City Council Regular Meeting 6
AGENDA STAFF REPORT
DATE:
January 21, 2025
TO:
Honorable Mayor and Members of the City Council
APPROVED BY:
Julian Lee, Interim City Manager
PREPARED BY:
Gabriel Linares, Director of Community Development
SUBJECT:
PUBLIC HEARING AND PUBLIC INPUT ON HOUSING AND
COMMUNITY DEVELOPMENT NEEDS CONCERNING THE FIVE-YEAR
2025-2029 CONSOLIDATED PLAN FOR THE ALLOCATION OF
COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) AND HOME
INVESTMENT PARTNERSHIP PROGRAM (HOME) FUNDS, AND THE
ANALYSIS OF IMPEDIMENTS TO FAIR HOUSING CHOICE
Agenda Item # 8.1.
Recommendation:
Staff recommends that the City Council conduct a public hearing to receive public input and provide direction to Staff on the Five-Year Consolidated Plan, and Analysis of Impediments.
Background:
The City of Lynwood is considered an entitlement jurisdiction and receives an annual allocation from the U.S. Department of Housing and Urban Development (HUD) for the operations of its CDBG and HOME programs. The funding is determined by a formula calculated by HUD based on population, age of the city, poverty levels, etc. The City’s allocation can fluctuate year-to-year causing funding to increase or decrease in various programs.
As a recipient of the federal funds, the City is required to submit a five-year Consolidated Plan (ConPlan), an Annual Action Plan, and monitor its progress, outcomes, and expenditures through the Consolidated Annual Performance and Evaluation Report (“CAPER”).
City Council City Council Regular Meeting 7
The purpose of the ConPlan is to identify the City’s housing and community development needs, priorities, goals, and strategies and to stipulate how funds will be allocated to housing and community development activities over the next five (5) years. The CDBG Program provides Federal funds for local improvement projects and programs. Activities assisted with CDBG funds must meet one of the three (3) national objectives:
1 .
Benefit low and moderate-income persons; or
2 .
Aid in the elimination of slum and blight; or
3 .
Meet a particular urgent community need because existing conditions pose a serious threat, and no other source of funds is available. This national objective is rare and is designated only for activities that alleviate emergency conditions, e.g., fire, flood, earthquake.
The HOME program provides formula grants, often in partnership with local nonprofit groups, to fund a wide range of activities including building, buying, and/or rehabilitating affordable housing or providing direct rental assistance to low-income persons. HOME is the largest Federal Block Grant to State and Local Governments designed exclusively to create affordable housing for low-income households.
In addition to the ConPlan, HUD requires the development of a Five-Year Analysis of Impediments to Fair Housing Choice.
Discussion and Analysis:
The Consolidated Plan
is a HUD required plan assessing affordable housing and community development needs for the next five-year 2025-2029 period. The ConPlan determines how funds from HUD will be used.

The Analysis of Impediments to Fair Housing Choice
is a review of policies, procedures,
and practices within the community that affect the location, availability and accessibility of housing and current residential patterns and conditions related to fair housing choice. Fair Housing Choice is a condition in which individuals and families of similar income levels in the same housing market have a like range of choices available to them regardless of protected status. Federal and State Law define protected status as:
Race
Color
Ancestry
National Origin
Religion
Sex
Age
Disability
Familial Status
Marital Status
Sexual Orientation
Source of Incomer
Any other arbitrary factor
The Analysis of Impediments to Fair Housing Choice is a study of actions, omissions, or decisions that restrict housing choices or the availability of housing choices or that have the effect of restricting choice or availability.
The scope of the analysis includes:
Community Profile
Demographic Profile
Household Characteristics
Income Profile
Housing Profile
Accessibility to public facilities, jobs, and housing
City Council City Council Regular Meeting 9
Fair Housing Profile
Fair Housing complaints, violations, and lawsuits
Trends and patterns of Impediments
Community Profile
Fair Housing practices of realtors and other housing associations Mortgage lending practices
Public policies and programs affecting housing development
Next Steps in Process
HUD requires two public hearings during the development of the Consolidated Plan. The first public hearing taking place today will receive input from the public and City Council may provide direction to city staff on the five-year ConPlan and Analysis of Impediments. After receiving input and direction from City Council, the drafts of the aforementioned plans will be finalized. The City will then conduct a 30-day comment period and hold the public hearing #2 to adopt the five-year Consolidated Plan and the Analysis of Impediments to Fair Housing. FY 2025/2026 Annual Action Plan will be considered as part of the ConPlan. Additionally, staff will present an updated Citizen Participation plan, if applicable. Following City Council adoption, the five-year Consolidated Plan, 2025/2026 Annual Action Plan and Citizens Participation Plan will be submitted to HUD.
