4 Agenda Staff Report
TO: Mayor & City Council Members
FROM: Lucille Mallonee, City Clerk
Nirorn Than, City Manager
Mary Lerner, City Attorney
DATE: March 9, 2026
TYPE OF REPORT: Agenda Item
SUBJECT: City Council Vacancy – District 2
______________________________________________________________________ RECOMMENDATION:
1. Confirm the interview process;
2. Confirm the voting procedure;
2. Conduct interviews of each applicant for District 2 and select one applicant to fill the vacant City Council seat; and
3. Adopt a resolution approving an appointee to the Los Banos City Council to serve the remaining term of the District 2 seat on the Los Banos City Council.
BACKGROUND:
As a result of the resignation of District 2 Council Member Evan Sanders on January 9, 2026, a mid-term vacancy occurred on the City Council. On March 4, 2026 the City Council by motion directed City Staff to proceed with the appointment process by noticing of the vacancy, accepting applications through Friday, March 6, 2026 and to hold a Special Meeting on Monday March 9, 2026 to fill the vacancy by appointment.
ITEM 6A
5 LOsBanos
At the Crossroads of California
Pursuant to Government Code §36512(b), if a City Council Member vacancy occurs, the City Council must, within sixty (60) days from the date of the vacancy, either fill the vacancy by appointment or call an election. The last day to fill the vacancy by appointment would be March 10, 2026. In this case a person either appointed or elected would hold office for the unexpired term of the former incumbent, which is December 2026.
DISCUSSION:
Based upon the direction of the City Council at their March 4, 2026 Council Meeting, staff posted the notice of vacancy and application for appointment on the City’s website and shared the notice of vacancy on various City social media platforms. The deadline for submittal of applications was set at Friday, March 6, 2026 @ 5:00 P.M.
Three(3) qualified applications were received for District 2: Refugio Llamas, Elias Reyes Jr., and Tyler Anthony Castillo and are attached to this Staff Report.
City Council Interviews.
At the March 4, 2026 City Council meeting, interviews were scheduled for a special meeting to occur on March 9, 2026 @ 6:00 p.m., in the City Council Chambers at 520 J Street. Applicant interviews must be conducted in open session of a public meeting. The order of interviews will be based on a random drawing. Each applicant shall be interviewed separately and shall be given the opportunity to make a brief statement concerning his or her qualifications and to answer pre-determined questions relevant to the applicant’s qualifications to sit on the City Council.
Attachment 1 to this Staff Report is the interview process and questions previously approved by the City Council at the January 2, 2025 meeting for the appointment process held in January 2025.
Voting Procedure.
It would take an affirmative vote of at least three City Council Members to select one of the applicants to fill the vacancy. The vote or announcement of the vote of each City Council Member must occur in open session of a public meeting. The selection shall be confirmed by Resolution of the City Council.
There are a number of different voting procedures that the City Council can consider depending upon the number of applicants.
Attachment 2 to this Staff Report sets forth the City Council’s preferred alternative voting procedure as determined at the January 2,2025 meeting and two alternatives. 6 Notwithstanding the voting procedure described above, at any time during the appointment process, the City Council in its discretion may abandon the process and choose to fill the vacancy by election.

5. Please explain your reasons for wishing to serve on the City Council and how you feel that you would contribute as a member of the City Council.
There has been a tremendous amount of progress accompliched by this Council in the past year.
I would be a meaningful contributor to continued progress in addressing our residents concerns, such as:
• water quality, roads, ligh1ing, traffic mitigation, community recreation and economic development.
My wife and I thoroughly enjoy living In Los Banos, As a Retiree, we have the option to move to another State. This is our Hometown and firml·; believe Los Banos has tremendous potential to be a hub and model of economic growth, which will help ensure the funding of city services and provide higher paying jobs to more of our Residents. Los Banos, as you know. is ideally located on Highway 152, which connects the central valley lo the Bay Area and beyond. We have much work to do, but we have a tremendously dedicated city staff which is essential in our efforts to make Los Banos a model city.
6. Why do you think you should be appointed to the City Council? I have the combination of experience, training, and education which will allow me to quickly be a meaningful contributor to the council. I continue to have a high degree of trust with our residents, particulalry in Dirstrlct 2. Residents regularly share their thoughts and concerns on various issues and this is essential in adequately addressing and funding these issues ..
My working knowlege of the various city departments and staff make me ideally positioned to reduce the 'learning' curve. My sole desire is to help in the decision making process and lo provide a direct conduit of information to the residents in District 2.
7. In your opinion, what are the top two pressing issues facing the City of Los Banos and why. please explain.
Economic development: As our city continues to grow in population, our police, fire and roads will consume an even larger percentage of the citys revenues. Our city must continue to actively work to attract large commercial partners in order to increase revenue to the city. The city must also continue to work to bring higher paying jobs with full time work hours. Far too many of our residents have no other option but to drive several hours a day to other cities in order to provide for their families.
Public Safey: Public safety is one of the highest priorities for any municipality or government entity . . As our population increases we must ensure that our first responder staffing continues to keep pace at a appropriate ratio. We cannot attract investors if they do not feel that their investments are not secure or that our public safety agencies do not have the proper equipment to mitigate industrial accidents.
8. You may attach a personal resume and any additional information you would like the City Council to consider.
14 Please Note appointment to the City Council require the following:
Statement of Economic Interest Form 700: Per the State of California Fair Political Practices Commission, persons appointed to the City Council are required to file a Statement of Economic Interests (Form 700).
