Agenda Staff Report
TO: Mayor Faria and City Council Members
FROM: William A Vaughn, City Attorney
DATE: February 16, 2022
TYPE OF REPORT: Consent Agenda
SUBJECT: Continuation of Virtual Meetings - Per AB 361
RECOMMENDATION
Adopt Resolution No. __ _
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOS BANOS
REAUTHORIZING REMOTE TELECONFERENCE MEETINGS OF THE LEGISLATIVE BODIES OF THE CITY OF LOS BANOS PURSUANT TO THE PROVISIONS OF AB 361
BACKGROUND
California's Ralph M. Brown Act has been amended to allow fully virtual public meetings during a state of emergency after the Governor signed Assembly Bill 361 into law on September 16, 2021.
DISCUSSION
The new law comes as local public agencies were preparing for the expiration of Executive Orders that currently allow virtual public meetings. AB 361 goes into effect immediately, and it amends Section 54953 of the Brown Act to allow virtual public meetings through January 1, 2024 in any of the following circumstances:
27 1. The legislative body holds a meeting during a proclaimed state of emergency, and state or local officials have imposed or recommended measures to promote social distancing.
2. The legislative body holds a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.
3. The legislative body holds a meeting during a proclaimed state of emergency and has determined, by majority vote, that, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.
These circumstances allow agencies to hold entirely virtual public meetings during the current pandemic, while California is in a proclaimed state of emergency.
The previous teleconference rules under the Brown Act also remain in place, but are not as flexible (for instance each teleconference location must be identified in the agenda and the teleconference location must be accessible by the public).
If a City Council or City Commission meeting is held virtually under the new provisions of AB 361, the agenda must still be posted under the appropriate timelines:
72 hours in advance for a regular meeting, and 24 hours in advance for a special City Council meeting. The agenda must include the meeting link or dial-in, so that members of the public may access the meeting. Members of the public must be allowed to address the City Council or City Commission in real-time during the meeting. In addition to the real-time public comments; the City can continue to allow public comments to be submitted in advance.
AB 361 also has special provisions for technical glitches. In the event the meeting broadcast is disrupted, or if a technical issue on the agency's end disrupts public comment, the City Council cannot take any further action on the agenda until the technical issue is resolved.
Most significantly, in order to continue to hold virtual meetings when a state of emergency remains active, the City Council must make findings every 30 days that 1) the City Council has reconsidered the circumstances of the state of emergency and 2) the state of emergency continues to directly impact the ability of the members to meet safely in person or state or local officials continue to impose or recommend measures to promote social distancing.
The City Council previously adopted a Resolution 6405, on October 6, 2021, finding that the requisite conditions exist for the legislative bodies of the City of Los Banos to conduct remote teleconference meetings without compliance with paragraph (3) of subdivision (b) of section 54953. Those conditions have not changed and continue to exist. In fact, on November 10, 2021, Governor Gavin Newsom signed Executive Order N-21-21 which extended through March 31 , 2022, the state of emergency in California related to the threat of COVID-19. And on January 5, 2022 as mitigation for the 28 Omicron variant, the California Department of Public Health (CDPH) extended the requirement that masks to be worn by all employees in all indoor public settings, irrespective of vaccine status, through February 15, 2022. Staff is recommending that the City Council reauthorize remote teleconference meetings of the legislative bodies of the City of Los Banos pursuant to the provisions of AB 361 by adoption of the attached Resolution.
FISCAL IMPACT
None.
CONCLUSION
Staff is recommending that for the time being City Council meetings continue to be held virtually pursuant to and under the requirements of AB 361 as outlined above.

FROM:
Mayor & City Council Members v
William Via, Public Works Operations Manager vJ. 1/4'
DATE: February 16, 2022
SUBJECT: Adopting a revised budget for the Fiscal Year 2021-2022 as it pertains to expenditures for Landscaping and Lighting District #9
TYPE OF REPORT: Consent Agenda
Recommendation:
That the City Council adopts the Resolution to amend the budget for the 2021-2022 Fiscal Year by increasing expenditures for Landscape & Lighting Districts #9 in the amount of $6,877.31.
Background:
The City Council may amend the budget by resolution, adjusting the overall appropriation levels in each fund at any time during the fiscal year if funds are available.
Increased appropriations can be recommended to either solve a current year problem, or address a critical service need.
The City Council approved appropriations for the 2021-2022 Fiscal Year Budget for Landscape and Lighting Districts revenue and expenditures in June 2021.
Discussion:
The Public Works Department routinely performs readiness/preventative maintenance on its storm drainage system. At the Jo Lin storm station, one of the storm water pumps was pulled for service. After further inspection, it was determined that repairs were necessary to ensure the station could respond effectively during large rain events.
Anderson Pump Company has completed the required repairs to the pump including a new line shaft, bearings, and impeller. The funds needed to complete the repairs were not included in the 2021-2022 Fiscal Year Budget.
Fiscal Impact:
The impact to the Landscaping and Lighting District #9 fund is to increase appropriations to expenditures in the storm drain maintenance account 279-458-200- 223 by $6,877.31. If approved, the estimated ending fund balance for District #9 for fiscal year 2022 will be $38,541.

TYPE OF REPORT: Consent Agenda
SUBJECT: Request for a Budget Amendment for the Recreation Electricity and Gas Line Item
Recommendation:
That the City Council approve an appropriation increase of $53,000 in the General Fund Recreation account for the line item, 100-451-240-264. At future budget discussion, Staff will bring forward analysis of possible solar options at the Community Center.
Background:
The General Fund Recreation account line item, 100-451-240-264, provides funding for expenses related to electricity and gas at the Los Banos Community Center, the College Greens building and the Ranchwood Park facility. Beginning in spring and summer 2021 monthly electricity expenses rose significantly and available funding in Fiscal Year 2021- 2022 has been exhausted.
Monthly expenses rose from approximately $1,000-$3,500 per month to over $5,000 a month, with a peak increase of $10,451.71 from July 15 to August 15, 2021. As shown in the table below, usage rates steadily increased beginning in May 2021. The increase coincided with seasonal temperature increases and increased rates during newly established peak hours.

3/16/2021 - 4/14/2021 $2,628.31
4/15/2021 - 5/13/2021 $2,816.65
5/14/2021 - 6/14/2021 $5,867.21
6/15/2021 - 7/14/2021 $8,375.62
6/29/2021 - 7/28/2021 $36.97
7/15/2021 - 8/15/2021 $10,451.71
8/16/2021 - 9/14/2021 $8,069.76
9/15/2021 - 10/13/2021 $4,720.13
10/14/2021 - 11/12/2021 $3,766.41
11/13/2021 - 12/13/2021 $4,224.05
12/14/2021 - 1/11/2022 $3,424.36
Staff investigated the issue by evaluating site usage and reviewing the facility for possible vandalism or theft. Pacific Gas & Electric (PG&E) staff reviewed the Community Center bills and usage and found no billing errors. On September 16, 2021, a PG&E technician visited the Community Center and verified that the meter and voltage readings were correct and no on-site issues were found. Staff also contacted an electrician who verified that the panel and wiring were in good condition.
On October 20 2021, after further investigation the PG&E Local Customer Relationship Manager, Randy Herbst, notified the City of their findings. Their records show that on March 1 2021, a meter technician performed an inspection. The technician discovered that a current transformer was wired backwards, which resulted in the City being billed for one third of its actual electrical usage dating back to the installation of the transformer on February 11, 2010. The error was corrected by PG&E staff at that time. PG&E estimates that current billing is capturing an additional 67% of energy use. The billing increase was additionally amplified by spring 2021 changes to the peak hour rates for PG&E. PG&E set new peak hours from 4:00-9:00pm every day and generated 4-month summer rates from June through September, which includes partial-peak periods from 2:00-4:00pm and 9:00- 11 :00pm. The new peak hour rates coincide with Community Center operational hours and summer temperature increases are reflected in in higher summer month billing.
Discussion:
Due to the identification of the issue by PG&E staff, City staff anticipates that future energy expenses will continue to rise. City staff considers it prudent to investigate solar options for the Community Center. Staff has conducted site visits at the Community Center with 40 two solar companies. Both companies agreed that the Community Center facility is ideal for solar panels. It is anticipated that solar panels could provide a dramatic decrease in monthly expenses. Staff will bring future solar panel projects forward as part of the future budget process.
For the Fiscal Year 2021-2022, a budget amendment is required to pay outstanding and future PG&E bills through June 30, 2022.
Fiscal Impact:
The Fiscal Impact of the appropriation increase is from the General Fund account in Recreation. An appropriation increase of $53,000 is being requested for amendment to create a total budget of $86,600.00.
