Finance Director Williams presented the staff report, which included a PowerPoint presentation.

There was Council Member and staff discussion regarding the $1 million already committed to the RAD Card Program for businesses which would include the small census track, how the Small Business Grant Program is just not fair to all businesses, may be a hassle for staff and tilted unfairly, putting the funding towards revenue reimbursement, money that will be allocated towards the special district downtown, 25 options for businesses outside that downtown area; not being an income qualification for either areas, the funding is to be focused on businesses that had a financial lost due to COVID-19, support for the idea of supporting both big and small businesses, if the funding can be used for parks, no interest for helping start-up businesses but okay with helping re-start businesses. Council Members Jones, Lambert, Lewis, and Faria supported allocating the undedicated ARPA funding to revenue and reimbursement; Council Member Llamas supported to also include the Small Business Funding option.

Motion by Lewis, seconded by Lambert to allocate the undedicated ARPA funds to revenue and reimbursement. The motion carried by the following roll call vote: A YES:

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOS BANOS

REAUTHORIZING REMOTE TELECONFERENCE MEETINGS OF THE LEGISLATIVE BODIES OF THE CITY OF LOS BANOS PURSUANT TO THE PROVISIONS OF AB 361

BACKGROUND
California's Ralph M. Brown Act has been amended to allow fully virtual public meetings during a state of emergency after the Governor signed Assembly Bill 361 into law on September 16, 2021 .

DISCUSSION
The new law comes as local public agencies were preparing for the expiration of Executive Orders that currently allow virtual public meetings. AB 361 goes into effect immediately, and it amends Section 54953 of the Brown Act to allow virtual public meetings through January 1 , 2024 in any of the following circumstances:
33 1. The legislative body holds a meeting during a proclaimed state of emergency, and state or local officials have imposed or recommended measures to promote social distancing.

2. The legislative body holds a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.

3. The legislative body holds a meeting during a proclaimed state of emergency and has determined, by majority vote, that, as a result of the emergency, meeting in person would present imminent risks to the health or safety of attendees.

These circumstances allow agencies to hold entirely virtual public meetings during the current pandemic, while California is in a proclaimed state of emergency.

The previous teleconference rules under the Brown Act also remain in place, but are not as flexible (for instance each teleconference location must be identified in the agenda and the teleconference location must be accessible by the public).

If a City Council or City Commission meeting is held virtually under the new provisions of AB 361, the agenda must still be posted under the appropriate timelines:
72 hours in advance for a regular meeting, and 24 hours in advance for a special City Council meeting. The agenda must include the meeting link or dial-in, so that members of the public may access the meeting. Members of the public must be allowed to address the City Council or City Commission in real-time during the meeting. In addition to the real-time public comments; the City can continue to allow public comments to be submitted in advance.

AB 361 also has special provisions for technical glitches. In the event the meeting broadcast is disrupted, or if a technical issue on the agency's end disrupts public comment, the City Council cannot take any further action on the agenda until the technical issue is resolved.

Most significantly, in order to continue to hold virtual meetings when a state of emergency remains active, the City Council must make findings every 30 days that 1) the City Council has reconsidered the circumstances of the state of emergency and 2) the state of emergency continues to directly impact the ability of the members to meet safely in person or state or local officials continue to impose or recommend measures to promote social distancing.

The City Council previously adopted a Resolution 6405, on October 6, 2021, finding that the requisite conditions exist for the legislative bodies of the City of Los Banos to conduct remote teleconference meetings without compliance with paragraph (3) of subdivision (b) of section 54953. Those conditions have not changed and continue to exist. In fact, on November 10, 2021, Governor Gavin Newsom signed Executive Order N-21-21 which extended through March 31, 2022, the state of emergency in California related to the threat of COVID-19. And on January 5, 2022 as mitigation for the 34 Omicron variant, the California Department of Public Health (CDPH) extended the requirement that masks to be worn by all employees in all indoor public settings, irrespective of vaccine status, through February 15, 2022. On February 7, 2022 the CDPH announced that effective February 16, 2022: universal masking shall remain required in only specified settings; and only unvaccinated persons are required to mask in all indoor public settings; and fully vaccinated individuals are recommended to continue indoor masking when the risk may be high.

Staff is recommending that the City Council reauthorize remote teleconference meetings of the legislative bodies of the City of Los Banos pursuant to the provisions of AB 361 by adoption of the attached Resolution.

FISCAL IMPACT
None.

CONCLUSION
Staff is recommending that for the time being City Council meetings continue to be held virtually pursuant to and under the requirements of AB 361 as outlined above.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LOS

BANOS DECLARING REAL PROPERTY OWNED BY THE CITY
LOCATED AT 644/646 I STREET, LOS BANOS, (APN: 025-201-010),

AS SURPLUS LAND DESIGNATED FOR FUTURE DEVELOPMENT,

FINDING THAT SUCH DECLARATION IS EXEMPT FROM

ENVIRONMENTAL REVIEW UNDER THE CALIFORNIA

ENVIRONMENTAL QUALITY ACT, AND TAKING RELATED ACTIONS
PURSUANT TO GOVERNMENT CODE SECTION 54221

BACKGROUND
Effective January 1, 2020, Assembly Bill (AB) No. 1486 amended the Surplus Land Act (SLA) by prohibiting local agencies from commencing negotiations over the sale or 41 lease of surplus property prior to sending notices about available, surplus local public land to designated entities (Eligible Entities), including:
• California Department of Housing and Community Development (HCD). • Any local public entity within the jurisdiction where the surplus local land is located.
• Developers who have notified HCD of their interest in developing affordable housing on surplus local land.

Importantly, AB 1486 now requires a local agency to declare property as "surplus land" before taking any actions to dispose of such property, including issuance of a Notice of Availability (NOA) or request for proposals (RFP). The declaration must be made by the legislative body of the local agency.

Following the declaration of surplus, the City must provide a NOA to the Eligible Entities for specified uses, including affordable housing, parks and recreation, and schools. An Eligible Entity desiring to purchase or lease the surplus land for any of the purposes described above must notify the City in writing of its intent to purchase or lease the land within 60 days after the receipt of the City's notification of intent to dispose of the land.

If the City receives notice of interest from any Eligible Entities, the SLA mandates a 90- day negotiation period with any designated entities that submit timely offers. If no notice of interest is received or negotiations do not result in a disposition, the City may proceed with disposing of the land. The SLA does not require the City to dispose of surplus land at less than fair market value.

Per the SLA, after City Council issues the surplus declaration, staff will issue NOAs to the Eligible Entities, beginning a minimum 60-day noticing period. During the 60-day noticing period, the SLA restricts the City's discretion in negotiating with potential buyers, prioritizing NOA responses.

If the City fails to provide proper notices, there is a significant penalty that requires a local agency to forfeit 30% of the purchase proceeds for the first violation and 50% for subsequent violations.

DISCUSSION
On December 15, 2021 the City acquired the property from the Los Banos designated Local authority for future development. The property is a 0.13 acre undeveloped parcel located downtown Los Banos at 644/646 I Street; currently zoned Mixed (M-X); The property is outlined in the aerial photo below.
42 The compensation agreement entered into by the City of Los Banos and the other taxing entities provides that this parcel is designated for future development.

The future development property is to be disposed of by the City and developed consistent with the Redevelopment Plans adopted by the Redevelopment Agency.

When sold the net proceeds are to be divided proportionately with the other taxing entities.

This property meets the definition of "surplus" property. As the property is not "exempt" per the amended SLA, the City must first declare it surplus and provide the notices described above before engaging in negotiations with a potential buyer.

If the City does not receive any proposals, staff will move forward to obtain a buyer or list the property for sale. Any proposed agreement for the sale of the Property shall be subject to the approval of the City Council.

FISCAL IMPACT
Adopting this Resolution has no financial impact to the City.

PURSUANT TO GOVERNMENT CODE SECTION 54221

BACKGROUND
Effective January 1, 2020, Assembly Bill (AB) No. 1486 amended the Surplus Land Act (SLA) by prohibiting local agencies from commencing negotiations over the sale or lease of surplus property prior to sending notices about available, surplus local public land to designated entities (Eligible Entities), including:
51 • California Department of Housing and Community Development (HCD).

DISCUSSION
In 2009 the City acquired a residential property in Dos Palos as part of a restitution order entered in the Maryann Jones case. The property is located at 1329 Frank Street in Dos Palos, improved by a single family residence. The property is being managed by Borelli Property Management and being rented on a month to month basis for $725.00.

The property is outlined in the aerial photo below.
52 This property meets the definition of "surplus" property because it is not necessary for the City's use as defined pursuant to the amended SLA. As the property is not "exempt" per the amended SLA, the City must first declare it surplus and provide the notices described above before engaging in negotiations with a potential buyer.

If the City does not receive any proposals, staff will move forward to list the property for sale. Any proposed agreement for the sale of the Property shall be subject to the approval of the City Council.

FISCAL IMPACT
Adopting this Resolution has no financial impact to the City.

Mid-Year Budget Review and Approval of a Resolution to Adjust the 2021/2022 Budget
TYPE OF REPORT: Non Consent Agenda
Recommendation:

Staff recommends that the City Council adopt a resolution to revise the budget for the 2021/2022 Fiscal Year as it pertains to changes in revenues and expenditures.

Background:

The primary purpose of the Mid-Year Budget is to review assumptions used in developing the fiscal year budget, particularly revenue assumptions. This review allows Staff the opportunity to determine if the City is on track or if adjustments are needed and provides an opportunity for staff to update the City council on the major financial factors affecting the City's current fiscal year budget and make recommendations for amending the budget.

Discussion:

The Mid-Year report is developed using six months of actual (unaudited) activity in budgeted operating departments with Finance and Departmental projections of anticipated spending and revenue trends for the remainder of the fiscal year. Staff projections include using statistical data, economic analysis, professional judgement and expertise from economic consultants, professional organizations and other resources. The findings and adjustments will be discussed in detail during the Council Meeting Presentation.

General Fund
Staff-analyzed the current Fiscal Year through December 31 , 2021 with the exception of Property Tax Revenues, which were received in January 2022. With fifty percent (50%) of the year completed, General Fund revenues collected are fifty-two percent (52%) of the budgeted amount. General Fund expenditures are forty-four percent (42%) of the budgeted amount. 61 General Fund Revenues are projected to end the fiscal year $2 million over the current budget. The primary driver of the increase in revenues is a continued, accelerated recovery from the COVID-19 pandemic which can be seen in both sales tax and transient occupancy tax revenue projections.

Given the complexities of projecting for revenues in the current climate, staff is recommending changes to both major revenues and other revenue sources.

The projections for revenues are based on the most recent economic information available to the City and actual revenue distributions known at the time of the preparation of this report. This Fiscal Year 2022 Adopted Budget general fund revenues were developed by incorporating the assumption of continued fiscal recovery from the COVID-19 pandemic. However, the most recent activity demonstrates a stronger economic recovery than originally anticipated due to accelerated and increased growth.

The Mid-Year budget report continues to project positive growth from the pandemic with improvements in property tax, sales tax and transient occupancy tax revenues through fiscal yearend.

Staff is requesting to increase general fund expenditures by a total of $611,614. The following points highlight some of the requested mid-year changes to the general fund budget:

1. Increase technical services in the Building department by $326,850, for expenditures related to the increased permit activity.

2. Increase Fire department personnel services by $37,190 for Fire Strike Team to offset expenditures reimbursed by the State.

3. Increase personnel services for the Fire department in the amount of $57,172 related to retirement accrual cash outs, recruitment cost and the subsequent overtime need for shift coverage.

4. Increase professional services by $70,900 for costs related to construction inspections and city engineering consulting fees.

Special Revenue Funds
The key changes to the Special Revenue Funds include increasing overtime and benefits by $90,539 to reflect Fire Strike Team Expenditures that are reimbursed by the State. Reimbursements from the State for Strike Teams assignments are accounted for in the fund from which the employee is paid.

The City's overall financial status will be further discussed during the March 2nd Mid-Year Budget Review, including additional changes to the budget not highlighted in this report.

Fiscal Impact:

Attached to the resolution is a schedule showing a detailed account of the requested changes to the Budget for the 2021/2022 Fiscal Year.
