PUBLIC COMMENT:

The first 15 minutes of the meeting are reserved for members of the public to address the Council on items which are within the subject matter jurisdiction of the Council. Speakers shall be limited to three minutes. Speakers will be asked, but are not required, to identify themselves and state the subject of their comments. If the subject is an item on the Agenda, the Mayor has the option of asking the speaker to hold the comment until that item is called. Comments on items listed as a Public Hearing on the Agenda should be held until the hearing is opened. The Council is prohibited by law from taking any action on matters discussed that are not on the agenda, and no adverse conclusions should be drawn if the Council does not respond to public comment at this time.

Destiny Delgadillo of Crest Creations and Promotions stated that she held an event on April 28th and expressed concern that vendors thought the mobile vendor application permit fees were too high. She asked that making the fees more affordable would benefit the community.

Xitlali, a District 6 resident invited Council to attend a Nu’u Yavi culinary event where the Oaxacan community will showcase their homemade/authentic foods. The event will be held on Friday, May 3rd from 12 noon – 7:00 p.m. at Courthouse Park.

A member of the public, Hector Hernandez stated he held an event this past Saturday for Day of Kids.

He stated that his experience with obtaining the permit from the Parks Department was stressful. He turned in the required paperwork and fees the first week of April. The Parks Department reached out two days before the event to tell them they hadn’t received the insurance or the payment. He was able to have his event but it was stressful. He thinks the City can have a better process with better communication, so customers don’t stress.

A member of the public, Alexis stated she experienced something like Destiny and Hector. She submitted her application and payment for a Soccer League fundraiser. One day before the event, the permit still had not been approved. She agrees that fees are too high. She suggested that the City hold a workshop that shows customers how to navigate the permit process.

Jonathan Martinez stated that something should be done about the professional scammers in town that pretend to do tournaments and fundraisers then show up at these meetings to complain about the process and fees. They need to follow the rules. He does agree that there is a lack of communication between the City and customers.

Continuing Declaration Proclaiming the Existence of a Local Emergency – January 2023 Winter Storms
RECOMMENDATION:

Adopt a Resolution Continuing the Declaration Proclaiming the Existence of a Local Emergency – January 2023 Winter Storms in accordance with Madera Municipal Code Title III, Chapter 2 SUMMARY:

The City of Madera and State of California experienced significant storm events and related impacts beginning in December 2022. President Biden declared a major disaster for various counties in California, inclusive of Madera County, for severe winter storms, flooding, landslides, and mudslides. The disaster period began December 27, 2022, and concluded January 31, 2023.

The City of Madera declared a local emergency related to storm impacts incurred during the disaster period. The requested action is to continue the emergency declaration while the City works through project completion for repairs and finalizes disaster assistance through the Federal Emergency Management Agency (FEMA) and California Office of Emergency Services (CalOES).

DISCUSSION:

California experienced severe winter storms beginning in December 2022. President Biden declared a major disaster for various counties in California, inclusive of Madera County, for severe winter storms, flooding, landslides, and mudslides. The disaster period began December 27, 2022, and concluded January 31, 2023. During the disaster period, the City of Madera experienced significant impacts, including:
▪ Debris clearing in the storm system, public right-of-way, and park spaces ▪ Emergency protective measures
▪ Catastrophic failure of the Avenue 13 sewer trunk line at Granada Drive ▪ Multiple storm drain line failures and related asphalt and/or sidewalk failures ▪ Asphalt failure
▪ Degradation of equipment at the Wastewater Treatment Plant due to additional incoming debris
▪ Administrative costs associated with the above as well as with administration of the claim for damages with FEMA and CalOES
The City Manager as the Director of Emergency Services initially declared a local disaster for the City of Madera on January 27, 2023. This declaration was ratified by the City Council at its meeting February 1, 2023, and has since been extended in compliance with the City’s municipal code and FEMA and CalOES requirements. The contemplated action will continue the local emergency as staff works with FEMA and CalOES on projects to repair and mitigate local impacts related to the declared disaster.

Attachment 1 to this report summarizes the City’s projects submitted to FEMA and CalOES under this disaster. To be considered for reimbursement under the emergency declaration, all project work must be completed by July 14, 2024. At this time, the City has one remaining incomplete project relating to pump damage at the Wastewater Treatment Plant. Plant staff has advised that quotes for repair work on the final pump are in process.

FINANCIAL IMPACT:

The recommended action is necessary to ensure specific liability protection, emergency powers of the Emergency Services Director, and potential recovery of eligible costs, if any, from State and Federal emergency funds.

ALTERNATIVES:

Staff does not recommend consideration of other alternatives given alternatives likely would remove reimbursement to the City that may become possible as a result of this action.

Acceptance of Basketball Courts at McNally Park
RECOMMENDATION:

Staff recommends that the City Council approve Minute Order Approving:

1. Acceptance of the Newly Reconstructed Basketball Courts at McNally Park, located at 825 South A Street, Madera, CA 93638.

2. The Recording of Notice of Completion.

SUMMARY:

The reconstruction of two basketball courts at McNally Park was completed on April 22, 2024.

The scope of work encompassed the removal of the existing courts and the construction of two high-school-sized basketball courts. The new courts feature concrete surfacing, and both are standardized to measure 84 feet by 50 feet, including proper striping.

DISCUSSION:

During the CDBG Action Plan for Fiscal Year 2022/2023, the City was awarded a total of $609,307 for improvements at McNally Park. Staff proceeded with two major phases of improvement plans. The first phase included the complete renovation of the existing playground area. This consisted of the removal of existing playground equipment and upgrading with new playground equipment, swing sets, and new safety perimeter fencing for a brand-new playground area. This phase also included replacing outdated and damaged park amenities with new trash cans, picnic tables, grills, benches, and water fountains. A Notice of Completion was accepted by the Council Council Meeting of: May 15, 2024
Agenda Number: B-5
on November 15, 2023, for the playground equipment and park amenities installed at McNally Park.

After the completion of the first phase of improvements, staff began planning for the second phase to include the full reconstruction of the basketball courts. This was determined as a much needed component, being the courts have had no major repairs or maintenance for decades. The courts are highly utilized playing courts by members of the community, with even informal basketball tournament events taking place throughout the year.

To proceed with the improvements needed, staff prepared IFB No. 202324-24. The IFB was released on January 6, 2024, with bids due on Monday, January 29, 2024. The IFB notice was duly published in the Madera Tribune on January 6 and 13, 2024. In addition, the IFB was published on various bidding platforms.

On February 7, 2024, Council approved Juarez Brothers General Engineering, Inc. as the lowest, responsible bidder at $218,353. The contractor began work the week of February 21, 2024.

On March 20, 2024, Council approved a change order of $35,943.89 to address additional expenses, including:
 Change order was associated with the disposal and removal of excess materials from the site
 Additional labor and time due to unusual thickness found from the courts ranging from approximately 7-8 inches of thickness
 The subgrade was unstable. These conditions were attributed to elevated moisture levels causing the instability and posing challenges to the construction process if not addressed properly
After the approval of the change order, the contractor resumed progress on the project, with the reconstruction of the basketball courts completed as of April 22, 2024.

A grand re-opening event was held on Friday, May 3, 2024, to celebrate the completion of the project and to let the community know the courts were ready for use.

Clarification
During the March 20, 2024, staff inadvertently stated that the industry standard for new basketball courts is between 2-3 inches thick. After further review, basketball courts are constructed with a thickness ranging between 4-6 inches. This adjustment ensures the structural integrity and longevity of the courts, providing a safe and optimal playing surface for our community members.

FINANCIAL IMPACT:

Funding for the reconstruction of the basketball courts comes from the Community Development Block Grant (CDBG). A total of $609,307 was awarded to the Parks & Community Services Department for improvements at McNally Park in Fiscal Year 2022/2023.

To date, expenses associated with CDBG expenditure at McNally Park are captured in Table 1.

Acceptance of Trail Restoration Project at Vernon McCullough River Trail RECOMMENDATION:

Staff recommends that the City Council approve Minute Order Approving:

1. Acceptance of the Vernon McCullough River Trail Surface Restoration Project.

2. The Recording of Notice of Completion.

SUMMARY:

The Vernon McCullough River Trail surface restoration project was completed on April 26, 2024.

The scope of work encompassed crack filling and pothole repairs to the trail at identified locations, as well as seal coating of the entire extent of the trail.

DISCUSSION:

On November 15, 2023, Council approved Resolution No. 23-197 awarding a contract under Invitation for Bids (IFB) No. 202324-07 to Witbro Inc. dba Seal Rite Paving and Grading (Seal Rite) for the trail seal coating and repairs at the Vernon McCullough River Trail for $190,116.

For background, the trail conditions and the need to restore the trail surface were discussed as part of the Department of Transportation (Caltrans) Clean California Local Grant Program (CCLGP), Cycle 1, funding opportunity. During this grant application, and due to the grant's focus on revitalizing open spaces, trail restoration became a component of the grant application. The City was ultimately awarded the CCLGP funding for an award amount of $832,350 in late 2022.

Council Meeting of: May 15, 2024
Agenda Number: B-6
 With the help and support of the Engineering Department, clear technical specifications were developed for the trail work needed by the summer of 2023.  IFB No. 202324-07 was released on September 16, 2023.  Bids were due on October 16, 2023.
 The award recommendation was presented to Council on November 15, 2023.  Notice of Award provided to Seal Rite on November 21, 2023.  Seal Rite began work on January 30, 2024.

On March 20, 2024, Council approved a contract change order for the project in the amount of $62,428.50. This change order came to light after careful assessment and consideration of locations requiring additional attention. It was determined that supplementary work was necessary in two sections to address extensive alligator and spider cracking, as well as raising elevation points. Additionally, following the original scoping of the project, additional damaged areas were uncovered that needed to be rectified before the seal coating process happened, so as to provide an effective end product. Including the change order, the trail restoration totaled $252,544.50.

On April 24, 2024, City staff met with Seal Rite to do a walk-through of the trail and indicate final points of interest to be addressed prior to project completion. Items were addressed by the following day.

FINANCIAL IMPACT:

Funding for the trail surface restoration at Vernon McCullough River Trail comes from the CCLGP award. A total of $832,350 was awarded to the City for beautification and litter abatement efforts in and around the Fresno River and the Vernon McCullough River Trail. To date, expenses associated with CCLGP expenditure are captured in Table 1.

SUBJECT:

First Amendment to the Lease Agreement for Facilities at the Millview Community Center with Community Action Partnership of Madera County
RECOMMENDATION:

Adopt a Resolution Approving the First Amendment to Lease Agreement for Facilities at the Millview Community Center with the Community Action Partnership of Madera County (CAPMC) SUMMARY:

The City has maintained a written Lease Agreement with CAPMC for over 28 years for the use of a building at the Millview Community Center. CAPMC uses the Millview Community Center to house a Head Start program which provides preschool for Madera’s young children.

On April 30, 2024, CAPMC requested the Agreement be renewed, as the current agreement is set to expire on May 15, 2024. Due to the short turnaround, staff would like to thoroughly review the agreement for revisions, and updates, and ensure the fees associated with the lease agreement are in line with comparable lease agreements, thus staff is requesting a 90-day agreement extension to finalize the negotiations without interruption to the lease agreement. The extension would be through August 15, 2024.

DISCUSSION:

CAPMC entered into a Lease Agreement with the City in 1995 for the use of the Millview Community Center facilities. Several amendments and an updated, consolidated agreement in 2016 followed the 1995 agreement. The most recent Lease Agreement was executed in May 2021 for three years.

CAPMC has exclusive use of the west wing of the Millview Community Center facility, including a kitchen and an outdoor play area with playground equipment. The following provisions were contained in the 1995 document, the original Agreement, and subsequent amendments and updates:
 CAPMC has exclusive use of the west wing portion of the Millview Community Center.  CAPMC must pay for all building maintenance (interior and exterior) for their leased portion.
 CAPMC pays utilities, custodial supplies, and services for the portion of the property they lease.
 CAPMC is responsible for replacing all equipment, including air conditioning systems, of the portion of the property they lease.
 In exchange for their use of the facilities, in addition to the above-noted facility maintenance, CAPMC will pay $500 in monthly rent.

CAPMC has used this facility for the operation of the Verdell McKelvey Head Start program since 1995. The Head Start program serves children from birth to age 5 and their families through a variety of services related to growth and development in a positive learning environment. These services focus on early learning, health, and family well-being.

It should be noted that CAPMC has been an excellent tenant during the entirety of the lease agreement, with an open line of communication when issues have arisen. Staff holds no reservations about continuing the lease agreement, yet an extension to allow for a thorough revision of the agreement by risk management, for financial reasons, and for legal reasons is requested to ensure the City’s interest.

FINANCIAL IMPACT:

The monthly revenue generated from the lease agreement is currently set at $500. This totals $6,000 in annual revenue relief to the General Fund.

Staff would like to ensure the value of the lease agreement aligns with comparable lease agreements, as the monthly rent has been set to the $500 monthly fee for the last several years.

ALTERNATIVES:

Council may deny the extension of 90 days, through August 15, 2024, which would result in the immediate termination of the Lease Agreement for Facilities at the Millview Community Center with the CAPMC.

Arnoldo Rodriguez, City Manager
SUBJECT:

Second Reading and Adoption of an Ordinance to Rezone (REZ 2022-09) ±2.3 acres of property located on the westerly corner of the Intersection of North Schnoor Avenue and Foxglove Way (APN: 013-070-014).

RECOMMENDATION:

The Planning Commission and staff recommend the City Council hold a public hearing, make the necessary findings, and take actions as follows:

1. Waive full reading and adopt by title only an Ordinance of the City Council of the City of Madera approving Rezone 2022-09 and amending the official City of Madera Zoning Map to rezone approximately 2.3 acres of property (APN: 013-070-014) from the PO (Professional Office) zone district to the C1 (Light Commercial) zone district.

SUMMARY:

An amendment of the City’s zoning regulation requires two actions by the City Council (Council):
the introduction of the Ordinance (first reading); and the adoption of the Ordinance (second reading).

The Council waived the first reading and introduced by title only the Rezone Ordinance to amend the official City of Madera Official Zoning Map to rezone approximately 2.3 acres approximately

2.3 acres of property (APN: 013-070-014) property from the PO (Professional Office) zone district to the C1 (Light Commercial) zone district at a public hearing held on May 1, 2024.

At the public hearing held on May 1, 2024, the City of Madera City Council adopted Resolution No. 24-62 adopting the Mitigated Negative Declaration (SCH No. 2024030027) and the Mitigation Monitoring and Reporting Program prepared for purposes of the proposed project (including REZ CC 5/15/2024 (REZ 2022-09) – Foxglove & Schnoor 2
2023-09); and approving an amendment to the Madera General Plan (GPA 2022-08) and Madera Specific Plan No. 1 (SPA 2022-01) .

The owner/applicant, Edward J. McIntyre, filed General Plan Amendment (GPA) No. 2022-08, Specific Plan Amendment (SPA) No. 2022-01 and Rezone (REZ) No. 2022-09 pertaining to ±2.3 acres of property located on the westerly corner of the Intersection of North Schnoor Avenue and Foxglove Way (the project site) comprising APN(s): 013-070-014.

GPA 2022-08 was filed to amend the General Plan Land Use Map to change the planned land use designation for the project site from Office to Commercial. SPA 2022-01 was filed to amend the planned land use designation for the project site from PO (Professional Office) to C1 (Light Commercial).

Pursuant to the City of Madera Municipal Code (CMC), all uses of land within a Specific Plan shall be made consistent with the General Plan Land Use Map, which may include varying densities or residential, commercial, and/or industrial development. SPA 2022-01 was filed to amend City of Madera Specific Plan No. 1 planned land use designation for the project site from PO (Professional Office) to C1 (Light Commercial) in accordance with GPA 2022-08 pursuant to the provisions of the CMC.

REZ 2022-09 was filed to amend the City of Madera Zoning Map to rezone the project site from the PO (Professional Office) zone district to the C1 (Light Commercial) zone district in accordance with GPA 2022-08 and SPA 2022-01.

In accordance with Section 65358(a) of the California Government Code, if it deems it to be in the public interest, the legislative body may amend all or part of an adopted general plan.

Pursuant to the provisions of City Municipal Code (CMC) §§ 10-3.1507 & 10-3.1508, a public hearing (for amendments to zone boundaries/changes of property from one zone to another) was held before the Planning Commission on March 12, 2024. Following a complete hearing, the Commission adopted Resolution No. 1982 recommending the Council adopt the Mitigated Negative Declaration (SCH No. 2024030027) and the Mitigation Monitoring Program and approve REZ 2022-09.

In accordance with the provisions of CMC § 10-3.1509, upon receipt of such recommendation (report) from the Commission, the Council shall set the matter for a noticed public hearing and after the conclusion of such hearing the Council may adopt (or deny) the rezoning amendment, or any part thereof.

No physical development on the project site is proposed at this time.

Table 1 below provides a brief overview of the entitlement request, project applicant, project location and site characteristics.

Site Characteristics The project site remains vacant and is surrounded by residential, office and commercial uses.

ANALYSIS:

Site Characteristics:

The project site is currently vacant with no structures. There are minimal off-site improvements, including curb and gutter along Foxglove Way and Schnoor Avenue, as well as a drive approach on Schnoor Avenue. The project site street frontage includes Schnoor Avenue, a four (4)-lane north-south arterial and Foxglove Way, a two (2)-lane east-west local street. Topography is generally flat, and the existing biotic conditions and resources of the site can be primarily defined as ruderal. There are no shrubs, trees, or water features present on the site.

Surrounding Land Uses:

The project site is generally surrounded by a mix of residential and commercial uses. The existing General Plan land use designations surrounding the Project site are high density residential (north), commercial (east), office and medium density residential (south) and low density residential and resource conservation (west). Existing zoning designations surrounding the Project site include: PD-2000 (Planned Development, One unit for each 2,000 square feet of site area) to the north; C2 (Heavy Commercial) to the east; PO (Professional Office) and PD-4500 (Planned Development, One unit for each 4,500 square feet of site area) to the south; and, PD6000 (Planned Development, One unit for each 6,000 square feet of site area) and PD-2000 to the west.

Table 2 below summarizes the existing development/uses, and the General Plan land use designations and zoning districts surrounding the proposed project site. The General Plan designations identified in Table 2 represent the City’s General & Specific Plan land use designations surrounding the project site.

Land Use and Zoning:

Policy LU-23 of the City of Madera General Plan describes the Commercial Land Use Categories and Policies. The Madera General Plan identifies two commercial land use categories, Commercial and Office.

The existing Office land use designation for the project site is a land use category intended to provide for the development of office centers near residential areas and is designed to buffer between residential areas and more intense uses or arterial streets.

The areas are differentiated from office uses in commercial designations by reduced quantities of signage and architecture that is more consistent with any adjoining residential areas.

Architecture and other features should be sympathetic with adjacent residential values. The maximum floor area ratio (FAR) for the Office designation is 1.0 except in the Downtown District where this FAR may be exceeded if determined appropriate by the City.

GPA 2022-08, SPA 2022-01 and REZ 2022-09 collectively propose to amend the General Plan to change the planned land use designation from the Office planned land use designation to the Commercial land use designation and Specific Plan No. 1 to change the planned land use designation from the PO (Professional Office) planned land use designation to the C1 (Light Commercial) land use designation; and amend the official Zoning Map to rezone the project site from O (Office) to C1 (Light Commercial).

The Commercial land use designation is the City’s retail commercial land use category. A broad range of commercial uses is allowed, including professional offices. Various zoning designations shall be used to determine the specific character of commercial development, from regional CC 5/15/2024 (REZ 2022-09) – Foxglove & Schnoor 5
shopping centers to neighborhood stores. The maximum floor area ratio (FAR) for the Commercial designation is 0.30.

In accordance with General Plan Policy LU-23 and pursuant to the provisions of CMC § 10-3.751, aside from a specific intent of providing adequate space for professional office related uses to be in close relationship to one another, outside of commercial districts, to protect such offices from objectionable influences incidental to commercial and industrial uses, the Professional Office land use designation and zoning is also intended for application to those areas of the city where it is necessary and desirable to encourage the full development of properties which lie between residential and nonresidential districts. As cited herein above, this type of “buffer” is generally achieved through a lower allowable (less intense) floor-area ratio than the Commercial land uses in the zoning development standards, reduced quantities of signage, and architecture that is more sympathetic and consistent with any adjoining residential areas and values.

Pursuant to General Plan Policy LU-23 various commercial zoning designations shall be used to determine the specific character of commercial development from regional shopping centers to neighborhood stores. As the project site is a vacant parcel located adjacent to and between residential and nonresidential districts, the C-1 (Light Commercial) zone district is proposed to continue to provide and retain a buffer between the residential uses and more intensive heavy commercial uses and arterial roadway (Schnoor Ave) to the east.

No physical development of the project site is proposed at this time. Future development will require Site Plan Review and or Use Permit in accordance with the Zoning Regulations of the CMC.

Future development will be reviewed for consistency with the goals and policies of the General Plan, the goals and policies include but are not limited to the following:
• The General Plan Land Use Core Principles, which include a commitment by the City of Madera to promote walkability by establishing land use and circulation patterns that provide connectivity between neighborhoods, commercial services, and other public gathering places.
• General Plan Policy CD-15, which provides except where site conditions make it infeasible, new commercial development shall be designed to front or have a presence along all street frontages. The intent of this policy is to enhance the pedestrian scale of new development, and minimize the presence of parking, circulation, and loading areas as the primary visual features of development.
• General Plan Policy CD-52, which provides when more than one structure is on a site, they should be linked visually through architectural style, colors and materials, signage, landscaping, design details such as light fixtures, and the use of arcades, trellises, or other open structures.
• General Plan Policy CD-60, which provides commercial site boundaries adjacent to residential areas shall be visually screened with ornamental masonry walls and CC 5/15/2024 (REZ 2022-09) – Foxglove & Schnoor 6
landscaping. Wall height is to be determined and approved as part of the site plan review process.

It should also be noted that the General Plan recognizes retail and commercial areas outside of Downtown have been primarily developing in the northwest portion of the city along Cleveland Avenue and Howard Road. Additionally, the General Plan acknowledges commercial development such as regional shopping centers and “big box” retail are typically automobileoriented and are physically separated from nearby residential areas.

The C1 (Light Commercial) zone district standards and permissible uses will help promote the creation of a more complete neighborhood and a more walkable, bicycle-friendly activity center in this area (and outside of Downtown) by providing opportunities to afford more neighborhoodserving commercial uses (vs. heavy commercial, “big-box” and regional integrated centers which are either existing or planned to the east) in proximity to existing residential uses. Review of future development plans for compliance with these goals, objectives and policies will ensure adherence to the Madera’s Vision 2025 by supporting an increasingly vibrant city which not only attracts visitors but also continues to increase opportunities for local shopping diversity to serve local residents within neighborhoods, attract local activity for smaller-scale and neighborhoodserving commercial businesses and while providing availability for affordable commercial space.

Review of future development for compliance and consistency with these principles will also ensure an adequate transitional buffer between more sensitive residential uses and heavier and more intense non-residential uses and roadways to the east. The project may therefore be considered consistent with the goals, objectives and policies of the General Plan and is supported by staff.

Madera Countywide Airport Land Use Compatibility Plan:

The project site is located within the Airport Influence Area (Compatibility Zone D, Outer Airport Environs) of the Madera Countywide Airport Land Use Compatibility Plan (ALUCP).

The Airport Influence Area constitutes the Referral Area within which certain Land Use Actions and Airport Actions are subject to ALUC review to determine consistency with the policies herein.

The responsibility for implementation of the Airport Land Use Commission (ALUC)-adopted ALUCP, rests with the affected local agencies. One of the responsibilities of local agencies is to refer their plans and certain other proposed land use actions to the ALUC for review so that the ALUC can determine whether those actions are consistent with its ALUCP. Proposed adoption or amendment of general plans, specific plans, zoning ordinances, and building regulations always must be referred to the ALUC.

The ALUC referral and review process is defined in Section 2 of the ALUCP. The Local Agency always must refer certain Land Use Action to the ALUC for determination of consistency with the ALUCP prior to approval. These Land Use Actions include the following:
a) Local Agency adoption or approval of any new general plan, specific plan, or facility master plan or any amendment thereto that affects lands within the Airport Influence Area.

CC 5/15/2024 (REZ 2022-09) – Foxglove & Schnoor 7
b) Local Agency adoption or approval of a zoning ordinance or building regulation, including any proposed change to any such ordinance or regulation, that (1) affects land within the Airport Influence Area and (2) involves the types of airport impact concerns listed in Policy

1.3.1(a).

The ALUC Secretary is authorized on behalf of the ALUC to provide formal consistency determinations on Land Use Actions involving parcel-specific amendments (e.g., land use designation change).

A letter of consistency from the ALUC Secretary was provided as an attachment to the prior report for the May 1, 2024, public hearing. This letter provided a determination of consistency subject to specified conditions that shall be added to future development proposals and/or operations to ensure consistency with the ALUCP.

ENVIRONMENTAL REVIEW:

The proposed project has been reviewed for compliance with the requirements of the California Environmental Quality Act (CEQA) Guidelines.

Precision Civil Engineering has prepared an initial study, performed environmental analyses and evaluated the project in accordance with the CEQA Guidelines and criteria on behalf of the City as lead agency. The conclusions and findings resultant from these environmental studies, analyses and an evaluation of the proposed project determined that although the project could have a significant effect on the environment, there will not be a significant effect because mitigation measures have been identified to reduce the significant direct, indirect or cumulative effects on the environment, and that a Mitigated Negative Declaration is appropriate for this project.

The Notice of Intent to Adopt a Mitigated Negative Declaration was filed with the County Clerk on March 1, 2024, published in the Madera Tribune on March 2, 2024, and posted with the Governor’s Office of Planning and Research (OPR) on March 1, 2022, initiating a public review period effectively commencing on March 1, 2024, and ending March 22, 2024.

At the public hearing held on May 1, 2024, the City of Madera City Council adopted Resolution No. 24-62 adopting the Mitigated Negative Declaration (SCH No. 2024030027) and the Mitigation Monitoring and Reporting Program prepared for purposes of the proposed project (including REZ 2022-09).

FISCAL IMPACT:

The applicant paid Planning Department entitlement fees in accordance with the City’s adopted Master Fee Schedule to offset the cost associated with processing the subject project applications. Future development will be required to pay all contemporary impact fees, assessments and charges toward supporting City infrastructure and services.

ALTERNATIVES:

ORDINANCE NO. ______

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MADERA APPROVING REZONE 2022-09 AND AMENDING THE OFFICIAL CITY OF MADERA ZONING MAP TO REZONE APPROXIMATELY 2.3 ACRES OF PROPERTY (APN: 013-070-014) FROM THE PO (PROFESSIONAL OFFICE) TO THE C1 (LIGHT COMMERCIAL)

ZONE DISTRICT
WHEREAS, Edward J. McIntyre (“Owner”) submitted an application for a rezone (REZ 2022-09) for approximately 2.3 acres of land located on the on the westerly corner of the Intersection of North Schnoor Avenue and Foxglove Way, comprising APN(s) 013-070-014, in the City of Madera, California (“site”); and WHEREAS, the site is planned for Commercial land uses in the adopted City of Madera General Plan and Specific Plan No. 1 and is currently zoned PO (Professional Office) by the Zoning Ordinance; and WHEREAS, the Owner is seeking approval to rezone the site to the C1 (Light Commercial) zone district pursuant to REZ 2022-09; and
WHEREAS, this project was assessed in accordance with the provisions of the California Environmental Quality Act (“CEQA”) resulting in preparation of a Mitigated Negative Declaration (SCH No. 2024030027) including a Mitigation Monitoring and Reporting Program, which was circulated, and made available for public review pursuant to CEQA and the City of Madera Municipal Code (CMC) prior to adoption by the City Council; and
WHEREAS, pursuant to the CMC, a properly noticed public hearing was held before the Planning Commission of the City of Madera (Commission) on March 12, 2024, resulting in adoption of Planning Commission Resolution No. 1982 recommending the City Council of the City of Madera (Council) adopt the Mitigated Negative Declaration and mitigation monitoring and reporting program prepared for the proposed project and approve REZ 2022-09; and
WHEREAS, pursuant to the CMC, a public hearing (for amendments to zone boundaries/changes of property from one zone to another) shall be held before the City Council of the City of Madera (Council) and the Council shall adopt the amendment and Environmental Review; and WHEREAS, the City provided notice of the Council hearing as required by law; and WHEREAS, the Council received and independently reviewed REZ 2022-09 during the duly noticed public hearing conducted at the regularly scheduled meeting of the Council on May 1, 2024; and WHEREAS, at the May 1, 2024, public hearing, the public was provided an opportunity to comment, and evidence, both written and oral, was considered by the Council; and WHEREAS, after due consideration of all the items before it, the Council now desires to adopt this Ordinance approving REZ 2022-09.

NOW THEREFORE, the City Council of the City of Madera does ordain as follows:

SECTION 1. Recitals. The foregoing recitals are true and correct and incorporated herein by reference.

SECTION 2. CEQA: This project has been previously assessed. The City Council finds that pursuant CEQA Guidelines § 15162 subsequent environmental review is not required for REZ 2022-09 based on the following:
a. No substantial changes are proposed in the project which will require major revisions of the previous mitigated negative declaration due (MND) to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. In this case, the City Council approved the MND almost immediately prior to the adoption of this Ordinance. REZ 2022-09 is consistent with the same density, intensity, and use, and is exactly as contemplated by the MND. As such, the proposed REZ 2022-09 has the same environmental impacts assessed in the MND.
b. No substantial changes occur with respect to the circumstances under which the project is undertaken, which will require major revisions of the previous MND due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. In this case, REZ 2022-09 is exactly consistent with the MND and specifically contemplated by it. Additionally, approval of REZ 2022-09 was contingent upon the approval of General and Specific Plan Amendments (GPA 2022-08 & SPA 2022-01) approved by the City Council as part of the approval of the MND, the property will be zoned and will be used for commercial uses as originally contemplated by the MND, and there are no new substantial changes in the physical environment that were not anticipated in the MND, including its analysis in light of the rezone contemplated.
c. There is no new information, which was not known and could not have been known at the time of the previous mitigated negative declaration that the project will have significant effect not discussed in the MND. The REZ 2022-09 will not have any more significant effects than that already discussed and assessed in the MND, and was specifically contemplated by the MND. Furthermore, since a MND was previously adopted for the project, the considerations set forth in CEQA Guidelines § 15162(a)(3)(C) and (D), related to the adequacy and feasibility of previously adopted mitigation measures, are not applicable.

Based upon these findings, the City Council determines that this project has already been environmentally assessed and no further environmental documentation is required for REZ 2022-09.

SECTION 3. Findings. Based upon the record before it at the public hearing, the City Council determines the adoption of the proposed rezoning ordinance as recommended by the Planning Commission is in the best interest of the City of Madera. The City Council finds REZ 2022-09 is consistent with the City’s Zoning Ordinance to promote the growth of the City in an orderly and sustainable manner and to ensure consistency with the City General Plan. The City Council hereby makes the following findings:
a. The proposed Rezone will provide the required consistency between the General Plan and zoning in accordance with Table LU-A: General Plan/Zoning Consistency of the Madera General Plan as required by General Plan Policy LU-32. Table LU-A of the General Plan identifies General Plan Land Use Category and Consistent Zoning Districts. According to Table LU-A, the C1 (Light Commercial) zone district is consistent with the Commercial Land Use designation for the site.
b. The Rezone is not expected to be detrimental to the health, safety peace, comfort, or general welfare of the neighborhood or the City. Environmental analyses and findings prepared for the proposed project and as provided in MND (SCH No. 2024030027) considered potential environmental impacts associated with the project. Mandatory findings of significance provide the project will not result in significant environmental effects which will cause substantial adverse effects on human beings, either directly or indirectly. In addition, all required standards of the Zoning Regulations contained within the City Municipal Code will be complied with and conditions of approval will be applied to future development to ensure a future proposed project will not be detrimental to the health, safety, peach, comfort or general welfare of the neighborhood or City.

SECTION 4. Approval of REZ 2022-09. The City Council hereby approves REZ 2022-09 and hereby amends the City of Madera Zoning Map as provided for in Chapter 3 of Title X of the Madera Municipal Code as illustrated in the hereto attached Exhibit “A,” which indicates the segment of the City of Madera Zoning Map to be amended.

SECTION 5. Severability. If any section, subsection, sentence, clause, phrase, or portion of this ordinance is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The City Council hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases, or portions thereof may be declared invalid or unconstitutional.

SECTION 6. Posting. The City Clerk shall certify to the passage and adoption of this Ordinance by the City Council of the City of Madera and shall cause this Ordinance to be published or posted in accordance with Government Code Section 36933 as required by law.

SECTION 7 Effect Date of Ordinance. This Ordinance shall be effective and of full force and effect at 12:01 a.m. on the thirty-first day after its passage. * * * * *

Adopt a Resolution approving the Consultant Services Agreement with the Madera Unified School District (MUSD) for the 2024 Summer Enrichment STEAM Camps not to exceed $35,651 SUMMARY:

Beginning in 2017, the City has partnered with MUSD to provide enrichment activities through summer camps for students. This year, MUSD has once again reached out to the City to continue this collaboration, with a request for two one-week camps to be facilitated and held at the John Wells Youth Center (JWYC) under the oversight of the City.

The proposed program would be hosted by Parks and Community Services (PCS) Department staff. The program will focus on science, technology, engineering, art, and math (STEAM) curriculum, as well as providing swimming lessons, water safety, and recreational/sports activities for approximately 60 students per week.

DISCUSSION:

The City and MUSD have partnered for several years to provide meaningful programs to youth during critical out-of-school summer hours. The partnership in years past with MUSD has specifically targeted youth in the Foster Youth/FIT Programs. These programs were designed to serve MUSD’s most vulnerable students. These programs provide students and families with a network of support.

D-1
This year, MUSD would like to extend availability for these programs to district students from kindergarten to sixth grade, with the camps able to serve 120 students in total.

The STEAM-focused camps intend to provide students with a well-rounded and enriching experience. They will do so through hands-on learning, physical activity, and creative expression.

Students will develop new skills, build confidence, and make lasting memories in a supportive and inclusive environment.

The first week of camp would start July 8, 2024 through July 12, 2024. The second week of camp would run from July 15, 2024, through July 19, 2024. Camps would commence at 8:30 am and end at 3:30 pm. Some of the deliverables to be achieved include:
 Physical Activities: Participation in physical activities offers numerous benefits for youth, promoting physical, social, emotional, and cognitive development, and contributing to their overall health, well-being, and success in life.
 STEAM Activities: STEAM activities are important as they provide a holistic and interdisciplinary approach to learning, preparing the youth to thrive in a complex and rapidly changing world. They cultivate essential skills, foster creativity, and innovation, and empower youth to become lifelong learners and problem-solvers.  Arts and Crafts: Arts and crafts activities play a vital role in youth development by nurturing creativity, promoting emotional well-being, building confidence, and fostering social connections. They provide valuable skills and experiences that contribute to the holistic growth and flourishing of young individuals.
 Swim Lessons: The City can provide swim lessons through the on-site Centennial Park Pool Complex access. Swimming lessons offer numerous benefits, including educating and teaching youth about water safety, learning how to swim, providing physical fitness opportunities, confidence building, social interaction, and lifelong recreation. They provide essential skills and experiences that empower youth to lead healthy, active, and fulfilling lives both in and out of the water.

Camps will be broken up into three groups, with 20 students per group:
 Kindergarten – First Grade
 Second Grade – Third Grade
 Fourth Grade – Sixth Grade
MUSD will provide the meals for the students, which will consist of a breakfast and lunch meal.

MUSD will also organize the outreach and enrollment. The City will be responsible for staffing and training of program staff.

FINANCIAL IMPACT:

The total value of the Agreement is not to exceed $35,651. The value of the agreement covers staffing costs, materials, and includes an administrative fee. As a result, the contract will provide some General Fund relief for the activities borne from this Agreement.

With the summer camp taking place in July, these expenses and revenue generated from the Agreement will be budgeted in the Fiscal Year 2024/2025 in the Parks & Community Services Department – Recreation budget.

Table 1: Madera Unified School District 2024 Summer Camp Budget Item Amount
Staffing – Program Leaders & Lifeguards $23,521
Materials $5,000
25% Administrative Fee $7,130
Total $35,651
ALTERNATIVES:

As an alternative, the Council may elect to not enter into the Agreement with MUSD for the 2024 summer camp programming, thus not continuing the now annual partnership.

Council may also elect to request additional information be brought forth at the next meeting to make a more informed decision. Staff would like to note, MUSD has requested confirmation of approval of the Agreement before May 28th to confirm the summer programming will proceed, and to begin to plan accordingly. Any delay in providing confirmation may affect the City’s ability to enter into the Agreement altogether.

Rotary Park Rental for 2024 Farmers’ Market Fee Waiver Request RECOMMENDATION:

Adopt a Resolution waiving the rental fees of Rotary Park related to the 2024 Neighborhood Farmers’ Market at an anticipated fee rental of $1,775
SUMMARY:

The City received an inquiry from the Farmers’ Market Team requesting waiving rental fees for using Rotary Park starting on June 13 to September 12, 2024, for weekly Farmers’ Markers every Thursday from 3:30 pm to 7:30 pm.

DISCUSSION:

For context, the Farmers Market in previous years was sponsored by Madera Community Hospital through its non-profit Foundation. As a non-profit organization, the Foundation was eligible to receive funding via Market Match. The Foundation received funding that allows for operational expenses. This included staffing a general manager, a bookkeeper, two cashiers, advertising, and supplies.

Due to the closure of the Hospital and Foundation, the Farmer’s Market needed a new operator.

Last year, the Madera Coalition for Community Justice (MCCJ), with leadership from the former Farmers’ Market manager, stepped in to fill the void to continue the Farmers Market during the summer of 2023. MCCJ applied for Market Match funding and ultimately became the recipient of the Market Match funds, holding a 501(c)(3) title, which made them eligible for funding. MCCJ become the fiscal sponsor and leading operator of the Farmers Market, which included planning D-2
for operational logistics, staffing, advertisement, farmer recruitment, securing partnerships and collaboration, and supplying event with supplies.

This year, Latinas Unidas has been the applicant for Market Match funding to be the fiscal sponsor and leading operator of the Farmers’ Market. The group holds a 501(c)(3) title, which makesthem eligible for the funding. Latinas Unidas isa group of empowered women whose mission is to bring together Latina’s in the local area to support the Latino community.

The Farmers’ Market Tea, composed of both volunteers and Market Match funded staff, has submitted a request to the City seeking the waiver of rental fees for the use of Rotary Park starting on June 13 through September 12, 2024. There will be weekly Farmers’ Markets every Thursday during this timeframe. The market will run for a total of 14 weeks this upcoming summer, being funded by Market March grant funding, but also made possible through sponsors.

The Farmers’ Market Team does not charge farmers to be a part of the event.

Rotary Park is on Gateway Drive, just north of the Fresno River. This central location offers easy access for residents and visitors alike, fostering a vibrant atmosphere. It is important to note that the Farmer's Market is proposed to occupy only a relatively small portion of the park and no adverse impacts are anticipated on programmed activities within the park.

For context, Council approved a similar request the summer of 2023, as well as waived fees for the rental of the park in association with the Farmers’ Market. Resolution No. 23-47 reflects Council's decision to waive fees.

This year the market is scheduled between 4 pm to 7 pm, with an additional half-hour for setup and a half-hour for cleanup being requested.

The Farmers’ Market Team shared the market will bring such benefits to the community as providing vouchers for seniors worth $5,000. An additional $35,316 in vouchers for the Supplemental Nutrition Assistance Program (SNAP) and Women, Infants, and Children (WIC) recipients.

The rental request specifically includes using the shelter areas closest to the Zero Gravity Skatepark.

This event itself has been approved to take place, subject to all other applicable requirements for a special event. This includes the provision of acceptable rental insurance and all additional permits.

FINANCIAL IMPACT:

The applicable costs associated with the rental of Rotary Sports Complex Rental as requested are summarized in Table 1.

Table 1: Estimated Financial Impact to the City
Administrative Fee $25
Rental Charges for Shelter 1 - $10.00 per Hourly Rental Fee x 5 Hours x 14 Days $700 Rental Charges for Shelter 2 - $10.00 per Hourly Rental Fee x 5 Hours x 14 Days $700 Deposit $100
Special Event Charge $250
Total $1,775
ALTERNATIVES:

The Council may elect to reject the fee waiver and require the event organizer to remit any associated fees for the rental of Rotary Park on the datesrequested for the 2024 Farmers’ Market request.

On behalf of the Farmers Market Team, I wanted to express our hearelt gratude for your incredible support in waiving the fee for Rotary Park use during last year's market. We are incredibly grateful for your contribuon, which has allowed us to enhance the market experience for vendors, community agencies and visitors. We are currently gearing up for this year's farmers market, and we were wondering if we could count on your support once again waiving the fees for use of Rotary Park located at 930 N Gateway Dr. Madera Ca, 93637. Our Farmers Market season will be from June 13 to September 12 every Thursday 3:30 pm to 7:30pm, a total of 14 weeks. We are asking for this park because we received lots of good comments from community members and agencies about having the Farmers Market at this locaon last year.

SUBJECT:

Adoption of Updated District Boundary to Include Property Annexed into the City (Country Club Drive-Martin Street Annexation)
RECOMMENDATION:

Waive the full reading and introduce an Ordinance of the City Council of the City of Madera amending Subsection C (3) of Section 2-1.21 of the City Municipal Code to adopt revised district boundaries by title only, including CEQA Guidelines Section 15061(b)(3) determination.

SUMMARY:

LAFCo recently approved Country Club Drive-Martin Street Annexation 2023-001 into the City’s jurisdiction. The annexed territory “rounds out” the City’s boundaries and includes existing structures including several school facilities and multiple existing residences. Members of the public residing in this area are not legally allowed to participate in City elections until the City’s District boundaries are also updated. Normally there would not be sufficient time to complete this process by June 1st to allow voting in local elections this November due to the ballot process, etc. However, the County Register of Voters has graciously provided some additional time to the City, which will allow the ordinance to be adopted at the Council meeting on June 5th. The requested action is to use an expedited process to update the District map for District 3 by introducing the ordinance amending the Municipal Code.

BACKGROUND:

Every 10 years Election Code section 2160 requires cities with by-district election systems to redraw their district boundary maps to ensure compliance with the California and federal Voting Rights Acts. This process, called redistricting, ensures that all districts have a nearly equal population. The City adopted its current district boundaries in 2022 based on 2020 census data as required by law.
01425.0001/965922.1
Since the adoption of the current boundary maps, there continues to be annexation, including the Country Club Drive-Martin Street Annexation adjacent to District 3. The annexed area includes territory that is largely built out, including Jack G. Desmond Middle School, Madera Islamic Center, Ezequiel Tafoya Alvarado Academy, Kingdom Hall of Jehovah's Witnesses, the Tractor Supply Co., and Matilda Torres High School. It also includes several residences, including those along Ellis Street, Adell Street, and Clark Street.

While the area is in the City, it is not within a Council district, thus the Council District boundaries must be modified to incorporate the annexed area to allow for voting in City elections.

DISCUSSION:

State laws set strict criteria for the updates of the district boundaries in such circumstances.

Specifically, the City Council is required to add the new territory "to the nearest existing Council district” without changing the boundaries of other Council district boundaries. As a result, the City’s discretion is limited regarding the present annexation.

As District 3 is the “nearest existing Council district” to the annexed property, the ordinance proposes to add the annexed territory to District 3 consistent with the mandatory requirements of State law.

The City just recently learned that the annexation had been approved by LAFCo a few weeks ago.

Normally there would not be sufficient time complete this process by June 1st to allow voting in local elections this November due to the ballot process, etc. This would mean that the people living in the City (the annexed area) would not be able to vote in the City’s elections. However, the City Clerk reached out to the County Register of Voters, who graciously provided additional time to the City to provide all of the necessary information so that the ordinance could be adopted at the Council meeting of June 5th. An expedited process to update the District map for District 3 to adopt an ordinance amending the Municipal Code would allow for all people within City limits to be able to vote in City elections this November and thereafter.

FINANCIAL IMPACT:

There is no fiscal impact to modifying the boundaries other than staff time to prepare the necessary staff reports and modify the district boundary description.

ALTERNATIVES:

Decline to adopt the Ordinance at this time or continue the matter to a future meeting.

The U.S. Department of Housing and Urban Development (HUD) annually allocates CDBG funding to jurisdicons. Each year, the City is eligible to apply for and receive the funds through the development and submital of a CDBG Annual Acon Plan.

During the meeng held on April 3, 2024, Council reviewed the Annual Acon Plan allocaons as proposed by the Block Grant Commission (BGC). A public hearing was conducted, and, by moon, Council approved tentave funding allocaons. HUD requires a 30-day public comment period aer approving tentave allocaons. The public comment period opened on April 3, 2024, and expired on May 3, 2024. A second public hearing will be held to present the proposed allocaon to Council in June 2024 for final approval.

DISCUSSION:

The City is a CDBG entlement jurisdicon that receives an annual funding allocaon. Each year, the City is eligible to apply for and receive the funds through the development and submital of a CDBG Annual Acon Plan. Acvies proposed in the CDBG Annual Acon Plan must meet, at a minimum, one of the following objecves:

1. Benefit to low- and moderate-income (LMI) persons; or

2. Aid in the prevenon or eliminaon of slums or blight; or

3. Meet a need having a parcular urgency (referred to as urgent need).

In addion to the naonal objecves, HUD requires the idenficaon of primary and secondary- er local funding priories. The City has idenfied these local funding priories in the 2020-2024 Consolidated Acon Plan, which are as follows:
 Primary
o Quality Housing (Rent affordability and rental assistance) o Homelessness (Supporve services and prevenon)
 Secondary-Tier
o Neighborhood Revitalizaon (Infrastructure Improvements, Streets/Roads/Lighng, and Community Centers/Parks)

ELIGIBLE USES OF FUNDS
HUD mandates the allocaon of funds across three disnct categories, each subject to a specified maximum amount, as part of its expenditure requirements. The funding category allocaon amounts must be based on the current year’s award. During the April 3, 2024, Council meeng the 2024/25 allocaons had not been released by HUD, therefore tentave funding recommendaons were based on the 2023/24 allocaon ($981,730). On May 7, 2024, HUD released the 2024/25 Community Development Block Grant allocaons. The City of Madera is eligible to receive $989,495, an increase of $7,729 from the previous year. The CDBG allocaon is more than the projected allocaons discussed at the April 3, 2024 Council meeng.

The revised funding allocaons are provided in Table 1.

SUBJECT:

Status Update of Airport Property Agricultural Property Leases Within the City of Madera RECOMMENDATION:

This report is submitted to the City Council (Council) to provide an update on Airport Property Lease Agreements
SUMMARY:

At the City Council meeting on April 3, 2024, the Council requested an update on agricultural leases within the City of Madera (City). The City previously leased property adjacent to the Madera Municipal Airport (Airport) to allow for farming due to development restrictions on land owned by the Airport based on the proximity to the runway. The initial lease agreement for 296 acres was for 31 years. This agreement has since been amended in terms of duration and acreage to extend the initial parcel lease to 36 years and include additional parcels not originally incorporated in the initial agreement.

As part of this review, staff also identified a number of private parcels being farmed within the City Limits; some of which are subject to Interim Agricultural Use Permit (Use Permit).

DISCUSSION:

At present, 15 parcels of land are included in the Airport Property Lease Agreements (Attachment 1). These leases are solely for cultivating, farming, harvesting, and marketing crops grown on the premises. The initial lease agreement began in October 1998. With lease extensions and land additions, the leases will be terminated on December 31, 2034.

Revenue generated from these leases is based on the City receiving a percentage of the crop sales, with the amount varying from year to year based on factors that include the actual weight of the crop and the sale price per pound. Revenue is shown in Table 1 below for the 2022, 2023, 2024, and 2025 Fiscal Years. The funds are then placed into the Airport Operations Fund for general operations and Capital Improvement Projects.

Table 1: Airport Property Agricultural Lease Revenue
Fiscal Year 2021/22 2022/23 2023/24 2024/25
Revenue to Airport $178,000 $131,000 $162,000 $146,000 (Est.) In addition to the agricultural activities associated with the lease agreements, there are a number of additional parcels totaling approximately 2,550 acres that are privately owned within the City limits. These parcels are illustrated in Attachment 2. Of the private parcels, approximately 264 acres are subject to an Interim Agricultural Use Permit (Use Permit). Use Permits are granted when various factors combine to make the development of a property infeasible for a period of time anticipated to be in excess of five years. Of those parcels with a Use Permit, staff research indicates that the Use Permits have likely expired. Use Permits allow property owners the ability to continue farming operations until such time as the Use Permit indicates expired.

FINANCIAL IMPACT:

As this is an informational report, there is no impact on the General Fund.

ALTERNATIVES:

As this is an informational report, there are no alternatives.
