City Council Special Meeting
2 AGENDA STAFF REPORT

DATE:November 20, 2024
TO:Honorable Mayor and Members of the City Council
APPROVED BY:Julian Lee, Interim City Manager
PREPARED BY:Julian Lee, Interim City Manager
SUBJECT:CONSIDERATION OF APPOINTMENT TO FILL THE VACANT CITY

COUNCIL POSITION
Agenda Item # 6.1.

Recommendation:

Discuss and consider appointment of one of the twenty-four candidates to fill the vacant City Council position by adopting a resolution to fill the unexpired term of former City Councilmember Jose L. Solache.

Background:

A City Council position is expected to become vacant with the resignation of Mayor Jose L.

Solache due to his election to serve in the California Assembly. Mayor Solache has advised the City Manager and the City Attorney’s Office that he plans on making his resignation from the City Council effective Wednesday November 20, 2024. Under Government Code Section 36512(b), the City must either appoint a person or call for a special election to fill the vacancy:

"If a vacancy occurs in an elective office provided for in this chapter, the council shall, within 60 days from the commencement of the vacancy either fill the vacancy by appointment or call a special election to fill the vacancy. The special election shall be held on the next regularly established election not less than 114 days from the call of the special election. A person appointed or elected to fill a vacancy holds office for the unexpired term of the former incumbent."

Here, the vacancy will commence once Mayor Solache’s resignation becomes effective.

However, if the City Council does not appoint a replacement by the 60-day deadline, then it must call for a special election to fill the vacancy. (Government Code Section 1770, 36512). A special election in March 2025 would cost the City of Lynwood approximately $165,000.

Discussion and Analysis:

City Council City Council Special Meeting 3

The Lynwood Municipal Code does not include an appointment process for filling vacancies in elected offices. In the absence of the Lynwood Municipal Code including a process for the filling of vacant elected offices, on October 15, 2024 at the regular meeting of the City Council, Mayor Solache asked City staff to begin the preparation of a process for the possible appointment to fill his seat in the event Mayor Solache was elected to serve in the California Assembly. On November 5, 2025 at the regular meeting of the City Council, Mayor Solache once again asked staff to finalize the preparation of a process for the possible appointment to fill his seat in the event he was elected to serve in the California Assembly. Mayor Solache was elected to serve in the California Assembly.

City staff prepared an application for interested parties to fill out and submit to the City. The application was made available on October 25, 2024. All applications were required to be submitted to the City Clerk by 5:00 pm on Thursday November 14, 2024. The City received 24 applications. The City Council has the option to either appoint a person to fill the vacant City Council position or to call for a special election to fill the vacant position until January 20, 2025. (Government Code Section 36512.)
Fiscal Impact:

An appointment of the Council Member through special election would cost approximately $165,000.
