Subject: FOR PUBLIC COMMENT on Item #4C: Jan. 7, Special Meeting of City Council Dear Councilmembers,
Six weeks ago I submitted a Public Records Request to the Town seeking documents relating to the communications between Mr. Pirnejad and the owners, or representatives of the owners, of the Twin Oaks and Arastradero Road properties. I have yet to receive any documents which are responsive to that request. (The Town produced two batches of documents, none of which relate to communications with the owners of the Twin Oaks or Arastradero Road properties.) As I have noted in previous emails, it should not take Mr. Pirnejad very long, if he is at all organized, to identify and provide copies of documents relating to the communications which I have requested. Mr.

Pirnejad has, on more than one occasion, claimed to be in "negotiations" with the owners of the Twin Oaks property regarding a development agreement. If so, there certainly should be documents readily available to Mr. Pirnejad relating to such "negotiations." As no documents responsive to my request have been produced, I cannot help but conclude that Mr. Pirnejad is purposefully disregarding the Town's, and his, obligation to comply with my public records request. As I have previously pointed out, if I initiate litigation in order to compel Mr. Pirnejad to comply with my public records request, I will be entitle to recover my attorneys fees from the Town.

While it is shocking to me that Mr. Pirnejad would subject the Town to liability for payment of my attorneys fees to enforce the Town's obligation to produce the documents which I have requested, his behavior is certainly consistent with his previous actions regarding the Twin Oaks site and the time bomb which he and his consultants have included in the Town's Housing Element.

We now have 584 signatures on our petition asking the Council to pursue and amendment of the Housing Element to defuse Mr. Pirnejad's time bomb. (See link to Petition below.) Yet Mr. Pirnejad continues to act at cross-purposes to the expressed interest and desire of hundreds of Los Altos Hills residents (as well as of the Planning Commission and City Council) that the Town not enable a multi-hundred unit housing development along the narrow traffic and emergency evacuation corridor of Arastradero Road. Mr. Pirnejad's conduct has been consistently to act as an advocate for the Twin Oaks owners' ability to build hundreds of units along Arastrado Road. Accordingly, it is abundantly clear that Mr.

Pirnejad is an inappropriate person to represent the Town's interests with respect to amending the Housing Element.

The Council should take Mr. Pirnejad out of the loop regarding the Housing Element, and instead direct that a committee consisting of Planning Commissioners and Town residents be appointed and charged with pursuing an amendment of the Housing Element. Such an amendment could be as simple as changing the existing wording about rezoning the entire 15 acres of Twin Oaks to a density of 20-30 units per acre to read something like: “the Town will rezone a portion of the Twin ITEM 4C, Supplement 1

2 Oaks site, and provide certain MDA and MFA incentives so as to facilitate and encourage the development of at least as many new housing units, including affordable housing units, at the Twin Oaks site as was originally contemplated to be developed at Twin Oaks as stated in the Housing Element which HCD previously certified in May of 2023.” Most sincerely,
Michael Grady