Fiscal Impact:
The U.S. Department of Housing and Urban Development (“HUD”) has not yet announced allocations for local jurisdictions. It is anticipated that the City of Lynwood (“City”) will receive approximately $4.7 million in CDBG entitlement funds, and approximately $1.7 in HOME entitlement funds, from HUD for FY 2025-2029. The CDBG and HOME activities and some administrative costs will be funded solely by grant funds and will not impact the General Fund.

Recommendation:
Staff recommends that the City Council adopt the attached resolution entitled: “A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AWARDING a
CONSTRUCTION CONTRACT TO ALL AMERICAN ASPHALT FOR THE SLURRY SEAL IMPROVEMENTS AND THORSON AVENUE ALLEY DRAINAGE PROJECT FY 24-25 CIP PROJECT NO. 2121|2357|2352|9053|9056.68.141; AUTHORIZING THE MAYOR TO
EXECUTE THE AGREEMENT AND AUTHORIZING THE CITY MANAGER TO APPROVE AGREEMENT AMENDMENTS RELATED TO THE PROJECT”
Background:
The City’s capital projects are long-term infrastructure investments outlined in the Annual Capital Improvement Projects (CIP) Plan, which includes water, sewer, streets, parks, recreational amenities, and facilities. Slurry Seal projects play a key role in the City’s pavement management program. This treatment creates a new road surface, protecting it from sun and water damage. Slurry seal is a cost-effective maintenance solution that extends the lifespan of asphalt at a fraction of the cost of full pavement repair. On November 19, 2024, the City Council approved the plans and specifications, as well as authorized the solicitation of bids. The project has since been put out for bid and is now ready to be awarded.

Discussion and Analysis:
On November 20, 2024, the Notice Inviting Bids (NIB) was advertised on the City’s website (PlanetBids) for the Project. The bid opening took place on the PlanetBids Platform on Tuesday, December 17, 2024, at 10:00 A.M.
The following six (6) bids were received:
City Council City Council Regular Meeting 86
Bidder
Bid
1. Cali State Paving, Inc.
$664,875.00
2. All American Asphalt
$691,681.00
3. Marjani Builders, Inc.
$695,600.00
4. Hardy & Harper, Inc.
$750,000.00
5. Onyx Paving Company, Inc.
$818,000.00
6. Excel Paving
$985,880.00
Cali State Paving, Inc. was initially identified as the apparent lowest bidder with a base bid of $664,875.00. On December 19, 2024, All American Asphalt submitted a Bid Protest with the findings that line items #1 and #1A (mobilization/demobilization) submitted by the current apparent low bidder exceeded the 3% of the total of bid amount. Under Technical Provisions pages 71 and 72, the amount of mobilization/demobilization shall not exceed 3% of all bid items and the
staff confirmed that the line items #1 and #1A submitted by Cali State Paving, Inc. did exceed the 3% of the total of bid amount.
Upon further review of apparent lowest bid, staff also found that Cali State Paving Inc.’s subcontracted work amounted to 60% of total bid amount, exceeding the 50% limit specified in the "Information Required of Bidder 1.3.3 List of Subcontractors" form in the bid packet. The form states, "The Contractor shall perform, with its own organization, Contract work amounting to at least 50 percent of the Total Bid Price, except that any designated 'Specialty Items' may be performed by subcontract." Findings from both the bid protest on the mobilization/demobilization limitation and subcontracted work amount, resulted in Cali State Paving, Inc. being deemed a non-responsive bidder and has been disqualified.
A subsequent analysis of the second-lowest bidder, All American Asphalt, was conducted, including a review of their bid schedule, license, references, and required documents. All American Asphalt was found to be lowest responsive bidder and is eligible to proceed with the award of the Slurry Seal Improvements and Thorson Avenue Alley Drainage Project. Staff now recommends that the City Council award the project to All American Asphalt in the amount of $691,681.00

Contractor shall reimburse Indemnitees for any and all legal expenses and costs incurred by each of them in connection therewith or in enforcing the indemnity herein provided. The only limitations on this provision shall be those imposed by California Civil Code Section 2782.
This obligation to indemnify and defend Indemnitees as set forth herein shall survive the termination of this Agreement and is in addition to any rights which City may have under the law. This indemnity is effective without reference to the existence or applicability of any insurance coverages which may have been required under this Agreement or any additional insured endorsements which may extend to City.
V. INSURANCE
Without limiting Contractor’s indemnification of Indemnitees as set forth in Section IV of this Agreement, Contractor shall obtain, provide and maintain, at its own expense, the types and amounts of insurance described in Subsection 2.7.2 of the Special Provisions of the Contract Documents. Such insurance shall be in force prior to Contractor commencing any Work under this Agreement and shall remain in force for the duration of this Agreement and for any other such period as may be required herein. A. Prevailing Wage Requirements. Notwithstanding any other provision of this Agreement, Contractor shall not be entitled to any adjustment in compensation rates in the event there are adjustments to the General Prevailing Wages Rates.
B. Reports. Contractor shall not perform on site work on this contract until labor compliance documents are filed. Contractor agrees to cooperate with the City to fulfill its notifications requirement to the DIR, as required by DIR’s PWC-100 form or any other required form, and Contractor agrees to provide to the City the information required by the DIR, as generally set forth in Labor Code Section 1773.3. 131
E. Enforcement.
1. General. CONTRACTOR acknowledges it has read and understands that, pursuant to the terms and conditions of this Agreement, it is required to comply with the Wage Requirement and to submit certain documentation to the City establishing its compliance with such requirement. (“Documentation Provision.”) CONTRACTOR further acknowledges the City has determined that the Wage Requirement promotes each of the following (collectively “Goals”):
a. It protects public job opportunities and stimulates the City’s economy by reducing the incentive to recruit and pay a substandard wage to labor from distant, cheap-labor areas.
b. It benefits the public through the superior efficiency of well-paid employees.
c. It increases competition by promoting a more level playing field among contractors with regard to the wages paid to workers.
2. CONTRACTOS’s Breach of Prevailing Wage/Living Wage Provisions.
WITHOLDING OF PAYMENT: CONTRACTOR agrees that the
Documentation Provision is critical to the City’s ability to monitor CONTRACTOR’s compliance with the City’s public wage obligations.
CONTRACTORS further agrees its breach of the Documentation Provision or general public wage obligations results in the need for additional enforcement action to verify compliance with this Addendum. In light of the critical importance of the Documentation Provision, the City and CONTRACTOR agree that CONTRACTOR’s compliance with this Addendum is an express condition of City’s obligation to make each payment due to the CONTRACTOR pursuant to this Agreement. THE CITY IS NOT OBLIGATED
TO MAKE ANY PAYMENT DUE THE CONTRACTOR UNTIL
CONTRACTOR HAS PERFORMED ALL OF ITS OBLIGATIONS UNDER
THESE PROVISIONS. THIS PROVISION MEANS THAT CITY CAN
WITHOLD ALL OR PART OF A PAYMENT TO CONTRACTOR UNTIL ALL REQUIRED DOCUMENTATION IS SUBMITTED. Any payment by the City despite CONTRACTOR’s failure to fully perform its obligations under these provisions shall not be deemed to be a waiver of any other term or condition contained in this Agreement or a waiver of the right to withhold payment for any subsequent breach of this Documentation Provision or public wage obligations of the Contractor and the City.

On or about January 16, 2019, as contemplated under the Original DDA, the Original Developer assigned all of its rights and obligations set forth in the DDA to Lynwood Family Apartments, LP, a California limited partnership (the “Developer”) that assumed all of the rights and obligations of the Original DDA.
On or about September 9, 2019, City, Authority, and Developer entered into a First Amendment to Amended and Restated Disposition and Development amending the Original DDA by clarifying and confirming certain provisions of the Authority Loan as set forth in the Original DDA and providing for the payment and reimbursement to the Developer for Eligible Project Costs incurred prior to the “Close of Escrow” (as that term is defined in the Original DDA).
On or about June 2, 2020, City, Authority, and Developer entered into a Second Amendment to Amended and Restated Disposition and Development to amend the term of the Authority Loan and provide for the subordination of the Authority Loan to certain additional and private financing for the Project approved by the City and Authority in the maximum amount of One Million Five Hundred Thousand Dollars ($1,500,000) to Developer from a private lender.
On or about February 4, 2021, City, Authority, and Developer entered into a Third Amendment to Amended and Restated Disposition and Development to resolve certain issues that arose among the parties with respect to the development of the Project and provide for certain protective and security measures in favor of the City and Authority as to the Authority Loan and Project completion. Such protective and security measures included draw certifications and lien releases from the Developer upon each disbursement of Authority Loan proceeds and a cash deposit from the Developer in the amount of One Million Five Hundred Thousand Dollars ($1,500,000) to secure its construction and development obligations set forth in the DDA, as amended by the Third Amendment. The Third Amendment also authorized the Housing Authority and the City to enter into a right-of-entry agreement with the Developer allowing it to perform certain excavation and grading work prior to the Close of Escrow in order to assure the timely completion of the construction and development of the Project, and establish a budget proforma for the Project, identifying hard and soft construction costs, as well as various other financial protective measures, including, but not limited to, financial projection and income statement, audit statements, as well as various other necessary security and protective measures with respect to the disbursement of the Authority Loan to City Council City Council Regular Meeting 134

fund the Project.
Discussion and Analysis:
The parties desire to now enter into a Fourth Amendment to Amended and Restated Disposition and Development Agreement, a copy of which is attached hereto as Attachment A, to provide for the following amendments to the DDA: (i) extend the term of the Authority Loan (including the Authority Promissory Note and Deed of Trust) and the term of the Declaration of Affordable Housing Covenants, Conditions and Restrictions; (ii) establish a separate construction escrow account with US Bank for the deposit of funds by the Developer for disbursement by the City to the Developer to fund the remaining “Eligible Constriction Costs” for the completion of the Project subject to established City disbursement requirements; (iii) provide for the increased amount of the Developer-permitted private take-out loan from One Million Five Hundred Thousand Dollars ($1,500,000) to an amount not greater than Five Million Nine Hundred Thousand Dollars ($5,900,000) subject to certain City imposed loan terms and restrictions; and (iv) establish February 28, 2025 as the firm completion date for the Project subject to a very limited extension period resulting from delays directly attributable to Southern California Edison, and the imposition of fines where such failure to timely meet the Project completion date is not due to Southern California Edison.
Upon the approval of the Fourth Amendment, the City Manager of the City and Executive Director of the Authority shall be authorized to execute any and all documents necessary to effectuate and implement the construction and development of the Project by the Developer.

AGENDA STAFF REPORT
DATE:
January 21, 2025
TO:
Honorable Mayor and Members of the City Council
APPROVED BY:
Julian Lee, Interim City Manager
PREPARED BY:
Mark Flores, Director of Recreation & Community Services Jose Trejo, Deputy Director of Recreation & Community Services SUBJECT:
THIRD AMENDMENT TO THE SECURITY SERVICES AGREEMENT
Agenda Item # 10.1.
Recommendation:
Staff recommends that the City Council adopt the attached resolution entitled; “A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AUTHORIZING THE
MAYOR OR DESIGNEE TO EXECUTE, IN A FORM SATISFACTORY TO THE CITY
ATTORNEY, THE THIRD AMENDMENT TO THE SECURITY SERVICES AGREEMENT
WITH PROFESSIONAL SECURITY CONSULTANTS TO CONTINUE TO PROVIDE THE SECURITY SERVICES FOR UP TO NINE (9) ADDITIONAL MONTHS”.
Background:
The current security services agreement expires on January 31, 2025. During it's current Request for Proposal (RFP) selection process to approve a new services provider, the City Council expressed its interest in further reviewing received proposals This request pushes the decision making process for selecting the new provider past the expiration of the current security services agreement. Staff is requesting approval of a Third Amendment extension to allow the City sufficient time to reconsider the selection of a service provider, make a recommendation to the City Council and then a transition period into the next selected provider.
Discussion and Analysis:
In October of 2023, the City made the decision not to continue security services from Good Guard, Inc. On October 25, 2023, Council approved Resolution #2023.127 awarding Professional Security Consultants (PSC) a six-month agreement for professional security services through April 25, 2024 for providing security services. On April 16, 2024, the first amendment to the agreement was approved through November 17, 2024 to allow staff to prepare and gather input from Council regarding security services and considerations for City Council City Council Regular Meeting 159
THIRD Amendment to Security Consultants Agreement DRAFT 012125 v2 CM.docx Resolution - Security Services Third Amendment.docx
dedicated attention to homeless/quality of life matters in the City’s public parks. A Second Amendment was approved via Resolution #2024.134 on November 5, 2024 extending the agreement through January 31, 2025.
At the regularly scheduled meeting held on December 17, 2024, the City Council decided to continue consideration of the selection of a new security services provider to a regular meeting in February 2025. In order to continue security services without interruption, staff requests that the City Council to authorize the Mayor or designee to approve a third amendment to the agreement with PSC to continue to provide the security services up to nine (9) additional months. The professional services agreement retains the City's rights to terminate these services with thirty (30) days written notice.
Under the extended agreement period, the current hourly rates paid to PSC will reflect the same fee schedule approved with the Second Amendment. All other contract terms and scope of work would remain the same as outlined in the current contract. Staff is requesting approval of the recommended action through adoption of the accompanying Resolution. Approval will allow professional security patrol services to continue uninterrupted until the City's RFP process is completed and a new provider is chosen. Via resolution, staff is requesting authority to work with the Finance Department to make a Budget Adjustment of $220,000 for Account #1011.60.701.62016 to fund services for the remainder of the current fiscal year. This additional appropriation will be absorbed by Recreation & Community Services Department salary savings anticipated within the current fiscal year.
Fiscal Impact:
The requested action will authorize staff to work the Finance Department to execute a Budget Adjustment of $220,000 for Account #1011.60.701.62016. No additional appropriation is required, as the overage will be absorbed by Recreation Department salary savings of the current Fiscal Year. Funds for services to be provided in Fiscal Year 2025-2026 shall be considered and appropriated during the City's normal Budget development process.

Question- What type of interests do you have that would enhance your service as a commissioner or board member on the commission or board you are applying for? Answer- My interests in community revitalization, equitable development, and civic engagement strongly align with the mission of this board. I am deeply committed to enhancing economic opportunities and addressing the diverse needs of communities. With experience in grant management, resident engagement, and data - driven decision - making as a Community Development Analyst, I have a hands-on understanding of how to work with diverse stakeholders to implement programs effectively. My commitment to fostering inclusion, as evidenced by my role chairing an Equity, Diversity, and Inclusion Committee for the state of California, also drives me to ensure that our policies and funding decisions are inclusive and beneficial for all community members.
Additionally, as someone who has actively participated in local PTA and school site councils, I am deeply invested in supporting family and youth services. Serving on this commission would allow me to contribute my skills and passion for community building and help create sustainable, equitable solutions for the community.
Question- Based on your interest, what do you feel you can contribute as a commissioner or board member on this commission or board?
Answer- I believe my background in community development, coupled with my interests in equitable economic growth and civic engagement, would enable me to contribute a well- rounded, hands-on perspective to the commission. My experience managing grants, preparing reports for agreements with subrecipients, and coordinating with federal and state programs has given me a practical understanding of the processes required to implement community development projects successfully. I could bring this expertise to the commission by providing informed insights on funding allocations, project feasibility, and accountability measures.
Moreover, my leadership roles, such as chairing the Equity, Diversity, and Inclusion Committee for the state of California, have prepared me to advocate for inclusive policies that benefit all community members, particularly underrepresented groups. I am also deeply connected to the needs and aspirations of residents, thanks to my civic involvement with the PTA, school site councils, and organizations like the National Action Network. As a commissioner, I would work to ensure that our planning and development efforts genuinely reflect the community's voice and contribute to long-term, sustainable growth.
