SPEAKERS ARE LIMITED TO A FIVE (5) MINUTE PRESENTATION. DETAILED GUIDELINES ARE POSTED ON THE COUNCIL CHAMBER INFORMATIONAL TABLE. CHRISTIAN SANTOS, representing Congressman John Duarte, spoke of the important things he is working on, i.e. Los Banos Creek, importance of water, thanked Mike Hughes and Alan Cotta for coordinating the Town Hall Meeting at the Veterans Memorial Hall on 615 E Street, Los Banos being held on March 25, 2024 and introduced the new field representative, Kyle Savage; RAUL GRANILLO, Mercey Springs Church, spoke to the lack of graciousness at council meetings, he prays for all of you, appreciates your desire to bring forward items, he would also encourage all to be gracious, how Ms. Lewis sometimes speaks in an accusing manner, the Mayor interrupts Ms. Lewis and defends the City Manager and how that loses your credibility, spoke to a disrespectful situation he had yesterday with a PG&E employee and his thoughts on that, and you can't do something big if you can't do something small; KATHY BALLARD, speaking as a tax payer not as a Measure H member, stated that she read on the agenda regarding Measure H Funds that there are 17 currently three members on the committee so there is a quorum, and how she has reached out to Mr. Lambert and received no response and also to her district representative Mr. Begonia and no response, inquired as to when the Measure H meeting is going to be held and posted, we need to know where our tax dollars are going, she observed at a school board meeting also regulated by the Brown Act that responses can be done at meetings for which City Attorney Vaughn stated that matters that come up at the public forum cannot be answered and Ms. Ballard stated that she wants answers and how does she get answers for which City Attorney Vaughn stated to submit them to the city clerk or city manager; BLANCE JORGE, lives in the downtown area, spoke regarding Ronny Navarro and how his business got started and how nice it is to see a local young man grow up and become a thriving entrepreneur, how they have cleaned up places destroyed by the homeless, and how she hopes his business continues to flourish; NO NAME, stated that he was experiencing deja vu listening to Greg Hostetler speak about his dealings with the City and their refusal to communicate with him, also spoke to how he is has been asking questions for 9 months and have yet to receive an answer, how Marion Santos spoke about the City blackballing his business in retaliation, how Strike Fitness spoke about issues in the public forum and Brett Jones retaliated against them by telling them to write a check back to the City for the grant money they rightfully received and threatened their plans to move into a new building, these issues in the public forum seem to be a reappearing reoccurring problem, your bullying may stop people from speaking up, but it can't stop them at the ballot box, Measures G and H was more than a vote about the mayor, clerk and treasurer positions it was about if this council should have more power and if the citizens had trust in the council to do the right thing, the results said otherwise, you have put your own self-interests above what is best for the city, to prove otherwise explain the list of grant recipients and why a sitting council member sits at the top of the grant list; NO NAME, spoke regarding her complaints and concerns regarding the homeless on the rail trail and how they have been moved to a different location that appears to not be working out, amazed to see that the Shaunessey Park project is on hold because the land has not been purchased and the city does not own it, this is heartbreaking, she would encourage the City to work with Hostetler so that you can buy this piece of land and the park be built; GREG HOSTETLER, spoke regarding the Vineyard Subdivision, Ranchwood Estates over 2,000 homes and the property taxes paid and how it is going up, landscape down Stonewood Drive is a horrible mess and millions of dollars spent out there, all the money that has been collected, where's the money, inquired as to what Council Member Lambert knows about what's happening in his district, it appears to him that the Ranchwood Estates and Vineyards Subdivision are getting ripped off, the people are not getting their money's worth, you need to take care of your areas as council members, as a City Manager it would take you a couple of hours to drive around and see what needs to be fixed, what do you do for the city, you got paid $1.8 million, you've collected $17 million for parks, where is it, the conversations you are having with staff, former staff and the direction you are giving them is creating a liability for the city and you personally and them if they execute on what you tell them, he is getting calls and getting thank you' s for coming to the meeting, people are scared for their jobs and concerned for the liability, he will be back in a few weeks to talk about the corruption that is and has been going on for a number of years, past bribes, he knows about bad stuff and is surprised that Mr. Vaughn is still working for this city because of what is going 18 on this city; DUSTIN CAROPRESO, Los BAnos Little League, spoke regarding Colorado Ball Park that was built in the 1960s and how we need to look into doing things for the kids of Los Banos, we had over 300 kids last weekend and it was great to see, the kids in our community need it, they need something to do, Joe Heim is doing a great job, you have a tough job ahead of you, it is time that we do something for Colorado Ball Park and how if we build a nice facility they will come, the skate park is important too, and thanked the Council for taking the time to listen to him; T J LOBIG, spoke to the incredible facilities that have built in San Jose, something that should have been done many years ago, how the newspaper in town is not factual right now and they need to build our city up and not tear it down, we have a few Council Members that have only been in here a few years and are doing the best they can and give them time, if there are deals to be made they have to be made right, how Mr. Hostetler is worried about getting these houses done, whoever is the future of our city but sometime it is not worth it and now may be the time to help our kids and build these parks and do what hasn't been done these last few years, there is plenty of money around town to do some awesome stuff, comparing to another city we need more facilities, the 75% for Measure H is just those who read the newspapers, how the golf course was being built and it got trashed; MARIBEL GARCIA, Executive Director Los Banos downtown Association, extended the deepest gratitude to the city of Los Banos for their support for their recent event, your professionalism and expertise was appreciated, she gave sincere appreciation to officers and fire fighters for also making our event a success, she thanked the City of Los Banos for their exceptional support at the 1st Annual Pub Crawl, the next event is the Beer and Wine Stroll on April 27, 2024 and that Casino Night has been postponed. No one else came forward to speak and the public forum was closed.

