Lindsay McIntosh, founder and executive director of Musica Sierra is a proud resident of Sierra County. Truckee Ca native, historical oboist, arts entrepreneur and new music devotee has created and executed a muchneeded array of programs that benefit and enrich our community and students in our public school. Our programs include a community spotlight series, weekly music enrichment classes in the public school serving each grade level, community music classes, ages 0-5 music engagement, Musical Headwaters, and exposure in the schools. Since our launch in 2020, we’ve worked closely with our state-local partners, The Sierra Valley Arts Council (SVAC), Sierra Plumas Joint Unified, First 5 Sierra and The Sierra Schools Foundation who provide us with funding to create and execute our top caliber arts and music educational programming, as well as bringing out world-class musicians to perform
Lindsay is a graduate of the esteemed Juilliard School of Music, McIntosh was on a full scholarship in the Historical Performance program and has appeared under world-renowned conductors such as William Christi, Masaaki Suzuki, Jordi Savall, Richard Egarr and Monica Huggett. In 2013, while in her second year of graduate studies at the Juilliard School, McIntosh discovered her passion for leadership and creative programming. As a result, McIntosh founded New Vintage Baroque –an adventurous ensemble dedicated to promote the public good by creating musical programs, commissions and music education programs through different and unique styles that are accessible for all.

MUSIC
EDUCATION
With the support of the Sierra County Arts Council’s Artist In Schools Grant, and matching grants from Sierra-Plumas Joint Unified and The Sierra School’s Foundation, Musica Sierra has hired two music teachers to teach a weekly, sometimes twice a week, music appreciation class for grades Pre-K-12th at both schools site; Downieville and Loyalton.
Musical learning and exposure to the arts are essential experiences for healthy human development. We believe such experiences should be available to all youth in Sierra County regardless of their background Musica Sierra’s primary goal will be to facilitate the expansion of music education opportunities in the Sierra Valley with a regular, sustainable presence in local schools and learning centers.

Our first residency featured the watershed. It
premiered June 2022 called "The Rivers are
Our Brothers", written and performed by
vocalist and composer Majel Connery, along
with violin (Edwin Huizinga) and bassoon (Ben
Matus). The cycle is based on a quote from
the Native American leader, Chief Seattle,
who believed we must relate to our
environment the way we relate to our closest
kin. Each song begins “I am a river,” or “I am
rain,” giving the power of first-person speech
to these important elements of the Sierra
Nevada landscape.
We spent four days performing fourteen
interactive performances for grade levels
spanning preschool through 12th grade.
From Loyalton to Downieville we reached
over 400 kids district-wide, and even had the
kids compose their own musical thunderstorm
with various instruments and then performed
along with the musicians!

1 CITY OF LOYALTON
CITY COUNCIL STAFF REPORT
MEETING OF: December 20, 2022
Subject: Zoning Interpretation-Wireless Facilities
From: Gary Price, Contract Planner
Recommended Action: By vote of the Council (minute order), in accordance with Section
12.08.22, Subsection 1-10-B, of the Zoning Code, determine that the current zoning code allows wireless tower in all zone districts with a conditional use permit.
BACKGROUND: Epic Wireless on behalf of Verizon Wireless, has inquired about the installation of a wireless tower in the City. The City needs to provide Epic with an answer as to what level of planning review the City will require for such an installation.
Although not defined by City Code, a wireless tower means any structure built for the sole purpose or primary purpose of supporting FCC licensed or authorized antennas and their associated facilities. The City’s Zoning Code does not reference wireless facilities. Section
12.08.22, Subsection 1-10-B, allows the City Council to determine whether a particular use that is not listed in the Code to be allowed by right or subject to a conditional use permit. determine that the current zoning code allows wireless facilities in all zone districts with a conditional use permit.
