Sorry for the late response. Softball is requesting the field from 3:30-5:30 Monday-Friday. And then any games that we have scheduled. I know its a "big ask." Please let me know your thoughts and if we should move forward with presenting this to the board. Also, I will reach out to Louie and see if we can work things out.
Thanks,

Hi Stacey - We can put this on the February agenda to discuss. What times and days of the week are you anticipating that the school will need priority? I don't think the council will support removing it from use by the Little League all together, so I would need some sort of schedule to present.
Kathy - Please add this topic to the agenda for February for Discussion and Possible Action.
Thanks, Sarah

Good morning Sarah.

I am reaching out to you to see if there is a way that Loyatlon High School can enter into an MOU for field 1 during softball season. I know that in the past little league and softball have worked around each other's schedules, but our coaches are asking that softball have priority use on field 1. Sierra County Office of Education is willing to explore entering into an MOU with the City of Loyalton regarding this matter.
Please let me know if you think this is a possibility.
Thanks,

Re: Issues for an Agenda Item at 2/21/23 City Council Meeting:
a. City Ownership ofAlley between Main Street & Third Street b. Public Nuisance: Hazardous Trees in Alley - Request for City to Prune/frim/Remove trees
Dear Loyalton City Council Members:
Please be advised that I represent Elizabeth and Ronald Morgan owners ofthe real property at 509/511 Main Street in Loyalton. As you are aware, their property is adjacent to a 20 foot strip of land that appears on the Old Town Map ofLoyalton dated February 8, 1926. On that map said alley is "unowned" the same as the streets and other alleys on neighboring blocks. Note also that the Sierra County Assessor's Map Bk. 17 dated 1958 shows the existence of not only the alley adjacent to the Morgan's property but additionally an alley at a right angle to the original alley going to Third Street.
We submit that the alley is owned by the City ofLoyalton. California Civil Code, Section 669 (copy attached) states:
All property has an owner, whether that owner is the State, and the property public, or the owner an individual, and the property private ..." Since there is no evidence ofprivate ownership in the public record at the Sierra County Recorder's Office or in the Sierra County Assessor's Office, it has to have an owner, and that owner is the "property public" and because it is within the City Limits ofthe City of Loyalton, the "property public'' owner is in fact the City ofLoyalton.
It has been suggested that my clients use have acquired the alley by adverse possession through their use ofthe alley. This was the position communicated to my clients by Gina-Marie Morris by email on January 4, 2023, where she stated that "those surrounding the area whom have encroached upon it have thus assumed ownership ofit." She is incorrect. California Civil Code, Section 1007 (copy attached) states in part:
February 13, 2023
City Council, City ofLoyalton
"...but no possession by any person ...no matter how long continued of any land...owned by...any public entity, shall ever ripen into any title, interest or right against the owner thereof."
In brief, the use and enjoyment ofthe publicly owned alley by the adjacent private property owners does not result in their having acquired ownership ofsaid alley. Stated differently, public property is immune from adverse possession actions.
Three large, old trees grow in the subject alley. They haven't been groomed or pruned for years. We submit that they are a public nuisance in that recently in a storm a large branch fell on the roof of a nearby private residence causing damage. My clients are concerned because some ofthe large tree branches hang over their roof. Photos ofthe trees in question are also attached for your quick reference.
California Civil Code, Section 833 (copy attached) states as follows:
"Trees whose trunks stand wholly upon the land of one owner belong exclusively to him, although their roots grow into the land of another." Consequently, it is the City ofLoyalton's responsibility as the owner ofthis public land to maintain the trees in said alley as they have become a hazard and are a public nuisance and pose a liability to the City ofLoyalton.
In conclusion we urge the City ofLoyalton to prune, trim or remove the trees from the alley, as the trees do in fact pose a clear and present danger to the adjacent private properties and also to those individuals who use this public property.
Please add this request as an action item to your February 21, 2023 City Council Meeting Agenda. Please confirm by email to the undersigned. Time is ofthe essence: not only are the risks real, but the optimum time period for tree work is at this time ofthe year.
We look forward to your prompt response and action.
Sincerely,
Ingrid Larson
