CITY COUNCIL ORAL AND WRITTEN COMMUNICATION

Council Member Munoz-Guevara stated he wanted to start his comments with some incredibly awesome positive news by acknowledging Lynwood High School Basketball Team won the CIF State Championship and remarked that Jason Crowe Junior is the best freshman in the country. He mentioned he has heard rumors that Jason is signing a commitment to his alma mater, UCLA. He expressed his excitement of being able to join the team at their last game at Lynwood High but said unfortunately he was not able attend the victory game in Sacramento.

Council Member Munoz-Guevara pointed out that he has been bringing up the issue of renter protections at every single meeting since being voted into office. He indicated that being on the dais really is not about him but about the needs of the residents in the community and the issues that matter to them . He said that many folks are very, very anxious about housing. He commented that he works for a labor union in his day job and noted that unions historically have focused on wa ges and economics; however, he confirmed that housing is the second biggest issue for their members. He stated that it is important to consider the issue at this time due to the circumstances that many folks are living in . He expressed that he empathizes with the situation as he gets each side of the issue and has engaged in conversation with both the landlords and renters. He observed that many of the wealthy west side cities such as Santa Monica and West Hollywood together with some of our southeast neighbors, Bell Gardens, Cudahy, Maywood and the City of Los Angeles have enacted protections and so these cities are not under fire.

Council Member Munoz-Guevara revealed that he was invited by some of our housing groups to visit several of the apartments in our city and disclosed that what he City Council Regular Meeting - Page 35 of 107
8 witnessed in some of these apartments is just really heartbreaking . He described a conversation he had with a renter who is 78 years old that is taking care of his 98-year- old mother as they both survive on social security benefits. He ascertained that these folks are getting a rate increase effective April 1st to $1,610 and this renter presented a paycheck stub from social security reflecting $1600 monthly benefit deposit. He indicated that the difficulty now is they have to tap into the mother's social security and try to figure out the rest . He stated it is becoming economically impossible for many of our residents to sustain their housing.

Council Member Munoz-Guevara said he had the opportunity to interact with school board member Gary Hardy to discuss issues that our schools are facing including student enrollment declining over the last five year period as it is pointed out our students are leaving our schools becaus e their families many times cannot afford to live here. He recognized that student displacement directly correlates to the issue of school funding in our community. He commented that many families are moving to the Antelope Valley, Victorville and other the high desert communities that are more affordable. He said staff in Supervisor Han's office and Board Supervisors are putting the burden on us , the small cities to take action after being under the County's protections for over three years.

Council Member Munoz-Guevara concluded his remarks by encouraging Council to be in dialogue and conversations for action on this important issue and to come up with legislation that reasonable and sensible to provide some protection to Lynwood’s residential renters.

Council Member Camacho expressed her enthusiasm for Lynwood High School boys’ basketball team winning the CIF State Championship and she noted that it was the boys’ basketball team’s first state championship win in the high school's history. She stated that t he girls’ basketball te am have brought home the state championship several times, but she indicated this is the first time state championship win for the boys’ basketball team. She acknowledged a remark from one of the commentators describing Lynwood as a small community; she spoke to this victorious occasion as it really brought the community together collectively with visual support from community leaders representing the school board members, the entire city council members and also included many alumni residents that were there. She remarked that she was proud to hear so many very nice comments about Lynwood made on TV.

Council Member Camacho extended thanks to city staff that has been handling the issues involving the large volume of rain we have been subjected to and expressed gratitude for their responses to the demanding work associated with all th e rain that we have been experiencing.

She concluded her comm ents by indicating she is looking forward to the women's event scheduled on Saturday to celebrate Women’s History Month and extended appreciation to staff for all their efforts in organizing the event.

City Council Regular Meeting - Page 36 of 107
9 Council Member Solache conveyed excitement as across the board and community wide for Lynwood High School boys’ b asketball team w inning the CIF State Championship. He shared an audio he received from a resident and stated it was very appropriate.

He continued to praise Lynwood High School as an amazing school, applauded Mayor Oscar Flores, Lynwood Superintendent Gudiel Crosthwaite, and especially praised Lynwood High School Principal Ana Gonzalez as the best principal in in public schools right now. He emphasized that her care for our students is outstandingly displayed as she provides exceptional encouragement in the roll of the head coach of the basketball team.

Council Member Solache pointed out Patty Rodriguez as a Lynwood alumni that obviously works for Kiss FM. He declared her a superstar because she ensured that not only was our team featured on Kiss FM Live with an outstanding interview, but Patty also invited our team to the C rypto Center. He encouraged the community to keep celebrating our students as they have earned their place and remarked that Jason Crowe Junior is a superstar. He stated that it is impressive that he is a freshman and scored 40 points during the game and the whole team did phenomenal . He remarked that Jason is definitely our next Kobe and suggested to invite the team here to acknowledge their celebration and provide some sort of community acknowledgement such as a parade or a trolley ride throughout the city.

Mayor Pro Tem Soto also congratulated our high scho ol basketball team on their victory and indicated that she would like to see an activity provided to celebrate our students. She remarked that they are doing their best for our community and we should recognize their amazing efforts that brought the championship to Lynwood.

She concluded her comments by addressing her concern regarding rent control and expressed that the current situation does break her heart. She indicated that as a community member she cares about everybody and noted the small land lords also need protection. She questioned how as council members can protect everybody not only one group.

Mayor Flores declared the Lynwood High School boys’ basketball team as amazing and he noted that the way the team carried themselves was outstanding. He supported the suggestion for a genuine celebration for what they accomplished as a team and applauded the awareness they generated for our city and small community.

Mayor Flores spoke to renter protections issue and noted that there are many concerns that need consideration at minimum. He stated he wants to hear from more folks on all sides. He requested that staff conduct a review or study of available protections that exist now as well as resources available. He noted that at the State level, there are resources and at the County level as well, however he indicated from what has been expressed today it appears that the County is just wiping their hands of renter protection issues. He stated that it is incumbent upon us to communicate wit h those City Council Regular Meeting - Page 37 of 107
10 agencies at the higher levels to inform them how important it is for their involvement and not just simply wipe their hands for us to decide on appropriate action at a local level.

Mayor Flores recognized the need to identify resources required to take care of our people at all levels. He remarked that suggestions to lower the percentage of rent increase brings into consideration of the rights of the landowner. He noted that any council action taken would affect them also. He requested staff to provide a list of details for council consideration. He mentioned that he is aware that either Baldwin Hills or Baldwin Park has a side-by-side list and he requested staff to look into what is available on their website . He felt this would help Council to initiate and continue relevant discussions locally as to how to address resources available to our city and our residents.

Mayor Flores stated he was not happy personally hearing supervisors just passing this issue down, but would rather prefer a collaboration with everybody and not just totally push it down because in the end there is the bigger problem. He mentioned that Senator Bernie Sanders talked about th is problem stemming from a bigger issue .

Mayor Flores noted that he spoke with the representative from SCIU and expressed the need to get together with the rest of the unions and actually talk together and go fight that big fight. He said he was sure that the unions are going to have cities behind them even if you want to go to the Federal level with this fight, just imagine us working together.

Mayor Flores indicated that during that meeting it rang a bell loud that the supervisors consider us as the little people, even those individuals on the dais. He said it is shameful and we need to address that. He noted a lot of this happens because of the vote with 15% of us that are registered come out to vote , but he noted this could be powerful too.

Mayor Flores concluded his comments stating he wants more information in order to be knowledgeable of what is available for the renter and the landlord whomever it may involve.

Council Member Munoz -Guevara request to make an additional comment that he forgot to include in his remarks. He expressed appreciation to have our City Clerk Ms.

Quinonez attending the meeting tonight as she has been recovering from an auto accident, and was out for a while. He conveyed everyone was glad to have her back in person.

City Clerk Quinonez thanked everyone for their kindness and she expressed she was grateful to be alive.

STAFF ORAL COMMENTS

City Manager Hernandez indicated that he spoke to the school superintendent about City Council Regular Meeting - Page 38 of 107
11 inviting the basketball team to one of the council meetings. He also said he was open to entertain concepts and ideas from city council as to what we can do to recognize the boys’ basketball team further.

City Manager Hernandez commented that he did listen to the board of supervisors ’ conversation regarding renter issues and noted that they punted when taking action to initiate the conversation . He remarked that this is a regional issue not just a local concern and commented that he has been involved in municipal government for some time but finds it fascinating how our cong ress folks, our assembly and our county supervisors miss the mark on regional and social issues . He observed that unfortunately local government does all the heavy lifting and 99% of what the residents really benefit from.

Director Flores made mention of a couple of quick community events for everyone's information. He begin with stating that t his Saturday is our Women's History Month Conference held at Bateman Hall. He noted that the starting check-in time is at 9:30 a.m. and the program will start at 10 a.m. He announced the event features a keynote speaker, Anna Flores, who is the founder and CEO of We All Grow Latina, the renowned network of digital influencers and creators . He highlighted that , a distinguished panel consisting of news anchor from T elemundo, Sandra O’Neill, business coach and lifestyle personality, Daniela, lean actor and TV, hostess, Nia Chama and AEG executive Jay Requinto. He said the program will also feature lunch giveaways, a women owned vendors market, and of course opening co mments from our own Mayor Pro Tem Soto and Council Member Camacho. He remarked that t he event VPS have been filled and they are expecting a great crowd on this Saturday.

His second point announced that our Dodgers Dream Team registrations are open and the program sells out quick; multiple divisions have alrea dy sold out because of the popularity of the program, He encouraged everyone to please save the date for spring program as council is invited for opening day on April 15th L ynwood City Park. He mentioned that we need volunteer coaches across all age d ivisions and noted that further details are available and to please contact the Recreation Department for more information.

Director Flores concluded his comments by encouraging the community to take advantage of our expanded program offerings especially over at the senior center as there are new field trips starting next month. He also noted a new senior yoga class and a new health and fit fitness class as well as many of the programs that our seniors love. He stated that all this information is available on the website or on our social media at Lynwood Parks.

Community Development Director Linares presented a quick slide update for project to inform Council that the 7-Eleven retail store gas station is opening as permits were issued. He said c onstruction is complete and a cert ificate of occupancy for the gas station/7-Eleven was released . He indicated that staff would be working with the City Council Regular Meeting - Page 39 of 107
12 mayor's calendar to schedule a ribbon cutting and that more information to come on the ground opening a ribbon cutting event or we will present a certificate to the owner.

He concluded his comments by mentioning an additional car wash was approved and is under construction along Atlantic and there will be more information provided in the near future.

ADJOURNMENT

Staff recommends that the City Council adopt the attached resolution entitled: “A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF LYNWOOD FOR THE REJECTION OF ALL BIDS FOR THE CITYWIDE SLURRY SEAL (PHASE 3) PROJECT FY 2022-2023”.

Background:

The City of Lynwood has implemented a citywide slurry seal program. The citywide slurry seal program is currently on Phase 3 of this four-phase program. Slurry seal projects are an important part of the city’s pavement management program. The treatment provides a new wearing surface of the road and protects it from sun and water damage. A slurry seal is a maintenance treatment that prolongs the life of asphalt at a fraction of the cost of full pavement (structural) repair.

The work encompassed by the Citywide Slurry Seal (Phase 3) FY 2022-2023 (“Project”) consists of, but is not limited to: pavement slurry seal, including pavement cold milling and overlay, and street pavement restriping at the following locations:

Discussion and Analysis:

On August 16, 2022, the Notice Inviting Bids (NIB) was advertised on the City’s web site (PlanetBids). The Bid opening took place in the PlanetBids platform on Wednesday, September 7, 2022, at 10:00 am.

The following four (4) bids were received:

Bidder Bid

1. Pavement Coatings Co. $745,859.30

2. VSS International, Inc. $770,120.00

3. Roy Allan Slurry Seal, Inc. $804,826.56

4. All American Asphalt $829,407.50

An analysis of all bidders was conducted, including a review of their bid schedule, license, references, and federal documents. Pavement Coatings Co. was the apparent lowest responsible bidder with a low base bid of $745,859.30.

The lowest base bid exceeded the engineer’s estimate and the City does not have the funding to start the project in FY 2022-2023. Due to insufficient funding for this project, Staff recommends that the City Council reject all bids received on September 7, 2022; and re-advertise and publish Notice of Inviting Bids in FY 2023-2024.

AGENDA STAFF REPORT
DATE: April 4, 2023

TO: Honorable Mayor and Members of the City Council

APPROVED BY : Ernie Hernandez, City Manager

PREPARED BY : Gabriel Linares, Director of Community Development

SUBJECT: COMMERCIAL FACADE GRANT PROGRAM UPDATE
Recommendation:

Staff recommends that the City Council:

Amend the guidelines for the Commercial Façade Program to increase the grant award between to $20,000- $25,000.

Background:

At its regular meeting of April 19, 2022, the Lynwood City Council approved Resolution No. 2022.065 appropriating $830,000 in ARPA funding for program implementation of a Commercial Façade Grant utilizing Coronavirus Local Recovery Funds awarded to the City of Lynwood under the American Rescue Plan Act of 2021 (ARPA).

Utilizing the $830,000 appropriated for Economic Development under the City’s adopted ARPA plan, staff proposed a Commercial Facade Grant Program to assist business property owners in the hardest hit commercial areas of the City. The goals of the program are:

Improve visual quality of the building façades
Enhance or restore buildings to create attraction for new businesses Restore economic vitality and investment confidence
Assist businesses negatively impacted by the COVID-19 pandemic Achieve a high standard of design for individual buildings Use of high quality materials and workmanship on building façades

The grant program established the Business Beautification/Façade Improvement Plan to issue grants of up to $12,000 ($10,000 for direct labor and $2,000 for soft costs) to approximately 69 businesses and to retain a service provider to assist in program promotion and implementation. The funds would support basic repairs, facade improvements and beautification of high-need commercial corridors in the city affected by COVID -19 closures and other safety or quality of life impacts. The amount of the initial individual grant was limited in order to provide the greatest flexibility.

Three specifically designated commercial area corridors were designated a high priority for the city and required community investment to support public safety and enhance the general customer experience. Qualifying property/business owners are those located within city limits on Imperial Highway, Atlantic Avenue, or Long Beach Boulevard and storefronts must be visual from the street along one of the identified business corridors.

Upon approval of the program, staff enlisted an outreach consultant, Mayra Berenice En Vivo, that provided canvasing of the designated corridors, conducted monthly workshops to explain the program and provide applications and application assistance. They also provided business resources such as financial seminars and business-to-business referrals. The outreach consultant conducted monthly workshops from August- January. On July 25, 2022, the City’s On-Call Consultant, Avant Garde, was brought in to administer the City’s Commercial Façade Program.

Discussion and Analysis:

At the regular Council Meeting of March 21, 2022, staff provided an update to the program. Since the last report an additional nine (9) applications have been received. Below is a summary of the applications:

sixty-nine (69) applications have been received.
fifteen (15) have been closed/deferred for causes such as ineligible locations, business types, or other reasons. thirty-four (29) are still in the review process.
twenty (25) businesses have qualified for approval. Twelve (12) businesses have reached the bidding process for their desired improvement requests. The remaining are in the work write up stage.

City Council Regular Meeting - Page 53 of 107

Due to increased costs of materials and labor, bids received for projects exceed the existing guideline of $10,000 for minor improvements. Staff reached out to applicants to determine if they can pay the difference exceeding the $10,000 grant amount. Businesses expressed that they do not have extra funds to pay for these improvements and is the primary reason why they applied for the grant. Below is a summary of the bids received:

To provide the City of Lynwood and its businesses with the beautification and relief the Commercial Façade Program has intended, it is recommended that the City Council increase the grant amount between to $20,000- $25,000. The increase would allow staff to move forward with the improvements for some of the applicants. Remaining projects that exceed the new grant amount would have to be rescoped and sent out for re-bid.

If the City Council increases the grant amount it will also require that the ARPA allocation is amended to accommodate funding for all the business that have been qualified in addition to the administration costs associated with the program. Based on Council’s direction, staff will bring back a separate item at a future meeting date to amend the ARPA budget to allocate the additional funds. It is also recommended that the City Council direct staff to not accept any further applications based on the current budget appropriation.

Fiscal Impact:

Additional restricted ARPA funds would need to be allocated for this program. There is no fiscal impact to the City’s General Fund. Based on Council’s direction, staff will bring back a separate item at a future meeting date to amend the ARPA budget to allocate the additional funds.

APPROVED BY : Ernie Hernandez, City Manager

PREPARED BY : Julian Lee, Director of Public Works

SUBJECT: APPROVAL OF THE LYNWOOD PARK MEGA PLAYGROUND PROJECT

CONCEPT AND AUTHORIZATION TO SOLICIT PROPOSALS
Recommendation:

Staff recommends that the City Council adopt the attached resolution entitled: “A RESOLUTION OF THE CITY

COUNCIL OF THE CITY OF LYNWOOD APPROVING THE LYNWOOD PARK MEGA PLAYGROUND PROJECT CONCEPT AND AUTHORIZATION TO SOLICIT PROPOSALS”

Background:

Staff is seeking approval of the “Space” concept for the Lynwood Park Mega Playground and authorization to solicit proposals from qualified architects/contractors for design-build work. The Mega Playground is one of many improvements the City of Lynwood is seeking to complete in order to enhance outdoor experiences for community residents. The playground theme is “Space” as a tribute to the original playground pictured in the proposed RFP attachment.

Discussion and Analysis:

The Lynwood Park Expansion Project (Project Number #68.132) was approved as part of the 5-Y ear Capital Improvement Project (CIP) plan and will split into three (3) Phases. Mega Playground Project or Phase 1 of the Lynwood Park Expansion Project includes a large, destination playground complex which would expand into most of the available space in the designated area. The playground will be separated into age-group play areas and will utilize “pour in place” surfacing. A short fence will surround the entire area. A sample of playground scope and elements are attached as exhibits C & D in the proposed RFP. The project will include expanded walkways; safety lighting; seating areas outside of the playground fence, trash cans and water fountains.

Phase 2 of the Lynwood Park Expansion Project will include a splash pad water feature, space exhibition, picnic seating, shade canopy, a flowering tree and other various amenities. Phase 2 will also have a cloud pavilion that can be used for events. The project will include expanded walkways; safety lighting, seating areas, trash cans and water fountains.

City Council Regular Meeting - Page 55 of 107
Phase 3 of the Lynwood Park Expansion Project will include providing WIFI throughout the Lynwood Park.

Various internet and WIFI routers will be installed throughout the Park Area and will fit suitably with the “Space” theme concept.

Upon authorization by the City Council, staff will proceed with the request for proposal for just Phase 1 or Mega Playground Project. The draft RFP is attached to this report including its exhibits and appendices. Staff will publish the RFP on the City’s web site (PlanetBids). The published RFP shall state the time and place for the mandatory site walk, the receiving of proposals, and distinctly describe the project.

Upon receipt of proposals, staff will conduct an analysis where all consultants will be rated by the following criteria in accordance with the rating sheet Exhibit G in the RFP packet:

- Project Understanding and Approach (20%)
- Firm Experience (10%)
- Proposed Project Team and Qualifications (20%) - References (30%)
- Project Schedule (10%)
- Fee Proposal (10%)

Approved Budget

A budget of $ 9,550,000 is approved utilizing the following funding sources.

2019 Lease Revenue Bonds $5,000,000
ARPA $3,250,000
Measure A $1,300,000

Fiscal Impact:

No additional funding is needed.

This section is applicable only to work performed under contract, and is not applicable to work carried out by a public agency with its own forces. This section is applicable to contracts let for maintenance work.

Labor Code Section 1775
Forfeiture for paying less than prevailing wage rates; Amount of penalty; Payments to workers; Liability of prime contractor; Notification of complaint

(a)

(1) The contractor and any subcontractor under the contractor shall, as a penalty to the state or political subdivision on whose behalf the contract is made or awarded, forfeit not more than fifty dollars ($50) for each calendar day, or portion thereof, for each worker paid less than the prevailing wage rates as determined by the director for the work or craft in which the worker is employed for any public work done under the contract by the contractor or, except as provided in subdivision (b), by any subcontractor under the contractor.

(2)

(A) The amount of the penalty shall be determined by the Labor Commissioner based on consideration of both of the following:

(i) Whether the failure of the contractor or subcontractor to pay the correct rate of per diem wages was a good faith mistake and, if so, the error was promptly and voluntarily corrected when brought to the attention of the contractor or subcontractor.

(ii) Whether the contractor or subcontractor has a prior record of failing to meet its prevailing wage obligations.

(B)

(i) The penalty may not be less than ten dollars ($10) for each calendar day, or portion thereof, for each worker paid less than the prevailing wage rate, unless the failure of the contractor or subcontractor to pay the correct rate of per diem wages was a good faith mistake and, if so, the error was promptly and voluntarily corrected when brought to the attention of the contractor or subcontractor.

(ii) The penalty may not be less than twenty dollars ($20) for each calendar day, or portion thereof, for each worker paid less than the prevailing wage rate, if the contractor or subcontractor has been assessed City Council Regular Meeting - Page 61 of 107
penalties within the previous three years for failing to meet its prevailing wage obligations on a separate contract, unless those penalties were subsequently withdrawn or overturned.

(iii) The penalty may not be less than thirty dollars ($30) for each calendar day, or portion thereof, for each worker paid less than the prevailing wage rate, if the Labor Commissioner determines that the violation was willful, as defined in subdivision (c) of Section 1777.1.

When the amount due under this section is collected from the contractor or subcontractor, any outstanding wage claim under Chapter 1 (commencing with Section 1720) of Part 7 of Division 2 against that contractor or subcontractor shall be satisfied before applying that amount to the penalty imposed on that contractor or subcontractor pursuant to this section.

(C) The determination of the Labor Commissioner as to the amount of the penalty shall be reviewable only for abuse of discretion.

(D) The difference between the prevailing wage rates and the amount paid to each worker for each calendar day or portion thereof for which each worker was paid less than the prevailing wage rate shall be paid to each worker by the contractor or subcontractor, and the body awarding the contract shall cause to be inserted in the contract a stipulation that this section will be complied with.

(b) If a worker employed by a subcontractor on a public works project is not paid the general prevailing rate of per diem wages by the subcontractor, the prime contractor of the project is not liable for any penalties under subdivision (a) unless the prime contractor had knowledge of that failure of the subcontractor to pay the specified prevailing rate of wages to those workers or unless the prime contractor fails to comply with all of the following requirements:

(1) The contract executed between the contractor and the subcontractor for the performance of work on the public works project shall include a copy of the provisions of Sections 1771, 1775, 1776, 1777.5, 1813, and 1815.

(2) The contractor shall monitor the payment of the specified general prevailing rate of per diem wages by the subcontractor to the employees, by periodic review of the certified payroll records of the subcontractor.

(3) Upon becoming aware of the failure of the subcontractor to pay his or her workers the specified prevailing rate of wages, the contractor shall diligently take corrective action to halt or rectify the failure, including, but not limited to, retaining sufficient funds due the subcontractor for work performed on the public works project.

(4) Prior to making final payment to the subcontractor for work performed on the public works project, the contractor shall obtain an affidavit signed under penalty of perjury from the subcontractor that the subcontractor has paid the specified general prevailing rate of per diem wages to his or her employees on the public works project and any amounts due pursuant to Section 1813.

(c) The Division of Labor Standards Enforcement shall notify the contractor on a public works project within 15 days of the receipt by the Division of Labor Standards Enforcement of a complaint of the failure of a subcontractor on that public works project to pay workers the general prevailing rate of per diem wages

Labor Code Section 1777.5 Employment of apprentices on public works

(a) Nothing in this chapter shall prevent the employment of properly registered apprentices upon public works.

(b) Every apprentice employed upon public works shall be paid the prevailing rate of per diem wages for City Council Regular Meeting - Page 62 of 107
apprentices in the trade to which he or she is registered and shall be employed only at the work of the craft or trade to which he or she is registered.

(c) Only apprentices, as defined in Section 3077, who are in training under apprenticeship standards that have been approved by the Chief of the Division of Apprenticeship Standards and who are parties to written apprentice agreements under Chapter 4 (commencing with Section 3070) of Division 3 are eligible to be employed at the apprentice wage rate on public works. The employment and training of each apprentice shall be in accordance with either of the following:

(1) The apprenticeship standards and apprentice agreements under which he or she is training.

(2) The rules and regulations of the California Apprenticeship Council. (d) When the contractor to whom the contract is awarded by the state or any political subdivision, in performing any of the work under the contract, employs workers in any apprenticeable craft or trade, the contractor shall employ apprentices in at least the ratio set forth in this section and may apply to any apprenticeship program in the craft or trade that can provide apprentices to the site of the public work for a certificate approving the contractor under the apprenticeship standards for the employment and training of apprentices in the area or industry affected. However, the decision of the apprenticeship program to approve or deny a certificate shall be subject to review by the Administrator of Apprenticeship. The apprenticeship program or programs, upon approving the contractor, shall arrange for the dispatch of apprentices to the contractor. A contractor covered by an apprenticeship program's standards shall not be required to submit any additional application in order to include additional public works contracts under that program. "Apprenticeable craft or trade," as used in this section, means a craft or trade determined as an apprenticeable occupation in accordance with rules and regulations prescribed by the California Apprenticeship Council. As used in this section, "contractor" includes any subcontractor under a contractor who performs any public works not excluded by subdivision (o).

(e) Prior to commencing work on a contract for public works, every contractor shall submit contract award information to an applicable apprenticeship program that can supply apprentices to the site of the public work. The information submitted shall include an estimate of journeyman hours to be performed under the contract, the number of apprentices proposed to be employed, and the approximate dates the apprentices would be employed. A copy of this information shall also be submitted to the awarding body if requested by the awarding body. Within 60 days after concluding work on the contract, each contractor and subcontractor shall submit to the awarding body, if requested, and to the apprenticeship program a verified statement of the journeyman and apprentice hours performed on the contract. The information under this subdivision shall be public. The apprenticeship programs shall retain this information for 12 months.

(f) The apprenticeship program that can supply apprentices to the area of the site of the public work shall ensure equal employment and affirmative action in apprenticeship for women and minorities.

(g) The ratio of work performed by apprentices to journeymen employed in a particular craft or trade on the public work may be no higher than the ratio stipulated in the apprenticeship standards under which the apprenticeship program operates where the contractor agrees to be bound by those standards, but, except as otherwise provided in this section, in no case shall the ratio be less than one hour of apprentice work for every five hours of journeyman work.

(h) This ratio of apprentice work to journeyman work shall apply during any day or portion of a day when any journeyman is employed at the jobsite and shall be computed on the basis of the hours worked during the day by journeymen so employed. Any work performed by a journeyman in excess of eight hours per day or 40 hours per week shall not be used to calculate the ratio. The contractor shall employ apprentices for the number of hours computed as above before the end of the contract or, in the case of a subcontractor, before the end of the subcontract. However, the contractor shall endeavor, to the greatest extent possible, to employ apprentices during the same time period that the journeymen in the same craft or trade are employed at the jobsite. Where an hourly apprenticeship ratio is not feasible for a particular craft or trade, the Chief of the Division of Apprenticeship Standards, upon application of an apprenticeship City Council Regular Meeting - Page 63 of 107
program, may order a minimum ratio of not less than one apprentice for each five journeymen in a craft or trade classification.

(i) A contractor covered by this section that has agreed to be covered by an apprenticeship program's standards upon the issuance of the approval certificate, or that has been previously approved for an apprenticeship program in the craft or trade, shall employ the number of apprentices or the ratio of apprentices to journeymen stipulated in the applicable apprenticeship standards, but in no event less than the 1-to-5 ratio required by subdivision (g).

(j) Upon proper showing by a contractor that he or she employs apprentices in a particular craft or trade in the state on all of his or her contracts on an annual average of not less than one hour of apprentice work for every five hours of labor performed by journeymen, the Chief of the Division of Apprenticeship Standards may grant a certificate exempting the contractor from the 1-to-5 hourly ratio, as set forth in this section for that craft or trade.
(k) An apprenticeship program has the discretion to grant to a participating contractor or contractor association a certificate, which shall be subject to the approval of the Administrator of Apprenticeship, exempting the contractor from the 1-to-5 ratio set forth in this section when it finds that any one of the following conditions is met:

(1) Unemployment for the previous three-month period in the area exceeds an average of 15 percent.

(2) The number of apprentices in training in the area exceeds a ratio of 1 to 5.

(3) There is a showing that the apprenticeable craft or trade is replacing at least one-thirtieth of its journeymen annually through apprenticeship training, either on a statewide basis or on a local basis.

(4) Assignment of an apprentice to any work performed under a public works contract would create a condition that would jeopardize his or her life or the life, safety, or property of fellow employees or the public at large, or the specific task to which the apprentice is to be assigned is of a nature that training cannot be provided by a journeyman.

(l) When an exemption is granted pursuant to subdivision (k) to an organization that represents contractors in a specific trade from the 1-to-5 ratio on a local or statewide basis, the member contractors shall not be required to submit individual applications for approval to local joint apprenticeship committees, if they are already covered by the local apprenticeship standards.

(m)

(1) A contractor to whom a contract is awarded, who, in performing any of the work under the contract, employs journeymen or apprentices in any apprenticeable craft or trade shall contribute to the California Apprenticeship Council the same amount that the director determines is the prevailing amount of apprenticeship training contributions in the area of the public works site. A contractor may take as a credit for payments to the council any amounts paid by the contractor to an approved apprenticeship program that can supply apprentices to the site of the public works project. The contractor may add the amount of the contributions in computing his or her bid for the contract.

(2) At the conclusion of the 2002-03 fiscal year and each fiscal year thereafter, the California Apprenticeship Council shall distribute training contributions received by the council under this subdivision, less the expenses of the Division of Apprenticeship Standards for administering this subdivision, by making grants to approved apprenticeship programs for the purpose of training apprentices. The funds shall be distributed as follows:

(A) If there is an approved multiemployer apprenticeship program serving the same craft or trade and geographic area for which the training contributions were made to the council, a grant to that program shall City Council Regular Meeting - Page 64 of 107
be made.

(B) If there are two or more approved multiemployer apprenticeship programs serving the same craft or trade and geographic area for which the training contributions were made to the council, the grant shall be divided among those programs based on the number of apprentices registered in each program.

(C) All training contributions not distributed under subparagraphs (A) and (B) shall be used to defray the future expenses of the Division of Apprenticeship Standards.

(3) All training contributions received pursuant to this subdivision shall be deposited in the Apprenticeship Training Contribution Fund, which is hereby created in the State Treasury. Notwithstanding Section 13340 of the Government Code, all money in the Apprenticeship Training Contribution Fund is hereby continuously appropriated for the purpose of carrying out this subdivision and to pay the expenses of the Division of Apprenticeship Standards.

The body awarding the contract shall cause to be inserted in the contract stipulations to effectuate this section. The stipulations shall fix the responsibility of compliance with this section for all apprenticeable occupations with the prime contractor.

(n) This section does not apply to contracts of general contractors or to contracts of specialty contractors not bidding for work through a general or prime contractor when the contracts of general contractors or those specialty contractors involve less than thirty thousand dollars ($30,000).

(o) All decisions of an apprenticeship program under this section are subject to Section 3081.

Labor Code Section 1776
Payroll record of wages paid; Inspection; Forms; Effect of noncompliance; Penalties

(a) Each contractor and subcontractor shall keep accurate payroll records, showing the name, address, social security number, work classification, straight time and overtime hours worked each day and week, and the actual per diem wages paid to each journeyman, apprentice, worker, or other employee employed by him or her in connection with the public work. Each payroll record shall contain or be verified by a written declaration that it is made under penalty of perjury, stating both of the following:

(1) The information contained in the payroll record is true and correct.

(2) The employer has complied with the requirements of Sections 1771, 1811, and 1815 for any work performed by his or her employees on the public works project.

(b) The payroll records enumerated under subdivision (a) shall be certified and shall be available for inspection at all reasonable hours at the principal office of the contractor on the following basis:

(1) A certified copy of an employee's payroll record shall be made available for inspection or furnished to the employee or his or her authorized representative on request.

(2) A certified copy of all payroll records enumerated in subdivision (a) shall be made available for inspection or furnished upon request to a representative of the body awarding the contract, the Division of Labor Standards Enforcement, and the Division of Apprenticeship Standards of the Department of Industrial Relations.

(3) A certified copy of all payroll records enumerated in subdivision (a) shall be made available upon request by the public for inspection or for copies thereof. However, a request by the public shall be made City Council Regular Meeting - Page 65 of 107
through either the body awarding the contract, the Division of Apprenticeship Standards, or the Division of Labor Standards Enforcement. If the requested payroll records have not been provided pursuant to paragraph (2), the requesting party shall, prior to being provided the records, reimburse the costs of preparation by the contractor, subcontractors, and the entity through which the request was made. The public may not be given access to the records at the principal office of the contractor.

(c) The certified payroll records shall be on forms provided by the Division of Labor Standards Enforcement or shall contain the same information as the forms provided by the division. The payroll records may consist of printouts of payroll data that are maintained as computer records, if the printouts contain the same information as the forms provided by the division and the printouts are verified in the manner specified in subdivision (a).

(d) A contractor or subcontractor shall file a certified copy of the records enumerated in subdivision (a) with the entity that requested the records within 10 days after receipt of a written request.

Any copy of records made available for inspection as copies and furnished upon request to the public or any public agency by the awarding body, the Division of Apprenticeship Standards, or the Division of Labor Standards Enforcement shall be marked or obliterated to prevent disclosure of an individual's name, address, and social security number. The name and address of the contractor awarded the contract or the subcontractor performing the contract shall not be marked or obliterated. Any copy of records made available for inspection by, or furnished to, a joint labor-management committee established pursuant to the federal Labor Management Cooperation Act of 1978 (29 U.S.C. Sec. 175a) shall be marked or obliterated only to prevent disclosure of an individual's name and social security number. A joint labor management committee may maintain an action in a court of competent jurisdiction against an employer who fails to comply with Section 1774. The court may award restitution to an employee for unpaid wages and may award the joint labor management committee reasonable attorney's fees and costs incurred in maintaining the action. An action under this subdivision may not be based on the employer's misclassification of the craft of a worker on its certified payroll records. Nothing in this subdivision limits any other available remedies for a violation of this chapter.

(e) The contractor shall inform the body awarding the contract of the location of the records enumerated under subdivision (a), including the street address, city, and county, and shall, within five working days, provide a notice of a change of location and address.

(f) The contractor or subcontractor has 10 days in which to comply subsequent to receipt of a written notice requesting the records enumerated in subdivision (a). In the event that the contractor or subcontractor fails to comply within the 10-day period, he or she shall, as a penalty to the state or political subdivision on whose behalf the contract is made or awarded, forfeit twenty-five dollars ($25) for each calendar day, or portion thereof, for each worker, until strict compliance is effectuated. Upon the request of the Division of Apprenticeship Standards or the Division of Labor Standards Enforcement, these penalties shall be withheld from progress payments then due. A contractor is not subject to a penalty assessment pursuant to this section due to the failure of a subcontractor to comply with this section.

(g) The body awarding the contract shall cause to be inserted in the contract stipulations to effectuate this section.

(h) The director shall adopt rules consistent with the California Public Records Act (Chapter 3.5 (commencing with Section 6250) of Division 7 of Title 1 of the Government Code) and the Information Prac tices Act of 1977 (Title 1.8 (commencing with Section 1798) of Part 4 of Division 3 of the Civil Code) governing the release of these records, including the establishment of reasonable fees to be charged for reproducing copies of records required by this section.

Labor Code Section 1813

City Council Regular Meeting - Page 66 of 107

The contractor or subcontractor shall, as a penalty to the state or political subdivision on whose behalf the contract is made or awarded, forfeit twenty-five dollars ($25) for each worker employed in the execution of the contract by the respective contractor or subcontractor for each calendar day during which the worker is required or permitted to work more than 8 hours in any one calendar day and 40 hours in any one calendar week in violation of the provisions of this article. In awarding any contract for public work, the awarding body shall cause to be inserted in the contract a stipulation to this effect. The awarding body shall take cognizance of all violations of this article committed in the course of the execution of the contract, and shall report them to the Division of Labor Standards Enforcement.

Labor Code Section 1815

Agenda Item # 14.

AGENDA STAFF REPORT
DATE: April 4, 2023

TO: Honorable Mayor and Members of the City Council

APPROVED BY : Ernie Hernandez, City Manager

PREPARED BY : Maria Quinonez, City Clerk
Silvia Pineda, Assistant to the City Clerk

SUBJECT: SECOND READING AND ADOPTION OF ORDINANCE NO. 1757 - GRANTING A

NONEXCLUSIVE FRANCHISE TO TORRANCE PIPELINE COMPANY
Recommendation:

Conduct second reading, read by title only and adoption of the attached ordinance entitled, "AN ORDINANCE

OF THE CITY COUNCIL OF THE CITY OF LYNWOOD GRANTING A NONEXCLUSIVE FRANCHISE TO

TORRANCE PIPELINE COMPANY TO OPERATE AND MAINTAIN A PIPELINE SYSTEM FOR THE

TRANSPORTATION OF OIL AND GAS UNDER CERTAIN PUBLIC WAYS AND PUBLIC PLACES IN THE CITY OF LYNWOOD; SETTING FORTH CONDITIONS ACCOMPANYING A GRANT OF NONEXCLUSIVE FRANCHISE; PROVIDING FOR AMOUNT AND METHOD OF PAYMENT BY

FRANCHISEE FOR THE PRIVILEGE GRANTED, AND PROVIDING FOR THE TERM OF THE NONEXCLUSIVE FRANCHISE"

Background:

Pursuant to Ordinance No. 1600 adopted by the City Council on March 18, 2008, the City granted ExxonMobil Oil Corporation the right, privilege and franchise to lay and use pipes and appurtenances for transmitting and distributing oil and petroleum products through, under and along City streets (see attached copy of Ordinance).

The franchise succeeded a similar franchise between ExxonMobil and the Los Angeles County that pre-dated City incorporation. On June 7, 2016, the City Council approved a transfer of the franchise to Torrance Pipeline Company, LLC (grantee), who is the successor in interest to the related pipeline assets and remains the current owner.

The current franchise agreement term is fifteen (15) years, ending on April 17, 2023. The City receives a franchise fee from the grantee on a semi-annual basis, which is based on the allowable rate for similar public utility pipelines (per Public Utilities Code Section 6231.5[b][1]), which includes applicable adjustments annually based on the Consumer Price Index. The physical pipeline facility is twelve inches (12'') in diameter and has a length of 6,525 linear feet. It runs through the westerly portion of the City in a north-south alignment (see attached exhibit). The pipeline continues southerly and north beyond the City limits to its point of destination at the grantee's terminal facility in the City of Vernon.

As the expiration date (April 17, 2023) for the franchise is approaching, Torrance Pipeline Company, LLC, City Council Regular Meeting - Page 82 of 107
submitted a letter to the City on April 5, 2022, requesting renewal of the franchise agreement.

Public Utilities Code (PUC) Division 3, Chapter 2, authorizes local municipalities to grant franchises to private firms to lay pipes and appurtenances for transmitting oil under and along public streets in accordance with certain parameters outlined in the chapter. The two-step procedure for granting such franchises is outlined in Section 6232 et seq., which states that upon receiving an application, the legislative body shall pass a resolution declaring its intention to grant the franchise applied for, stating the character of the franchise, setting forth a notice of the day, hour, and place when and where all persons having any objection to the granting thereof may appear before the legislative body and be heard thereon, and directing the clerk of the legislative body to publish the notice at least once within fifteen (15) days after the passage of the resolution in a newspaper of general circulation within the municipality. The time for the public hearing shall be not less than twenty (20) nor more than sixty (60) days after the date of the passage of the resolution.

Discussion and Analysis:

Based on the foregoing procedural requirements, the City Council adopted Resolution No. (Insert Res No) on February 7, 2023, initiating renewal of the franchise agreement and setting a public hearing concerning renewal of the franchise agreement for the regular City Council meeting on March 7, 2023 and directing the City Clerk to publish notice of same within the local newspaper (15-days after adoption of resolution). Accordingly, a public hearing notice meeting the requirements of PUC Section 6232 et seq was published in the local Newspaper.

The subject pipeline franchise has been operating safely and without incident at its current location for decades.

Per section 51014.5(b) of the CA Government Code, M-145 was last hydrostatically tested on 1/21/2019. The pipeline was last inspected on 12/20/2019 by in-line inspection per 49 CFR 195.452. The pipeline in-line inspection schedule is currently set to five years with the next inspection due in 2024. On this basis, staff has retained the essential framework of the existing 2008 franchise agreement in preparing the current renewal, while incorporating only necessary updates to some of its provisions.

The Original revenue estimated for a 6,525 linear foot, 12 inch pipeline was $1.68 per cubic ft for a 12 inch pipeline including adjustments based on the increase in the Consumer Price Index. The 2023 fee projection is:
$10,640 and $10,674, a total payments of $21,314 (including a 5% projected increase in the CPI rate).

After further discussion and negotiation with Torrance Pipeline, Staff agreed on a new rate of $3.51 per lineal foot that equals $22,903/annually with no annual adjustment and a one time granting fee of $2,000. This is an increase from the original proposal and subject to a contract term of 2 years.

Staff also obtained a letter from the Department of Forestry and Fire Protection Office of the State Fire Marshal "Pipeline Safety Division" stating that the Torrance Pipeline is in compliance with Federal and State laws and regulations regarding the maintenance and operation of the pipeline in the City of Lynwood.

On March 21, 2023, the City Council conducted a public hearing to consider the adoption of an ordinance approving the franchise agreement. The City Council made two changes to the proposed franchise agreement. The City Council approved a two (2) year term (Section 4) and decreased the administrative cost amount from $10,000 to $2,000 (Section 12) to reflect the two year term. The City Council conducted a first reading to adopt the ordinance with these two changes reflected in the ordinance.

City staff now asks the City Council to conduct a second reading and adopt the ordinance approving the franchise agreement.

As part of the approval process, City staff is requesting that the City Council find that the action to grant a franchise for the existing petroleum products pipeline is categorically exempt from the provisions of the California Environmental Quality Act in accordance with the California Code of Regulations, Title 14, Division 6, Chapter 3, Article 19, more specifically, Section 15301 (Existing Facilities). The exemption under CEQA applies to projects involving the operation, repair, maintenance, permitting, leasing, licensing or minor alteration of existing public or private structures, facilities, mechanical equipment, or topographical features involving negligible or no expansion of existing or former use. The proposed project is a renewal of an existing Pipeline Franchise with no expansion of use. No special circumstances exist that would create a reasonable possibility that the project will have a significant adverse effect on the environment. Therefore, City staff is requesting that the City Council find that the project is exempt under CEQA.

Section 33. COMPLETION STATEMENT
Upon the completion of the construction of any pipelines or appurtenances authorized by the Franchise, the Franchisee must submit to the Director a statement which identifies the permit or permits issued by the Department, the total length of pipeline authorized to be constructed un der the permit or permits, and the total length of pipelines or Appurtenances actually laid.

Section 34. APPURTENANCES
The Franchisee has the right to construct, maintain and repair all traps, manholes, conduits, valves, appliances, attachments, and Appurtenances (collectively referred to as "Appurtenances") as may be necessary for the proper maintenance and operation of the pipelines under the Franchise. Those Appurtenances must be kept flush with the surface of the street and be located so as to conform to all applicable State, Federal and local laws, ordinances, codes, rules and regulations, and to all permits issued by the Department, and must not interfere with the use of the street for travel. The Fra nchisee has the right, subject to all applicable State, Federal and Local laws, ordinances, codes, rules and regulations, to make all necessary excavations in the streets for the construction, maintenance and repair of those Appurtenances; but the Franc hisee must first obtain an excavation permit from the Department to undertake that work.

Section 35. ORDINARY REPAIR
The Franchisee may excavate in the street for pipeline repair for the number of days agreed upon by the Franchisee and the Department; but the Franchisee must first obtain an excavation permit from the Department to undertake that work.

Section 36. RELOCATION OF PIPELINES AND APPURTENANCES
City Council Regular Meeting - Page 98 of 107
15 a. The City reserves the right to change the grade, alignment, or width, of any public street, way, alley, or place over which the Franchise is granted, including the construction of any subway or viaduct. If any pipelines, Facilities or Appurtenances constructed, installed, or maintained by the Franchisee are located in a manner which prevents or interferes with the change of grade, traffic needs, operation, maintenance, improvements, repair, construction, reconstruction, widening, alteration or relocation of a street, the Franchisee must permanently or temporarily relocate that Facility, at no expense to the City, upon receipt of a written request from the D irector to do so. The Franchisee must commence that work on or before the date specified in the written request, which date may be not less than ninety (90) days from receipt of the written request. Franchisee must then diligently prosecute that work to completion.

b. The City reserves the right for itself, and all other public entities which are now or may later be so authorized, to lay, construct, repair, alter, relocate , and maintain subsurface or other facilities or improvements of any type or description within the streets over which the Franchise is granted. If the City or other public entity determines that the location or relocation of those facilities or improvements conflicts with the Facilities laid, constructed or maintained under the Franchise, whether those Facilities were laid before or after the facilities of the City or other public entity were laid, the Franchisee must relocate those Facilities or improvements, at no expense to the City or other public entity.

The Franchisee must, on or before the date specified in a written request from the Director, which date may not be less than ninety (90) days after receipt of the notice and request to do so, commence work to permanently or temporarily change the location of all Facilities which conflict with those improvements to another location which is approved by the Director. Franchisee must then diligently prosecute the work to completion. If the street is later designated as a State highway, the rights of the State of California will be as provided in California section 680 of the Streets and Highways Code while it remains a State highway.

Section 37. BREAKS OR LEAKS
If any portion of a street is damaged by reason of breaks or leaks in any pipeline, conduit, or Appurtenance constructed or maintained under the Franchise, the Franchisee must, at its sole expense and immediately following written or oral notification from the Director, promptly repair that damage and put the street in as good condition as existed before that damage or leak, all to the satisfaction of the Department. The Franchisee must obtain an excavation permit from the Department to undertake that work.

Section 38. EMERGENCY EQUIPMENT
At all times during the term of the Franchise, the Franchisee must maintain or arrange for, on a twenty four (24) hour basis, an emergency telephone number provided to the Los Angeles County Fire Department Station 147, adequate emergency equipment, and a properly trained emergency crew. The emergency equipment and crew must be available within a radius of twenty five (25) miles from any Facilities installed or maintained under the Franchise for the following purpose: shutting off the pressure and the flow of substances in those Facilities in the event of an emergency resulting from an earthquake, act of war, civil disturbance, fire, flood, or any other cause.

City Council Regular Meeting - Page 99 of 107
16 Section 39. REMOVAL OR ABANDONMENT OF FACILITIES
a. Upon the expiration, revocation or termination of the Franchise, or upon the permanent discontinuance of the use of all or a portion of its Facilities, Franchisee must, within the following thirty (30) days, make written application to the Director for authority, as determined by the Franchisee, either: 1) to abandon all or a portion of those Facilities in place; or 2) to remove all or a portion of those Facilities. The application must describe the Facilities desired to be abandoned or removed by reference to the map or maps required by Section 6 of this Ordinance and must describe with reasonable accuracy the physical condition of those Facilities.

b. The Director must determine whether the abandonment or removal proposed by the Franchisee may be performed without detriment to the public interest and under what conditions the proposed abandonment or removal may be safely completed. The Director must then notify the Franchisee of that determination. The Franchisee must pay to the City the cost of all tests and studies required to determine the disposition of the application for abandonment or removal.

c. Within thirty (30) days after recei pt of the notice, the Franchisee must apply for a permit from the Department to abandon or remove all or any portion of the Facilities and must pay all applicable fees and costs. The permit must set forth any conditions of abandonment or removal that may be prescribed by the Director . Any abandonment of the Facilities must be conditioned, in part, upon Franchisee's future compliance with the provisions of Section 35 of this Ordinance.

d. Within ninety (90) days after obtaining the permit, the Franchisee must commence and diligently prosecute to completion the work authorized by the permit.

e. If the Franchisee applies for authority to abandon in place all or a portion of its Facilities, and the Director determines, in his or her sole discretion, that such abandonment in place may be effected without detriment to the public interest, and the Director accepts such abandonment in place of all or a portion of the Facilities, the Franchisee must pay to the City an abandonment fee as follows:

Pipelines with an Internal Diameter of: Amount per Lineal Foot 0-12 inches $15.00
13-18 inches $22.00
19-30 inches $28.00

Section 40. FAILURE TO COMPLY
a. If any Facilities proposed to be abandoned "in place" and subject to prescribed conditions are not abandoned in accordance with those conditions, the Director may issue additional orders, including an order that the Franchisee remove any or all of those Facilities. The Franchisee must comply with these additional orders.

City Council Regular Meeting - Page 100 of 107
17 b. If the Franchisee fails to comply with the terms and conditions of abandonment or removal as required by this Ordinance and within the time prescribed by the Director, then the City may remove or cause to be removed those Facilities at the Franchisee's expense.

The Franchisee must pay to the Ci ty the cost of that work, plus the current rate of overhead then charged by the City for reimbursable work after receiving an itemized statement of reasonable costs incurred by City in the performance of such repair.

c. If, upon the expiration, revocation or termination of the Franchise, or the permanent discontinuance of the use of all or a portion of its Facilities, the Franchisee, within thirty (30) days thereafter, fails or refuses to make written application for the authority referenced above, the Di rector will make the determination as to whether the Facilities are to be abandoned in place or removed. The Director must then notify the Franchisee of that determination. The Franchisee must then comply with the provisions of Section 39 of this Ordinance.

Section 41. ABANDONMENT "IN PLACE" CONDITIONS:

Facilities abandoned "in place" are subject to the condition that, if at any time after the effective date of the abandonment, the Director determines that any Facility interferes with a public project, Franchisee or its successor in interest must remove that Facility at its expense when requested to do so by the City, or pay the City for the cost of that removal.

PART D. SPECIAL PROVISIONS

Section 42. RIGHTS GRANTED
Franchisee has the right, during the term of that Franchise, to transport petroleum, oil, gas, gasoline, and like substances through the pipelines maintained under the Franchise.

Section 43. MATERIALS USED
All pipelines used for the transportation of petroleum, oil, gas, gasoline, and like substances, or other flammable liquids must be of standard material and in conformity with current American Petroleum Institute pipeline specifications.

Section 44. APPROVALS
No excavation permit for a pipeline to be constructed or installed in accordance with the Franchise may be issued unless the Franchisee has complied with all applicable provisions of Subsection 20b of this Ordinance relating to pipelines for the transportation of hazardous liquid substances or highly volatile liquid substances. This requirement does not apply to emergency situations, such as those involving the mitigation of pipeline ruptures, spills or leaks.

Section 45. REPORTS
During the term of the Franchise, and within thirty (30) days after the expiration of each Franchise Payment Period, the Franchisee must:

City Council Regular Meeting - Page 101 of 107
18 a. b. File with the Director a report in triplicate, showing the number of each permit obtained for the installation of new mains during the immediately preceding Franchise Payment Period, together with the length and size of those mains. The Franchisee must show on this report any change in pipeline footage since the last Franchise Payment Period, segregating that footage as to new mains laid, old mains removed, old mains abandoned in place, and the footage of mains in any territory annexed or incorporated since the last Franchise Payment Period.

Section 46. PAYMENTS DUE
The Franchisee's payments are due semi-annually in accordance with the Franchise Payment Period indicated in Section 2 of this Ordinance.

Section 47. SEVERABILITY
If any section, subsection, sentence, clause, or phrase of this Ordinance is for any reason held to be invalid or unconstitutional by a deci sion of any court of any competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Ordinance. The City Council hereby declares that it would have passed this Ordinance, and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of the Ordinance would be subsequently declared invalid or unconstitutional.

Section 48. PUBLISHING ORDINANCE
The City Clerk is directed to certify to the passage and adoption of this Ordinance and to cause it to be posted or published as required by law and said Ordinance shall become effective 30 days after its passage.
