difficulty with charging our one Ford Mustang Mach-E with the existing infrastructure due to its unreliability. In addition, current EV technology does not yet meet the operational demands, range requirements and reliability standards necessary for emergency response and public safety functions.
 Limited vehicle range and charging time: Patrol vehicles often need to be available for extended shifts or emergencies without delays. The current range and recharge times of many EVs can be a limitation, especially with our current charging infrastructure and the difficulties we have faced with reliability.
 Smaller vehicle size: The Chevrolet Blazer EV’s are much smaller than traditional police vehicles like the Ford Police Interceptor hybrids that we currently have, making them less suitable for certain operational needs. There is limited space in the prisoner transport area, which will make it uncomfortable and sometimes impossible to transport certain arrestees in the Chevrolet Blazer EV vehicles.
 Insufficient storage space: The Chevrolet Blazer EV’s were discovered to have very limited storage space, which is necessary for patrol operations. Police vehicles need to carry a wide range of equipment including weapons, medical kits, traffic cones and more.

The Chevrolet Blazer EV’s lack the cargo space to accommodate all of this gear.  Lack of compatible equipment: Existing law enforcement equipment such as partition cages, weapon mounts, computer systems and light bars are designed for specific traditional vehicle models and we have found that some of this equipment is not available or compatible with the Chevrolet Blazer EV.
10 Agenda Item # 1.
 Lack of pursuit-rated options: As of now, the Chevrolet Blazer EV is the only pursuitrated electric option, so we do not have another choice at this time for an electric patrol vehicle.

Looking to the future, the technology is rapidly improving as it relates to batteries and charging, so there will be better options in upcoming years. We anticipate other vehicle manufacturers producing police pursuit-rated electric vehicle options over the next few years and we would like to evaluate those options, especially ones that are comparable in size to our current Ford Police Interceptor hybrids.

Although we initially purchased two Chevrolet Blazer EV’s for patrol usage, once we discovered these various issues, we were able to pivot and will be using all three Chevrolet Blazer EV’s for administrative and detective vehicles. Our current Ford Mustang Mach-E is already used as an administrative vehicle. Staff can continue to replace administrative and detective vehicles with electric vehicles. We can electrify all of our fleet vehicles other than the patrol vehicles, as long as charging infrastructure can accommodate the charging needs.

Staff proposes the purchase of two 2025 Ford Police Interceptor Hybrid vehicles for patrol use.

These hybrids offer improved fuel efficiency, reduced emissions and support our gradual transition toward fleet electrification. They will provide operational reliability while the City continues building out the necessary infrastructure and evaluating advancements in EV technology. Our current patrol fleet is comprised of Ford Police Interceptor Hybrids and staff would like to continue with the standardization due to the following operational and logistical benefits:
 Ease of Upfitting: When all patrol vehicles are the same make and model, installation of equipment such as lights, sirens, radios, computer mounts, prisoner partitions and other emergency gear is streamlined. This reduces installation time, cost and the risk of compatibility issues.
 Officer Familiarity and Safety: Consistency in vehicle layout enhances officer performance and safety. Under high-stress situations, officers rely on muscle memory to access critical equipment. A standardized setup across all vehicles ensures that tools and technology are located in the same place in every unit, reducing response time and minimizing errors.
 Maintenance Efficiency: Fleet maintenance becomes more efficient when vehicles share the same parts, service procedures and diagnostic tools. This reduces downtime and simplifies inventory management for the City’s fleet services division.  Training and Operational Consistency: A uniform fleet reduces the training burden for officers and support staff, as they only need to learn and maintain proficiency with one vehicle platform.

AUTHORIZING THE CITY MANAGER TO APPROVE THE PURCHASE OF TWO 2025 FORD POLICE INTERCEPTOR HYBRIDS IN THE AMOUNT OF $120,964 AS PART OF THE 2025/2026 VEHICLE REPLACEMENT PLAN
WHEREAS, the City Council has adopted goals to reduce greenhouse gas emissions and transition to a more sustainable and energy-efficient municipal fleet; and WHEREAS, the Police Department has begun implementing this directive by replacing administrative and detective vehicles with fully electric vehicles; and WHEREAS, fully electric patrol vehicles are not currently feasible due to limitations in charging infrastructure and the operational demands of 24/7 emergency response; and WHEREAS, hybrid patrol vehicles provide an effective interim solution by reducing emissions and fuel consumption while maintaining operational readiness; and WHEREAS, standardizing the patrol fleet with Ford Police Interceptor Hybrid vehicles promotes officer safety, improves efficiency in vehicle upfitting and maintenance and ensures consistent access to emergency equipment under high-stress conditions; and WHEREAS, funding for the purchase of two 2025 Ford Police Interceptor Hybrid vehicles is available and appropriated in the Police Department’s Vehicle Replacement Fund; NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Los Altos hereby authorizes the City Manager to approve the purchase of two 2025 Ford Police Interceptor Hybrids in the amount of $120,964 as part of the City’s vehicle replacement program.

City Council Agenda Report

Subject: Adoption of Resolution—Agreement with Axon Enterprise, Inc

COUNCIL PRIORITY AREA
☒Public Safety

☐Environmental Sustainability
☐Housing
☒General Government

RECOMMENDATION
Adopt a resolution authorizing the City Manager to execute a contract with Axon Enterprise, Inc. ("Axon") for the purchase and deployment of public safety technology and equipment, in an amount not to exceed $453,600 over a 5-year contract.

FISCAL IMPACT
The $93,366 annual cost is included in the adopted FY25/26 Operating Budget under the Public Safety Department to support this contract with Axon Enterprise, Inc. No additional appropriation is required at this time.

ENVIRONMENTAL REVIEW
Not Applicable.

PREVIOUS COUNCIL CONSIDERATION
None

ANALYSIS
The current contract with Axon is $69,482 annually and will exceed the City Manager’s signing authority when the next payment comes due in October 2025. Staff are requesting the City Council to authorize the City Manager to execute an agreement with Axon for a total of $453,600 over 5 years. We have already completed Year 1 of the contract.

DISCUSSION
The Los Altos Police Department has contracted with Axon for many years and has obtained bodyworn cameras and “Tasers” from Axon, along with software to store the body-worn camera footage (Evidence.com). In October 2024, the contract was renewed for $69,482 annually and was set for 14 Agenda Item # 2.
a 5-year term. Axon is a sole source vendor for this equipment and software. All of the Los Altos Police Department’s digital evidence, including body worn camera footage, is stored in Axon’s Evidence.com system.

Staff would like to continue our contract with Axon, but need Council approval to surpass the City Manager’s signing authority. We need to add an additional three (3) tasers and five (5) body worn cameras to use as spares when equipment goes down and to assign to staff that will be hired within the next year. A transcription feature and more storage that is needed is also being added, which is increasing the annual cost for Years 2-5 to $93,366 per year. There will also be a one-time prorated payment in July 2025 for $10,615 to add the new equipment and services until our annual bill comes due in October. There is no additional fiscal impact to the City as all these expenses were budgeted in the FY25/26 Budget.

RECOMMENDATION
Introduce the draft ordinances and consider the Planning Commissions June 5th, 2025, recommendations for the adoption of the proposed ordinances which include:

1. An Ordinance of the City Council of the City of Los Altos Adding Chapter 14.77 (Design Review) to the Los Altos Municipal Code; and

2. An Ordinance of the City Council of the City of Los Altos Repealing in its Entirety Chapter

14.76 and Chapter 14.78 for Existing Design Review Regulations; and

3. An Ordinance of the City Council of the City of Los Altos Amending Chapter 14.01 (Administration of Zoning) to the Los Altos Municipal Code; and Find that the proposed amendments are exempt from environmental review pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines.

FISCAL IMPACT
Not Applicable.

ENVIRONMENTAL REVIEW
The proposed amendments are exempt from environmental review pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines.

PREVIOUS COUNCIL CONSIDERATION
Not Applicable.
40 Agenda Item # 4.

BACKGROUND
The proposed Design Review ordinance merges together two (2) existing Chapters within the Los Altos Municipal Code, Chapter 14.76 and 14.78. The two (2) existing chapters both necessitate amendments for consistency in the Los Altos Zoning Code. The two (2) chapters are being proposed to be merged as the best practice for user experience and ease of application of the Code.

The merger of the two (2) chapters into a standalone chapter is common practice for the requirements of Design Review in most jurisdictions, as the process for permitting should be the same, and the district specific regulations are reflected elsewhere in the code. Specific provisions in the proposed ordinances are largely consistent with the existing two separate chapters, and existing practice within the City.

ANALYSIS
The Ordinance consolidates two (2) standalone ordinances for design review within the City of Los Altos, one for the Single-Family Districts, and one for all other Districts. The two (2) standalone ordinances necessitate updates for consistency with the Los Altos Municipal Code based on several recently completed code amendments. The merger of the two (2) chapters allows for best practice and what is commonly seen in other codes within the industry. Regulations contained within the newly proposed Chapter are largely the same as what exists today, and existing practices of the City of Los Altos.

DISCUSSION
The consolidated Design Review Ordinance ensures consistency and adherence to the City of Los Altos established rules and regulations for development. The existing two (2) standalone chapters do not speak to each other, and in some areas fall short of the prescriptive compliance that is necessary for a well-established regulatory framework. The amendments are proposed based on the existing practices of the City of Los Altos, and industry standards which are known for this municipal function in Planning and Zoning. Overarchingly the amendments streamline the review process for all parties, which is crucial as Design Review is the City’s single most application requested and reviewed by the Development Services Department.

Planning Commission June 5th Recommendation
On June 5, 2025, the Los Altos Planning Commission held a public hearing to consider the draft ordinances. During that meeting public testimony was received; the commission considered all testimony.

2. That the granting of the variance will not be detrimental to the health, safety, or welfare of persons living or working in the vicinity or injurious to property or improvements in the vicinity; and

3. That variances from the provisions of this chapter shall be granted only when, because of special circumstances applicable to the property, including size, shape, topography, location, or surroundings, the strict application of the provisions of this chapter deprives such property of privileges enjoyed by other property in the vicinity and under identical zoning classifications.

C. PREVIOUS COUNCIL CONSIDERATION
Not Applicable.

BACKGROUND
At its regular meeting on June 10, 2025, the Los Altos City Council approved a Resolution amending the existing Los Altos Flag Raising Policy.

Los Altos’ flag raising policy says that in addition to the flags of the United States, the State of California, and the City of Los Altos, “the City Council may authorize the display of other flags on City property, including to commemorate an event or occasion.” Authorization to fly an additional flag must be in the form of a resolution.

At its regular meeting on June 10, 2025, the Los Altos City Council approved placing on its agenda the question of whether to fly the America 250 flag in the month of July 2025.

DISCUSSION
The United States of America will celebrate its Semiquincentennial, its 250th anniversary, in 2026, marking the July 4, 2026 anniversary of the Declaration of Independence. 67 Agenda Item # 5.

The United States Semiquincentennial Commission Act of 2016 directs the federal government to mark this anniversary with celebrations such as issuing commemorative postage stamps and coins. Cities across the United States will mark the semiquincentennial with events recognizing local historic milestones or celebrating the nation, including Boston, Philadelphia, New York, Pittsburgh and Louisville.

The America 250 program is a nonpartisan, multi-year, nationwide effort to commemorate and celebrate this 250th anniversary of the Declaration of Independence. Its initiatives include exhibits, a student contest, time capsules, and more.

The raising of this flag would invite the Los Altos community to join in celebrating our nation's semiquincentennial. July 4, 2025 will be the 249th anniversary of the Declaration of Independence. This occasion offers us all the opportunity to reflect on American history and the colonists standing up against the King to form our republic and bring a new nation into being. There will be several programs planned by the Daughters of the American Revolution Los Altos Chapter over the coming year including ones on the First Amendment, Birthday of the United States Navy, and the Declaration of Independence.

Displaying this America 250 flag encourages the Los Altos community to celebrate Independence Day on July 4th and to join in celebrating America 250 with events this year, in 2026, and beyond.

EXHIBIT 1

LOS ALTOS FLAG POLICY
The flags of the United States, California, and the City may be flown on City property.

The United States flag shall always be given precedence, and the flag of California shall be given precedence over the City’s flag. The display of these flags shall comply with 4 U.S.C. § 1, et seq., and Government Code Section 430, et seq.

In addition to these flags, or in lieu of the display of the City’s own flag, the City Council may authorize the display of other flags on City property, including to commemorate an event or occasion. Such authorization by the City Council shall take the form of a resolution, which shall include the following information:
(1) The date or dates on which the flag shall be displayed and any locations in addition to City Hall where the flag shall be displayed;
(2) A finding that the display of the flag constitutes government speech in that the particular message conveyed by the flag is a message that the City Council wishes to express on behalf of the residents of the City;
(3) A statement describing the particular message conveyed by the flag and expressing the reason or reasons the City Council wishes to express that message on behalf of the residents of the City; and
(4) A statement that the resolution is adopted pursuant to this policy and a statement of reasons why the adoption of the resolution is consistent with this policy.

Under no circumstances shall the City Council authorize the display of a flag that:
(1) Represents a group, organization, or movement that advocates the unlawful overthrow of the state or federal government;
(2) Commemorates a rebellion against the federal government by the government of any state;
(3) Advocates discrimination or intolerance against individuals on the basis of any classification specified in Civil Code Section 51;

The City Council may consider authorizing the display of a flag pursuant to this policy referral of the entire Council on motion of any Councilmember made during the time reserved at regular City Council meetings for discussion of future agenda items, or at the recommendation of a commission of the City. The City Council may also consider authorizing the display of a flag on application of a resident or community group, as follows:

City staff shall provide a recommendation to City Council for every application on whether the proposed flag or organization meets the above criteria listed 1 through 6 for a flag raising, which will allow City Council to make the final determination on the application.

The City Council shall not authorize the display of the same flag more than once per year, and if it approves an application from an individual or group within a particular calendar year, it shall not consider another application from that individual or group until the following calendar year. The City Council may condition its authorization to display a particular flag on the applicant’s agreement to donate the use of a flag for that purpose.

The flag must be a clean and serviceable flag with dimensions no larger than 4’ x 6’ that is sturdy enough to be flown on an outdoor flagpole for at least one week, and the City shall not be responsible for any loss or damage to the flag while in its possession. The flag must be collected by the applicant within two business days of removal or it may be discarded or destroyed by City staff.

At the time it authorizes the display of any flag, the City Council may also authorize a flag raising ceremony. Any such ceremony shall be open to the general public, subject to reasonable rules of decorum intended to avoid disruption and reasonable efforts by law enforcement to maintain public order in case of a lawful or unlawful protest occurring at or near the site of the ceremony. If the display of the flag has been authorized by the City Council on the application of a private individual or organization, then the City Council may condition authorizing a flag raising ceremony on the applicant’s agreement to pay the costs of the ceremony and to coordinate or assist in the coordination of the ceremony; provided, however, that:

(2) City staff shall oversee the coordination of the ceremony and shall supervise and maintain ultimate control over the conduct of the ceremony.

RECOMMENDATION
Introduce an Ordinance of the City Council of the City of Los Altos Repealing Chapter 8.32 in its entirety and replacing it with a new Chapter 8.32 entitled “Bicycle and Electric Mobility Devices” to Title 8 (Vehicles and Traffic) of the Los Altos Municipal Code.

FISCAL IMPACT

ENVIRONMENTAL REVIEW
Not a Project Under CEQA.

PREVIOUS COUNCIL CONSIDERATION
The ordinance was considered by the City Council on June 8, 2025.

BACKGROUND
The city has received numerous concerns from Los Altos residents regarding the unsafe use of ebicycles and e-scooters on city streets and sidewalks, particularly by juveniles. Residents have reported, and City staff have observed, riders without helmets, multiple riders on e-bicycles or escooters designed for one rider, excessive speeding, unsafe behaviors on sidewalks, riding against traffic, and a general disregard of traffic laws. There is a perception that current state law does not adequately address safety concerns related to e-bicycles for riders and passengers, as well as for pedestrians on sidewalks.

This matter was brought to the Complete Street Commission (CSC) on October 30, 2024, with recommendations from the Police Department. With input from the public and the CSC, it was 78 Agenda Item # 6.
determined that e-bicycles and e-scooters should be restricted from using the sidewalk in the downtown triangle.

The recommendation from the CSC to restrict e-bicycles and e-scooters only in the downtown would not have the outcome that the police department is looking for. The issue of e-bicycles and e-scooters is not isolated to the downtown area. The problem is widespread, and the residents and the police officers are seeing the issue in other parts of the City. For this reason, the police department would like to implement an e-bicycle and e-scooter ordinance for the whole City.

The recommended ordinance was brought before the City Council on June 8, 2025, for consideration and adoption. At this Council meeting, the Council was asked to adopt the recommendation:

1. Operators of e-bikes and e-scooters are required to wear a helmet if they are under 18 years of age in accordance with the State law.

2. E-bikes and e-scooters shall be restricted from operating on sidewalks throughout the City, except by juveniles 12 years of age and younger.

3. The number of riders on an e-bike and e-scooter shall not exceed one (1), unless the e-bike or scooter is specifically designed for multiple riders.

4. Any individual may operate a bicycle on a sidewalk if riding the bicycle on the street or designated bicycle lane places the individual in an unsafe situation, given the current road conditions.

Based on the recommendation, the Council would like to modify the ordinance as written. The Council directed staff to remove the age exemption, and the restriction of riding on playgrounds or school grounds. The Council further directed staff to broaden the exemption for sidewalk riding to include roadway conditions or other considerations that may make a rider feel unsafe operating in the roadway.

ANALYSIS
California Vehicle Code (CVC) 231 classifies an e-bicycle as a bicycle, granting the same rights and privileges. CVC 21100 further extends vehicle driver rights, including, but not limited to, a provision concerning driving under the influence, to bicycle riders. Under existing State law, bicyclists and e-bicyclists can operate on the road and the sidewalk without restriction. However, CVC 21100(3) and 21207 permit local agencies to restrict the operation of bicycles and e-bicycles.

For e-scooters, CVC 21221 provides similar rights and privileges to those of a vehicle operating on the highway, including, but not limited to, provisions concerning driving under the influence.

CVC 21230 permits e-scooter operation on bicycle paths, trails, or bicycle ways, unless the local authority or the governing body of a local agency has jurisdiction over that path, trail, or bicycle way and prohibits that operation by ordinance. CVC 21235 mandates a valid driver’s license for e-scooter operation and prohibits sidewalk use, except when entering or leaving an adjacent property.

DISCUSSION
Under the proposed ordinance, bicycles and e-bicycles can utilize the sidewalk if riding on the street or in a designated bicycle lane is considered unsafe by the rider, within reason. The types of hazards that would qualify a rider to utilize the sidewalk in place of the road are as follows:
79 Agenda Item # 6.

1. The road is less than eleven (11) feet in width without a designated bicycle lane.

2. Debris blocks a dedicated bicycle lane, and it is the only means of getting around the hazard.

3. Vehicles are parked in the bicycle lane or utilizing it for turning movements at an intersection.

4. The condition of the road has deteriorated to the point where it is unsafe for a bicycle to traverse through the area.

5. Include traffic as a cause—traffic congestion or circulation, or other similar elements.

Other conditions may exist that are not listed by the staff, nor can they be anticipated. This is where judgment must be exercised by the police officers who will enforce this ordinance.

The purpose of the low fines for violation of the ordinance is not to penalize, but to promote behavioral change among the public. Staff and the Police Department felt that if the fine for the violation is too high, it would not encourage behavior modification that we would like to see from the residents. Since the Council is adopting some state laws into the City’s municipal code, it would provide our police officers with the flexibility to issue administrative citations. If the violation is egregious, the police officer has the option to cite the violator under the vehicle code, which typically carries higher penalties administered by the traffic courts.

Staff recommends to the City Council introduce an Ordinance of the City Council of the City of Los Altos Repealing Chapter 8.32 in its entirety and replacing it with a new Chapter 8.32 entitled “Bicycle and Electric Mobility Devices” to Title 8 (Vehicles and Traffic) of the Los Altos Municipal Code.

DATE: 6/24/2025
TO: COUNCILMEMBERS
FROM: CITY MANAGER’SOFFICE
SUBJECT: COUNCIL Q&A FOR JUNE 24, 2025 CITY COUNCIL REGULAR MEETING Agenda Item 2 (Purchase of Ford Hybrid Interceptors):
• Palo Alto is buying Rivian police interceptors. Has the LAPD looked into this option? Why will these work for Palo Alto but not Los Altos?
Answer: Palo Alto has one Rivian that took about one year to fully upfit since it is a completely custom vehicle. They are testing the Rivian as a Watch Commander’s vehicle (not a patrol vehicle for officers) and then will determine whether it meets their needs before they purchase more. These are very costly to purchase and upfit (approximately $125K for Palo Alto’s vehicle), plus the maintenance is high if vehicles were to get damaged, as they often do in police work. There are not as many repair shops that are able to service these vehicles for law enforcement use. They can only be repaired at RIvian. These vehicles are still new to the market, so all the additional equipment needed for patrol usage is not necessarily available yet. We will keep in contact with Palo Alto to see what their experience was like with Rivian to see if it might meet our needs in the future when we have a reliable charging infrastructure. • In October of last year, when approving the purchase of Chevy Blazer EV’s, the PD represented to the Council that it was good idea for the following reasons (copied from the 10/22/24 packet, pages 49-50):

1. Alignment with Sustainability Goals: The proposed vehicles will help the City meet its sustainability goals by reducing the overall carbon footprint of the Police Department’s fleet. The transition to electric vehicles is a key initiative in our environmental strategy.

Answer: We will still be reducing the overall carbon footprint since we will ultimately still obtain approximately the same number of electric vehicles as originally planned; they will just be detective and administrative electric vehicles, rather than patrol vehicles. The current patrol vehicles and the two we are requesting to purchase are hybrids, which further contributes to the reduction of the overall carbon footprint. We still purchased four electric vehicles (Ford Mustang Mach-E and 3 Chevy Blazers), as was originally planned.

They will just be used for non-patrol functions.

2. Operational Efficiency: Electric vehicles offer lower maintenance costs compared to traditional internal combustion engine vehicles. They also provide substantial savings in fuel costs, which will contribute to overall budget efficiency.

Answer: This may still be the case, but if we cannot charge all of the patrol vehicles simultaneously with our current infrastructure, We will still have some 93 Agenda Item # 8.
savings related to fuel costs since the rest of the non-patrol fleet will eventually be switched to electric.

3. Enhanced Performance: The Chevy Blazer EV and Chevy Silverado EV are equipped with advanced technology and features that meet the operational requirements of the Police Department. These vehicles are capable of handling diverse tasks and will support the department’s efficiency in urban areas.

Answer: See above answer about the charging infrastructure. Additionally, we found the vehicles are too small in the rear seat for arrestee transport and also do not have enough cargo space in the rear for the equipment that needs to be carried, so the Blazers do not meet our operational needs.

4. Support for Infrastructure Development: Investing in electric vehicles will also underscore the city’s commitment to supporting and developing EV charging infrastructure, fostering a more sustainable environment city-wide.

Answer: We do not currently have a permanent charging solution at the police department. The infrastructure will have to built either as part of a new police station or rehabilitating and expanding the current station. The solution in place right now works well for non-patrol vehicles as mentioned in this QA. • Why has the PD disregarded their own arguments from October of 2024? Answer: One of the main issues is the lack of a permanent charging infrastructure.

Until this is remedied, it is not practical to switch to electric patrol vehicles at this time. Additionally, we discovered the Chevy Blazers are too small to fit our needs, so we are anticipating a potential switch in the future when Ford manufactures electric Explorers or another manufacturer starts producing pursuit rated electric patrol vehicles that are comparable in size to the Ford Explorers. For operational effectiveness, we need a vehicle the same size or larger than a Ford Explorer. • Resolution: The NOW THEREFORE clause is not clear whether the $120,964 is the total amount for the two vehicles or if they are each $120,964.

Answer: The is the cost for the two vehicles.
• Confirming that $120,964 is the total cost for both vehicles (not for each).

Answer: Yes, $120,964 is the total cost for both vehicles together. They are approximately $60K each.

Agenda Item 3 (Renewal of Contract with Axon Enterprise, Inc.):
• Why are Axon Enterprise’s services increasing by almost $10,000 (13.6%) annually? Answer: We are adding several features: transcription ($8000) and more storage for our drone footage ($2000). The cost hasn’t increased, just our additions. • Did the City put out an RFP for this contract? If not, then why not? Answer: It is a sole source vendor.
• Have alternative providers been considered?
94 Agenda Item # 8.

Answer: It is a sole source vendor.
• Please provide a cost breakdown for Tasers, body cameras, and video cloud storage. Detail to the exact cents not required, a “pie chart” level of clarity would be sufficient. Also, would like to understand what costs are purchases versus recurring charges.

Answer: We do not have a breakdown for each item since it is sold as a “bundle” with all items priced together (other than the two new items we’re adding: transcription and extra storage). The annual cost for added storage is approximately $2000. The cost for the transcription for all users per year is approximately $8000. We have already purchased/received the hardware. The total cost for hardware, software and support is spread evenly over a 5-year contract, but you receive the hardware (cameras and Tasers) upfront, which we already received last year. In order to continue using them, we need to get the contract approved to pay the rest over the next 4 years.

Agenda Item 4 (Fire Protection Services):
• Does this resolution obligate the City to enter into a contract only with County Fire for services beyond 2026?
Answer: No, this Resolution simply directs staff to explore continuing with County Fire.

If an agreement cannot be reached, or Council directs otherwise, the City can implement an alternative solution for fire protection services. • Has staff looked into alternative providers for fire protection services? Answer: Staff has briefly explored whether neighboring jurisdictions or other provider would be viable for fire protection services. At this time it is believed that County Fire is the best possible provider of fire protection services for Los Altos. • Is staff investigating the feasibility of re-establishing our own fire department? Answer: Staff has briefly explored the feasibility of bringing fire protection services in house.

Agenda Items 5 (Zoning Code Amendments):
• RESOLUTION FOR CHPTR. 14.77: This is a new section. The word “AMENDMENT” should be “ADDITION” and the word “amended” should be “added” in Section 1 of the NOW THEREFORE part of the resolution.

Answer: Noted. This will be changed in final ordinance. • In Appendix A, new Chapter 14.77, Section 14.77.070 Design Review Findings - L, shouldn’t it say Design Review not Development Review, "The approval of the Development Review complies with the California Environmental Quality Act (CEQA).”? Answer: Noted. This will be changed in final ordinance. 95 Agenda Item # 8.
• With the proposed deletions of "14.76.070 Variance findings" and "14.78.070 Variances" from the existing ordinances, where are variances addressed? They don’t appear to be in the new proposed ordinance.

Answer: Variances are now addressed in Chapter 14.01, and is applicable for any variance request, not just for design review requests.

Agenda Item 6 (Flag Raising Policy and America 250 Flag):
• Staff proposes that the Council amend the flag raising policy. Isn’t that beyond the scope of the published agenda item?
Answer: City staff is not proposing any change to the flag raising policy. Attachment #1 is the flag raising policy that was adopted at the last City Council meeting as a reference for discussion, and no action on that resolution is necessary. • Why are we being asked to change the policy?
Answer: City staff is not proposing any change to the flag raising policy. Attachment #1 is the flag raising policy that was adopted at the last City Council meeting as a reference for discussion, and no action on that resolution is necessary. • Can the City obtain an America 250 flag without “Daughters of the American Revolution?” Answer: City staff can obtain any flag at the direction of City Council. • Why are we being asked to fly this flag one year early? Are any other agencies flying an America 250 flag one year early?
Answer: This was a request by the City Council for discussion. City staff does not know if any other jurisdictions will be flying the America 250 flag at this time. • RESOLUTION: The NOW THERFORE section refers to the “Juneteenth flag.” Answer: Staff apologizes for the error. Attached is an updated resolution. • Is the Council the applicant for this flag? There is no application included.

Answer: This item was requested to be placed on this meeting’s agenda at the end of the last City Council meeting by the City Council when presented by Mayor Dailey with support from Councilmembers Weinberg and Meadows.
• The policy requires that "A full color picture of the flag (front and back) must be included with the completed application, and the dimensions of the flag must be specified.” Do we have this, the attached exemplar doesn’t provide complete information.

Answer: The exemplar attached to the staff report was provided to staff by Mayor Dailey.
• In the policy “1. Applicant Guidelines, section f”, it says that "Approved Commemorative flags will be flown for no longer than seven calendar days … “. The proposal as described in the staff report says it will be flown the entire month of July but the resolution specifies just the first week of July. Please clarify which time period the proposal is for, I assume it’s for one week to be consistent with our policy?
96 Agenda Item # 8.

Answer: If Council approves the resolution, the flag would be flown from July 1, 2025 through July 8, 2025 at Los Altos City Hall, which would be consistent with the policy. • Is there a flag representing America 250 that doesn’t include the DAR name on it? If that is the flag that is proposed, shouldn’t DAR be the applicant? Answer: City staff can obtain any flag at the direction of City Council. This item was requested to be placed on this meeting’s agenda at the end of the last City Council meeting by the City Council when presented by Mayor Dailey with support from Councilmembers Weinberg and Meadows.
• The photograph of the flag seems to differ from the official design approved by the U.S. Semiquincentennial Commission, as shown here:
https://america250.org/news/etter-from-the-chair-on-new-logo-launch/ Answer: The exemplar attached to the staff report was provided to staff by Mayor Dailey.
• Why not use a flag with that design? They seem to be readily available. https://www.united-states-flag.com/collections/america-250-flags Answer: The exemplar attached to the staff report was provided to staff by Mayor Dailey. City staff can obtain any flag at the direction of City Council.

Agenda Item 7 (E-Bike and E-Scooter):
• In the Ordinance, the title of "8.32.070 – Riding in playgrounds or school grounds.” shouldn’t that section in its entirety—including the title—be struck out, and not leave the title with no text below it? Then the following sections should be renumbered as necessary.

Answer: The strike out is left in the ordinance to show the modification to the ordinance requested by the Council. The second reading of the ordinance will have a clean copy of the ordinance, and the numbering will be adjusted accordingly. • In the ordinance, shouldn’t "8.32.110 – Exemptions, section c-1" also be struck out or at least moved to section d.

Answer: The strike out is left in the ordinance to show the modification to the ordinance requested by the Council. The second reading of the ordinance will have a clean copy of the ordinance, and the numbering will be adjusted accordingly. • Which kinds of roads are typically less than eleven (11) feet in width and how would a bicyclist know that this was the case?
Answer: An eleven (11) feet road is narrow, and a car cannot pass a bicycle without crossing the centerline of the road. Typically, most roads in the City with eleven (11) feet travel lanes already have a bicycle lane. If the road is narrow then eleven (11) feet, we have also started to place sharrows on the road when repaving the road. • "8.32.110 – Exemptions, section d-5" doesn’t seem to be finalized, it says "Include traffic as a cause—traffic congestion or circulation, or other similar elements“ and seems to only be preliminary wording as a reminder for the writer. Please clarify what this should say. 97 Agenda Item # 8.

Answer: This section, d-5 can be revised to state “Include traffic as a cause such as traffic congestion and/or circulation issues, or other similar road conditions creating a traffic safety concern.” If this recommendation is too flexible, and difficult for PD to enforce, Staff can remove this exemption from the ordinance. 98 Agenda Item # 8.
