SUBJECT: Nuisance Referral - APN # 017-022-008-000 & 017-022-003-000 215 Church Street & 11 Zollinger Street.
OWNER: EBERHART JOHN F
Mailing Address: PO BOX 1106, LOYALTON CA 96118
Sierra County Environmental Health has become aware of a significant public health nuisance concern within the City of Loyalton located near the intersection of Church Street and Zollinger Street. The property consists of two (2) parcels located at 215 Church Street and 11 Zollinger Street.
According to the Sierra County Assessor's office, the property is owned by John F Eberhart.
The current conditions on the property are not only an esthetic nuisance, but a health and safety hazard. Attached are photos taken on 04/20/2026 from the adjacent streets showing the accumulation of vehicles, equipment, demolition debris, and other solid waste.
The issues of concern include:
• Potential rodent and pest infestations due to the presence of undisturbed vehicles and debris • Possible oil and fluid leaks from the vehicles, which may pose environmental hazards and contamination risks to soil and shallow groundwater
Increase fire risk, particularly during dry conditions, due to flammable materials and improper storage
General public safety concerns, including visual flight and potential hazards to nearby residents and passerby's
On April 30, 2026, I went to the Loyalton City Hall to ask how this property was zoned and was informed that it was "residential" zoning. I also asked if the Nuisance Ordinance has changed since that last referral that was sent to the City of Loyalton. I was notified that the Nuisance Ordinance has not changed. I alerted the staff that Environmental Health would be requesting the City of Loyalton to proceed with appropriate enforcement actions to abate this nuisance.
City of Loyalton Nuisance Referral - Eberhart APN # 017-022-008-000 & 017-022-003-000 Page 1 of 3 Since this property is zoned "residential", the accumulation of vehicles, equipment, and other solid waste debris indicates that this property is being used for vehicle storage, automotive junk yard, equipment yard, with evidence of operating a dismantling yard/salvage operations which is not consistent with residential zoning.
The accumulation of solid waste violates several sections of the California Code of Regulations (CCR) pertaining to the storage and removal of solid waste (see code sections below):
CCR, Title 14, Division 7, Sections 17311, 17312, & 1733/ Storage of Solid Wastes:
Section 17311. General.
The owner, operator and/or occupant of any premise, business establishment, industry, or other property, vacant or occupied, shall be responsible for the safe and sanitary storage of all solid waste accumulated on the property.
Section 17312. Storage.
In all cases in which garbage and rubbish are combined, the standards for garbage shall prevail. The property owner or occupant shall store solid waste on his premises or property or shall require it to be stored or handled in such a manner so as not to promote the propagation, harborage, or attraction of vectors, or the creation of nuisances.
Section 17331. Frequency of Refuse Removal.
The owner or tenant of any premises, business establishment or industry shall be responsible for the satisfactory removal of all refuse accumulated by him on his property or his premises. To prevent propagation, harborage, or attraction of flies, rodents or other vectors and the creation of nuisances, refuse, except for inert materials, shall not be allowed to remain on the premises for more than seven days, except when:
(a) disruptions due to strikes occur, or
(b) severe weather conditions or "Acts of God" make collection impossible using normal collection equipment, or
(c) official holidays interrupt the normal seven-day collection cycle in which collection may be postponed until the next working day. Where it is deemed necessary by the local health officer because of the propagation of vectors and for the protection of public health, more frequent removal of refuse shall be required.
Furthermore, the accumulation of solid waste on the property could be considered a public nuisance per Section 373a (California Penal Code):
CA Penal Code Section 373a
Every person who maintains, permits, or allows a public nuisance to exist upon his or her property or premises, and every person occupying or leasing the property or premises of another who maintains. permits or allows a public nuisance to exist thereon, after reasonable notice in writing from a health officer or district attorney or city attorney or prosecuting attorney to remove, discontinue or abate the same has been served upon such person, is guilty of a misdemeanor, and shall be punished accordingly; and the existence of such nuisance for each and every day after the service of such City of Loyalton Nuisance Referral - Eberhart APN # 017-022-008-000 & 017-022-003-000 Page 2 of 3 notice shall be deemed a separate and distinct offense, and it is hereby made the duty of the district attorney, or the city attorney of any city the charter of which imposes the duty upon the city attorney to prosecute state misdemeanors, to prosecute all persons guilty of violating this section by continuous prosecutions until the nuisance is abated and removed.
In addition, The City of Loyalton previously adopted Ordinance 403 adding Chapter 6.32 (Nuisances) to the Loyalton City Municipal Code. This Ordinance provides the City of Loyalton with additional tools to abate a nuisance within the City of Loyalton. (Attached is a copy of this ordinance) In conclusion, the Health Department requests that the City of Loyalton take appropriate measures to ensure that this nuisance be abated, and the accumulation of solid waste/debris removed from the property and properly disposed of.
Please contact Sierra County Environmental Health at [email protected] or by phone at (530) 993-6716 if you have any questions.

The amount of the cost for abatement of a nuisance upon any lot or parcel of land brought pursuant to a civil action under Section 6.32.120 or under any other statutory authority, rule or regulation shall be determined pursuant to the provisions of this Chapter. An itemized report of such cost, including any incidental expense, shall be submitted to the City Council for hearing and confirmation pursuant to the procedures set forth in Section
6.32.110.
B. The amount of the costs for abatement of such nuisance upon any lot or parcel of land, including incidental expenses as confirmed by the City Council following the procedure set forth in Section 6.32.110, shall, at the election of the City Council, constitute a special assessment against the respective lot or parcel of land to which it relates, and after it records, as thus made and confirmed, shall constitute a lien on the property in the amount of such assessment. After the confirmation of the report, a copy thereof shall be transmitted to the assessor and tax collector for the City, whereupon it shall be the duty of the assessor and tax collector to add the amounts of such assessment or assessments to the next regular bill of taxes levied against and respective lots and parcels of land for municipal purposes, and thereafter the amounts shall be collected at the same time and in the same manner as ordinary municipal taxes are collected and shall be submitted to the same penalties and the same procedure under foreclosure and sale in case of delinquency as provided for ordinary municipal taxes.
6.32.140 Nuisance Abatement Lien - Notice and Recordation A. As an alternative to the procedures set forth in Section 6.32.110, or any other procedure available by law for recovery of abatement costs, the amount of the cost for abatement of such public nuisance upon any lot or parcel of land, including incidental expenses as confirmed by the City Council, may, at the election of the City Council, be recorded in the office of the Sierra County Recorder as a nuisance abatement lien in accordance with Government Code sections 38773 and 38773.1. Such nuisance abatement lien shall be a lien on the property on which it is maintained and a personal obligation against the property owner, and from the date of recording shall have the force, effect and priority of a judgment lien.
B. At least ten (10) days prior to recordation of a nuisance abatement lien pursuant to this Section, notice of intent to record such lien shall be given to the owner of record of the parcel of land on which the nuisance is maintained based on the last equalized assessment roll or the supplemental roll, whichever is more current. The notice shall be served in the same manner as a summons in a civil action in accordance with Article 3 (commencing with Section 415.10) of Chapter 4 of Title 5 of Part 2 of the Code of Civil Procedure. If the owner of record, after diligent search, cannot be found, the notice may be served by post in a copy thereof in a conspicuous place upon the property for a period of ten (10) days and publication thereof for a period of ten (10) days in a newspaper of general circulation published in the county in which the property is located pursuant to Government Code Section 6062.
C. A nuisance abatement lien and the notice required by this Section, shall specify the amount of the lien, the name of the city, the date of the abatement order, the street address, legal description and assessor's parcel number of the parcel on which the lien is imposed, and the name and address of the recorded owner of the parcel.
6.32.150 - 6.32.190
6.32.150 Foreclosure and Discharge of Nuisance Abatement Lien A nuisance abatement lien authorized by Section 6.32.140 may be foreclosed by a civil action brought by the City for a money judgement. In addition to recovering the amount of its lien in such foreclosure action, the City may recover from the property owner any costs incurred regarding the processing and recording of the lien and providing notice to the property owner, as well as all interest, attorney's fees and litigation expenses permitted by law.
B. In the event that the lien is discharged, released or satisfied, either through payment or foreclosure, notice of the discharge containing the information specified in Section
6.32.140B shall be recorded with the Sierra County Recorder's Office by the City Clerk.
6.32.160 Second or Subsequent Judgement - Abatement of Nuisance - Treble Damages Upon entry of a second or subsequent civil or criminal judgment within a two year period finding that an owner of property is responsible for a condition that may be abated in accordance with an ordinance enacted pursuant to Government Code Section 38773.5, except for conditions abated pursuant to Health and Safety Code Section 17980, the City attorney is authorized to request the court to order the owner to pay treble the costs of the abatement, including incidental costs.
6.32.180 Violations
A. Any person who maintains any public nuisance as defined in this chapter, or who violates or fails to comply with an order of abatement made pursuant to Section 6.32.070 or
6.32.090, is guilty of a misdemeanor or infraction as provided in Section 1.20.010.
B. No person shall obstruct, impede or interfere with any representative of the City or with any owner; as defined in this chapter, of a property which has been ordered vacated, repaired, rehabilitated, demolished or removed, whenever such representative of the City or owner is engaged in vacating, repairing, rehabilitating or demolishing and removing any such building or premises pursuant to the provisions of this chapter, or in performing any necessary act preliminary or incidental to such work as authorized or directed pursuant to his chapter.
6.32.190 Limitation of Filing Judicial Action
An owner or other person who has an interest in the property aggrieved at any proceeding taken on appeal by the City Council in affirming, reversing or modifying in whole or in part either the order finding and ordering the abatement of a public nuisance or the order determining the cost of such abatement must bring judicial action to contest such decision within thirty (30) days after the date of such decision by the City Council. Otherwise, all objections to such decision shall be deemed waived.

RESOLUTION NO. 2-2026
RESOLUTION ADOPTING A LIST OF PROJECTS FOR FISCAL YEAR 2026-2027 FUNDED BY SB 1: THE ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017
WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 in order to address the significant multi-modal transportation funding shortfalls statewide; and WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of The City of Loyalton are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year; and WHEREAS, the City of Loyalton must adopt by resolution a list of all projects proposals to receive funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, which must include a description and the location of each proposed project, a proposed schedule for the project's completion, and the estimated useful life of the improvement; and WHEREAS, the City of Loyalton will receive an estimated $ 46,677 in RMRA funding in Fiscal Year 2026-2027 from SB 1; and
WHEREAS, this is the eighth year in which the City of Loyalton is receiving funding and will enable the City of Loyalton to continue essential road and maintenance and rehabilitation projects, safety improvements, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB 1: and
WHEREAS, the City of Loyalton has undergone a robust public process to ensure public input into our community's transportation priorities/the project list; and WHEREAS, the City of Loyalton used a Pavement Management System to develop the SB 1 project list to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the communities priorities for transportation investment; and WHEREAS, the funding from SB 1 will help the City of Loyalton maintain and rehabilitate streets/roads, add active transportation infrastructure throughout the City of Loyalton this year and hundreds of similar projects into the future; and
WHEREAS, the 2023 California Statewide Local Streets and Roads Needs Assessment found that the City of Loyalton streets and roads are in an "at risk/poor condition and this revenue will help us increase the overall quality of our road system and over the next decade will bring our streets and roads into a "better" condition; and
WHEREAS, without revenue from SB 1, the City of Loyalton, would have otherwise been canceling projects throughout the community and/or laying off city staff; and WHEREAS, if the Legislature and Governor failed to act, city streets and county roads would have continued to deteriorate, having many and varied negative impacts on our community; and WHEREAS, modernizing the local street and road system provides well-paying construction jobs and boosts local economies; and
WHEREAS, police, fire, and emergency medical services all need safe reliable roads to react quickly to emergency calls and a few minutes of delay can be a matter of life and death; and WHEREAS maintaining and preserving the local street and road system in good condition will improve bicycle safety, and make the pedestrian experience safer and more appealing and WHEREAS, restoring roads before they fail also reduces construction time which results in less air pollution from heavy equipment and less water pollution from site run-off; and WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, investing in complete streets infrastructure, and using cutting-edge technology, materials and practices, will have significant positive co-benefits statewide.
NOW, THEREFORE IT IS HEREBY RESOLVED, ORDERED AND FOUND by the Loyalton City Council, County of Sierra, State of California, as follows:
