Establishment of a Solid Waste Fee Review – MWS Senior Compliance Expert, Louis Ippolito, has completed more municipal franchise audits than any other consulting in the California solid waste industry. As a result, MWS performs the most complete and effective franchise audit and compliance evaluation of any other firm and will bring this quality of professionalism and an exhaustive array of required and recommended tasks worthy of the City of Lynwood and it’s community. Mr. Ippolito, is very familiar with the City’s Agreement with Waste Resources, Inc. and has developed a preliminary fee schedule which corresponds directly with the Agreement.
The fee review for FY 2025 as required herein will petition all pay ment records from the Contractor at the time specified pursuant to the Agreement. In order to perform an adequate and comprehensive evaluation of the Contractor’s performance and submittal of all fees, contributions, services promised the City’s residents and businesses negotiated into the Agreement under Section 11 Contractor’s Consideration as identified in the following table:
Table I Requirement Agreement Payments to City
As stated, each of the associated payments to the City are directly identified in Section 11 Contractor’s Consideration and most have timelines, CPI escalations and penalties for late or non-payment. It was learned through discovery of the Agreement under this section, that the City is not responsible for payments associated with Co nsultant fees for many of the CalRecycle requirements and legal fees associated with any and all tasks associated with the management of the Agreement. MWS will use its expertise and public information from Franchise Agreement

Consultant and legal fees for the estimate of pay ments necessary to make the City whole and comply with the requirements under Section 11.
As a result, in addition to the records submitted to the City including customer service data and legislative compliance assistance, MWS recommends the following task s to be completed that ensures the City has received the services it deserves:
Customer Service Audit: The following flow chart indicates an effective and efficient C S R Strategy deployed across many industries including the solid waste and recycling space the Contractor should be familiar with:
Develop Formal Flow Chart: MWS will conduct a Customer Service Response Assessment (Assessment) with the following tasks:
a) Contact general CSR line(s) publicized by Contractor and conduct a Time and Response evaluation by performing following tasks and inputting resulting data:
1) time to answer;
2) accuracy of transfer to appropriate department;
3) department response to nature of call;
4) demeanor of CSR and department representatives;
5) duration of call, transfer and resolution;
6) follow-up to call and resulting notification.
This exercise is a simple, but effective way of determining the basic nature of CSR response by the Contractor to the City residents, businesses or community groups to ensure efficient WRI CSRs

customer response, timeliness, professionalism and manner of call resolution as outlined in Section 10.8.2.2 and 10.8.3 of the Agreement which requires:
Contractor to answer all phone calls within five (5) rings After five (5) rings and three (3) minutes, caller can leave a message CSR makes three (3) attempts to contact caller within twenty-four (24) hours First attempt to contact caller sent to message center must be within one hour In addition, MWS will test the requirements in the Agre ement under Complaint Documentation by contacting the City ’s direct line to CSRs and relay customer complaints for appropriate response. MWS will also check to see if this system works and the method of response and storage for all Customer Complaints either received by the Contractor directly or handed off by the City. An appropriate number of random calls will be made by MWS to test the complaint response system and the ability of Contractor to effectively manage, respond and store said complaints and cu stomer issues. Per the Agreement, Contractor is required to record the complaint, date and time -stamp the record(s) and accumulate for follow-up, resolution and reporting to City as required.
The following spreadsheet indicates a sample of the Assessment tasks and number of calls necessary for a succinct evaluation of the Call to CSR process:
Upon completion of these tasks, MWS will develop a Recommendations Report, if warranted, and summarize and evaluate task results, suggestions for improvement, policy or response adjustments and fine tune the rules of customer engagement.
Education and Outreach Commitment and Adherence to Agreement Being familiar with the Contractor ’s Agreement requirements, MWS was present during the initial transition from Republic Services, Inc. to Waste Resources, Inc. in early 2014. Of particular importance is the Contractor ’s educational and outreach materials necessary to avoid confusion and provide a smooth transition from one service to the next. Option II Cost Estimate - Full Compliance Evaluation from Inception of Agreement MWS has provided an alternative Cost Estimate to bring the Performance Evaluation and Audit from the inception of the A greement from January, 2014. The following rationale has been developed for the City’s review and consideration:
1. The first-year audit in 2014 found $327,000 in fees due the City for year one of the Agreement
2. WRI is involved in transferring 100% of shares, including the Lynwood Agreement, to Waste Management, Inc.
3. If a complete Performance Review and Audit is not conducted since Agreement start, any fees owed the City by WRI, not uncovered over the past ten (10) years will be lost to the City.
4. Over $21,000,000 in City fees are due from WRI since inception of Agreement, and a Financial Audit can and will determine if all fees are paid 171

AGENDA STAFF REPORT
DATE:
August 19, 2025
TO:
Honorable Mayor and Members of the City Council
APPROVED BY:
Julian Lee, City Manager
PREPARED BY:
Rita Montalvo, Public Works Director
SUBJECT:
ACCEPTANCE OF THE ANNUAL SIDEWALK IMPROVEMENT
PROJECT, FY 2024-2025 (CIP NO. 2121|2251.68.143 & 4011.68.130) AS
COMPLETE
Agenda Item # 9.2.
Recommendation:
Staff recommends that the City Council adopt the attached resolution entitled: “A
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD ACCEPTING THE ANNUAL SIDEWALK IMPROVEMENT PROJECT FY 2024-2025 CIP NO. 2121|2251.68.143 & 4011.68.130 AS COMPLETE; AUTHORIZING THE FILING OF THE NOTICE OF COMPLETION WITH THE LOS ANGELES COUNTY RECORDER’S OFFICE AND THE RELEASE OF THE 5% RETENTION 35 DAYS AFTER THE ACCEPTANCE.” Background:
Sidewalk improvements are implemented as part of the City's 5-year CIP program. These improvements are crucial because they enhance pedestrian safety, provide better accessibility for people with disabilities, reduce the risk of accidents, and promote overall walkability within the community. Additionally, well-maintained sidewalks contribute to the aesthetic appeal of neighborhoods and can encourage healthier, more sustainable modes of transportation.
Staff conducted an Informal Request for Proposals (IRFP) for the Sidewalk Improvements Project FY 24-25 CIP No. 2121|2251.68.145 & 4011.68.130. On October 24, 2024, staff sent an invitation to six (6) contractors to submit proposals for the Project. On November 6, 2024 staff received two (2) proposals.
Discussion and Analysis:
After a thorough review of the submitted proposals, including DIR verification and CSLB License verification, staff determined that Gentry General Engineering, Inc. met all necessary City Council City Council Regular Meeting 176
qualifications, and was awarded a construction contract. in the amount of $117,238.00 on December 17, 2024.
A Notice to Proceed was issued, marking the start of construction on March 24, 2025.
Throughout the life of the project, there were discrepancies in working conditions that required additional materials and working days. These had to be addressed through two (2) change orders issued. The final date of construction was June 6, 2025.
