SUBJECT:

TRAFFIC SIGNAL AT IMPERIAL HIGHWAY AND RUTH AVENUE
Recommendation:

Staff recommends that the City Council adopt the attached resolution entitled: “

A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF LYNWOOD APPROVING

THE APPROPRATION FROM ARPA FUND
(FUND 1055) IN THE AMOUNT OF $1,001,350 FOR THE INSTALLATION OF A NEW TRAFFIC SIGNAL

AT THE INTERSECTION OF IMPERIAL HIGHWAY AND RUTH AVENUE .”

Background:

Willdan Engineering prepared a traffic signal warrant analysis for the intersection of Imperial Highway and Ruth Avenue. In conformance to the California Manual on Uniform Traffic Control Devices, the analysis looked into the current traffic conditions at the intersection of Imperial Highway and Ruth Avenue and determined whether a traffic signal is justified at that intersection.

Discussion and Analysis:

The intersection of Imperial Highway and Ruth Avenue is a T-intersection that is currently stop controlled on the North (Southbound) approach on Ruth Avenue. Imperial Highway runs east-west, while Ruth Avenue runs north- south. (Attachment A)
Imperial Highway is a 72-foot-wide arterial roadway with two lanes in each direction and a left turn lane running through the intersection. On-street parking is permitted on both sides of the roadway except where there is painted red curb. The posted speed limit is 40 miles per hour (mph). There is a yellow-painted diagonal school crosswalk across Imperial Highway at the East side of the intersection. Additionally, from the Westbound approach (East side), there is an overhead flashing beacon alerting motorists to the school crossing.

California Department of Transportation (Caltrans) has issued the California Manual on Uniform Traffic Control Devices (CA MUTCD). The CA MUTCD provides uniform standards and specifications for all official traffic control devices in California. Applying the standards set forth under the CA MUTCD, Willdan Engineering City Council Regular Meeting - Page 233 of 271
recommends the installation of a traffic signal based on the Peak Hour Volume Warrant and the Crash Experience traffic warrant.

Project Scope: Design and installation of a traffic signal.

Project Location: Intersection of Imperial Highway and Ruth Avenue

Fiscal Impact:

Staff estimates the Project cost at $1,001,350. The following table shows the Project cost breakdown:

INITIAL REVIEW OF AN EMERGENCY ACTION AT WELL NO. 19
Recommendation:

Staff recommends for the City Council to adopt the attached resolution entitled: “

A RESOLUTION OF THE

CITY COUNCIL OF THE CITY OF LYNWOOD DELEGATING TO THE CITY MANAGER OR HIS OR HER

ENGINEER THE AUTHORITY TO ORDER ANY ACTION SPECIFIED UNDER CALIFORNIA PUBLIC CONTRACT CODE SECTION 22050(a)(1) PURSUANT TO SECTION

AND APPROVING THE
APPROPRIATION OF $440,694 FROM THE 2020 LUA ENTERPRISE REVENUE BOND (6305) TO THE WELL 19 EMERGENCY REHABILITATION PROJECT.”

Background:

Well No. 19 produces 2,054 acre-feet of water per year. This represents almost half of the City’s entire water system.

Having Well No. 19 offline requires the City to import water from Metropolitan Water District at a rate of $1,185 per
acre
-
foot.

Staff has observed that Well 19 started producing an overwhelming amount of sand during normal pumping. Staff flushed the sand separator to remove the fine silt and sand from the system; however, after running the pump to waste, the fine silt and sand did not clear. The well was taken off-line in mid-December 2021 to mitigate water quality issues.

Staff requested services from three companies to perform initial investigation and provide a report. Weber Water Resources, Inc. (Weber) was the only contractor that responded. Weber was available to start immediately. Weber pulled the pump and investigated the pumping equipment. Additional assessment work is needed to ascertain cause of the problem.

Discussion and Analysis:

City Council Regular Meeting - Page 239 of 271
Emergency Work Performed

Weber contracted to pull the well pumping equipment, tear down, and inspect the equipment. In December 2021, the well equipment was removed. The first video was performed in January 2022. Unfortunately, there was limited visibility, and the perforations where water extracted were not visible. A decision was made to remove approximately 203 feet of fill, clean the casing and retake the video to further analyze the well casing condition.

Weber completed 720 feet of airlift installation and pumped out the fill, which was fine silt and sand that had intruded the system and caused water quality issues. After removing the fill completed, they bailed the casing and performed another video to further investigate issues that led to the sand intrusion into the system.

The second video showed a total of seven (7) holes and a large obstruction or calcified growth protruding from the well at and around 840’, scale and bio growth was evident throughout the well. A Gyroscope Survey was requested to test the integrity and thickness of the casing which showed no serious materials deterioration.

The total work performed by Weber on an emergency basis was $76,849.

Additional Emergency Work

Staff has a better understanding of the required rehabilitation. Staff proposes the following scope of work: to backfill the well with
850 feet of approved gravel, brush the casing with Sterilene to remove the bio-fouling, patch the seven (7) holes in the well casing, change the pump from oil to water lubrication for water quality, and disinfect the well to complete the rehabilitation. Staff also recommends to perform optional zone sampling to provide a profile of the water quality to determine where the manganese issue is to isolate that zone and improve water quality since the well is already off-line. The recommended emergency work, which includes the zone sampling, will cost $320,180.

Findings of an Emergency Action

Emergency action is needed to place Well No. 19 back into production. Well No. 19 is under a waiver to run due to the manganese levels when the well first starts. It is run to waste to remove the manganese and to ensure that the manganese levels do not continue to be an issue. If the well is turned off for any length of time, a start-up protocol must be followed which leads to operational and maintenance long term costs. Also, given the uncertainty of supplies, and the need to have reliable water system, it is necessary to have Well No. 19 back into production.

Staff recommends that Weber complete the rehabilitation of Well No. 19 due to the poor water quality, the impending increase in demand during the warmer months and the operational benefit of eliminating the manganese zone with well profiling.

Background:

O
n March 1, 2022, the City Council by minute action approved the recommended repairs at the Natatorium, the City’s pool. The Acting City Engineer recommended immediate repairs of the patio wall, pool deck floor, electrical and interior wall to the City Manager. Upon that recommendation and authority delegated by the City Council to the City Manager, the City Manager has ordered certain emergency repairs at the Natatorium.

Appropriation is needed for Finance Department to appropriate the funds and establish a capital improvement project for the repairs.

Discussion and Analysis:

The Natatorium houses the City’s pool. It is located at 3770 Martin Luther King Boulevard in Lynwood. On March 1, 2022, the City Council approved certain repairs at the Natatorium for the safe use of the public as well as approved a $5,000,000 budget for these repairs. Repairs include the following:

Findings of Emergency Actions

The patio wall shows major signs of compromised structural deficiencies. The pool deck is detaching and cracking throughout the surface of the pool deck. The electrical system is outdated that if not replaced could result in electrical shorts and possible fire. The pool wall require replacement to avoid collapse. Based on these findings, the Acting City Engineer recommended immediate repairs. On the Acting City Engineer’s recommendation, the City Manager approved the emergency actions waiving the informal competitive bidding requirements.

Authority to Act in an Event of an Emergency:

Pursuant to Section 22050(a)(1) of the California Public Contract Code, a public agency, pursuant to a four-fifths vote of its governing body may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services and supplies for those purposes, without giving notice for bids to let contracts.

Honorable Mayor and Members of the City Council

APPROVED BY:

Ernie Hernandez, City Manager

PREPARED BY:

Ernie Hernandez, City Manager

SUBJECT:

APPROVE RECOMMENDATION OF A BOND UNDERWRITING FIRM AUTHORIZE

STAFF TO PROCEED WITH THE PROCESS TO REFINANCE THE CITY'S

PENSION DEBT
Recommendation:

Staff recommends that the City Council of the City (the “City Council”) approve the recommendation to work with Cabrera Capital Markets, LLC as the City's Bond Underwriter to proceed with structuring a proposed refinancing of the City's Pension Debt.

Background:

The City has a large Unfunded Accrued Liability (the "Pension Debt") with the California Public Employees' Retirement System ("CalPERS") of approximately $43.1 million. City Staff is exploring opportunities to refinance this debt and working with an underwriter would better enable the City to evaluate the options that may be available to reduce the City's pension costs. With the assistance of the City's Municipal Advisor, Kosmont Transactions Services, Inc. ("KTS"), the City issued a Request for Qualifications. Based on review of the Statements of Qualifications received, Staff is recommending that the City engage [Cabrera Capital Markets, LLC] as the City's Bond Underwriter for this potential financing.

Discussion and Analysis:

The City Council adopted a retirement plan pursuant to the Public Employees’ Retirement Law, commencing with Section 20000 of the Government Code of the State of California, as amended (the “Retirement Law”). The Retirement Law obligates the City to (1) make annual contributions to the System, to fund pension benefits for its employees, (2) amortize the unfunded accrued actuarial liability with respect to such pension benefits, and (3) appropriate funds for the purposes described in (1) and (2). The City is obligated to make certain payments to the System in respect of the Pension Debt under the Retirement Law and the System Contract.

CalPERS currently charges the City 7% interest to amortize its $43.1 million Pension Debt. Because current City Council Regular Meeting - Page 254 of 271
interest rates in the taxable municipal bond market are substantially lower than the 7%, the City has an opportunity to refinance the Pension Debt at a much lower interest rate and recognize substantial pension cost reductions, potentially saving the City as much as $9.6 million, depending on various factors, including the repayment structure ultimately chosen and prevailing interest rates at the time of a sale of securities.

To determine if the City should move forward with issuing its own securities to refinance the Pension Debt, a Bond Underwriting firm is needed to assist with the preparation of various analyses to determine the best approach to consider. Two (2) firms responded to the City's Request for Qualifications: Cabrera Capital Markets, LLC ("Cabrera") and Raymond James and Associates, Inc. ("RJ") Each firm is well qualified to work with the City, and each firm possesses certain differing attributes. Cabrera is a regional firm that was instrumental in issuing some of the very first Pension Debt refinancing when the markets first became favorable for this type of approach back in 2017. RJ is a large national firm; their lead banker has worked on several of the City's past bond issues, most recently on the 2020 Taxable lease revenue bonds that were issued to provide "working capital" to the City's general fund. Given Staff's direct experience with, and knowledge of each of these firms, Staff has concluded that Cabrera is the preferred firm to work with the City on this specific bond issue to refinance the City's Pension debt and recommends that the Council select Cabrera as the Bond Underwriter for this financing.

Tonight, Staff is seeking authorization from Council to work with the Cabrera and to proceed with developing a bond transaction. Council is not currently authorizing the issuance of any securities or obligating the City to incur any expenses at this point. If authorized to proceed tonight, an action item to authorize the issuance of bonds to refinance the Pension Debt and various transaction documents will be brought back to the Council for its consideration in the near future.

Fiscal Impact:

There is no fiscal impact at this time, but current estimates show pension cost savings could be as great as $7.88 million if the City were to refinance this Pension Debt today.

AGENDA STAFF REPORT
DATE:

April 5, 2022

TO:

Honorable Mayor and Members of the City Council

APPROVED BY:

Ernie Hernandez, City Manager

PREPARED BY:

Ernie Hernandez, City Manager

SUBJECT:

CONSIDERATION OF AN ORDINANCE OF THE CITY OF LYNWOOD TO

ESTABLISH CONTRIBUTION LIMITS
Recommendation:

Staff recommends that the City Council consider the new ordinance and, if acceptable, introduce for first reading, waive full reading, read by title only, an Ordinance entitled: “AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ESTABLISHING CAMPAIGN CONTRIBUTION LIMITS”, and direct staff to bring back for second reading and adoption at the next regularly scheduled City Council Meeting.

Background:

The Political Reform Act of 1974 prohibits a person from making campaign contributions to a candidate for elective state office and prohibits those candidates from accepting a contribution totaling more than a specified amount per election. Formerly, state law authorized a county, city, or district to limit campaign contributions in local elections. In 2019, a bill was introduced which took effect on January 1, 2021, that would add contributions candidates to county or city office to the list of those limited by these campaign contribution restrictions.

This bill is known as AB 571. This action by the state Legislature amended, repealed, and added sections of state law, including sections of the Elections Code and the Government Code. It provided FPPC the authority to adjust the amounts as needed pursuant to Government Code Section 85301 and 83124. However, the bill provided that a local government could impose a limitation that is different from the limitation imposed by the bill pursuant to Government Code Section 85702.5 and a resolution or ordinance passed by the local government.

This has created a choice for local governments, either elect to use the default campaign contributions as set by the FPPC under AB 571 or pass an ordinance controlling campaign contributions at the local level.

The FPPC has currently imposed a campaign contribution limit for most state elected officials of $4,900 per election. This amount is the same for local elected officials, including Lynwood elected officials and candidates for elected office. It is the purpose and the intent of this ordinance to establish an orderly political forum in which individuals and groups may express themselves effectively within the City of Lynwood. To do this, the ordinance will establish a campaign contribution limit of $3,000 per calendar year for candidates for elected office and controlled committees of that candidate.

City Council Regular Meeting - Page 256 of 271

Discussion and Analysis:

Assembly Bill No. 571 (“AB 571) imposes a default campaign contribution limit upon cities and counties without campaign contribution limits. The default contribution limit amount is set at the same amount as the limit for State elected officials, subject to adjustment by the Fair Political Practices Commission (“FPPC”). The default limit is $4,900 per person or entity.

Government Code Section 85702.5 permits the City to establish its own campaign contribution limits that are different from what is established by Government Code Sections 85301 and 83124, and the FPPC. Currently, the FPPC has imposed a campaign contribution limit for State elected officials of $4,900 per election. To recognize the unique aspects of the City, the City Council desires to establish a campaign contribution limit different from that imposed by the FPPC.

It is the purpose and the intent of the City Council through this Ordinance is to establish an orderly political forum in which individuals and groups may express themselves effectively; to place realistic and enforceable limits on the amounts of money that may be contributed to political campaigns for City offices; to provide a full and fair playing field for incumbents and new candidates seeking to be elected to City Council and to provide for the full and fair enforcement of all the provisions of this Ordinance.

To do this, the ordinance will establish a campaign contribution limit of $3,000 per calendar year for candidates for elected office and controlled committees of that candidate.

The council may adopt a policy of progressive remedies starting with warnings and increasing to more serious penalties to deter or prevent future violations.

e. Code Of Ethics: The following principles shall constitute the Lynwoo d code of ethics, applicable to all members of the city council and the city’s commissions, boards and committees:

1. Act In The Public Interest: Recognizing that stewardship of the public interest must be their primary concern, members will work for t he common good of the people of Lynwood and not for any private or personal interest, and they will assure fair and equal treatment of all persons, claims and transactions coming before the Lynwood city council, commissions, boards and committees.