Section 12.08.22, Subsection 1-10-B of the Zoning Code, regarding, Scale on Zoning Map states:
“B. The City Council, by written findings, may interpret any of the provisions of this Part and may determine what additional uses may be permitted with or without use permits in any zone district because of similarity and compatibility with listed uses. Said findings shall clearly set forth the justification for the interpretation. Such interpretations shall not be used to circumvent other available established procedures such as conditional use permits and variances.
ANALYSIS: Wireless towers are a rather unique type of use and could be considered a type of public utility that might be allowed with or without a Conditional Use Permit in some or all of the zoning districts, such as:
R-1- Single-Family Residential
R-2-Multiple Family Residential
C-1-Commercial
2 C-2-Highway Commercial
C-3-Heavy Commercial
M-1-Light Industrial
M-2-Heavy Industrial
P-D-Planned Development
O-S-Open Space
P-F-Public Facility
As an allowed use, the City would have no discretion as to location, design, or denial of an installation. As a use subject to a conditional use permit, an installation could be allowed at the discretion of the City Council if certain findings can be made in accordance with Section
12.08.19-4 as follows:
“That the establishment, maintenance or operation of the use of building applied for will not, under the circumstances of the particular case, be materially detrimental to the health, safety, peace, morals, comfort and general welfare of persons residing or working in the neighborhood of such proposed use or be materially detrimental to property or improvements in the neighborhood or to the general welfare of the City.“
Also, with a conditional use permit, the City would have the ability to add conditions to an installation to make it more compatible with the neighborhood.
Sierra County has processed a number of wireless tower installations and they require a conditional use permit for these uses. Similar to how the County processes these requests, staff suggests that a wireless tower in Loyalton, which is visually apparent from most locations in the City, should be subject to a conditional use permit. Since public utilities typically can be located in any zoning district, staff also suggests that such wireless towers be evaluated on a case by case basis with a conditional use permit in all zone districts.
ALTERNATIVES: The City Council should provide written findings in interpreting the Zoning Code to address wireless towers by zoning district. Options include allowing these by right or allowing them with a conditional use permit.
Height Variance Requirements: Regardless of the Council’s determination on whether a conditional use permit would be required for an installation, since a wireless tower is typically taller than what the zoning code allows, a variance to building/structure height is required. For example, if an installation is located in the R-1 Zone, where the maximum height allowed is 30 feet, a variance application would be required since a wireless tower is typically 80 feet tall or taller. In a C-1 Zone, where the maximum allowed height is 60 feet, an installation would also require a variance. Similar to a conditional use permit, a variance is subject to approval by the City Council based on findings and may include conditions of approval. In most cases conditional use permit and variance applications can be processed together and the Council can consider both applications in one public hearing.
SECONDARY DISCUSSION: Epic is contemplating locating a wireless tower in the City, on City owned property, so the Council does have the opportunity to provide staff some direction on possible options and preferences for a particular wireless tower style. In this case, a wireless tower, either looking like a tall pine tree (monopine) versus a standard structure (monopole) may be proposed at the northwest corner of Lewis and Railroad Avenues (see Exhibits A through F). The 3 Council is welcome to offer some suggestions to staff and Epic as to appearance preferences for such a possible project. If the existing trees around the site are similar height to the 90 foot tall installation, then a monopine might be less visually prevalent and therefore more compatible with the surrounding neighborhood. On the other hand, if the monopine is much taller than the surrounding trees, a monopine might stick out more than the appearance of a monopole. There are pros and cons to either type of installation that the Council might be interested in discussing. Epic Wireless representatives will be available by Zoom at the meeting to answer any technical questions about a wireless tower.

Conflicts of Interest
The City Council will annually review the adopted Conflict of Interest Policy. See Enclosure 3.
Council members and staff are expected to disclose potential or existing conflicts of interest at least annually and throughout the year on a regular and consistent basis.
No council member shall participate in the selection or award of a contract if a conflict of interest real or perceived, would be involved.
ENCLOSURE 3
CONFLICT OF INTEREST POLICY
ARTICLE I - PURPOSE
The purpose of the conflict of interest policy is to protect The City of Loyalton’s (City) interest when it is contemplating entering into a transaction or arrangement that might benefit the private interest of an officer or council member of the City or might result in a possible excess benefit transaction. This policy is intended to supplement but not replace any applicable state and federal laws governing conflict of interest.
ARTICLE II - DEFINITIONS
1. “Interested Person.” Any council member, officer, or member of a committee with governing delegated powers, who has a direct or indirect financial interest, as defined below, is an interested person.
2. “Financial Interest.” A person has a financial interest if the person has, directly or indirectly, through business, investment, or family:
a. An ownership or investment interest in any entity with which the City has a transaction or arrangement, b. A compensation arrangement with the City or with any entity or individual with which the City has a transaction or arrangement, or
c. An opportunity to acquire an ownership or investment interest in, or compensation arrangement with, any entity or individual with which the City is negotiating a transaction or arrangement. Compensation includes direct and indirect remuneration as well as gifts or favors that are not insubstantial. A “Financial Interest” is not necessarily a conflict of interest. Under Article III, Section 2, a person who has a financial interest may have a conflict of interest only if the appropriate governing council or committee decides that a conflict of interest exists.
ARTICLE III - PROCEDURES
1. Duty to Disclose. In connection with any actual or possible conflict of interest, an interested person must disclose the existence of the “Financial Interest” and be given the opportunity to disclose all material facts to the directors and members of committees with governing council delegated powers considering the proposed transaction or arrangement.
2. Determining Whether a Conflict of Interest Exists. After disclosure of the “Financial Interest” and all material facts, and after any discussion with the “Interested Person”, he/she shall leave the governing Council or committee meeting while the determination of a conflict of interest is discussed and voted upon. The remaining council or committee members shall decide if a conflict of interest exists.
3. Procedures for Addressing the Conflict of Interest
a. An “Interested Person” may make a presentation at the governing council or committee meeting, but after the presentation, he/she shall leave the meeting during the discussion of, and the vote on, the transaction or arrangement involving the possible conflict of interest. b. The chairperson of the governing council or committee shall, if appropriate, appoint a disinterested person or committee to investigate alternatives to the proposed transaction or arrangement. c. After exercising due diligence, the governing council or committee shall determine whether the City can obtain with reasonable efforts a more advantageous transaction or arrangement from a person or entity that would not give rise to a conflict of interest.
d. If a more advantageous transaction or arrangement is not reasonably possible under circumstances not producing a conflict of interest, the governing council or committee shall determine by a majority vote of the disinterested council members whether the transaction or arrangement is in the City’s best interest, for its own benefit, and whether it is fair and reasonable. In conformity with the above determination it shall make its decision as to whether to enter into the transaction or arrangement.
4. Violations of the Conflicts of Interest Policy
a. If the governing council or committee has reasonable cause to believe a member has failed to disclose actual or possible conflicts of interest, it shall inform the member of the basis for such belief and afford the member an opportunity to explain the alleged failure to disclose. b. If, after hearing the member’s response and after making further investigation as warranted by the circumstances, the governing council or committee determines the member has failed to disclose an actual or possible conflict of interest, it shall take appropriate disciplinary and corrective action.
ARTICLE IV - RECORDS OF PROCEEDINGS
The minutes of the governing council and all committees with council delegated powers shall contain:
a. The names of the persons who disclosed or otherwise were found to have a “Financial Interest” in connection with an actual or possible conflict of interest, the nature of the “Financial Interest”, any action taken to determine whether a conflict of interest was present, and the governing council’s or committee’s decision as to whether a conflict of interest in fact existed.
b. The names of the persons who were present for discussions and votes relating to the transaction or arrangement, the content of the discussion, including any alternatives to the proposed transaction or arrangement, and a record of any votes taken in connection with the proceedings.
ARTICLE V - ANNUAL STATEMENTS
Each council member, principal officer and member of a committee with governing council delegated powers shall annually sign a statement which affirms such person:
a. Has received a copy of the conflicts of interest policy, b. Has read and understands the policy, and
c. Has agreed to comply with the policy

SECTION 5
EXPLANATION OF INVESTMENT TYPES
5.1 State and Local Agencies
Definition: These are bonds, notes, warrants or other evidences of indebtedness of any local or State agency, including as City’s own bonds, within the State of California. This includes bonds payable solely out of the revenues from a revenue producing property owned, controlled or operated by the local or state agency, or by a department, board, agency, or authority of the local agency or State.
Legal Authority: Section 53601(a,c,d,e) of the California Government Code authorizes local and State agencies to purchase these bonds with no limitations as to the amount that can be owned.
5.2 U.S. Treasuries
Definition: These are instruments in which the full faith and credit of the United States Government is pledged. They are designated as Bills, Notes, or Bonds, depending on their maturity.
Legal Authority: Section 53601(b) of the Government Code authorizes local agencies to purchase U.S. Treasuries with no limitations as to the amount that can be owned of each.
5.3 Specified Bank Obligations
Definition: This category includes securities issued by federally owned or sponsored agencies that have the backing of the full faith and credit of the Federal Government. These securities are very liquid and marketable, and they offer a wide range of available maturities. Bank obligations in this category are limited to certain federally owned or sponsored agencies such as Banks for Cooperatives, Federal Land Banks, Feral Intermediate Credit Banks, and Federal Home Loan Banks. Also included are obligations, participations, or other instruments of, issued by, or fully guaranteed by the Federal National Mortgage Association, guaranteed portions of Small Business Administration notes, and obligations, participations, or other instruments of, or issued by, a Federal agency or a United States government-sponsored enterprise.
Legal Authority: Section 53601(f) of the Government Code allows public agencies to invest in obligations issued by banks for these federally sponsored agencies.
5.4 Bankers’ Acceptance
Definition: A Bankers’ Acceptance (BA) is a time draft drawn on and accepted by a bank for payment of the shipment or storage of merchandise. The initial obligation of payment rests with the drawer, but the bank substitutes its credit standing for that of the borrower and assumes the obligation to pay face value at maturity.
Legal Authority: Section 53601(g) limits investments in this category to those Bankers’ Acceptances that are eligible for purchase by the Federal Reserve System and not exceeding 180 days’ maturity. In addition, no more than 40% of the City’s surplus funds may be invested in BA’s, and no more than 30% may be invested in any one bank.
5.5 Commercial Paper
Definition: Commercial paper consists of promissory notes of large business concerns of high credit standing, usually maturing in four to six months. These Corporate IOU’s are bought and sold in the open market. Large companies raise short-term capital needs with this type of instrument.
Legal Authority: Section 53601(H) of the Government Code allows public agencies to invest in only “prime” quality Commercial Paper issued with the highest rating provided by Moody’s Investors’ Service, Inc. or Standard and Poor’s Corporation. Eligible paper is further limited to issuing corporations: (1) organized and operating within the United States, (2) having total assets in excess of $500 million dollars and (3) having an “A” or its equivalent or higher rating for the issuer’s debt, other than commercial paper, if any, as provided for by Moody’s or Standard and Poor’s. Commercial Paper may not exceed 270 days maturity and must not represent more than 10% of the outstanding paper of the issuing corporation. In addition, the amount invested in this type of instrument cannot exceed 25% of the total funds available to the City.
5.6 Negotiable Certificates of Deposit
Definition: A CD is a negotiable instrument evidencing a time deposit with a bank at a fixed rate of interest for a fixed period. CD’s of this type are not collateralized and should be considered an unsecured deposit.
Legal Authority: Section 53601(i) of the Government Code allows public agencies to invest a maximum of 30% of surplus funds in the CD’s of State or Federal associations, credit unions or State licensed foreign banks. Section 53601(i) also stipulates that these investments are not allowed if anyone on the legislative body, its officers or staff with oversight or signing authority also serves on its board of directors or a committee of the credit union. Section 53638 stipulates that negotiable CD’s may not exceed the shareholder’s equity of the bank, and that the amount of CD’s purchased from a State or Federal association may not exceed the total of the net worth of that association unless the purchase amount is less than $500,000 and the deposits are insured or secured as required by law.
5.7 Repurchase Agreements
Definition: A Repurchased Agreement (Repo) involves tow simultaneous transactions. One transaction involves the sale of securities (collateral) by a borrower of funds, typically a bank or broker/dealer in governments or agencies, to a lender of funds. The lender can be any investor with cash to invest. The second transaction is the commitment by the borrower to repurchase the securities at the same price plus a predetermined amount of interest on an agreed future date.
Legal Authority: Section 53601(j) of the Government Code permits Repos in any security that is allowed for purchase as defined in that same section of the Code and for a term of one year or less. It also places restrictions on the transactions. The value of underlying securities must be at least 102% of the funds borrowed against those securities and transactions must be made only with primary dealers of the Federal Reserve Bank of New York. Subject to fluctuations in the market, if the value falls below 102%, the value must be brought back up by the next business day.
5.8 Medium Term Corporate or Bank Notes
Definition: A Medium Term Note is a promise to pay, issued by a corporation or a bank at a fixed interest rate for a fixed period of nine months to fifteen years. Most are unsecured, although some are collateralized or carry other credit enhancements such as letters of credit.
Legal Authority: Section 53601(k) of the Government Code allows public agencies to invest a maximum of 30% of surplus funds in Medium Term Notes for a maximum maturity of five years. The notes must be issued by an U.S. Corporation or by a depository institution licensed by the United States or any State. To minimize risk, the notes must be rated in a rating category of “A” or its equivalent or better by a nationally recognized rating service, like Moody’s Investors’ Service, Inc. or Standard and Poor’s Corporation.
5.9 Designated Mutual Funds
Definition: These are companies that are defined under IRS Code 26 U.S.C. 851, which are typically mutual funds that make diversified investments for their shareholders.
Legal Authority: Section 53601(l) of the Government Code authorizes investments in mutual funds as long as mutual companies are investing only in those securities and obligations otherwise authorized for direct investment by public agencies. Additionally, these companies must have attained the highest rating provided by at least two of the three largest nationally recognized rating services or have an investment advisor registered with the SEC with assets under management in excess of $500 million and with at least five (5) years’ experience investing in statutorily permitted securities. Investments in this category are also limited to 20% of total funds available, and no more than 10% of the funds may be invested in shares of beneficial interest of any one mutual fund.
5.10 Non-negotiable Certificates of Deposit (CD)
Definition: A Non-negotiable CD is an instrument evidencing a deposit with a financial institution for a fixed period of time and normally for a fixed rate of interest. They can be collateralized with securities or mortgages or, if issued in denominations of $100,000 or less, they can be insured by the Federal Deposit Insurance Corporation if issued by a bank, or the Federal Savings and Loan Insurance Corporation if issued by a savings and loan association.
Legal Authority: Section 53601(n) of the Government Code allows public agencies to invest in Non-negotiable CD’s of banks or savings and loan associations with no limitations.
5.11 Mortgage Backed Securities
Definition: Mortgage Backed Securities are issued by U.S. Government agencies and are collateralized by home loans that create mortgage pools which are purchased and serve as payment pass-through obligations.
Legal Authority: Section 53601(o) of the Government Code allows public agencies to invest in mortgage pass-through and mortgage-backed securities rated in a rating category of “AA” or its equivalent or better by a nationally recognized rating service. Purchases of these securities may not exceed 20% of the District’s surplus money that may be invested, and the term may not exceed five years.
5.12 Local Agency Investment Fund (LAIF)
Definition: The Local Agency Investment Fund (LAIF) is a special fund in the State of California Treasury created by law. The law permits local government agencies (cities, counties, and special districts) to pool idle monies in this fund and utilize the trained personnel in the State Treasurer’s Office for its investment.

(3) Reverse repurchase agreements or securities lending agreements may be utilized only when all of the following conditions are met:
