She said the courts have been very well received and are heavily used in the mornings and evenings. She noted that teenagers, commuters, working residents, and new players have been using the courts and playing into the evening. Ms. Ballati invited the Council and community to visit the courts. BRAD MCCRAY spoke in support of the new pickleball courts, noting that he regularly sees new players learning the sport and participating in lessons. He said the increased activity and number of new players has been one of the most positive aspects of the new courts. HENRY PENAMONTE thanked the City for the new courts and said he was surprised by the number of young people and new players using them in the evenings. As someone who commutes between Los Banos and San Jose, he said evening play is particularly important to him and expressed excitement about the planned installation of lights. As a teacher who recently returned to work, she said she is primarily able to play in the evenings and appreciates seeing young people using the courts. Ms. Ballati reiterated that the courts are being used extensively and encouraged Council Members to visit and see the activity firsthand. ERASMO VIVEROS, Los Banos, thanked the Public Works Department, City Manager, and Traffic Safety Committee for their quick response regarding the intersection of 4th and J Streets. He said the stop signs were installed shortly after the Traffic Safety Committee reviewed the issue and that the signs have helped slow traffic. Mr. Viveros said that, before the signs were installed, he frequently heard drivers arguing and observed vehicles traveling at high speeds and racing through the area. He thanked the City for listening to downtown residents and taking swift action to improve safety at the intersection. City Clerk Mallonee read the following items: Email from ANDREW AYALA concerns about speeding vehicles and motorcycles in the Vineyard neighborhood, particularly on Cabernet Street. He cited safety and noise concerns and requested traffic-calming measures, including speed bumps. Letter from LARRY BYERS requesting that the City Council consider funding a comprehensive tree maintenance program for trees within the City right-of-way. He recommended using a certified arborist to address tree health, safety, and maintenance needs and protect the City's investment in approximately 13,000 trees. No one else came forward to speak and the public forum was closed.

Mayor Amabile thanked residents for participating in the public forum and submitting correspondence, noting that public input helps the City Council and staff understand neighborhood concerns. He advised residents that information on the City’s website explains the process for requesting speed bumps. He also acknowledged Mr. Byers’ comments regarding tree maintenance funding as an issue the City can consider during the budgeting process.

CONSIDERATION OF ADOPTION OF CITY COUNCIL RESOLUTION NO. 7147 – RATIFYING THE CITY MANAGER’S APPROVAL OF THE EMPLOYMENT

AGREEMENT BETWEEN THE CITY OF LOS BANOS AND ROBERT LOMELI AS EMPLOYEE FOR THE POSITION OF ASSISTANT CITY ATTORNEY. City Manager Than presented the staff report, explaining that the Assistant City Attorney position was included in the adopted budget and that, as a management position, an employment agreement was required. He introduced Robert “Rob” Lomeli and highlighted his more than 20 years of public-sector experience in municipal law, labor law, public safety, and water issues, as well as his prior experience as a deputy sheriff. Mr. Than recommended ratification of the employment agreement, effective August 24, 2026. The agreement provides an annual salary of $234,996, management employee benefits, 120 hours of vacation leave, 96 hours of sick leave, 96 hours of administrative leave, paid holidays, and a $500 monthly vehicle allowance.

Mayor Amabile invited the public to comment. ERASMO VIVEROS questioned the cost savings associated with bringing legal services in-house compared to the City’s prior legal expenses. He also asked how the position would be integrated throughout the City and what the City would receive in return for the additional position. No one else came forward to speak.

Mayor Amabile discussed the City’s prior legal expenses, noting that the City had spent approximately $1 million annually on attorney fees. City Manager Than explained that the City had historically spent approximately $1 million to $1.2 million annually on outside legal services, including firms such as BBK and LCW. He noted that the high hourly cost of outside counsel often limited departments’ ability to use legal services because those expenses impacted department budgets. Mr. Than stated that having an in-house legal team allows the City to be proactive rather than reactive and provides readily available legal guidance on matters such as construction claims, employee protections, workers’ compensation, and public safety laws, including POBAR and FBOR. He said the position was expected to be essentially a wash, with potential savings, and noted that approximately $500,000 had been available in the budget due to reduced reliance on outside professional services. Mr. Than also emphasized succession planning and continuity within the City Attorney’s Office. He noted that matters such as Public Records Act requests, which were previously handled by consultants, are now being handled inhouse. He added that department heads have experienced a significant improvement in responsiveness with legal services available internally. City Attorney Lerner stated that prior legal service bills did not necessarily reflect the City’s actual legal needs because legal services were often an area where departments attempted to limit expenditures.

She said it is better to address legal issues proactively and noted that additional work, including updating the Municipal Code and ensuring compliance with state law, is needed.

Mayor Amabile spoke in support of having an attorney dedicated to the City who is familiar with its operations and can identify potential legal issues before they become problems.

She noted the challenges of relying on outside attorneys and the benefit of having legal counsel available to staff and the community. Council Member Lewis stated that the position would allow the City to stay ahead of legal issues and prepare for future laws, updates, and compliance requirements. She called the position worthwhile and beneficial to the City’s future. Council Member Chavez also supported the position, stating that having an in-house attorney allows the City to seek legal guidance without the additional concern of outside legal fees and helps the City remain proactive rather than reactive.

Motion by Lewis, seconded by Chavez to adopt City Council Resolution No. 7147 – Ratifying the City Manager’s Approval of the Employment Agreement Between the City of Los Banos and Robert Lomeli as Employee for the Position of Assistant City Attorney.

The motion carried by the following roll call vote: AYES: Chavez, Lewis, LLamas, Perez, Mayor Amabile; NOES: None; ABSENT: None.

Mr. Lomeli thanked the City Council for the opportunity and expressed his appreciation for the opportunity to join the City. He said he looked forward to working with the Council and staff and helping the City continue moving forward.

CONSIDERATION OF ADOPTION OF CITY COUNCIL RESOLUTION NO. 7148 –

APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF

LOS BANOS AND QUIRING GENERAL, LLC FOR PRECONSTRUCTION SERVICES FOR FIRE STATION NO. 4 AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT. Public Works Director Via presented the staff report, explaining that the City is working with the design-build team to further evaluate the project scope and bring the project within the established $13 million budget. The pre-construction work will include reviewing the existing design documents, developing schematic designs, refining the project scope, estimating costs, and identifying potential areas for cost savings before entering into a final design-build agreement. City Manager Than spoke regarding the project and clarified that the $283,125 cost for the pre-construction services is included within the $13 million project budget. He explained that the City is evaluating the option of housing the Fire Station and Emergency Operations Center under one roof rather than constructing two separate buildings, which could provide cost savings while maintaining the intended functions of the project.

Mayor Amabile invited the public to come forward to speak, and no one came forward.

Council Member LLamas asked about the parking and site layout. City Manager Than explained that the facilities would have separate functions, but could share certain areas such as a lobby. He noted that the design process would further evaluate entrances, parking, physical separation, and other site details, while identifying additional opportunities to reduce costs.

Motion by Lewis, seconded by Chavez to adopt City Council Resolution No. 7148 – Approving a Memorandum of Understanding Between the City of Los Banos and Quiring General, LLC for Preconstruction Services for Fire Station No. 4 and Authorizing the City Manager to Execute the Agreement. The motion carried by the following roll call vote:

AYES: Chavez, Lewis, LLamas, Perez, Mayor Amabile; NOES: None; ABSENT: None.

CONSIDERATION OF ADOPTION OF CITY COUNCIL RESOLUTION NO. 7149 –

APPROVING A MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF

LOS BANOS AND THE COUNTY OF MERCED FOR REPAVING OF PIONEER ROAD AND AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT. Public Works Director Via presented the staff report, explaining that the County had recently completed its repaving project from Volta Road to the City limits on Pioneer Road. The City requested that the County extend the paving to the limits of the City’s new intersection at Ortigalita Road and Pioneer Road, creating a continuous newly paved roadway. Mr.

Via stated that the project covers approximately 2,750 linear feet and that, because the County’s contractor was already mobilized, the City’s cost for the additional paving was approximately $250,000. He explained that the City had originally considered completing the work as part of its own project but was unable to do so because of federal funding requirements and the work being outside the City limits.

Mayor Amabile invited the public to comment, and no one came forward. He noted that the project demonstrated the benefits of working cooperatively with the County and asked about the estimated savings. Mr. Via estimated the City saved approximately $50,000 in project costs, not including staff time associated with preparing bid documents and administering the bidding process. He noted that the savings could potentially exceed $100,000 compared to completing the project independently.

Council Member Chavez thanked Merced County Road Commissioner Nathan Bray for working with the City and noted the importance of improving roads in and around Los Banos. Mr. Via provided an update that the first phase of the City’s 2026 roadway rehabilitation projects in the Snow Goose area had been completed, with the I Street portion remaining.

Motion by Chavez, seconded by Perez to adopt City Council Resolution No. 7149 – Approving a Memorandum of Understanding Between the City of Los Banos and the County of Merced for Repaving of Pioneer Road and Authorizing the City Manager to Execute the Agreement. The motion carried by the following roll call vote: AYES: Chavez, Lewis, LLamas, Perez, Mayor Amabile; NOES: None; ABSENT: None.

CONSIDERATION OF ADOPTION OF CITY COUNCIL RESOLUTION NO. 7150 –

APPROVING AN AMENDED AND RESTATED PROPERTY TAX SHARING

AGREEMENT BETWEEN THE CITY OF LOS BANOS AND THE COUNTY OF MERCED. City Manager Than presented the staff report, describing the agreement as another example of collaboration between the City and County. Mr. Than provided background on the existing agreement, originally adopted in 1997 and amended in 2016.

He explained that the agreement establishes how property tax revenues are shared between local agencies when properties are annexed or development occurs. He noted that the City’s adoption of the 2042 General Plan, which expanded the City’s sphere of influence and updated land-use planning, required the property tax sharing agreement to be updated. Mr. Than stated that the City and County were able to reach an agreement on the proposed amendments in approximately six weeks, compared to approximately six months during the previous negotiations. He credited the collaboration of the City Council, Supervisor Silveira, County CEO Mark Hendrickson, and Assistant CEO David Marioni. He said the amended agreement formally recognizes the City’s 2042 General Plan and reflects the City’s anticipated growth and service areas.

Mayor Amabile invited the public to come forward to speak and no one came forward.

Motion by Chavez, seconded by Lewis to adopt City Council Resolution No. 7150 – Approving an Amended and Restated Property Tax Sharing Agreement Between the City of Los Banos and the County of Merced. The motion carried by the following roll call vote:
