6. PUBLIC FORUM. (Members of the public may address the City Council Members on any item of public interest that is within the jurisdiction of the City Council; includes agenda and non-agenda items. 7. CONSIDERATION OF APPROVAL OF CONSENT AGENDA. (Items on the Consent Agenda are considered to be routine and will be voted on in one motion unless removed from the Consent Agenda by a City Council Member.) A. Check Register for #255813 – #256050 in the Amount of $1,401,744.65.
Recommendation: Approve the check register as submitted.
B. City Council Resolution No. 7043 – Designating Thirty (30) Taser x26 Units as Surplus Equipment.
Recommendation: Adopt the resolution as submitted.

A. Public Hearing – To Receive Public Comment and Consideration of Conditional Use Permit #2025-03 to Allow the On-Sale of Alcohol (Type 41 ABC License – Beer and Wine) at D Pho, Inc., Located at 2160 E. Pacheco Boulevard, Suites D & E.
Los Banos City Council Agenda – February 4, 2026 Page 3 of 4 1) City Council Resolution No. 7044 – Finding Conditional Use Permit #2025-03 Categorically Exempt From the California Environmental Quality Act (CEQA) and Approving Conditional Use Permit #2025-03 to Allow the On-Sale of Beer and Wine (Type 41 ABC License) at D Pho, Inc., Located at 2160 East Pacheco Boulevard, Suites D and E.
Recommendation: Receive staff report, open public hearing, receive public comment, close the public hearing, and adopt the resolution as submitted.
B. Public Hearing – To Receive Public Comment and Consideration of Final Development Plan#2024-01 and Development Agreement for the Villages VI Subdivision.
1) City Council Resolution No. 7045 – Approving Final Development Plan #2024-01 for the Villages VI Subdivision.
2) Ordinance No. 1214 – Approving a Development Agreement Relative to the Development Known as Villages VI (Rosalyn M. Simon Revocable Trust UTD). (First Reading & Introduction)
Recommendation: Receive staff report, open the public hearing, adopt the resolution, waive the first reading, and introduce the ordinance as submitted.
