November 6, 2024
TYPE OF REPORT: Consent Agenda
SUBJECT: Closure of Non-Essential City Offices
Recommendation:
Approve closure of non-essential City offices on Tuesday, December 24, 2024 and Tuesday, December 31, 2024.
Background:
City policy provides a paid holiday to City employees for Christmas Day and New Year's Day. With Christmas Day and New Years Day falling on a Wednesday, it is reasonably certain that the preceding Tuesdays will be exceptionally slow business days. Thus, it provides a great opportunity to close all non-essential functions in an effort to realize associated employee and energy cost savings.
Discussion:
Under this scenario, all offices located at 520 J Street, 411 Madison Avenue, 645 7th Street, and 1015 F Street would be closed on Tuesday, December 24, 2024 and Tuesday, December 31, 2024. All non-essential functions outside of these offices (Police and Fire) would also be closed and departments may reduce staffing in other areas that are necessary for the provision of essential services. 37 ITEM 7C
Employees affected by the closures may utilize accrued leave balances such as Vacation and Compensatory Time Off (CTO), which is accrued by overtime-eligible employees in lieu of accepting actual cash payment for overtime. As a result, the City may realize additional cost savings by reducing the long-term liability associated with these accrued leaves.
Fiscal Impact:
The City will realize cost savings through reduced energy usage on the business closure days and reduce the unfunded liability associated with the accrued leave balances.

FROM: Charles Bergson, P.E., Public Works Director/City Engi e DATE: November 6, 2024
TYPE OF REPORT: Consent Agenda
SUBJECT: City of Los Banos 2024 Congestion Mitigation Air Quality ( Project Assurance of Timely Project Delivery
Recommendation:
That the City Council adopt a resolution committing to use all of the CMAQ funds they receive, on the project that it was allocated to, within the timeframe required by the program and authorizes the City Manager to execute any necessary agreements to secure grant funding.
Background/Discussion:
Typically, every summer the Merced County Association of Governments (MCAG) issues a call for projects for CMAQ grant funding for Merced County agencies. Eligible projects must contribute to air quality improvements. In the past, the City has obtained grant funding for the traffic signal synchronization on SR 152 and intersection improvements at SR 165 and Vineyard Drive. Public Works staff identified one project that we believe will be competitive in the 2024 grant cycle, improve air quality and enhance the quality of life for Los Banos residents and visitors. Each project must have a cost effectiveness of less that $88/pound of air quality enhancement and meeting this cost effectiveness ratio drives grant funding thresholds.
The identified project would install two Level 3 electric vehicle quick charging stations at City Hall and the Community Center. The requested grant amount is just under $400,000 with a local match of $52,219. The project would also leverage a $12,000 grant from the San Joaquin Valley Air Pollution Control District.
The grant applications will be reviewed by a scoring committee comprised of representatives from each Merced County agency and is anticipated to be conducted before the end of the calendar year.
ITEM 7D
41 Fiscal Impact:
There will be no impact to the General Fund by adopting the recommended Resolution. In the event we are successful with our application staff would return to the Council with a recommendation to appropriate any grant funding and identify the source of the local match, possibly Parks and Recreation or General Government Impact Fees.

WHEREAS, in the event the CMAQ grant application is successful staff will return to Council with a recommendation to appropriate the grant funding and required local match.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Los Banos does hereby:

STATEMENT OF INVESTMENT POLICY
NOVEMBER 2024
1 52
POLICY
It is the policy of the City to invest public funds in a manner which will safely preserve portfolio principal, provide adequate liquidity to meet the City's cash flow needs and optimize returns while conforming to all federal, state, and local statues governing the investment of public funds.
SCOPE
This investment policy applies to all cash and financial investments of the various funds of the City of Los Banos as reported in the City's Annual Comprehensive Financial Report, with the exception of those financial assets explicitly excluded from coverage for legal or operational reasons. The provisions of the related bond indentures or resolutions shall govern investments of bond proceeds. City funds to which this policy applies are as follows:
• General Fund
• Special Revenue Funds
• Capital Projects Funds
• Debt Service Funds
• Internal Service Funds
• Enterprise Funds
• Fiduciary Funds
PRUDENCE

The standard of prudence to be used by investment officials shall be the "prudent person" and/or "prudent investor" standard in accordance with CA Government Code Section 53600.3, and shall be applied in the context of managing an overall portfolio. Investment officers acting in accordance with the investment policy and exercising due diligence shall be relieved of personal responsibility for an individual security's credit risk or market price changes, provided deviations from expectations are reported in a timely fashion and appropriate action is taken to control adverse developments.
INVESTMENT OBJECTIVES
The criteria for investing and managing public funds and the order of priority are as follows:
Safety of Principal: Safety of principal is the foremost objective of the investment program. Investments of the City shall be undertaken in a manner that seeks to ensure the preservation of capital in the overall portfolio. To attain this objective, the City will diversify its investments by investing funds among a number of financial institutions offering a variety of securities with independent returns.
Liquidity: Liquidity is the ability to change an investment into its cash equivalent on short notice at its prevailing market value. The City's investment portfolio shall remain sufficiently liquid to enable the City to meet all operating requirements which might be reasonably anticipated. This is accomplished by structuring the portfolio so that securities mature concurrently with anticipated cash needs. Since all possible cash demands cannot be anticipated, the portfolio will maintain a liquidity "buffer" equivalent to six months of expenses and invest in short-term, highly liquid vehicles such as LAIF and/or money market funds.
2 53
Rate of Return (Yield}: The portfolio shall be designed with the objective of attaining a benchmark rate of return throughout budgetary and economic cycles, considering safety and liquidity requirements. The benchmark may vary from time to time depending on the economic and budgetary conditions present.
DELEGATION OF AUTHORITY
Authority to manage the City's investment program is derived from the California Government Code Section 53607. Responsibility for the operation of the investment program is hereby delegated to the Finance Director, who shall act in accordance with established written procedures and internal controls for the operation of the investment program consistent with this investment policy. At a minimum, procedures should include references to the following: safekeeping, delivery vs. payment, investment accounting, repurchase agreements, wire transfer agreements, and collateral/depository agreements.
Any and all independent investment managers used by the City must be approved by the City Council.

The Finance Director and all investment personnel shall disclose to the City Manager and the City Council any material financial interests in financial institutions that conduct business within this jurisdiction and shall disclose any material investment positions which could be related in a conflicting manner to the performance of the City's investment portfolio. The State of California Fair Political Practices Commission Statement of Economic Interests shall be completed on an annual basis by the City Treasurer.
AUTHORIZED FINANCIAL INSTITUTIONS AND DEALERS
The Finance Director will maintain a list offinancial institutions, selected on the basis of credit worthiness, financial strength, experience, references and minimal capitalization that are authorized to provide investment capacity. No public deposit shall be made except in a qualified public depository as established by state laws. As part of a due diligence program, the City Treasurer should review the annual financial reports of key counter-party banks as well as summary reports retrieved from each bank's regulator. These summary reports are known as Call Reports and can be viewed on the Federal Financial Institutions Examination Council's {FFIEC) website at https://cdr.ffiec.gov/public/. Annually and before engaging in investment transactions with a broker/dealer, the firm shall sign a certification form, attesting that the individual responsible for the City's account with that firm has reviewed the investment policy and that the firm understands the policy and intends to present only those investment transactions appropriate under the policy. The City Treasurer with assistance from the Finance Director shall request for the broker/dealer to provide the latest/most available financial statement to the City.

The definition of fair value is the price that would be received to sell an asset or paid to transfer a liability in an orderly transaction between market participants at the measurement date. This Statement provides 5 56
guidance for determining a fair value measurement for financial reporting purposes. This Statement also provides guidance for applying fair value to certain investments and disclosures related to all fair value measurements. Determination can be obtained by the fiscal agent statements in which the City's cash and investments are held.
DIVERSIFICATION AND OTHER GUIDELINES
Credit risk is the risk that a security or a portfolio will lose some or all of its value due to a real or perceived change in the ability of the issuer to repay its debt. Credit risk will be mitigated by limiting investments to the types of securities authorized by this policy, using pre-qualified financial institutions, and diversifying the investment portfolio. The City will diversify its investments by security type, except for securities issued by the U.S. Government and its agencies, and by institution to reduce or eliminate risk of loss. The following guidelines shall apply:
• Maturities shall be matched against projected liabilities to avoid an over-concentration in a specific series of maturities.
• Maturities selected shall provide for stability and liquidity. • Expenditures and revenues will be carefully monitored and forecast to allow as much money to be invested as possible.
• In general, securities will be bought and kept to maturity. • The City's cash should be pooled.
• The Local Agency Investment Fund should be used to provide daily liquidity to the portfolio. The portfolio will be diversified to balance yield with other objectives.
PERFORMANCE STANDARDS
The investment portfolio will be managed in accordance with the standards established within this investment policy and should obtain a market rate of return throughout budgetary and economic cycles, considering the City's investment risk constraints, cash flow needs and maturities of its investments. The basis to determine whether market yields are being achieved shall be the total return of the portfolio.
The U.S. Treasury and U.S. Government agency securities yield curves shall be considered useful benchmarks of the City's portfolio performance.
REPORTING
The Finance Director shall submit to each member of the City Council a quarterly report. The report shall contain a complete description of the portfolio, including the types of investments, issuers, maturity dates, par values and current market values. The report will also include a certification of the following:
• All investments meet the requirements of the City's investment policy. • Sufficient investment liquidity and anticipated revenues are available to meet the City's budgeted expenditure requirements for the next six months.
ADOPTION
The investment policy shall be adopted annually by resolution of the City Council.

Agenda Staff Report
TO: Mayor & City Council Members
FROM: Charles Bergson, P.E. Public Works Dir
DATE: November 6, 2024
TYPE OF REPORT: Consent Agenda
SUBJECT: Authorizing Award of Construction Contract to Taylor Backhoe Service, Inc. in the amount of $367,592.05 with a 25% Contingency in the amount of $91,898.00 for the Animal Shelter Rehabilitation and Amend Fiscal Year 2024-25 Budget by Increasing Appropriations in the amount of $1,000,000.00.
Recommendation:
That the City Council adopts the Resolution to:
• Award the Construction Contract to Taylor Backhoe Service, Inc. and authorize the City Manager to execute the Construction Contract in the amount of $367,592.05.
Staff is requesting a 25% contingency of $91,898.00.
• Amend the Fiscal Year 2024-25 Budget by increasing appropriation amount in the ARPA fund account 206-410-100-720 by $789,760.00 and Police Capital Improvement fund account 245-421-100-720 by $210,240.00.
Background:
The Animal Shelter is located at 1010 Airport Rd Los Banos, CA 93635. Animal Control Services is headed by the Code Enforcement Sergeant and employs a team of two Code Enforcement Officers and two Animal Shelter Attendants. A variety of volunteer organizations are utilized to help care for, return and/or adopt animals that come to the shelter.
The Animal Shelter Project is vital for staff to be able to continue to provide excellent care for the animals in Los Banos. The deterioration throughout the building has led to safety 63 ITEM 7G
and health concerns. The site consists of unpaved surfaces, uncontrolled entrances, and aged perimeter fences.
Discussion:
The City worked with an Engineering Firm to design a modular building and site improvements. The project was designed to be constructed in two phases - demolition and replacement of the office complex, and then grading and all other site work. The first phase was awarded to BMY Construction Group, Inc. on February 21, 2024. This project is nearing completion.
The City released the advertisement for bid for the Animal Shelter Rehabilitation on September 25, 2024, held a pre-bid meeting on October 3, 2024 and bid opening on October 25, 2024. The City received six responsive bid.
Contractor Location Amount
BMY Construction Group, Inc. Fresno, CA $555,288.00
Taylor Backhoe Service, Inc. Merced, CA $326,268.30
Converaent Construction Milpitas, CA $429,013.00
Paradigm Construction, Inc. Modesto, CA $521,900.00
Westside Landscape & Concrete Newman, CA $458,218.61
Marvulli Commercial Merced, CA $505,824.90
Staff reviewed the bid proposals for completeness. Taylor Backhoe Service, Inc. has provided the lowest responsive and responsible bid for the project. Bid Item 11 was removed from the cost comparison, as this item was no longer in the plans and specifications. Staffing is recommending Taylor Backhoe Service, Inc. be awarded the contract for the construction of the Animal Shelter Rehabilitation, including the base bid of $326,268.30 plus the bid alternative of $41 ,323. 75 with a 25% contingency. The administration of this contract, including the 25% contingency, is to be performed by the Public Works Director/City Engineer.
Fiscal Impact:
Available funding in Fiscal Year 2024-2025 from the ARPA Fund account number 206- 410-100-720 is $800,000. The appropriations from Fiscal Year 2023-24 for phase 1 were not carried over to the Fiscal Year 2024-25 budget. Therefore, staff is recommending City Council to amend this Fiscal Year budget by increasing appropriations in the amount of $1,000,000 (ARPA fund $789,760 and Police Capital Improvement fund $210,240.00).
This would bring the total available project budget to $1,800,000.00.

TYPE OF REPORT: Consent Agenda
SUBJECT: Authorizing Award of Bid for the Purchase of Two (2) New 2024 Model ¾ Ton Medium Duty Utility Trucks with Lift Gates - Bid No. 25WA0019 Recommendation:
That the City Council adopts the Resolution to award the bid for the purchase of Two (2) 2024 Model ¾ Ton Medium Duty Utility Trucks with Lift Gates in the amount of $145,716.00; and authorize a purchase order to be issued to Greenwood Chevrolet in the amount of $145,716.00 for the purchase of Two (2) 2024 Model¾ Ton Medium Duty Utility Trucks with Lift Gates.
Discussion:
The Public Works Department and Parks and Recreation Department utilizes a variety of vehicles and equipment to provide essential services throughout the community. The City purchases new vehicles as staff expands or as the City evaluates their condition for replacement due to age and deterioration.
In the Fiscal Year 2024-2025 budget, City Council approved the addition of several trucks in the City's fleet. Bid documents for the purchase of Two (2) New 2024/2025 Model ¾ Ton Medium Duty Utility Trucks with Lift Gates, Bid No. 25WA0019 were released on Wednesday, August 28, 2024. A public notice was advertised on Wednesday, August 28, 2024 in the Westside Express. The bid opening occurred on Thursday, September 26, 2024. The Public Works Department, through the office of the City Clerk, received three (3) sealed bids. The following dealerships responded to the City's invitation:
Greenwood Chevrolet
McAuley Ford
Santos Ford
$145,716.00
$140,026.04
$160,000:00
73 ITEM 7H
After review of the submitted bid documents, it was determined that Greenwood Chevrolet was able to meet all specifications outlined in the bid package; therefore, making their bid the responsive and responsible bid. These trucks are included in their inventory and are available for delivery as soon as the purchase order is issued; therefore, staff is requesting awarding the purchase order to Greenwood Chevrolet for their total bid price in the amount of $145,716.00.
The trucks will replace Unit #4064, a 2003 Utility Truck with 191,490 miles; and Unit #4219, a 2014 Utility Truck with 143,284 miles. As these vehicles have continued to age and deteriorate, they have also become less dependable. The maintenance costs and reliability contribute to the decision of these replacements.
Fiscal Impact:
The Fiscal Impact of this purchase is $145,716.00. Funds have been allocated in the 2024-2025 Fiscal Year budget within the Water Fund account 501-461-100-750, Wastewater Collections Fund account 502-432-100-750 and the General Fund Parks Maintenance account 100-452-100-750.

Agenda Staff Report
Mayor Llanez and City Council Members
Stacy Souza Elms, Community and Economic Development Director~~ November 6, 2024
TYPE OF REPORT: Consent Agenda
SUBJECT: Authorizing the Execution of an Amendment to Professional Services Agreement with PlaceWorks and Budget Amendment for Additional Services Related to the Los Banos 2042 General Plan Update Recommendation:
Staff recommends the City Council authorize the execution of a third amendment to Professional Services Agreement with PlaceWorks to include additional services necessary to amend the completed Los Banos General Plan Update 2042 in alignment with the Transportation Master Plan, including an addendum to the certified Environmental Impact Report (EIR).
Background:
On November 20, 2017, the City of Los Banos entered into a Professional Service Agreement in the amount of $669,393 with PlaceWorks for the preparation of the Los Banos General Plan Update. The City was awarded two (2) State SB2 Planning Grants (PGP & LEAP) that were utilized to fund the General Plan Update in the amount of $310,000.
On February 2, 2022, the City of Los Banos entered into a First Amendment to said Agreement to include additional services necessary for the preparation and completion of the Los Banos 2042 General Plan EIR specifically in the areas of biological resources and water supply assessment.
1 85
ITEM 7J
On January 4, 2023, the City of Los Banos entered into a Second Amendment to said Agreement to include additional services necessary for the preparation of GIS data development, map development, and final map deliverables to align with the completed Los Banos 2042 General Plan Update.
Since the completion of the Los Banos 2042 General Plan Update, the City has undergone the preparation of a Transportation Master Plan, which outlines critical transportation infrastructure and policies essential for the City's long-term transportation network. This process includes recommended revisions to the Circulation Element and other components of the Los Banos 2042 General Plan in order to ensure these two important planning documents are consistent.
The City Council may amend the budget by resolution adjusting the overall appropriation levels in each fund at any time during the fiscal year if there are available funds and council is in agreement with the request to adjust the budget.
Discussion:
Staff is requesting a Third Amendment to ensure the General Plan aligns with the new Transportation Master Plan. This amendment will include integrating transportationrelated objectives, policies, and actions that support sustainable development and mobility within Los Banos. The Third Amendment also includes an Addendum to the certified Environmental Impact Report which is necessary to ensure consistency with the Transportation Master Plan.
Fiscal Impact:
The fiscal impact of the contract amendment in Fiscal Year 2024-2025 would increase expenditures by $57,804.00 to account 100-419-100-238 for Technical Services.
A General Plan Maintenance Fee is collected with each building permit in the amount of 1 % of the valuation of each permit to revenue account 100-000-341-039. This fee is used to revise and prepare the General Plan as necessary.

Subject: Proposal to Prepare General Plan 2042 Amendments and CEQA Review Dear Stacy:
The City of Los Banos is undertaking an update to the Transportation Master Plan (TMP). This process includes recommended revisions to the Circulation Element and other components of the Los Banos 2040 General Plan in order to ensure these two important planning documents are consistent. This proposal presents a proposed scope of work to amend General Plan 2040 and prepare an updated CEQA document.
Scope of Work
Task 1. General Plan 2042 Amendments
PlaceWorks will amend General Plan 2042 to remove the State Route 152 (SR 152) bypass land use designation and references to the future bypass throughout the plan. Amendments will include, but not be limited to:
A. Revise the UGB and SOI boundaries in GIS using existing parcel boundaries, roadways, or other physical features as reference. Revised boundaries will be shared with the City to ensure that the revised boundaries are properly represented on the map before finalizing.
This scope assumes that the revised UGB and SOI boundaries will be smaller than the boundaries adopted in General Plan 2042 and analyzed in the General Plan EIR.
B. Remove the SR-152 Bypass Corridor Land Use Designation in the Land Use Element.
Update acreages in Table 3-1, Land Use Designations.
C. Remove the SR-152 bypass alignment from all General Plan Map figures.
D. Revise and export updated versions of each General Plan map figure to capture both the UGB/SOI revisions and SR-152 bypass alignment changes. Closely review and capture any other necessary map element updates that need to be made like source dates, legend components, etc. to ensure consistency with surrounding map elements and the latest revisions.
2040 Bancroft Way, Suite 400 I Berkeley, California 94704 I 510.848.3815 I PlaceWorks.com 92 ~ PLACEWORKS
E. Review and provide feedback on the suggested amendments to the Circulation Element provided by the City's TMP consultant to improve consistency between the two documents. This will include any necessary updates to the Planned Improvements in Figure 4-3 and Table 4-2 to reflect the TMP. This scope assumes up to three meetings with Fehr & Peers to discuss Circulation Element changes.
F. Update Table 9-2 to revise or remove actions related to the SR-152 bypass.
G. Update cover, title page, and other components as needed to note date of amendment.
Update table of contents to reflect correct pagination of the amended General Plan.
We will make additional edits as needed to ensure consistency and clarity after the removal of references to the bypass and other changes triggered by the TMP.
Deliverable(s}:
• Administrative Draft General Plan amendments in Word and PDF, electronic files only • Final Draft General Plan amendments in Word and PDF, electronic files only • PDF file of complete and final Amended General Plan 2042, high resolution and web-ready • 5 printed copies of the final Amended General Plan 2042 • Package and share all updated GIS files/data (geodatabase and shapefiles) and map/project files (.aprx)
Task 2. Outreach
PlaceWorks will support City staff in explaining the amendments to stakeholders and decisionmakers and receiving public input.
2.1 Community Meeting
PlaceWorks will prepare for and attend one community meeting on the General Plan 2042 Amendment process. This scope assumes an in person meeting; this can be switched to a virtual meeting at no additional cost at City direction. PlaceWorks will prepare:
• Content for an e-blast announcing the meeting. This assumes the City would distribute theeblast using an existing mailing list. • Image and text content for a social media post announcing the meeting • Meeting agenda and presentation
• Meeting support materials such as sign-in sheets, signage, easels, and easel pads • Up to 4 posters or large-scale maps
September 5, 2024 I Page 2
93 ~ PLACEWORKS
This scope assumes that the City will be responsible for identifying and reserving a community meeting location. Place Works will provide one presenter/facilitator for the community meeting.
2.2 Tribal Consultation Support
Place Works will prepare the request to the Native American Heritage Commission for a current list of Tribal Nation representatives and a Sacred Lands File search. Once the list is received, PlaceWorks will draft outreach letter(s) to the representatives to be submitted by the City. If consultation is requested, this scope assumes that the City will take the lead on scheduling and conducting any government-to-government consultation. PlaceWorks will assist with meeting preparation or attendance at up to three meetings, to the degree accepted by the tribes.
2.3 City Council Meeting
PlaceWorks will prepare for an attend one meeting of the City Council in support of the General Plan Amendment, including preparation and delivery of a presentation and providing content for the staff report.
Task 3. Addendum to the Certified EIR
The proposed amended General Plan 2042 will be analyzed to assess whether new impacts are created beyond those identified in the Certified EIR and that none of the conditions in CEQA Guidelines Section 15162 or Section 15163 requiring the preparation of a Subsequent EIR or Supplemental El R, respectively, have been met.
It assumed that there will be no changes to the buildout projected and evaluated in the Certified EIR due to the General Plan amendments. Therefore, the Addendum would describe qualitatively how impacts associated with the proposed amendments are accounted for in the Certified EIR.
3.1 Project Description
PlaceWorks will draft a project description for the City to review and approve, with additional narrative discussing the location and context in the city and region. The project description will discuss the general components of the proposed General Plan amendments, as well as the differences between the adopted General Plan 2042 covered by the Certified EIR and the proposed General Plan amendments. The project description will expand on the purposes of the environmental document and will discuss the required permits and approvals needed to adopt the proposed General Plan amendments. We will respond to one round of consolidated City comments on the Administrative Draft Project Description and submit a revised project description as part of the administrative draft Addendum.
September 5, 2024 I Page 3
94 (@ PLACEWORKS
3.2 Environmental Analysis
The analysis for each environmental issue area will describe the impact conclusions for each environmental threshold identified in the Certified EIR (including mitigation strategies adopted as part of the Certified EIR) and evaluate if the adoption and implementation of the proposed General Plan amendments would result in new or more severe impacts compared to what was evaluated in the Certified EIR. This evaluation will be supported by substantial evidence cited in the Addendum, will leverage the use of existing data sources (e.g., the Certified EIR, Los Banos Municipal Code, etc.), and will be supplemented with current sources and regulations as required.
The Addendum will provide detailed information for each of the resource categories that were evaluated in the Certified EIR. Technical information, if required, will be included as appendices.
Because SR-152 was not included in transportation modeling for the Certified EIR, this scope of work does assumes that no additional traffic modeling will be necessary, and therefore no revised modeling of air quality, greenhouse gases, or noise is included.
3.3 Administrative Draft Addendum
PlaceWorks will prepare an Addendum to the Certified EIR, which will include an associated discussion that compares the Approved Project in the Certified EIR to the proposed General Plan amendments. It will include graphics and tables as needed to describe the changes to the Approved Project and provide substantial evidence to justify the environmental impact conclusions. The analysis will also consider changes in circumstances subsequent to preparation of the Certified EIR that could affect the respective impacts. The Addendum will be based on the documentation and findings in the environmental analyses described under Task 2.2.
The Addendum will include the following chapters:
• Introduction: The introduction will summarize the proposed General Plan amendments and its relationship to the previous environmental analyses. This section will reference State CEQA Guidelines and case law to demonstrate why the Addendum is the appropriate environmental review document.
• Project Description: The Project Description for the proposed General Plan amendments will clearly describe the changes between the Approved Project and the proposed General Plan amendments using text, tables, and figures as needed. • Environmental Analysis: The Addendum will include qualitative or quantitative discussions for each of the CEQA-required topical areas, referencing the conclusions in the Certified EIR, wherever possible, for the conclusions in the Addendum.
The City will act as a clearinghouse for comments and will provide PlaceWorks with one set of comments on the Administrative Draft Addendum. As part of our regularly scheduled meetings PlaceWorks will meet with reviewers to discuss comments on the Administrative Draft Addendum.
September 5, 2024 I Page 4
95 ~ PLACEWORKS
3.4 Screencheck and Final Addendum
After receipt of a consolidated, internally reconciled set of City comments on the Administrative Draft Addendum, PlaceWorks will revise the document and prepare a Screencheck Draft Addendum for the City's final review. After receipt of a consolidated, internally reconciled set of the City's final comments, PlaceWorks will prepare the Final Addendum.
3.5 Notice of Determination
Within five days of approval of the Addendum and adoption of the amended General Plan 2042, Place Works will prepare the Notice of Determination (NOD) to be filed by the City atthe San Benito County Clerk's Office. Place Works will submit the NOD to the State Clearinghouse via CEQAnet and the City will submit to the County Clerk. Our scope of work does not include filing fees required pursuant to the County Clerk. Note, the Addendum would not require the payment of the required California Department of Fish and Wildlife fees.
Deliverable(s):
• Administrative Draft Project Description (electronic submittal in Word and PDF) • Administrative Draft Addendum (electronic submittal in Word and PDF) • Screencheck and Final Addendum (electronic submittals in Word and PDF) • 5 printed copies of Final Addendum
• Draft and Revised Notice of Determination (electronic submittals in Word and PDF) Task 4. Project Management
Place Works staff will be available for up to five virtual meetings with the City in addition to regular communication between project team members.
During the course of the project, the PlaceWorks team will be mindful of recordkeeping for the purpose of building the administrative record for the environmental document.
Proposed Schedule
We anticipate that the amendments to the General Plan could be completed within 5 weeks, as follows:

Agenda Staff Report
TO:
FROM:
Mayor Llanez & City Council Members
Ray Reyna, Chief of Police
William A. Vaughn, City Attorney
DATE: November 6, 2024
SUBJECT: Ordinance Relating to Public Camping and Storage of Personal Property in Public Areas [Second Reading]
TYPE OF REPORT: Regular
Recommendation:
Staff recommends that the City Council consider waiving the second reading and approve the following ordinance:
ORDINANCE NO. 1205
AN ORDINANCE OF THE CITY OF LOS BANOS ADDING CHAPTER
11, TO TITLE 5 OF THE LOS BANOS MUNICIPAL CODE RELATING
TO PUBLIC CAMPING AND STORAGE OF PERSONAL PROPERTY
ON PUBLIC PROPERTY OR IN PUBLIC AREAS
Background:
On October 2, 2024 the City Council waived the first reading and introduced Ordinance No. 1205 which if adopted will add Chapter 11, to Title 5 of the Los Banos Municipal Code relating to public camping and storage of personal property on public property or in public areas.
The key provisions of the proposed ordinance are: 1) will make it unlawful and a public nuisance for any person to camp, occupy camp facilities, build, maintain or establish an 99 ITEM 8
Encampment, occupy an Encampment, use camp paraphernalia, or store or maintain personal property in or on Public Property or Waterways at any time, unless specifically authorized or permitted by the City, in writing; 2) authorizes the City Manager in his or her discretion, to issue a permit to establish, maintain and operate a camp or a camp facility on public property in connection with a special event; 3) any Encampment established in violation of the ordinance or unauthorized storage of personal property on public property is declared to be a public nuisance, and the City is authorized to abate the nuisance and remove the Encampment, Camp Paraphernalia, related facilities, and stored personal property as authorized by law and in accordance with the process set forth in the ordinance; and 4) establishes a notice and abatement process for removal of personal property from public property.
Johnson v. City of Grants Pass is a recently decided landmark case by the U.S.
Supreme Court, which addressed the legality of municipal ordinances prohibiting camping in public spaces. The case arose from the enforcement of anti-camping laws in Grants Pass, Oregon, which led to fines and penalties for homeless individuals camping on public property.
The plaintiffs argued that the city's ordinances criminalized the status of being homeless, thus violating the Eighth Amendment's prohibition on cruel and unusual punishment. The Ninth Circuit Court of Appeals had previously ruled in favor of the plaintiffs, holding that the ordinances were unconstitutional when applied to homeless individuals with no other place to go. This was consistent with the Ninth Circuit's decision in Martin v. Boise.
In a 6-3 decision, the Supreme Court reversed the Ninth Circuit's ruling, allowing the City of Grants Pass to enforce its anti-camping ordinances. The majority opinion, authored by Justice Neil Gorsuch, held that the ordinances did not violate the Eighth Amendment when they were applied in a manner targeting the conduct of camping in public spaces, rather than the status of being homeless.
After this decision, California Governor Newsom issued Executive Order N-1-24 which ordered the State agencies to work with local agencies to clean up encampments immediately where the encampment poses imminent threat to life, safety, or infrastructure.
Key Points from the Decision: Conduct vs. Status:
The Court distinguished between penalizing conduct (camping in public spaces) and penalizing status (being homeless). It emphasized that the ordinances were constitutional as long as they addressed the act of camping and not the individual's status as homeless.
Public Health and Safety: The Court acknowledged the city's interest in maintaining public health, safety, and welfare, which includes regulating the use of public spaces to prevent hazards and ensure accessibility for all community members. 100
Supportive Measures: The decision noted the importance of cities providing supportive services and resources to homeless individuals. The Court suggested that punitive measures alone are insufficient without adequate support systems.
Discussion:
The proposed ordinance aligns with the Supreme Court's decision by targeting the act of camping and storing personal property rather than the status of individuals. It ensures that enforcement is based on conduct, thereby avoiding unconstitutional penalties based on status. Provisions within the ordinance mandate that enforcement officers attempt to provide notice and opportunities for individuals to remove their belongings before any penalties are applied, ensuring a compassionate and fair approach.
Camping in public spaces often leads to health hazards, unsanitary conditions, and increased risks of fire and crime. The ordinance is necessary to mitigate these risks and maintain the safety and cleanliness of public spaces.
The City of Los Banos has demonstrated its commitment to a many pronged approach where enforcement is only one aspect, including the establishment of a Housing Department within the Community and Economic Development Department staffed by two full time employees. The resources provided by the City, County of Merced, and the State of California and various local nonprofits strive to ensure access to transitional and supportive housing programs, and other essential services.
Fiscal
None.
Conclusion
Staff recommends that the City Council waive the second reading and adopt Ordinance No. 1205. Staff will be available to answer any questions.

1 102
WHEREAS, the City Council desires to continue to protect the public health, safety and welfare by regulating the use of public property.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF LOS BANOS DOES ORDAIN AS FOLLOWS:
SECTION 1. The City Council hereby finds and determines that the recitals above are true and correct and are incorporated herein.
SECTION 2. Chapter 11 of Title 5 is hereby added to the Los Banos Municipal code to read as follows:
Chapter 11 - UNPERMITTED PUBLIC CAMPING AND PUBLIC STORAGE OF
PERSONAL PROPERTY IN PUBLIC AREAS
Sec. 5-11.01 Purpose.
The streets and public areas within the city should be readily accessible and available to residents and the public at large. The use of these areas for camping purposes or storage of personal property interferes with the rights of others to use the areas for which they were intended. Such activity can constitute a public health and safety hazard which adversely impacts neighborhoods and commercial areas. Unlawful camping on private property without the consent of the owner, proper sanitary measures and for other than a minimal duration adversely affects private property rights as well as public health, safety, and welfare of the city.
The purpose of this Chapter is to maintain streets, parks and other public and private areas within the city in a clean, sanitary and accessible condition; to establish a process for the collection, storage, disposal, or return of personal property found on public property; and to adequately protect the health, safety and public welfare of the community, while recognizing that, subject to reasonable conditions, camping and camp facilities associated with special events can be beneficial to the cultural and educational climate in the city.
Nothing in this Chapter is intended to interfere with otherwise lawful and ordinary uses of public or private property.

The City Manager may also impose conditions on the establishment, maintenance and 5 106
operation of the camp or camp facility, including, but not limited to, security, sanitation facilities, the number of occupants, posting of bonds or deposits, insurance, quiet hours, duration of the permit, and permitted activities on the premises. When the City Manager shall issue any permit under the terms of section 5-11.04 of this Chapter, the same may be revoked at any time thereafter by the City Manager if the City Manager becomes satisfied that the maintenance or continuing operation of the camp or camp facilities is adverse to the public health, safety and welfare.
Sec 5-11.07 Public Nuisance Declared.
Any Encampment established in violation of this Chapter or unauthorized storage of personal property on public property is declared to be a public nuisance, and the City is authorized to abate the nuisance and remove the Encampment, Camp Paraphernalia, related facilities, and stored personal property as authorized by law and in accordance with this Chapter.

Any Personal Property coming into the possession of the City and/or City's Police Department may be immediately disposed of without notice, in a manner that the City and/or City's Police Department determines to be in the public interest, when such Personal Property is trash, contaminated, dangerous, perishable, or contraband pursuant to State or Federal law, and/or constitutes an immediate threat to the public health, safety, or welfare.
(e) The owner of impounded Personal Property may repossess the Personal Property prior to its disposal upon submitting satisfactory proof of ownership. A person may establish proof of ownership by, among other methods, describing the location from and date when the Personal Property was impounded from a Public Area, and providing a reasonably specific and detailed description of the Personal Property. Valid, governmental-issued identification or other acceptable form of identification is required to claim impounded Personal Property.
(f) Additional Procedures. The City Manager may adopt additional notice and collection procedures, as necessary, to implement this section. (g) Applicability. To the extent known by the City or the City's Police Department, the provisions of this section shall not apply to the following:

Imposition, enforcement, collection and administrative review of administrative penalties imposed shall be conducted pursuant to Chapter 11 Title 4 of this Code.
8 109
(c) Remedies under this Chapter are in addition to, and do not supersede or limit, any and all other remedies, civil or criminal. The remedies provided for herein shall be cumulative and not exclusive.
SECTION 3. To the extent that the terms and provisions of this Ordinance may be inconsistent or in conflict with the terms or conditions of any prior City ordinance, motion, resolution, rule or regulation governing the same subject, the terms of this Ordinance shall prevail with respect to the subject matter thereof and such inconsistent or conflicting provisions of prior ordinances, motions, resolutions, rules or regulations are hereby repealed.
SECTION 4. If any section, subsection, subdivision, paragraph, sentence, clause or phrase added by this Ordinance, or any part thereof, is for any reason held to be unconstitutional or invalid or ineffective by any court of competent jurisdiction, such decision shall not affect the validity or effectiveness of the remaining portions of this Ordinance or any part thereof. The City Council hereby declares that it would have passed each section, subsection, subdivision, paragraph, sentence, clause or phrase thereof irrespective of the fact that any one or more subsections, subdivisions, paragraphs, sentences, clauses or phrases are declared unconstitutional, invalid or ineffective.
SECTION 5. The proposed amendments to the Los Banos Municipal Code do not propose any changes to City policies or regulations that would result in a direct or indirect physical environmental impact; therefore it has been determined that this ordinance amendment is covered by the general rule that the California Environmental Quality Act applies only to projects which have the potential for causing a significant effect on the environment pursuant to CEQA guidelines section 15601 (b)(3) and is not subject to environmental review.
SECTION 6. This Ordinance shall go into effect and be in full force and operation thirty (30) days after its final passage and adoption. The City Clerk shall certify to the adoption of this Ordinance and cause the same to be posted and published once within fifteen days after passage and adoption as may be required by law; or, in the alternative the City Clerk may cause to be published a summary of this Ordinance and a certified copy of the text of this Ordinance shall be posted in the Office of the City Clerk five days prior to the date of adoption of this Ordinance; and, within fifteen days after adoption, the City Clerk shall cause to be published, the aforementioned summary and shall post a certified copy of this Ordinance, together with the vote for and against the same, in the Office of the City Clerk.
