City Council City Council Regular Meeting 20
CITY OF LYNWOOD
THIRD QUARTER FINANCIAL STATUS REPORT
Fiscal Year 2022-23
Quarter ending March 31, 2023
(Unaudited)
This report summarizes the activities of the General Fund and is not meant to be inclusive of all finance and accounting transactions and excludes encumbrances. Its sole purpose is to provide the City Council and the general public with an overview of the City's general fiscal condition. This report covers the third quarter of FY 23 which ends March 31, 2023.
GENERAL FUND BUDGET POSITION
The City Council adopted the FY 2022-23 budgets on June 21, 2022 with approved General Fund estimated revenue of $42,139,935 and expenditures of $41,350,671 with these amounts including transfers with other city funds. Adjustments to the budget have increased the revenue budget to $42,214,935 and expenditures to $41,818,798.
GENERAL FUND REVENUES
Table 1 shows the amount and percentage of revenue received in each of the major classifications for the first three quarters ending March 31, 2023. The first three quarters result for fiscal year 2022-23 shows General Fund revenues at 58% of budget. The cash receipts are typical at this time of year due to the cyclical nature of when revenue receipts are received. More revenue is received in the second half of the year. In the case of Sales Tax, the majority is received later in the year, and sales tax received in July and August 2023 will be accrued to FY22-23.

Total Revenues 42,139,935$ 42,214,935$ 24,677,459$ 58% 21 Sales tax (including Measure PS) accounts for 34.4% of total annual General Fund revenues. Revenues received through the third quarter were 53% of the budgeted amount. Sales tax collection typically lags behind about two months, so we expect to receive sales tax revenue for FY 23 until August 2023.
Property taxes, including in-lieu payments, account for 30.8% of total General Fund annual revenues and are collected primarily in December/January and April/May. Through the third quarter, property tax revenues came in at 53% of the annual budget. This percentage is about what is expected at this time, major distributions will arrive around April/May.
Utility User Tax comprises 12.5% of the total annual General Fund revenues. These funds are paid to the City one month after collection. Collections of 89% have been made to date.
Other taxes include Transfer tax, Franchise tax, Cannabis tax, and other small miscellaneous collections. These account for 5% of total General Fund annual revenues. Revenues through the third quarter were 45% of the budgeted amount.
The majority of this revenue is received in the months of April, May, and June.
Licenses and Permits comprises 1.6% of the total General Fund annual revenues. Revenues received through the third quarter came in at 135% of the adopted budgeted amount, which shows higher activities and revenues than we originally budgeted.
Charges for Services comprises 3.1% of the total General Fund annual revenues. Revenues received through the third quarter came in at 85% of the adopted budgeted amount.
Use of money and Property is comprised of interest earned on investments and on the sale of City properties. Revenues received through third quarter came in at 251% of the budgeted amount, which is because of the increase in yields due to the various Federal Reserve rate hikes.
22 GENERAL FUND EXPENDITURES
Table 2 highlights the amount and percentage expended by each department. As of the first three quarters, the General Fund departments combined have expended 56% of the budget.

This is the result of vendors and contractors invoicing in the month after the work is performed. This means that salaries are current but operating expenses can be a few months behind in being invoiced to the city. Currently, it appears that the city's highest spending is in the area of public safety, which includes fire and sheriff costs. 23 AGENDA STAFF REPORT

He indicated it is important for the city to signal where we stand on the environment and that this small decision we can make as a city to divest from fossil fuels, from oil and gas is an important message to send to our residents who are surrounded by freeways, who are surrounded by the Alameda Corridor, who deal with pollution every day. He expressed that sadly, there has been research that shows that folks in South East L. A. live less than many folks in West Side communities because of the burden of pollution. He voiced that this is a small gesture we can make and clarified his motion from the last meeting by stating he did not want the city to immediately sell off investments, but noted that this policy will just ensure that when the time comes, when our current investments expire that we make sure that we are not investing in repurchasing options deriving from fossil fuel assets.
City Manager Hernandez stated that he and the Treasurer met about this concern and noted the current environment would result in some losses in revenue as it relates to our dividend revenue. He indicated that he understands the requested modification 30 5
that Council Member Muñoz-Guevara introduced would provide direction for the city to go with more environmentally friendly investment options relating to our financial dividend revenue.
Council Member Muñoz-Guevara reiterated that he was not asking for immediate divestment, rather requesting that over the years as our investments come up we evaluate divestment direction at that time. He recommended that if we learn from the Treasurer when it is time to look at the investments again that this item would come back to us. He introduced a subsequent motion to approve the Treasurer's investment policy with an amendment to the unauthorized investments, to reflect the prohibition on investments in firms that are predominantly in the business of exploration, production, drilling, and refining of coal, petroleum, oil, and or natural gas, and have the opportunity to re-evaluate those investments when our current investments expire.
Mayor Flores thanked Council Member Muñoz-Guevarafor the clarification, seconded the subsequent motion. He inquired if there was any other discussion or if he could get a roll call.
Acting City Attorney John Lam stated that it appears there are two motions on the floor right now. He requested clarification for which particular motion that is being referred to for the roll call.
Mayor Flores indicated that it is his understanding that the subsequent motion takes precedent and inquired if that is correct.
Acting City Attorney John Lam indicated that would be applicable only if the subsequent motion maker made the first motion also.
Mayor Flores indicated that Council would go back to the first motion.
Acting City Attorney John Lam stated the appropriate action would be to visit the first motion or rescinding the first motion.
Mayor Flores stated the need to revisit the first motion and noted the motion had a first and a second as well. Mayor Flores requested a roll call for that motion.
Council Member Muñoz-Guevara requested clarification if that the roll call was for the first motion with no amendments.
Mayor Flores replied that is correct and requested a roll call and the motion carried by the following 3/2 vote:

13. APPROVAL OF SPECIAL EVENT PERMIT – CIRCO HERMANOS CABALLER CIRCUS MOTION: It was moved by Council Member Solache, seconded by Council Member Camacho to approve the item.
Mayor Flores opened discussion to Council Member Muñoz-Guevara per his request.
Council Member Muñoz-Guevara stated that the reason the item was pulled was to take a moment to recognize Circo Hermanos Caballer Circus. He noted that a Lynwood resident had reached to out to him and that the resident happens to work for a nonprofit called “Reach L. A.” that is dedicated to providing critical services to individuals aging out of the foster youth system. Council Member Muñoz-Guevara indicated that the resident asked him to write a letter to the circus operators advocating for a partnership between the nonprofit and the circus. He said he wanted to recognize that the circus was gracious enough to agree to donate 30% of their proceeds from this Friday’s 7:30 p.m. showings to the nonprofit. Council Member Muñoz-Guevara expressed gratitude to Circo Hermanos Caballer Circus and hoped that they can continue being good neighbors and partners to our city. He requested the Council to support the circus and attend the Friday shows, as they are willing to donate so much of their proceeds.
Mayor Flores commented that when he first saw agenda item 13, he thought was that they are already set up. He remarked that we are working a little backwards here and stated that events require permits before setting up.
32 7
Gabriel Linares, Community Development Director responded affirmative and stated that last year we went through a policy change for special event permits. He mentioned that one of the changes was that we now have is a procedural manual. He also noted need to have the events come in earlier than scheduled, with possibly a six-month or a special expedite permit process that may be reviewed by the city manager or somebody directed by him. He acknowledged this does not negate from the requirement to bring the item to council, but it does provide a method to streamline the process. He admitted that the circus was not aware of the policy but he encouraged council to extend some leniency and direction to work with the vendors as they show up. He stated the vendor did have all the clearances from the fire department and police department and staff went ahead and processed it through an expedited permitting process, reviewed the application, and consulted with the city manager. He apologized that there was not time to put the item on the last council agenda and so it is on tonight’s agenda.
City Manager Hernandez stated that the city’s administrative policy related to the use of public facilities and this event involved the use of private facilities. He voiced that staff was somewhat reactionary and found a mechanism to do an expanded process.
He noted that the plan right now is to reduce the timeline for private sector locations to a 30-day process; however, he acknowledged that this item’s timeline would still have been an issue. Additionally, he disclosed Circo Hermanos Caballer Circus has a long history with the city and revealed the fact that they had to pay a penalty for the expedited process. He expressed that because we know there are certain groups that do business with the city every single year staff will be proactively reaching out to them informing them about the new process. He asserted that this group has a lot of established relationships, including existing relationships that assisted in achieving a much faster process than other groups. He said that most events would not have been able to do accomplish the same timeline if they did not have the required clearances in place, which would then encompass an emergency permit.
Mayor Pro Tem Soto stated that she was aware that for years Circo Hermanos Caballer Circus has been working with the city and donating a lot of items for the community such as thanksgiving turkeys, toys for the students and also participating in our special events and that they have been successful working all the time with our city.

CITY COUNCIL ORAL AND WRITTEN COMMUNICATION
Council Member Muñoz-Guevara indicated he wanted to remind everyone that this Thursday is the City's Black History Program and acknowledged the work that our staff accomplished for this important celebration. He encouraged individuals to attend and take advantage the event. He also addressed the issue of renter protections and noted that as of today there are 39-days remaining before expiration of important protections provided by the County. He mentioned that in the time since our last Council meeting he met with additional landlords and with more renters. He remarked one particular renter actually brought out his notice, which signaled a rent increase of over $200, which already had been sent out, and effective April 1. Additionally, he commented the landlords are immediately waiting for the protections to expire in order to start the process of raising rents. He also wanted to emphasize just as scholars have mentioned, this is one tangible thing, one tangible policy that our council can adopt and stated it is a sensible policy that protects renters and small landlords. He said it is possible that that we raise the issue and study the matter.
Council Member Camacho had no further comments.
Council Member Solache stated he wanted to acknowledge the beautiful lights all along the Linear Park, as they are amazing and beautiful. He noted that the community is just ecstatic about them. In addition, he noted the need to make sure this feature is well taken care of because he always tell people we deserve everything other communities have and we must take care of these things so they continue to look beautiful. He mentioned that he drives through the area often and lives near the location and stated that our city deserves to have something of that quality to enjoy.
He also observed that the lights are on literally 24-hours right now and so obviously recommended that staff makes sure they are not on during the daylight hours when there is no need
Mayor Pro Tem Soto agreed with Council Member Solache that the lights along Linear Park are beautiful and that she had noticed the lights were on during the daylight hours. She wished everyone “Happy Black History Month” and wanted to be sure that everyone celebrates and continues celebrating Black History Month. She mentioned that next month during the first week of March Lynwood schools would be celebrating “Read across America”. She extended a welcome to everyone to visit a school on Thursday March 2 nd and participate with the students by joining the celebration for “Read across America” at all of the Lynwood schools.
Mayor Flores questioned the status of our favorite playground and final changes. 38 13

Honorable Mayor and Members of the City Council

PREPARED BY:
Gabriel Linares, Director of Community Development
SUBJECT:
COMMERCIAL FACADE GRANT PROGRAM AMENDMENT
Agenda Item # 9.2.
Recommendation:
Staff recommends that the City Council:
1 .
Amend the guidelines for the Commercial Façade Program to increase the grant award to $20,000.
2 .
Adopt the attached Resolution entitled “A Resolution of the City council of the City of Lynwood amending the Commercial Façade Grant program and the appropriation amount in ARPA funding for program implementation.”
Background:
At its regular meeting of April 19, 2022, the Lynwood City Council approved Resolution No. 2022.065 appropriating $830,000 in ARPA funding for program implementation of a Commercial Façade Grant utilizing Coronavirus Local Recovery Funds awarded to the City of Lynwood under the American Rescue Plan Act of 2021 (ARPA).
Utilizing the $830,000 appropriated for Economic Development under the City’s adopted ARPA plan, staff proposed a Commercial Facade Grant Program to assist business property owners in the hardest hit commercial areas of the City. The goals of the program are:
Improve visual quality of the building façades
· Enhance or restore buildings to create attraction for new businesses · Restore economic vitality and investment confidence
· Assist businesses negatively impacted by the COVID-19 pandemic City Council City Council Regular Meeting 47
· Achieve a high standard of design for individual buildings · Use of high quality materials and workmanship on building façades The grant program established the Business Beautification/Façade Improvement Plan to issue grants of up to $12,000 ($10,000 for direct labor and $2,000 for soft costs) to approximately 69 businesses and to retain a service provider to assist in program promotion and implementation. The funds would support basic repairs, facade improvements and beautification of high-need commercial corridors in the city affected by COVID -19 closures and other safety or quality of life impacts. The amount of the initial individual grant was limited in order to provide the greatest flexibility.
Three specifically designated commercial area corridors were designated a high priority for the city and required community investment to support public safety and enhance the general customer experience. Qualifying property/business owners are those located within city limits on Imperial Highway, Atlantic Avenue, or Long Beach Boulevard and storefronts must be visual from the street along one of the identified business corridors.
Upon approval of the program, staff enlisted an outreach consultant, Mayra Berenice En Vivo, that provided canvasing of the designated corridors, conducted monthly workshops to explain the program and provide applications and application assistance. They also provided business resources such as financial seminars and business-to-business referrals. The outreach consultant conducted monthly workshops from August- March. On July 25, 2022, the City’s On-Call Consultant, Avant Garde, was brought in to administer the City’s Commercial Façade Program.
Discussion and Analysis:
The City Council has received updates and provided staff direction for further discussion and implementation of the program at the Regular City Council meetings of March 21, 2023, and April 4, 2023.
To date, seventy-one (71) applications have been submitted. sixteen (16) have been closed/deferred for causes such as ineligible locations, business types, or other reasons.
thirty (30) are still in the review process.
twenty (25) businesses have qualified for approval. Twelve (12) businesses have qualified have reached the bidding process for their desired improvement requests. The remaining are in the work write up stage.
Due to increased costs of materials and labor, bids received for projects exceed the existing guideline of $10,000 for minor improvements. Staff reached out to applicants to determine if they can pay the difference exceeding the $10,000 grant amount. Businesses expressed that they do not have extra funds to pay for these improvements and is the primary reason why they applied for the grant.
To provide the City of Lynwood and its businesses with the beautification and relief the Commercial Façade Program has intended, it is recommended that the City Council increase the grant amount between $20,000 and allow staff the flexibility to award up to $25,000 based City Council City Council Regular Meeting 48
Resolution - Facade Improvement Program.doc
on funding availability. The increase would allow staff to move forward with the improvements for some of the applicants. Remaining projects that exceed the new grant amount would have to be re-scoped and be sent out for re-bid. The budget allocation for this program will also need to be revised to accommodate the change in grant amount per business.
On April 4, 2023, the City Council directed staff to fund 75 applicants. Based on 75 applications at $20,000, the amount needed for the grant program is $1,500,000 in addition to administrative costs in the amount of $170,625 for a total amount of $1,670,625.
Fiscal Impact:
Allocate additional ARPA funds to the program in the amount of $832,500 to the program for a total amount of $1,662,500. There is no impact to the City’s General Fund.