COLORADO BALLPARK RENOVATION PRESENTATION. Parks & Recreation Director Heim presented the staff report, which included a PowerPoint presentation.

Mayor Llanez inquired as to what's between the shade structure, picnic area, storage building for which Parks & Recreation Director Heim stated that it is an additional skate park. Council Member Jones inquired as to if we have internal funds to completely fund this design for which Parks & Recreation Director Heim stated that we could fund half of the project and would need to seek additional funding or general funds, it's in a good census district to get funding for. Council member Jones stated that this park has been bad, wonders why this wasn't done 20 years ago and put off from one year to the next, appreciates the City Manager going out and seeing that our parks need to be addressed, happy to see that this City Manager created a Parks & Recreation Director position to do things like this. Council Member Lewis stated that $13-17 million is a bit high and there could be grants out there to help fund projects like this, there is $150,000 allocated to start the site survey, what other funds are there, LLDs for which Parks & Recreation Director Heim stated that the primary funding source would be the Park Fund with about $4 million and Council would have to direct staff to use these funds and Measure H funds as Colorado Ball Park is not in a LLD. Financial Consultant Kuhn explained the funding available and the feasible aveneus to cover this debt to get this done and collecting in revenues and changing priorities, he spoke to how Measure H is discretionary but we can bring to Council in the future and address the funding need, and that grants are competitive and also matching. Council Member Lewis inquired as to the build out date and Parks & Recreation Director Heim stated that it depends on the discussion tonight, take 8-9 months design and 8-9 months build out, 2 years total. Council Member Lewis wants to make sure we are not going to be financially strapped, likes the design and that we are in good financial standing to do this. Council Member Begonia stated that Colorado Ball Park is my favorite baseball field, he played there, umpired there, worked the snack bar, kept score, even though it is his favorite it is quite possible the worse ever, sports isn't the most important thing but in this community it is what kids have to do, we have basketball courts, we have awesome football stadiums, what we have now won't bring a kid out to the field, hope we can make it happen as it is long over due, skate park is very small and needs to be upgraded too, tennis courts too, going to take a lot of money, our community deserve it, hope we can agree and make it happen. Council Member Lambert stated that we have a lot of the skaters here that shows the support, we have a lot of baseball fields around town, do we need to approve now for which Parks & Recreation Director Heim stated that he does not need approval tonight but direction is needed. Council Member Lambert added that they start at 4/5 years old and this means the world to them, he feels that we will find a way if we don't get what we need, make 21 some few minor adjustments, would like to see some solar panels, this is the oldest park in Los Banos and is all for to see how far we can go and get this thing started and we have to start somewhere. Council Members Jones made note that we are just approving you to proceed, excited to see this brought forward and good luck on getting it done.

Council Member Lewis stated that she would like to see us move forward with the conceptual plan and have staff pursue grants, would like to see an occasional report back to the City Council to see how it is progressing and moving along with the project. Mayor Llanez stated that this is long overdue, it really got to him the how bad the park is when the fellow throwing out the first pitch was in a wheel chair could not get around very easy, if we do not get grants is this a feasible project for which Financial Consultant Kuhn stated yes. Mayor Llanez added that we have other youth groups that use this field, wildcat football; Joe - are you willing to take on a project of this size and will benefit many in the community. Parks & Recreation Director Heim acknowledged the skateboarders who have been there throughout it all, feels that Los Banos is a community full of families that care, wants the skateboarders to come to Los Banos and wants to have baseball tournaments, too. Mayor Llanez stated that he wholeheartedly supports this, grant or not, commit and go for it.

