Dear Town Council:
We ask that you review this independent Acoustics Technical Analysis Report provided by Christian Hoobyar of Sundance Acoustics. Mr Hoobyar found that the Salter Noise study commissioned by and paid for by the applicant, West Valley Muslim Association, was insufficient. We ask that you consider this critical new information in regards to WVMA's CUP modification U-24-010.
Please find the report attached.

RE: West Valley Muslim Association’s Conditional Use Permit – 16769 Farley Road Dear Honorable Mayor and Members of the Town Council:
We write on behalf of the San Francisco Bay Area office of the Council on American-Islamic Relations, (“CAIR-SFBA”), our nation’s largest American Muslim civil rights and advocacy organization.
CAIR-SFBA has previously written to the Town Planning Commission and the Town Council in support of West Valley Muslim Association’s (“WVMA”) request to modify its Conditional Use Permit (“CUP”) for its property located at 16769 Farley Road (“the Property”), and to support WMVA’s appeal of the conditions imposed by the Planning Commission in its May 21, 2026, decision. We write to once again urge the Town Council to grant WVMA’s appeal, and to again remind the Town of its obligations under federal law to respect religious freedom.
As you should already know, the Religious Land Use and Institutionalized Persons Act (“RLUIPA”) protects people of all faiths and their institutions from unduly burdensome or discriminatory land use regulations.1
RLUIPA prohibits governments from implementing land use regulations that impose a “substantial burden” on religious exercise, unless the regulations are justified by a “compelling governmental interest” and use the least restrictive means possible.2 For example, RLUIPA prohibits governments from unreasonably limiting religious assemblies by imposing “significantly great restriction on religious use of a property.3 RLUIPA’s protections are expansive and may include any exercise of religion, “whether or not central to [ . . . ] a system of religious belief.”4 The use 1 As a threshold issue, we note that RLUIPA applies where a challenged government action involves “individualized assessments of the proposed uses for the property involved.” New Harvest Christian Fellowship v. City of Salinas, 29 F.4th 596, 601 (9th Cir. 2022) (quoting 42 U.S.C. § 2000cc(a)(2)(C).) 2 RLUIPA, 42 U.S.C. § 20000cc(a). 3 See generally RLUIPA, 42 U.S.C. § 2000cc(b)(3)(B); see, e.g., Guru Nanak Sikh Soc’y v. Cty. Of Sutter, 456 F.3d 978, 988 (9th Cir. 2006); see also San Jose Christian Coll. v. City of Morgan Hill, 360 F.3d 1024, 1034 (9th Cir. 2004). 4 42 U.S.C. § 2000cc-5(7)(A).
ATTACHMENT 41
of real property for purposes of religious exercise is itself considered to be a religious exercise.5 Finally, RLUIPA also prohibits governments from discriminating against groups based on their respective faiths and/or religious denominations.6
The extensive list of conditions imposed by the Planning Commission is concerning. If approved, these myriad conditions would cumulatively amount to much more than mere inconveniences on WVMA’s congregants’ ability to practice their faith; instead, they would squarely impact the community’s exercise of religion. For example, the conditions attempt to distinguish between “worship services” and “other activities,” and restrict the allowable hours for non-worship activities. In doing so, these limits on operational hours for “other activities” would substantially restrict WVMA’s ability to conduct fellowship activities, educational programs, and other religious ceremonies that are part of the Islamic faith.
CAIR-SFBA urges the Town Council to grant WVMA’s appeal. The Town must also heed RLUIPA’s protections and take care not to infringe on the constitutionally-protected right of Muslims to exercise their faith in Los Gatos.
Sincerely,
Zahra Billoo, Esq.

Dear Mayor and Members of the Town Council,
I'm a Campbell resident and longtime member of the WVMA community in Los Gatos, writing to ask you to grant WVMA's appeal.
The conditions imposed on the mosque appear to hold it to a stricter standard than other houses of worship in town have faced. That's the heart of my concern — not the specifics of any one condition, but whether the same rules are being applied to everyone.
This community is why my wife and I settled in the area. We shop, eat, and spend time in Los Gatos regularly, and we've always felt welcome here. I hope the Council will make sure that welcome extends to how the town treats our mosque.
Thank you for your consideration.
Sincerely,

I urge you to grant WVMA's appeal and ensure equal treatment for the Town's Muslim community.
The conditions imposed on WVMA appear to subject the mosque to requirements that are not imposed on comparable houses of worship. Religious institutions should be treated fairly regardless of faith.
I am a student at Rolling Hills Middle School in Los Gatos and a muslim who goes to the Los Gatos Islamic Center on Farley Rd every week. The LGIC means a lot to me, my family, and my closest friends.

Subject: Public Hearing for the Appeals of Conditional use Permit Application U-24-010 Dear Town Council:
My house is located at the middle part on Farley road between Los Gatos Blvd and WVMA's campus. I attached a document describing the safety issue on Farley road with significant increase vehicle traffic and parking as the result of the newly proposed CUP U-24-010 by the LG planning committee.
Regards,

Farley Road Pedestrian Safety Issue
due to Intensified Traffic and Parking
Hongzhi zhao,
8/2/2026
There is no designated sidewalk for pedestrian and no street light on Fraley Road. Farley Road measures approximately 36 feet in width a dimension calculated based on the property lines on either side of the roadway. Farley Road is a two-way thoroughfare shared by pedestrians and children riding bicycles. Currently, this stretch of road is not equipped with streetlights.
Given that the standard safe width for a single vehicular lane is 11 feet, a two-way, two-lane configuration would require a total road width of 22 feet. Furthermore, a motor vehicle (including side mirrors) measures approximately 8 feet in width; Consequently, if vehicles are parked on both sides of Farley Road, the total required road width increases to 38 feet. However, the actual width of Farley Road is merely 36 feet. This width is already insufficient to accommodate the increasingly heavy traffic volume. As a result, pedestrians on Farley Road are left with absolutely nowhere to walk. This situation places the lives and safety of our community residents in extreme jeopardy, especially during the night. It not only deprives community pedestrians and cyclists of their right to safe passage but also forces the residents of the Farley Road community to live in constant fear—perpetually anxious about their personal safety and facing the fatal risk of being struck and killed by a vehicle at any moment.
There is no designated sidewalk for pedestrian on Farley Road. It is used by both pedestrian, parking and traffic vehicles.

This house of worship has allowed me to meet members of community when I had moved to the Bay Area not knowing anybody. Without this mosque, I would’ve been struggling to find community. I am not sure why WVMA is being scrutinized more than other places of worship and is being placed under a microscope.

The ongoing push and pull between our mosque and community seem to be contributing to an air of disharmony. We’re all ready for there to be a resolution and for this to be behind us. I would love to be able to walk from my home to the mosque, as I often do children in tow, without being filmed by Kim or any of the other neighbors who sit and videotape our entry and exit as if we’re committing some grievous harm by entering our house of worship. Their comments of our being incompatible with the neighborhood reek of racism and exclusion. If it was simply a matter of inconvenience due to their trying to rest why are we being filmed no matter the time of day?
I also took great offense to my neighbors going through our member log and calculating what percentage of us are residents of Los Gatos, then claiming the rest can go worship somewhere else. Since when are our houses of worship restricted to residency? My good friends drive an hour plus to worship at churches where they feel the most love and sense of community.
Argument after ridiculous argument has been made to ostracize and isolate our community when we have gone way above and beyond to be neighborly while practicing our faith.
Underlying hints of xenophobia have been present in almost all their actions and claims. We just want to be able to worship in peace as is our constitutional right.
Thank you for your consideration and for supporting fairness, religious freedom, and equal treatment for all.

[EXTERNAL SENDER]
Dear Mayor Moore and Members of the Los Gatos Town Council, I respectfully ask you to grant WVMA’s appeal and ensure that the Muslim community is treated by the Town with the same fairness afforded to other faith communities.
As a Muslim parent and an active member of the local community, this issue is deeply personal to me. WVMA is not simply the place where my family gathers for congregational prayer each week. It is where our families come together and form lifelong friendships. It is where my two sons met some of their closest friends. It is also where our community provides charitable support and service to those in need—including the poor, the elderly, and members of the surrounding neighborhood. WVMA is a place whose doors are always open.
It is therefore disheartening to feel that this spirit of openness and service is not always met with the same openness and goodwill from the community we strive to support.
Mayor Moore, as a leader and mentor to the youth of Los Gatos, you have opened doors for young people through Youth Commission opportunities and fostered a culture of service to all.
We hope that you and the Town Council will uphold those same values by supporting fairness, religious freedom, and equal treatment and granting WVMA’s appeal.
We are not asking for special treatment. We are asking only that WVMA be treated in a manner that is fair, consistent, and reasonable.
Thank you for your time, consideration, and service to the community.

Dear Mayor and Members of the Los Gatos Town Council,
I am writing to respectfully urge you to grant the West Valley Muslim Association's (WVMA) appeal to ensure that the Muslim community in Los Gatos is treated with fairness and equity.
The conditions currently imposed on the WVMA subject the mosque to requirements not expected of other local houses of worship. Our community deserves to be treated fairly, regardless of faith.
As the only mosque serving the West Valley area, this facility is much more than just a building; it is where our community gathers in times of both joy and hardship. It is a place where children develop lifelong friendships, young adults connect with mentors, and, most importantly, where our congregation connects with God. Practicing our faith in Los Gatos should be as accessible and supported as it is in other parts of the country.
Therefore, I urge the Council to do the right thing for our community: allow us to practice peacefully without the burden of additional requirements or restrictions.
Thank you for your time, your consideration, and your ongoing commitment to supporting fairness, religious freedom, and equal treatment for all.

Hello Planning Commission,
I would like to send this email to ask the commission/town to consider collecting more data on the noise and traffic around the neighborhood streets of Farley before making any decisions. I live on and there has been a lot of traffic and speeding from Flintridge/Farley onto Chirco Drive over the last few years. A cat of our neighbors got run over and killed in front of our house recently. The amount of traffic after mass also increased with cars speeding through the neighborhood.
Thank you so much!

Dear Mayor and Members of the Los Gatos Town Council,
I urge you to grant WVMA's appeal and ensure equal and fair treatment for the Town's Muslim community.
The conditions imposed on WVMA appear to subject the mosque to requirements that are not imposed on comparable houses of worship. Religious institutions should be treated fairly and consistently, regardless of faith.
This issue matters deeply to me because I believe every faith community should have the same opportunity to worship, gather, and be part of our community without facing unequal or unsupported barriers.
I am particularly concerned that some neighbors opposing the mosque have relied on claims with little or no factual basis. Some statements have gone beyond ordinary land-use concerns and have been deeply hurtful and damaging—including references to the San Diego mosque shooting in this discussion. Such rhetoric should have no place in a fair and evidence-based land-use process.
During the previous meeting, I was also troubled to hear several speakers describe us as "not compatible." Language like this is deeply concerning when directed at a religious institution and its community. Decisions affecting a house of worship should be based on objective evidence, established standards, and requirements applied equally to comparable institutions—not on fear, stereotypes, unsupported allegations, or perceptions about whether a particular faith community is "compatible" with the neighborhood.
Thank you for your consideration and for supporting fairness, religious freedom, and equal treatment for all members of our community.

I am writing to respectfully urge you to grant WVMA’s appeal and ensure that our local Muslim community receives fair and equal treatment.
As a Muslim family living in this community, having a place where our children can worship, learn, gather, and feel a sense of belonging is incredibly meaningful to us. We chose to build our family and our home in this community because we value the schools, walkability, and strong sense of community that Los Gatos offers.
The conditions imposed on WVMA appear to place requirements on the mosque that are not imposed on comparable houses of worship. Religious institutions should be treated fairly and consistently, regardless of the faith they represent.
I respectfully ask the Town Council to consider WVMA’s appeal and uphold the principles of fairness, religious freedom, and equal treatment for all members of our community.
Thank you for your time and consideration.
