damage at least as broad as ISO Form CA 00 01 for all activities of Contractor arising out of or in connection with Work to be performed under this Agreement, including coverage for any owned, hired, non-owned or rented vehicles. Automobile Liability policies shall be endorsed to provide that the City and its officers, officials, employees, and agents shall be additional insureds under such policies.
 Worker’s Compensation as required by the State of California and $1,000,000 Employer’s Liability per accident for bodily injury or disease. Contractor shall submit to the City, along with the certificate of insurance, a Waiver of Subrogation endorsement in favor of the City, its officers, agents, employees, and volunteers.
 Builder’s Risk (Course of Construction) insurance covering all risks of loss less policy exclusions equivalent to the completed value of the project with no coinsurance penalty provisions.

Contractor may submit evidence of Builder’s Risk insurance as evidence of course of construction coverage. Termination of coverage shall not occur prior to full completion of the applicable project. The City of Madera, its officers, officials, employees, and agents shall be named as loss payee. Policy must include: (1) coverage for any ensuing loss from faulty workmanship, Nonconforming Work, omission, or deficiency in design or specifications; (2) coverage against machinery accidents and operational testing; (3) coverage for removal of debris, and insuring the buildings, structures, machinery, equipment, materials, facilities, fixtures, and all other properties constituting a part of the Project; (4) transit coverage, including ocean marine coverage (unless insured by the supplier), with sub-limits sufficient to insure the full replacement value of any key equipment item; and (5) coverage with sub-limits sufficient to insure the full replacement value of any property or equipment stored either on or off the Site. Such insurance shall be on a form acceptable to City to ensure adequacy of terms and sub-limits.  $1,000,000 Professional Liability for design/build, if applicable.

Maintenance of Coverage
Contractor shall procure and maintain, for the duration of the contract, insurance against claims for injuries to persons or damages to property, which may arise from or in connection with the performance of the Work hereunder by Contractor, his agents, representatives, employees, subcontractors or subconsultants as specified in this Agreement.

Proof of Insurance
Contractor shall provide to the City certificates of insurance and endorsements, as required, as evidence of the insurance coverage required herein. Insurance certificates and endorsements must be approved by the City prior to commencement of performance. Current evidence of insurance shall be kept on file with the City at all times during the term of this Agreement. City reserves the right to require complete, certified copies of all required insurance policies, at any time.

Acceptable Insurers
All insurance policies shall be issued by an insurance company currently authorized by the Insurance commissioner to transact business of insurance in the State of California, with an assigned policyholders’ Rating of A- (or higher) and a Financial Size Category Class VII (or larger), in accordance with the latest edition of Best’s Key Rating Guide.

Waiver of Subrogation
All insurance coverage maintained or procured pursuant to this agreement shall be endorsed to waive subrogation against the City, its elected or appointed officers, agents, officials, employees, and volunteers, or shall specifically allow Contractor, or others providing insurance evidence in compliance with these IFB 202425-22B James Taubert Park Construction Rebid

specifications, to waive their right of recovery prior to a loss. Contractor hereby waives its own right of recovery against the City and shall require similar written express waivers and insurance clauses from each of its subconsultants or subcontractors.

Enforcement of Contract Provisions (non estoppel)
Contractor acknowledges and agrees that any actual or alleged failure on the part of the Agency to inform Contractor of non-compliance with any requirement imposes no additional obligations on the City, nor does it waive any rights hereunder.

Specifications not Limiting
Requirements of specific coverage features or limits contained in this Section are not intended as a limitation on coverage, limits or other requirements, or a waiver of any coverage normally provided by any insurance. Specific reference to a given coverage feature is for purposes of clarification only as it pertains to a given issue and is not intended by any party or insured to be all inclusive, or to the exclusion of other coverage, or a waiver of any type. If Contractor maintains higher limits than the minimums required above, the entity shall be entitled to coverage at the higher limits maintained by Contractor.

Notice of Cancellation
Contractor agrees to oblige its insurance agent or broker and insurers to provide to the City with thirty (30) calendar days’ notice of cancellation (except for nonpayment for which ten (10) calendar days’ notice is required) or nonrenewal of coverage for each required coverage.

Self-insured Retentions
Any self-insured retentions must be declared to and approved by the City. The City reserves the right to require that self-insured retentions be eliminated, lowered, or replaced by a deductible. Self-insurance will not be considered to comply with these specifications unless approved by the City’s Risk Manager.

Timely Notice of Claims
Contractor shall give the City prompt and timely notice of claims made or suits instituted that arise out of or result from Contractor’s performance under this Agreement, and that involve or may involve coverage under any of the required liability policies.

Additional Insurance
Contractor shall also procure and maintain, at its own cost and expense, any additional kinds of insurance, which in its own judgement may be necessary for its proper protection and prosecution of the Work.

Introduction
Pursuantto California Public Contract Code (PCC) §22000 etseq.,the City of Madera (“City”) hereby seeks bids in response to thisInvitation for Bid No. 202425-22B for the James Taubert Park Construction Rebid.

A contract will be awarded to the lowest responsive, responsible bidder based on the base bid amount.

Add alternates may be added upon contract award as budget allows and at the City’s discretion.

Description of Work
The City of Madera is seeking qualified contractors to submit bids for the construction of a new public park, James Taubert Park, located at 1280 E. Olive Avenue, Madera, CA 93638. The park will be about 0.46 acre. The scope of work includes, but is not limited to:
• Demolition and Site Preparation
• Providing Site Amenities & Features
• Site Utilities
• Concrete
• Playground Equipment & Installation
• Surfacing
• Shade Structures
• Planting & Irrigation
• Drainage
The project must be completed within 180 calendar days from the issuance of the Notice to Proceed. All work shall be performed per the specifications and plans provided by the City and in accordance with applicable building codes.

The Engineer’s Opinion of Cost for this project is $1,340,000.

Required Contractors Licenses
Each Bidder shall be a licensed contractor pursuant to the California Business and Professions Code §7028.15 and California Public Contract Code §3300 and shall be licensed in the following classification as required by the scope of work: Class A, General Engineering Contractor. Any Bidder not meeting the license requirement(s) following the bid opening will be rejected as nonresponsive. All Bidder’s license(s) must be active and in good standing at the time of the bid opening and must remain so throughout the term of the Contract.

Per Labor Code §1771.1, a contractor or subcontractor is not qualified to bid on, be last in a bid proposal for, or perform work on this project unless registered and qualified under Labor Code §1725.5.

The City of Madera hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, DBE, Minority Business Enterprise, and Women-Owned Business Enterprise will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, religious creed, sex, or national origin in consideration for an award.

The City hereby notifies all Bidders that no person shall be excluded from participation in, denied any benefits of, or otherwise discriminated against in connection with the award and performance of any contract on the basis of race, religious creed, color, national origin, ancestry, physical disability, mental disability, medical condition, marital status, sex, age, sexual orientation, ethnicity, status as a disabled veteran or veteran of the Vietnam era or on any other basis prohibited by law.

Bonding Requirements
Bid security required in the amount of ten (10) percent of the amount of the bid. Bid security must be in the form of cash, cashier's check, certified check, or a bid bond issued by an admitted surety insurer licensed by the California Department of Insurance and certified by the US Bureau of Fiscal Service to conduct business in the state of California. Bid securities shall accompany the bids. Bid securities shall be made in favor of the City of Madera.

Payment Bond equal to one hundred percent (100%) of Bid are required within 7 days of the Notice of Intent to Award on all projects valued at $25,000 and above.

Performance Bond equal to one hundred percent (100%) of Bid are required within 7 days of the Notice of Intent to Award on all projects valued at $100,000 and above.

All bonds (Bid, Performance, and Payment) must be issued by a California admitted surety as defined in California Code of Civil Procedure section 995.120.

Prevailing Wages
The project is a public works project subject to California Labor Code §1770 et seq., The Director of Industrial Relations has determined the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work in the locality in which the work is to be performed, for each craft, classification or type of worker needed to execute this contract. Per Diem wages shall be deemed to include employer payments for health and welfare, pension, vacation, apprenticeship or other training programs, and similar purposes.

The California DIR Public Works Contractors website is: http://www.dir.ca.gov/PublicWorks/Contractors.html. Copies of the rates are on file with the City and are deemed included in this IFB.

Upon request, the City will make available copies to any interested party. The rate of prevailing wage for any craft, classification, or type of workmanship to be employed on this Project is the rate established by the applicable collective bargaining agreement which rate so provided is hereby adopted by reference and shall be effective for the life of this Agreement or until the Director of the Department of Industrial Relations determines that another rate be adopted. It shall be mandatory upon the selected contractor and on any subcontractor to pay not less than the said specified rates to all workers employed in the execution of this contract. Contractor shall post on site all required job site notices as prescribed by law or regulation.

Bid Protest Procedures
Any actual or prospective bidder, offeror, or contractor may protest an RFP/RFQual/IFB to the City’s Procurement Services Manager and/or Director of Financial Services by submitting a written appeal within five (5) working days of knowing or reasonably should have known the facts giving rise to the protest, sent via email to [email protected], or mail to Jennifer Stickman, 205 W. 4th Street, Madera, CA 93637, addressing specific issues such as bid contradictions or procurement errors. The Procurement Services Manager and/or Director of Financial Services have the authority to resolve such protests and will provide a written response within five (5) working days unless more time is needed; if the protester is unsatisfied, they may appeal to the City Manager within five (5) business days, and then to the City Council as a final appeal, where they may be heard. While protests generally halt solicitation proceedings, the City may proceed if the Procurement Services Manager and/or Director of Financial Services determine it's necessary to protect a substantial City interest, and to deter frivolous protests, those who file two (2) unsuccessful protests within twelve (12) months may face debarment from future bids.

Scope of Work
The City of Madera is soliciting bids for the complete construction of James Taubert Park at an undeveloped site located at 1280 E. Olive Avenue, Madera, CA 93638. The completed park is estimated to measure approximately 0.46 acres.

This project is made possible through the State of California – The Natural Resources Agency, Department of Parks and Recreation, Statewide Park Development and Community Revitalization Program of 2018 grant funding.

The scope of work will generally consist of general requirements, site preparation, infrastructure development, amenities construction, landscaping, and special features in accordance with this IFB and all attachments listed herein.

1. General Requirements
 Conduct all work in accordance with the project plans, specifications, and applicable codes and regulations, including ADA standards and environmental requirements.  Coordinate with the City’s project manager and other relevant stakeholders to ensure adherence to the project timeline.
 Obtain all necessary permits and inspections prior to the start of construction.  Implement site safety measures to protect workers, visitors, and adjacent properties throughout the construction process.

2. Site Preparation
 Clear and grade the site, including removal of debris, vegetation, and unsuitable materials.  Perform necessary excavation and backfilling for utilities, pathways, and building foundations.

3. Infrastructure Development
 Install utility connections, including water, electricity, and drainage systems, as per the project design.
 Construct pathways and fencing using specified materials.  Install an irrigation system to ensure coverage of landscaped areas.

4. Amenities Construction
Construct amenities and features as detailed in Description of Bid Items including but not limited to:
 Construct playground structures, including safety surfacing and borders.  Build and install picnic shelters, benches, and trash receptacles as specified in the design.  Install lighting fixtures.
 Construct sports courts (e.g., half basketball court, table tennis) with appropriate surfacing and equipment.

5. Landscaping
 Prepare soil and plant trees, shrubs, grasses, and other vegetation as per the landscape plan.  Install mulch, topsoil, and decorative elements to enhance aesthetic appeal.  Ensure proper operation of the irrigation system to support plant health.

6. Special Features (if applicable)
 Construct additional features such as designated public art mural walls.  Install signage, including park name sign and play area signs.

7. Finalization and Close-Out
 Conduct final inspections to ensure compliance with all specifications and standards.  Provide the City with as-built drawings and warranties for installed systems and equipment.  Address any punch list items identified during the final walkthrough.  Perform site cleanup, ensuring the park is ready for public use.

The lump sum price bid for this item shall include all costs for temporary erosion & sedimentation control measures and BMPs as indicated on the Drawings and specifications. The item also includes labor, materials, tools, equipment, and incidentals and for doing all the work required by the Drawings and Specifications, including but not limited to installation and removal, which is not specifically set forth in the Bid Form as a pay item.

Bid Item A.2 – Construction Fencing:

The lump sum bid for this item shall include all costs for construction fencing, labor, materials, tools, equipment, incidentals and for doing all the work, including but not limited to installation and removal from the site necessary for completion of the work.

California Air Resources Board (CARB) Off-Road Diesel Fleet Compliance (DOORS Certification) All contractors and subcontractors utilizing off-road diesel-fueled vehicles with 25 horsepower or greater, or most two-engine vehicles, on this public works project in California shall be in full compliance with the California Air Resources Board (CARB) In-Use Off-Road Diesel-Fueled Fleets Regulation (California Code of Regulations, Title 13, Section 2449 et seq.).

Effective January 1, 2024, prime contractors and public works awarding bodies are required to obtain and retain a fleet's valid Certificate of Reported Compliance from CARB's Diesel Off-Road Online Reporting System (DOORS) prior to awarding or entering into a contract for work on public works projects involving the use of such vehicles.

Bidders shall provide a copy of their firm's (and any proposed subcontractors') current and valid CARB "Certificate of Reported Compliance" for their off-road diesel fleet(s) with their bid proposal.

The City reserves the right to verify the authenticity and validity of all submitted Certificates of Reported Compliance through the CARB DOORS system at http://www.arb.ca.gov/doors/compliance_cert1.html or by contacting the CARB DOORS Hotline.

The awarded Contractor shall maintain continuous compliance with all CARB Off-Road Diesel-Fueled Fleets Regulations throughout the duration of the contract and shall provide updated Certificates of Reported Compliance to the City throughout the project annually, or upon request, to demonstrate continued compliance.

Failure to provide a valid Certificate of Reported Compliance, or to maintain ongoing compliance, may result in the rejection of the bid, termination of the contract, and/or other penalties as permitted by law.

Information for Bidders

1. Attention of Bidders is especially directed to the specifications which, in addition to the bid proposal and these instructions, are basis for evaluation and will be part of any contract with the successful bidder. Any deviations from the specifications in this notice shall be proper reason for rejection of all or any part of the bid proposal.

2. Proposer is responsible for checking the City’s PlanetBids vendor portal prior to submitting a Proposal to determine if any amendments were made to the IFB. Documents, amendments, addenda, etc. will be posted to the City’s PlanetBids vendor portal at https://pbsystem.planetbids.com/portal/54016/portal-home.

Any questions related to this IFB shall be submitted through the City’s PlanetBids vendor portal no later than 5:00pm on _______________.

6. Bid proposals will be evaluated by the City. If a bid proposal is found to be incomplete or not in compliance with the format required, it will not be submitted for evaluation. During the evaluation process, the City may find it beneficial to request additional information. Bids will be compared on the basis of the grand total of BID SCHEDULE A through BID SCHEDULE L. Award will be made to the lowest responsive, responsible bidder. Furthermore, the City retains the right, at its option, to award Add Alternate 1, Add Alternate 2, or any combination of these alternates, in addition to the base bid.

7. Any bid proposal may be withdrawn at any time prior to the hour fixed for the opening, provided that a request in writing executed by the Bidder, or his/her duly authorized representative, for the withdrawal of such bid proposal is filed with Purchasing. The withdrawal of a bid proposal shall not prejudice the right of a Bidder to file a new bid proposal prior to the time and date set for the opening. After the expiration of the time and date for receipt of bid proposals, a bid proposal may not be withdrawn or altered.

8. Bidder is responsible for fully acquainting itself with the conditions of the project site (which may include more than one site), as well as those relating to the construction and labor of the project, to fully understand the facilities, difficulties, and restrictions which may impact the cost or effort required to complete the project.

9. The City reserves the right to seek supplementary information from any Bidder at any time after official bid proposal opening and before the award. Such information will be limited to clarification or amplification of information asked in the original bid proposal.

10. Issuance of the IFB and receipt of bid proposals does not commit the City to award an agreement.

The City reserves the right to postpone the IFB process for its own convenience, to accept or reject any or all bid proposals received in response to this IFB, to negotiate with other than the selected company should negotiations with the selected company be terminated, or to cancel any section of this IFB. The City also reserves the right to apportion the award among more than one company.

11. The successful Bidder shall enter into a formal agreement with City which will be very similar in content to the Attachment C, Sample Construction Agreement which is provided for information purposes only and to help clarify City intent relevant to this IFB as well as general contract requirements of the City.

12. Bidder and its subcontractors performing work under this contract will be required to pay California sales tax and other applicable taxes, and to pay for permits, licenses, and fees required by the agencies with authority in the jurisdiction in which the work will be located, unless otherwise expressly provided by the Contract Documents.

13. Prior to beginning any work or delivering any equipment or material to be furnished under this bid proposal, the Bidder shall secure the appropriate Business License from the City of Madera.

Any Federal or State of California License/Certification required to provide the services will be required.

A Class A, General Engineering Contractor license will be required. Insurance documentation in accordance with the Insurance Requirements for Contractors will also be required.

14. Bidder’s Proprietary Information: Upon award, all documents provided by the successful Bidder shall become public record. All documents provided by any Bidders, other than the successful Bidder, shall become public record in their entirety and subject to disclosure. This shall also include but is not limited to documents for projects for which all bid proposals are rejected and projects for which an award is not made for any reason. In the event that one or more bid proposals are returned to the bidding parties, it is the intent of the City that such documents shall not become public records of the City unless required by the California Public Records Act or other provisions of law.

15. It is the City's policy to encourage the purchase of supplies, services and equipment from vendors located within the boundaries of the City. Local vendors are sellers, vendors, suppliers, and contractors who maintain places of business located within the limits of the City and who have a current City of Madera business license. The local vendor outreach policy shall not apply to those Agreements where State or Federal law, or other laws or regulations preclude such a preference.

Contractors will, to the greatest extent feasible, attempt to incorporate local area businesses as subcontractors and suppliers. Contractors will, upon request, provide records showing the outreach efforts made to local businesses to demonstrate that they have made a reasonable effort to inform local businesses of the opportunity.

16. All applicable laws, ordinances, and the rules and regulations of all authorities having jurisdiction over construction of the Project shall apply to the Contract throughout.

Insurance Requirements for Contractors
Without limiting Contractor’s indemnification of City, and prior to commencement of Work, Contractor shall obtain, provide, and continuously maintain at its own expense during the term of the Agreement, and shall require any and all Subcontractors and Subconsultants of every Tier to obtain and maintain, policies of insurance of the type and amounts described below and in form satisfactory to the City.

Minimum Scope and Limits of Insurance
Contractor shall maintain limits no less than:
 $2,000,000 General Liability (including operations, products and completed operations) per occurrence, $4,000,000 general aggregate, for bodily injury, personal injury, and property damage, including without limitation, blanket contractual liability. Coverage shall be at least as broad as Insurance Services Office (ISO) Commercial General Liability coverage form CG 00 01.

General liability policies shall be endorsed using ISO forms CG 20 10 and CG 20 37 to provide that the City and its officers, officials, employees, and agents shall be additional insureds under such policies. The additional insured coverage under the Contractor’s policy shall be primary and noncontributory and will not seek contribution from the City’s insurance or self-insurance and shall be at least as broad as CG 20 01 04 13.

The Foundation for Fair Contracting (FFC) is a nonprofit organization which has been serving the public interest since 1985. The objective of the FFC is to monitor for compliance with prevailing wage and other public contracting laws relevant to the public works construction industry to ensure a fair and level playing field for all contractors. As part of this effort, we focus on informing and educating industry stakeholders when issues are identified. Unbalanced bids raise questions in regard to performance and compliance with the rules and regulations for the payment of prevailing wages and the safety and well-being of the workforce. It further opens the question of excessive future change orders, the fairness to and rights of other bidders in the bidding process, and the intent of the competitive bidding process in general.

In deference to all bidders and in order for the public interest to best be served, please enter this formal bid advisory against the above-noted contractor as a matter of public record. We respectfully request that Taylor Backhoe Service, Inc. (TBS) be rejected for the following reasons:
· ONGOING VIOLATIONS OF PREVAILING WAGE LAWS RESULTING IN WAGE THEFT TBS has numerous infractions/violations which have resulted in willful circumvention of the laws and regulations governing the payment of prevailing wages, including, but not limited to, violations resulting in wage theft and non-compliance with apprenticeship laws. Parks & Community Services Department Fiscal Year 2025/26 Quarter 1 Recap RECOMMENDATION:

This report is submitted to provide the City Council with an informational report on the status of the Parks & Community Services (PCS) Department Fiscal Year 2025/26 Quarter 1 Recap SUMMARY:

Staff is providing an update on Fiscal Year 2025/26 Quarter 1 (July – September 2025) accomplishments, progress, and ongoing efforts of the PCS Department. This informational update covers various divisions within the PCS Department.

DISCUSSION:

The PCS Department delivers a wide range of direct services to the public and is divided into three major operational divisions: Administration, Recreation & Community Services, and Parks Maintenance. Together, these divisions provide high-quality recreational pursuits, preservation of parks and open space areas, entertainment, and leisure services to community members of all ages.

During Quarter 1 of Fiscal Year 2025/26, staff are pleased to share the following highlights of accomplishments and progress work, presented in no particular order:

Administration
 Executed a Construction Services Agreement under Invitation for Bid (IFB) 202425-23 for the Lions Town & Country Park Trail improvements for $841,019.63 to Tosted Asphalt, Inc., with a construction contingency of up to 10 percent of the original construction agreement E-1

amount, up to $84,102. A Notice of Award and a Notice to Proceed were executed thereafter.

This project officially began construction on September 29, 2025, and is expected to run through the end of the year.
 Executed a Contractor Notice of Completion for the Frank Bergon Senior Center (FBSC) Fence Installation project was accepted on June 18, 2025. This project was made possible by Community Development Block Grant (CDBG) funding. The City received $213,558 towards improvements at the FBSC. Improvements have included exterior painting of the building, kitchen renovations, and the installation of safety perimeter fencing.  Executed Amendment No. 3 to the West Coast Arborists, Inc. Agreement for City-wide Tree Management and Maintenance Services. The amendment allowed an additional $39,900 to be added to the agreement to address maintenance needs along the medians of Mainberry Drive, West 3rd Street, and Westgate Drive. The area has approximately 150 trees that require trimming, with trimming/pruning conducted ahead of schedule to prevent limb failure and additional branch breakages.
 Awarded 3 CDBG agreements under Program Year 2025/26. o $413,317.15 towards improvements to Centennial Pool Park Complex. o $10,000 towards the construction of James Taubert Park. o $40,022.45 towards aging services and programming.
 Received confirmation from the Office of Grants and Local Services, California State Parks, of the acceptance of the Lions Town & Country Park Restroom Renovation Project. The City was awarded $177,952 towards improvements to the restroom building. The scope of work for this project included a comprehensive renovation of the restroom building interior, including the replacement of all restroom toilet fixtures and dispensers, restroom partitions, new flooring and lighting, and all plumbing connections. The exterior improvements included painting, entrance improvements, lighting, and replacement of concrete walkways.  Demolition and reconstruction of the damaged parts at the Thaddeus Sran Playground, at Centennial Park, caused by an arson incident, began in July. Since then, the park has reopened to the public. The project still has one minor part that has to be received and installed thereafter before the official completion of the project can occur. This part does not affect access to the playground or other play features.
 Received 4 bids in response to Invitation for Bids (IFB) 202425-22B for James Taubert Park Construction. Bids were due September 8, 2025. Shortly after, a bid protest was received.

Staff is currently working to address the bid protest and ensure next steps align in the best interest of the project, funding sources, and the City.  On July 2, 2025, Council approved a Consultant Services Agreement with Westwood Professional Services, Inc. for $171,205. Since then, staff have been working diligently with Westwood Professional Services, Inc., for the design and bidding packet preparation for Tozer Park. To date, Westwood has provided a conceptual plan that includes the primary grant objectives.
 Starting in July, the Administration division rolled out the new digital survey initiative designed to enhance how the City gathers feedback on parks, facilities, and recreational programming. Surveys are automatically sent via email weekly following a reservation or program. This goal is to assess the customer experience related to facility/park conditions, cleanliness, accessibility, and overall satisfaction. Some key responses collected include:
o For programming, over 67percent of participants heard about our programming via social media. Other sources noted included Friend/Word of Mouth or a Flyer/Poster. o 100 percent of respondents noted a satisfactory experience with the program they received.
o 100 percent of respondents noted programming was well-organized and communicated clearly.
o 100 percent of respondents noted park restrooms were stocked with necessary supplies such as toilet paper, soap, and trash bags.
o 100 percent of respondents noted a satisfactory response when asked about City staff’s professionalism and helpfulness during the rental process. o 100 percent of respondents noted they would rent facilities again with the City. o 80 percent of respondents noted making their park and facility rentals in person instead of by phone or online.

Parks Maintenance
 Lions Town & Country Park: Staff began preparing an area near Field #1 for the installation of batting cages.
 Rotary Park: Assisted staff with the reconstruction of dike curbing along the medians near Gateway Drive. The curb had been lifted due to tree roots, resulting in unevenness along its length.
 Tree maintenance: Staff coordinated with West Coast Arborists, Inc. on the completion of the tree trimming/pruning along Mainberry Drive, West 3rd Street, and Westgate Drive medians.  Park furnishings: Several new concrete tables were installed at Lions Town & Country Park and Sunrise Rotary Sports Complex, replacing worn-out metal tables.  Facility aesthetics: Staff continue to proactively maintain park restroom facilities through regular painting to ensure a clean environment. During this quarter, two restroom buildings at Sunrise Rotary Sports Complex received fresh paint touch-ups.  Parking lot rehabilitation: Several park and facility parking lots were resurfaced and restripped, including those at John Wells Youth Center, Sunrise Rotary Sports Complex, Millview Center, Pan-American Community Center, and Frank Bergon Senior Center.

Recreation
 Executed the Consultant Services Agreement with Madera Unified School District for the Expanded Learning Opportunities Program (ELOP) Summer Camps. The Camps took place from July 7 to 23, 2025, with students ranging from transitional kindergarten to 6th grade in attendance. The camp offered a variety of educational, recreational, and water activities to promote engagement and physical activity during the summer break.  On August 2nd, the division hosted the Street-Smart Traffic Safety Event for kids, a fun and educational program promoting bicycle and pedestrian safety. Participants engaged in games, an interactive scavenger hunt to locate traffic signs throughout the building, and other hands-on learning experiences. Children who completed the scavenger hunt received a free safety helmet, and several lucky participants won bicycles/scooters through our raffle.

The event was made possible by funding from the Madera County Department of Public Health’s CalFresh agreement with the City.
 Over 736 duplicated youth attended the Pan American Center from July to September.  Over 731 duplicated youth attended the John Wells Youth Center from July to September.

Aging Services

 The Facilities division is overseeing the procurement of stage curtains for the Pan American Community Center to enhance the stage as an amenity for community use during rentals, as well as add beautification improvements to the center.  Staff is also completing maintenance of the Centennial Pool Park Complex, which has been closed to the public due to a leak issue. Staff is engaged in a sourcing exercise related to securing a vendor for the PVC pipe replacement and repair.  Assemblywoman Esmeralda Soria used the Pan American Community Center for a backto-school backpack giveaway. Over 1,000 people were in attendance.

Special Events
 Hosted a successful Annual Fall Fishing Derby, one of our most anticipated community events of the year. The event took place at the Madera Municipal Golf Course on Saturday, September 13, 2025. Participants enjoyed a day of outdoor recreation, friendly competition, and community connection. Prizes were awarded for various categories, and many families expressed appreciation for the opportunity to enjoy nature together.  Hosted a successful 4th of July Golf Tournament, also at the Madera Municipal Golf Course. The event brought in over 136 golfers. Sponsors this year were Riley’s Brewery, Kaur Dentistry, and Sugar Pine Smoke House.
 The PG&E Movies in the Park summer series successfully ran from July to August, providing an entertaining and memorable family night to the community. The series is hosted at Lions Town & Country Park on Friday evenings, screening family-friendly movies.

Madera Municipal Golf Course
 The Golf Course Advisory Committee said farewell to two of its members: Chito Romero as the Golfer/At-Large Committee Member and Karla Gran as the Service Organization Representative. The Committee welcomed two new members in August: Andy Medellin, as the Non-Golfer/At-Large Committee Member, and Dan Riley, as the Service Organization Representative.
 A total of 4,140 rounds were played in July.
 A total of 3,747 rounds were played in August.
 A total of 3,423 rounds were plated in September.

FINANCIAL IMPACT:

The preparation and presentation of this informational report does not result in any significant financial impact. While there are costs associated with the organization and execution of the community events referenced in this report, these expenses have been accounted for in the City's Fiscal Year 2025/26 budget. All activities and events were planned in alignment with the City's financial resources and were incorporated into the approved budget to ensure fiscal responsibility. As such, no additional appropriations or budget adjustments are necessary at this time.

RECOMMENDATION:

This item is being presented at the request of the City Council for discussion and information purposes only. No formal action is requested at this time.

SUMMARY:

At its October 15, 2025 meeting, the City Council requested that this item be agendized for discussion.

DISCUSSION:

The Airport Advisory Commission (AAC) is comprised of seven members who serve in an advisory capacity to the City Council on matters related to the operation, maintenance, and development of the Municipal Airport. Commission members are appointed pursuant to Section 2-3.101 of the Madera Municipal Code, which was adopted by the City Council on March 2, 2022. This action formally established the structure, membership, and purpose of the Commission.

In addition to the City’s Airport Advisory Commission (AAC), which advises the Council on matters directly related to airport operations, maintenance, and development, land use issues surrounding the airport are reviewed by the Airport Land Use Commission (ALUC). The ALUC is a County administered body responsible for ensuring that proposed land uses within the Airport Influence Area are compatible with airport operations and consistent with the adopted Airport Land Use Compatibility Plan. ALUC’s primary role is to prevent potential conflicts between airport activities and surrounding land uses to promote public safety and preserve the long-term viability of the airport.

Revisions to Airport Advisory Commission (AAC) Rules of Procedure RECOMMENDATION:

Adopt a resolution approving revised Airport Advisory Commission (AAC) Rules of Procedure SUMMARY:

During the October 22, 2021, AAC meeting, Commissioners requested a review of the rules of procedure. One of the main concerns that spurred this review was due to issues amongst the group not being able to consistently establish a quorum during the quarterly AAC meetings.

Moreover, during the January 22, 2022 AAC meeting, the Commissioners and City staff made rules of procedure recommendations regarding the membership selection process, term of office, officers, and meetings that were also in compliance with the Madera Municipal Code for commissions.

DISCUSSION:

Upon review of the rules of procedure by the AAC, the following recommendations were made in Table 1:

Therefore, these recommendations enable the AAC rules of procedure to maintain compliance the Madera Municipal Code. Furthermore, the set meeting times were in agreement with the AAC commissioners with the hopes of maintaining a consistent quorum moving forward.

FINANCIAL IMPACT:

There is no financial impact associated with the rules of procedure revisions.

CONSISTENCY WITH THE VISION MADERA 2025 PLAN:

The proposed action is not specifically addressed as part of the Vision Plan, nor is it in conflict with the Plan.

ALTERNATIVES:

If Council chooses not to adopt these rules of procedure revisions, the AAC rules of procedure will be out of compliance with the Madera Municipal Code relating to commissions. Moreover, the AAC could continue to struggle with achieving a consistent quorum if these recommendations are not approved which will also impact the ability of the AAC to be a functioning commission.

AIRPORT ADVISORY COMMISSION
Rules of Procedure

1. Appointment.

The Airport Advisory Commission (AAC) of the City of Madera shall consist of seven (7) members who shall be appointed in accordance with Section 2-3.101 of the Madera Municipal Code. A copy of that Code section is attached and incorporated by reference as Attachment A.

2. Term of Office:

The term of each AAC member shall be in accordance with Section 2-3.101 of the Madera Municipal Code. See Exhibit A.

3. Officers:

Elections to be held the first regular meeting of the calendar year. By a majority vote of a quorum present, the following officers will be elected to serve a one-year term: Chair and Vice Chair.

4. Meetings:

Meetings of the Commission to be held the second Tuesday of each quarter per calendar year, with the meeting to be held at the Madera Municipal Airport Lobby, 4020 Aviation Drive, Madera, CA 93637, starting at 10:00 a.m. Special meetings may be called at the option of the Chair or upon majority decision of the Commission membership in accordance with requirements of the Brown Act.

5. Attendance Requirements:

A. Attendance is required and failure to attend three consecutive regular as opposed to special meetings shall be considered as automatic resignation; a significant pattern of absences may also be considered grounds for removal from the Commission.

B. Members may be excused by the Chairman for authorized absences.

C. Removal and replacement of Commission members shall be by City Council action.

6. Compensation:

All members of the commission will serve without compensation; however, payment for any actual and necessary expenses incurred in the conduct of

7. Duties and Responsibilities:

It is the intention of the City Council that the Commission will serve in an advisory capacity only to the City Council and staff on matters involving the Madera Municipal Airport. These duties shall include the following:

A. Budget – Review annually the airport financial status pertaining both to general operations and capital projects and recommend an annual budget for operational and capital improvement purposes, including methods of financing and lease arrangements.

B. Operations – Compile analytical data and comparative information involving the establishment or modification of airport fees, rates, charges, or fuel prices, ascertain the type of service to be rendered and keep abreast of developments in the aviation industry on all pertinent matters concerning airports, airport law, and aviation generally, and based upon the foregoing, review and recommend formal adoption of airport policies and operation procedures.

C. Master Planning – Review the status of the Airport Masterplan and propose periodic revisions thereto, reflective of capital expansion projects, possible financing methods, and to federal and state regulations; review and recommend on special permits and proposals, as required, that deviate from the airport development plan.

D. Land Use – Review and recommend action regarding land use surrounding the airport, as it effects aviation, both directly and indirectly.

E. Reports – At least once each year report activities to the City Council and make information available to other Commissions and Officials of the City, as required.

F. Other – Perform other related duties as directed by the City Council.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF MADERA, CALIFORNIA AMENDING SECTION § 2-3.101 OF TITLE II, CHAPTER 3 OF

THE MADERA MUNICIPAL CODE RELATING TO APPOINTMENTS AND

TERMS TO CITY BOARDS, COMMITTEES, AND COMMISSIONS
THE CITY COUNCIL OF THE CITY OF MADERA DOES ORDAIN AS FOLLOWS:

SECTION 1. Section 2-3.101 of the Madera Municipal Code is amended to read as follows:
§2-3.101
Unless otherwise specifically provided by statute or a joint powers agreement, the members of all city boards, committees, and commissions shall be appointed and serve as provided herein notwithstanding any other provision of this code, City resolution, or City minute order.
(A) Appointment.
(1) The Mayor is authorized to make appointments to City boards, committees, and commissions subject to approval by the City Council. (2) For new boards, committees, and commissions comprised of seven members, the Mayor will seek nominations for appointments from each Council Member and the Mayor may make a direct appointment for the at-large seat for consideration by the Council.
(3) For existing boards, committees, and commissions comprised of seven members and as vacancies occur, the Mayor will seek a nomination to fill the vacancy from the Council Member for the Council District who originally nominated the person. The Mayor may also make one direct appointment for the seventh seat for consideration by the City Council.
(4) For boards, committees, and commissions comprised of less or more than seven members and as vacancies occur, a numerical rotation system based on district numbers will be utilized and the Mayor will seek a nomination to fill such vacancy from a Council Member who has not yet made or waived their opportunity to nominate a person to serve on the particular board, committee, or commission.

In other words, if the last nomination was from the Council Member for District 3, the Mayor will seek a nomination from the Council Member for District 4. (S) The Mayor is not required to appoint persons nominated by Council Members.

(6) The Mayor will submit appointees to the City Council for consideration. (7) The City Council is authorized to approve or reject any appointment made by the Mayor.
(8) Council approval of any appointment shall be made by resolution adopted by four votes of the City Council. The appointment shall be for the remainder of an unexpired term or for a new term.
(9) Upon the City Council's determination not to approve a Mayor's appointee, the Mayor shall proceed to seek another nominee, make another appointment, and submit the appointee to the City Council for consideration and approval as set forth in this section.
(B) Term.

Each board, committee, or commission member appointed as set forth in Section (A) above shall serve a term of four years unless a different term is otherwise provided by law, or until the Council member who nominated such board, committee or commission member is no longer serving as a Council member, whichever period is less. Each appointed member shall serve until his or her successor is appointed and qualified.

SECTION 2. SEVERANCE. If any section, subsection, phrase, or clause of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portions of this ordinance.

SECTION 3. ~- The City Council finds this ordinance is not a project under the California Environmental Quality Act because it can be seen with certainty that it will not have a significant effect or physical change to the environment. See Title 14, California Code of Regulations, Section 15061 (b) (3).

SECTION 4. PUBLICATION. This ordinance shall be published in accordance with the provisions of Government Code Section 36933.