PUBLIC FORUM: MEMBERS OF THE PUBLIC MAY ADDRESS THE CITY COUNCIL

MEMBERS ON ANY ITEM OF PUBLIC INTEREST THAT IS WITHIN THE JURISDICTION OF THE CITY: INCLUDES AGENDA AND NON-AGENDA ITEMS. NO ACTION WILL BE TAKEN ON NON-AGENDA ITEMS. SPEAKERS ARE LIMITED TO A FIVE (5) MINUTE PRESENTATION. DETAILED GUIDELINES ARE POSTED ON THE COUNCIL CHAMBER INFORMATIONAL TABLE. VINCE FERNANDEZ spoke about concerns with the Ag Sports Complex, how his godfather's name is on the field and wonders why there have not been adult leagues able to play on the field. For seven years, there was no adult softball and last year was the first time adult softball came back to the complex. The first few weeks of this new softball season, the adults league has suffered 25 retaliation from the Bases Academy or price hikes that are unnecessary from the Recreation Department. The man who runs the adult league will not come forward in fear of retaliation. There has been retaliation against those wanting to play at the complex but they are being stonewalled with Bases Academy. The man who owns the league and the kids who play for the league ruin it before we can play. Bases Academy claims they own the fields yet they have not produced proof. He nitpicks about this and that and now a Los Banos tradition will be lost in the shuffle or taken away from us. Why is this happening? The City Council should be made aware of this if they are not already; CHRISTIAN SANTOS, representing Congressman John Duarte, thanked all those for coming out to his town hall where a wide range of topics were discussed. He thanked Mike Hughes and Alan Cotta for allowing him to use the Veterans Hall for this meeting. He spoke to how a check was presented at the top of the Los Banos Reservoir Dam for $5 million to the San Joaquin River Exchange Contractors for the Los Banos Creek Recovery and Recharge project. Thanked all of the stakeholders for their participation and looks forward to future working relationships to enhance water reliability in the Central Valley. Duarte's first bill passed on the House floor for the Clean Water Permits Act which puts us one step closer to clean water; UNNAMED PERSON spoke regarding his original agreement with the City was that he was not going to get involved without any political drama however there are a lot of folks in Merced who feel as though he was involved with payouts or other things that have occurred in this City. He spoke to how he agreed to assist with getting closed session items achieved but that when there were personnel items involved, he was allowed to leave the meeting. He appreciates City officials upholding their end of the agreement. He spoke to how he enjoyed working on projects during his seven-month tenure and provided some details on some achievements he attained. He wanted to set the record straight that he had no part in the political drama; GREG HOSTETLER, stated he would like to talk about the direction the City should be going and the things the City should be doing. He believes the City should be focusing on water issues, particularly the sewer system. Future annexations should also be planned to include industrial, commercial, single family and multi-family homes in order to create jobs for those in our community. It's been almost two decades since new annexations have been made. He spoke to how former Mayor Amabile put these types of plans in place which brought certain amenities like Walmart and Home Depot. This created many jobs for our community and generated funds that assisted with building the Police Station and we have current needs for additional projects like this, in particular a new fire station. He spoke to how he has offered free land, at no charge, for a new fire station but it has gone nowhere. In addition, he has offered to help relocate the airport as he has land that meets certain specifications necessary for an airport, but again those offers went nowhere. He additionally offered to build Pioneer Road from Mercey Springs to Ward Road at no cost to the City. Surrounding cities are all bringing in warehouse industries which are creating lots of jobs and revenue for those cities, but Los Banos is missing out when all the City needs to do is speak with the stakeholders. Instead, there are revolving positions in key City departments that are taking away from the success of the City. He suggested some folks at the dais seek legal counsel; JOHN MICHAEL ARON, resident of Los Banos, specifically on Pioneer Road, he received an "insultingly" low offer on his property as it is in the area set to be a part of the Pioneer Road Widening Project. After receiving this letter, he scheduled a meeting with City staff and had some follow up questions that were 26 never answered despite multiple attempts, but eventually received a call back from Public Works Director/City Engineer Bergson who stated at this time, the project will not be impacting his property but will in the future. Mr. Aron requested this response in writing as information constantly changes. He read minutes and other documents from prior meetings related to this project to emphasize how much the project design along with other elements have drastically changed. He provided some simple suggestions but ultimately hopes to be presented with a fair offer when the time comes around. He understands that growth happens and things are going to change, but he wants to be treated fairly; RUTH, resident of Los Banos, specifically on Pitzer Way, spoke to the homeless population that live behind her backyard fence. She thanked the City for trimming the trees back on the rail trail which prevented the homeless from congregating back there for about two months or less. She stated that the evenings were fairly quiet during the rainy season but now that it is getting darker later in the day, the sounds and activity are picking up again. She doesn't want to take up Council's time and stated that a phone call with information on what is going on would put her at ease. She provided two examples of times she was awakened by activity that was brought forth by the homeless population that live behind her house. She pays property taxes and those people do not. She asked her District Council Member to give her a call and Mayor Llanez asked her to leave her contact information with Police Chief Reyna; VICKY VEGA, First 5 of Merced County, thanked the Mayor for the proclamation presented earlier. She wanted to invite the public to an event being held on April 13 at Pacheco Park from 1 O am to 3 pm. There will be face painting, balloon artists, activity booths and food boxes; UNNAMED PERSON, stated that the Mayor lied to the public at the last council meeting.

He stated that the Mayor has never reached out to him in response to emails he sent to the him with supporting documentation. It wasn't until the third email where a response was received however none of the issues were addressed, only ignored, then proceeded to discredit him. He claims the last email he sent to the Mayor has gone unanswered and that the Mayor withheld essential information to manipulate the public's opinion. He stated that, yes, Crossfit Valley View is a sole proprietorship that is not in his name but that it is in his wife's name. He claims he has Power of Attorney for the business and that the City of Los Banos is the only entity the business deals with that does not honor that power.

City staff had no issues discussing matters with him until he produced documents to them that proved staff was lying to him. He further accused the Mayor of manipulating the public's opinion by leaving out the fact that he is also a chartered Financial Analyst which he feels is relevant information especially as it pertains to his credibility relating to Finance. Instead of fixing the concerns brought forth, they were ignored. He referenced the small business grant guidelines noting the requirements for businesses to receive funding and spoke to how the first check written for this grant was to a business who did not have a proper business license until March 10 of 2023. This was in violation of the rule stating that the commercial business licenses had to have been issued and in effect since at least 2020. Multiple checks were written to businesses who did not have a commercial business license. He stated that Los Banos will be known as a "Pay-to-Play" city with corrupt leadership; RAUL GRANILLO, Pastor of the Mercey Springs Church of the Nazarene, invited the community to the immigration workshop with CIVIC on April 4, 2024 from 4-7 pm at the Mercey Springs Church of the Nazarene. He further spoke to the services that would be available at the event and what documentation they should bring 27 with them. He asked for the word to be spread in order to help those who will benefit from these services in our community. On another topic, he spoke to how people come to council meetings to speak simply to complain and that people only talk about the bad things and not the good. He appreciates how council can disagree strongly yet come together to make decisions on important things. He encouraged the council members to get to know their people; UNNAMED PERSON, spoke to the recent Measures that recently failed during the March Special Election and how the failures are basically a referendum against the Mayor and the majority of the Council. The community does not want another two years of what's been going on in the City and they are tired of the ongoing retaliation. He spoke to various issues he sees the council has mishandled lately and further spoke to how crime rate has risen in our community and that is due to the pace of growth versus the safety personnel we have available. Our safety services are understaffed. When members of the unions come forth to speak on the issues, they are retaliated against. There are more ball parks being built and he supports that but the number one priority should be public safety and council is failing at that. He asked council to redirect their motivations claiming the public is not happy and they are paying attention; UNNAMED PERSON, she is so grateful that for the microchipping event that will be taking place this Saturday at the Community Center from 9 am - 12 pm. She thanked all the groups that came together to make this possible; MARIBEL GARCIA, Los Banos Downtown Association, spoke regarding upcoming events: Thursday, April 11 will be a Merchant Meeting at 5:30 p.m. at the Los Banos Arts Council Crafts Studio on I Street, the Wine and Beer Stroll on Saturday, April 27 from 5 pm - 10 pm with tickets being priced at $40 for 10 drinks, Casino Night will be held on June 22 at the Crest Event Center at 516 I Street and tickets priced at $65 or a table for 8 for $500. She thanked council for their continued support with these events.

No one else came forward to speak and the public forum was closed.

Council Member Lewis spoke to public safety systems and programs that other cities are utilizing and wonders if these types of systems and programs would be beneficial for our public safety personnel. She is not against funding for parks but feels there are greater needs in other divisions.

Council Member Lambert thanked the Finance Department team for their report and reminded all that some of these items were already approved in the past and that certain items are being added. He is pleased with how the money is being spent.

Mayor Llanez reminded all that his job is to listen to the needs/wants of the community and what he heard was needs/wants for the animal shelter and pickleball courts. Crime cannot be predicted and we have to trust in the work of our Police Officers.

Motion by Jones, seconded by Lambert to adopt City Council Resolution No. 6757 - Authorizing an Amended Spending Plan for the American Rescue Plan Act (ARPA) Funding. The motion carried by the affirmative action of all Council Members present, Lewis voting NO.

ADVISEMENT OF PUBLIC NOTICES. (One Report). Community & Economic Development Director Elms stated that there will be a Public Hearing at the Planning Commission Meeting on April 10, 2024 to consider a Categorical Exemption from the California Environmental Quality Act (CEQA) Pursuant to Section 15301, Existing Facilities, and Cottage Food Operation #2024-01 for Chalotta Wilson at 1888 Lane Ct., more specifically identified as Assessor's Parcel Number: 083-480-022.

CITY MANAGER REPORT. City Manager Pinheiro asked Community & Economic Development Director Elms to play a video that highlighted all of the accomplishments City staff achieved in 2023. After the video played, City Manager Pinheiro spoke in greater detail about these major accomplishments and provided some statistics on the work done.

He is excited about the things that have been accomplished and looks forward to what's upcoming.
31 REPORT/UPDATE ON MERCED COUNTY ASSOCIATION OF GOVERNMENTS (MCAG), PENINSULA CLEAN ENERGY (PCE), MEASURE V COMMITTEE, AND SAN JOAQUIN VALLEY AIR POLLUTION CONTROL DISTRICT (SJVAPCD}i AND LOS

BANOS DOWNTOWN PROPERTY & BUSINESS IMPROVEMENT DISTRICT (LBDPBID). Council Member Lewis, on behalf of San Joaquin Valley Air Pollution Control District, spoke regarding funding still available for those who suffer from asthma and how they can obtain air filters for their home in order to have cleaner air flow. There is also filter funding available for municipalities to designate "clean air rooms" for bad air days.

Another program out there is dedicating funding for firework show alternatives. There are agencies out there who are receiving funding for drone shows instead of fireworks. It would allow for a nice 4th of July program. Mayor Llanez, on behalf of MCAG, spoke to how illegal dumping is a big concern right now. There's folks who advertise that they are haulers and that they will take trips to the dump for you but they are not and are actually dumping it on the side of the road all throughout the county or taking it to homeless encampments. They are working with the Sheriff's Department and local resources to try and manage this situation. The highway 99 project between Atwater and Merced has been a mess for quite a while but he's happy to say that project is nearing its completion.

As far as PCE goes, they have confirmed their rates will not be going up but PG&E rates will be. The misconception on social media is that if you are a PCE customer, you are paying higher rates and that information is incorrect. Refer to your bill and do the calculations. There is going to be a hybrid-model customer rate study happening and he feels the ratio will be much more fair and will further separate customers from PG&E. PCE has many programs that customers can take advantage of.

CITY COUNCIL MEMBER REPORTS
DEBORAH LEWIS: Council Member Lewis spoke to how this past Saturday was the 3rd Annual Easter Egg Hunt at Cardoza Park and feels the event grows each year. Everyone had a wonderful time. She thanked staff for putting the event on as it was well attended and fun for the children.

KENNETH LAMBERT: Council Member Lambert thanked staff for the great meeting tonight and the great presentations. It's going to be hard to follow the City Manager's comments. He spoke to how he has had his business license going back to 2020 and he is unsure of where some information regarding his business license is coming from. He spoke to the RAD card program and how a former Finance Director implemented that program and he feels like he is getting picked on. People believe he gets special privileges and he doesn't. He is just a regular guy and follows the guidelines. He is frustrated that he gets singled out because he does not get special treatment. On another topic, he spoke to how he sees a lot of stuff going on on social media and he feels our Police Officers are doing a great job. He can't thank Police Chief Reyna enough for the job he's doing with his department. Police and Fire had a quick response time to a shooting that occurred yesterday and he believes they're doing a great job. As far as infrastructure goes, the City has come a long way as many parks have been done - three in his district - and a dog park in his area. We've been watching our spending and everything that's 32 been happening, and finances are still up. We will continue to keep moving forward. He invited those who question his business license to contact him so he can show them.

DOUGLAS BEGONIA, JR.: Council Member Begonia stated that as a Council Member, he is a citizen just like everyone else. City Manager Pinheiro is doing an awesome job and every employee is doing fantastic things for the City. He thanked staff for all they do.

He looks forward to the next year and a few more years after that.

BRETT JONES: Council Member Jones spoke to how in the past twelve months there has been so much done. People are happy now that City Manager Pinheiro is back and it seems as though when he was gone, it was stressful. City Manager Pinheiro works 80 hours a week and puts time in on the holidays and weekends. He's a business man. He spoke to comments made regarding the ARPA funding and how some feel it is a conflict of interest for a Council Member to apply for the money yet the person who graded and evaluated the applications was the most impartial person - Finance Consultant Brent Kuhn. He spoke to what conflict of interest is and how Graciano hasn't spoken to how much he has received from the ARPA grant. During COVID, the former City Manager went around town closing businesses and he did not support that. Graciano contacted him and made comments about Strike Fitness, he belittled his staff and there's a developer that keeps coming in with smoke and mirrors. There's a lot of stuff going on and you won't find any of it in the newspaper as it is more of a tabloid. What you saw in the video earlier is just a small shot of what is happening. Contact us and get the information directly from the horse's mouth.

PAUL LLANEZ: Mayor Llanez attended the Easter Egg Hunt and spoke to how great the event was. It was awesome to see all the kids and families out there. He recently attended the town hall meeting with Congressman Duarte and he thanked the Veterans Hall for sponsoring that event. He recently participated in a Masters study program where he was interviewed by students from USC regarding being a Mayor. He also participated in an interview with the Westside Express and hopes it gets published. Today he signed a letter of support for Rick Ortega with the Grasslands Water District to support a water project.

He encouraged anyone with any type of resources for the community to share that information with him because he likes to share that information on social media. As far as comments go during public forum, he knew what he was signing up for when he took office and he feels as though creative discussions can be had. He spoke to how he just emailed Mr. Rubio and asked him for an in-person meeting. We will see if he responds or not. The same thing goes for Mr. Hostetler. He considers him a friend and would love to have a conversation, but he will not say yes to everything. He's here to get things done for the benefit of the community. As far as Hostetler's comments regarding his offers of assisting with Pioneer Road and the airport relocation, he never asked him as he would have said yes to all of these items right now. He spoke to how he walked the rail trail today and he is realizing that when he came into office he had some great ideas but because this is a statewide issue, local attempts will not create the results you want. It's a much bigger issue. In addition, you cannot help those who do not want to help themselves. Resources can be offered but it is up to them to accept the assistance. We are not giving up and we are continuing to move forward. He spoke to Measure H and 33 how if it would have passed, he would not have ran for Mayor again anyways as he is a not a career politician. He wanted to extend his thoughts and prayers to City of Los Banos Fire Captain, Daniel Freeman, as he is currently experiencing health issues with cancer.

He also extended his thoughts and prayers to Tim Marrison and his family with his recent passing.

ADJOURNMENT. Motion by Jones, seconded by Lambert, the meeting was adjourned at 8:40 p.m.

SUBJECT: Authorizing an Amendment to Fiscal Year 2023-2024 Budget in Assessment District No. 9, account 279-458-200-714, for the rehabilitation of the Jo-Lin storm lift pump.

Recommendation:

That the City Council adopt the Resolution authorizing the amendment to the Fiscal Year 2023-2024 budget in Assessment District No. 9, account 279-458-200-714, in the amount of $11,500.00 for the rehabilitation of a storm lift pump located at the Jo-Lin Storm Station, near the corner of East B Street and Ward Road.

Background:

The Jo-Lin Storm Station has three storm pumps that are on routine maintenance schedules. In April 2024, during a rain event it was discovered that pump number 2 at the Jo-Lin Storm Station was not operating correctly. The pump had locked up causing the shaft to shear. The City contacted Anderson Pump Company to pull the pump for inspection. It was determined that pump needs to be rebuilt and the motor replaced.

This pump station services Assessment District 9, from San Luis Street to East B Street and from Place Road to Ward Road. As well as taking on the excess discharge from the East B Street Storm Station. It is recommended that the rehabilitation to pump number 2 at the Jo-Lin Storm Station be completed in Fiscal Year 2023-2024.

Discussion:

An estimate was provided for the replacement of the storm lift pump. This includes the rehabilitation and installation of the motor, impeller, shaft, and all miscellaneous parts required to perform the work.

Fiscal Impact:

Pursuant to Resolution 6657, a total of $11,500.00 is being requested for an amendment to the Fiscal Year 2023-2024 budget in Assessment District No. 9, account 279-458-200-714.

Per discussion with Oscar there just now a better alternative might be a Vertical Hollow Shaft motor (quoted below, also in stock). You would not need a P base adapter or have to worry about the coupling coming loose again.

TYPE OF REPORT: Consent Agenda
SUBJECT: Accepting the Exterior Painting of the Community Center Project as complete and authorizing the filing of a Notice of Completion with the Merced County Recorder
Recommendation:

That the City Council adopt the Resolution to:

1. Accept the exterior painting of the Community Center as complete; and

2. Authorize the City Manager to file the Notice of Completion with the Merced County Recorder; and

3. Authorize the Public Works Director/City Engineer to release the five (5) percent retention after the thirty-five (35) day period from the date of filing the Notice of Completion with the County Recorder.

Background:

The Los Banos Community Center, located at 645 7th St., was constructed in 2009 and is one of the premier City-owned buildings. It includes four connecting buildings.

Observation of the buildings showed fading and discoloration of exterior paint throughout the facility. City staff utilized the painting contract with Perfection Painting Corp approved by City Council on January 3, 2024 to paint the exterior of the Los Banos Community Center.

The Los Banos Community Center is a heavily used and visible building that hosts daily activities including youth sports and events. This improvement provides an aesthetically pleasing investment for the City.
45 The project included the painting of the downspouts, wood pillars, and gate entry points.

Pre-finished window frames and doors were not included. The color scheme matched the existing facility colors. Work included pressure washing the facility, and any required priming or scraping and minor repairs to siding and soffit.

The Public Works Department, released the bid documents for the Exterior Painting of the Los Banos Community Center on November 3, 2023. The bid opening occurred on December 1, 2023.

The exterior painting project began and completed in the month of March 2024.

Agenda Staff Report
Mayor Paul Llanez and City Council Members
Christy McCammond, Housing Program Manager
Stacy Souza Elms, Community and Economic Development Directo~ May 15, 2024
TYPE OF REPORT: Agenda Item
SUBJECT: Permanent Local Housing Allocation-Competitive-Navigation Centers Recommendation:

Adopt a resolution to apply for one million dollars ($1,000,000.00) of Permanent Local Housing Allocation (PLHA) Competitive funding to create Navigation Centersi/NonCongregate Emergency Shelter "Bridge Homes" with at least a thirty-five (35) person capacity within the City limits of Los Banos.

Background:

The Permanent Local Housing Allocation Program is provided pursuant to Senate Bill 2 (SB 2) (Chapter 364, Statutes of 2017). SB 2 established the Fund and authorizes the Department to allocate seventy percent (70%) of moneys collected and deposited in the Fund, beginning in calendar year 2019, to Local governments for eligible housing and homelessness activities. The intent of the bill is to provide a permanent, ongoing source of funding to Local governments for housing-related projects and programs that assist in addressing the unmet housing needs of their local communities.

The California Housing and Community Development (HCD) agency released a Notice of Funding Availability (NOFA) on March 6, 2024 announcing the release of the NonEntitlement Local Government Competitive Notice of Funding Availability. Through this NOFA, $1 million dollars ($1 ,000,000.00) is available through a competitive process for 1 69
the eligible activity of assistance to persons who are experiencing or at risk of homelessness, including, but not limited to, through rapid rehousing, rental assistance, supportive services, and case management services that allow people to obtain and retain housing, operating and capital costs for Navigation Centers, or new construction, rehabilitation, or preservation of permanent or transitional rental housing.

Discussion:

The current emergency shelter capacity in the City of Los Banos (twenty (20) beds) does not meet the need of the City's Unhoused Community. The 2024 Merced City and County Continuum of Care (CoC) Point in Time Count reports one hundred and twentyone ( 121) unsheltered People Experiencing Homelessness.

Emergency Shelter is an essential element of the City's system response to homelessness. The Bridge Homes have remained at 100% occupancy since May 2023.

Emergency Shelter results in People Experiencing Homelessness to come out of public space encampments and shelter indoors. Participants in emergency shelter are able to stabilize and better participate in case management.

The City of Los Banos was recently awarded $11.8 million dollars from the Encampment Resolution Fund (ERF) grant for Permanent Supportive Housing (PSH) and Case Management for at least 50 Unhoused People and potentially up to 100 people. This grant funding is important because it will permanently house those experiencing homelessness, but it does not address the need and the lack of emergency shelter still needed within the City of Los Banos. Staff is requesting the opportunity to apply for the PLHA Competitive grant to help address the unmet housing needs of People Experiencing Homelessness by providing service-enriched shelter that provides temporary living facilities while case managers connect individuals experiencing homelessness to income, public benefits, health services, shelter, and housing focused on moving homeless individuals and families into permanent housing.

The emergency shelter will compliment the PSH project funded through ERF. This is an essential element of the comprehensive system to address homelessness.

If awarded, the City's Housing Division intends to conduct a Request for Proposal (RFP) process in order to identify an organization which can perform the operations of the Navigation Centers. These Navigation Centers will be operated from single-family dwellings, similar to the existing Bridge Home model utilized by the CoC.

Fiscal Im pact:

There is no General Fund fiscal impact. As previously stated, PLHA funds are allocated through the California Housing and Community Development (HCD) from SB2.

The fiscal impact would be an increase to the HCD expenditure account in fiscal years 2024/2025 and potentially 2025/2026 for a total of one million dollars ($1,000,000.00) to account 296-463-110-231 . The HCD revenue account 296-000-334-010 would be 2 70
increased for years 2024/2025 and potentially 2025/2026 for a total of one million dollars ($1,000,000.00).

In addition, if awarded the one million dollars ($1,000,000.00) the City is eligible to receive the Administrative portion reimbursable through PLHA Formulaic funding in the amount of fifty thousand dollars ($50,000.00), which reimburses the City for staff costs associated with administering the grant program and reporting.

Notice of Funding Availability
I. Overview
A. Notice of Funding Availability
The California Department of Housing and Community Development (Department) is announcing the availability of approximately $12.5 million in funding for the Permanent Local Housing Allocation (PLHA) program Non-Entitlement Local Government Competitive Notice of Funding Availability (NOFA). This NOFA is funded from moneys deposited in the Building Homes and Jobs Trust Fund (Fund) in calendar year 2022.

Funding for this NOFA is provided pursuant to Senate Bill 2 (SB 2) (Chapter 364, Statutes of 2017). SB 2 established the Fund and authorizes the Department to allocate 70 percent of moneys collected and deposited in the Fund, beginning in calendar year 2019, to Local Governments for eligible housing and homelessness activities. The intent of the bill is to provide a permanent, on-going source of funding to Local Governments for housing-related projects and programs that assist in addressing the unmet housing needs of their local communities. The Non-Entitlement competitive grant program component prioritizes assistance to persons experiencing or At risk of homelessness and investments that increase the supply of housing to households with incomes of 60 percent or less of Area Median Income (AMI).

This NOFA outlines threshold and application requirements for Non-Entitlement Local Governments as defined in Guidelines Section 101. Non-Entitlement Local Governments are governments in areas which are not metropolitan cities or part of an urban county as defined in Appendix A.

83 Section 50470 (b)(2)(B)(i)(I) of the HSC requires the Department to allocate 90 percent of PLHA funds based on the federal CDBG formula specified in U.S. Code (USC), 42 USC, Section 5306, except that the portion allocated to NonEntitlement Local Governments is required to be distributed through a competitive grant program for Non-Entitlement Local Governments.

HSC, Section 50470 (d) authorizes the Department to adopt Guidelines to implement the PLHA program, not subject to the rulemaking provisions of the California Administrative Procedure Act.

This NOFA governs the administration of funding from the Fund (created by HSC, Section 50470, subdivision (a)(1) and appropriated by item 2240-103-3317 in the Budget Act of 2019) and made available under the PLHA program.

92 VI. Other state requirements
A. Administration, monitoring, and reporting requirements A recipient of PLHA funds must meet the administration and monitoring requirements set forth in Guidelines Sections 500 and 501 and reporting requirements in Section 503.

8. Article XXXIV
All projects shall comply with Article XXXIV, Section 1 of the California Constitution, as clarified by the Public Housing Election Implementation Law (HSC Section 37000 - 37002). Article XXXIV documentation for loans underwritten by the Department shall be subject to review and approval by the Department prior to the announcement of award recommendations.

Article XXXIV requires local voter approval before any state public body can develop, construct, or acquire a low-rent housing project in any manner. However, the Public Housing Election Implementation Law (HSC Section 37000 - 37002) provides clarification as to when Article XXXIV is applicable. HSC Section 37001, for example, lists a number of project types that are not considered "low-rent housing projects." Applicants must submit documentation that demonstrates the project's compliance with, or exemption from, Article XXXIV. If a project is subject to Article XXXIV, the Department requires an allocation letter from the locality, which shows that there is Article XXXIV authority for the project. A Local Government official with authority should prepare the allocation letter and it should include the following:

1. The name and date of the proposition and the number of units that were approved;

2. A copy of the referendum and a certified vote tally;

3. The number of units that remain in the locality's "bank" of Article XXXIV authority (i.e., the number of units that are still available for allocation); and

4. The number of units that the locality will commit to this project, including the manager unit.

If a project is statutorily exempt from Article XXXIV, the Department requires an Article XXXIV opinion letter from the Applicant's legal counsel. The Article XXXIV opinion letter must demonstrate that the Applicant has considered both the legal requirements of Article XXXIV and the relevant facts of the project (e.g., all funding provided by public bodies, including state, county or city sources, the number of lowincome restricted units, and the general content of any regulatory restrictions). Any conclusion that a project is exempt from Article XXXIV must be supported by facts anda specific legal theory for exemption that itself is supported by the Constitution, statute, or case law.

93 C. Pet Friendly Housing Act of 2017
Housing funded through this program is subject to the Pet Friendly Housing Act of 2017 (HSC Section 50466). Each awardee will be required to submit a signed and dated certification that residents of the program-funded housing development will be authorized to own or otherwise maintain one or more common household pets as required by HSC Section 50466. Pursuant to this statute, "common household pet" means a domesticated animal, such as a dog or cat, commonly kept in the home for pleasure rather than for commercial purposes.

D. State Prevailing Wages
Program Funds awarded under this NOFA are subject to state Prevailing Wage Law, as set forth in Labor Code Section 1720 et seq. and require the payment of prevailing wages unless the project meets one of the exceptions of Labor Code Section 1720 (c), as determined by the Department of Industrial Relations (DIR). The DIR can be contacted via its website at https://www.dir.ca.gov/oprl/DPreWaqeDetermination.htm.

Applicants are urged to seek professional advice as to how to comply with state Prevailing Wage Law.

E. Relocation
Both the Applicant and the Department must comply with applicable Relocation Law, pursuant to Government Code Section 7260 et seq., Title 25, CCR, Section 6000 et seq., and if federal law is applicable (depending on project financing), Code of Federal Regulations (CFR) at 49 CFR Part 24 of the UM Rs and Real Property Acquisition for Federal and Federally Assisted Programs (the "URA") (collectively referred to herein forth as "Relocation" or "Relocation Law").

Relocation Law provides important protections and assistance for displaced persons and entities affected by the acquisition, rehabilitation, or demolition of real propertyfor government funded projects. Relocation Law ensures that those displaced individuals and entities whose real property is acquired, or who move (even if temporarily), as a direct result of projects receiving government funds, are treated fairly and equitably and receive assistance in moving from the property they occupy. The Department seeks to ensure that displaced persons, which includes tenants, businesses, and homeowners, do not suffer disproportionately as a result of programs designed for the benefit of the public as a whole.

At the NOFA application stage, it is premature to conduct a detailed Relocation review. At this stage, the Department only needs to confirm that Relocation is properly budgeted. Due to the importance of satisfying Relocation Law, the Applicant is encouraged to employ the services of a Relocation consultant to procure a good faith estimate of the potential Relocation cost, which may (or may not) necessitate a Relocation plan. The Department has found that the services of a professional Relocation consultant may save an Awardee money and time in the loan process.

California Department of Housing and Community Development 2023 PLHA Non-Entitlement Local Government Competitive NOFA

Page 12 ends

94 The importance of satisfying Relocation Law cannot be understated. Failure to follow the Relocation requirements will result in the project not being funded by the Department. Applicants cannot circumvent Relocation Law to avoid Relocation payment assistance by simply not renewing leases, which is not permissible under Relocation Law. At the construction loan close stage, the Department will notify all lenders that failure to satisfy Relocation Law, particularly the improper displacement of individuals or entities, could jeopardize Department funding .

F. Accessibility and non-discrimination
All projects or programs shall adhere to the accessibility requirements set forth in California Building Code Chapter 11 A and 11 B and the Americans with Disabilities Act, Title II. In addition, projects or programs shall adhere to either the Uniform Federal Accessibility Standards (UFAS), 24 CFR Part 8, or HUD's modifiedversion of the 2010 Americans with Disabilities Act (ADA) Standards for Accessible Design (Alternative 2010 ADAS), HUD-2014-0042-0001, Federal Register, 79 FR 29671 (5/27/14) (commonly referred to as "the Alternative Standards" or "HUD Deeming Memo"). Accessibly units shall, to the maximum extent feasible and subjectto reasonable health and safety requirements, be distributed throughout the project and be available in a sufficient range of sizes and amenities consistent with 24 CFR Section 8.26.

Recipients shall adopt a written non-discrimination policy requiring that no person shall, on the grounds of race, color, religion, sex, gender, gender identity, gender expression, sexual orientation, marital status, national origin, ancestry, familial status, source of income, disability, age, medical condition, genetic information, citizenship, primary language, immigration status (except where explicitly prohibited by federal law), arbitrary characteristics, and all other classes of individuals protected from discrimination under state or federal fair housing laws, individuals perceived to be a member of any of the preceding classes, or any individual or person associated with any of the preceding classes be excluded from participation in, be denied the benefits of, or be subjected to discrimination under, any program or activity funded in whole or in part with program funds made available pursuant to this NOFA.

Recipients shall comply with the requirements contained in the ADA, the Fair Housing Amendments Act, the California Fair Employment and Housing Act, the Unruh Act, Government Code Section 11135, Rehabilitation Act Section 504, and regulations promulgated pursuant to those statutes, including 24 CFR Part 100, 24 CFR Part 8, and 28 CFR Part 35, in all of the Sponsor's activities.
