Agenda Item # 3.B.3.

Council Agenda Report
To: Mayor Silverstein and the Honorable Members of the City Council Prepared by: Brandie Ayala, Senior Administrative Assistant Reviewed by: Rob DuBoux, Public Works Director/City Engineer Approved by: Steve McClary, City Manager
Date prepared: February 28, 2023 Meeting date: March 27, 2023 Subject: Federal Surface Transportation Program – Local Funds Exchange RECOMMENDED ACTION: Authorize the Mayor to execute the Exchange Agreement and Assignment of Federal Surface Transportation Program – Local Highway Infrastructure Programs Funds.

FISCAL IMPACT: The City of Malibu is allocated approximately $32,000 in Federal Surface Transportation Program – Local Funds (Federal STP-L) every year. The City currently has a balance of $110,453 in Federal STP-L funds. The City has the option of converting these federal funds to local transportation funds. Los Angeles County Metropolitan Transportation Authority (LACMTA) administers these funds and requires the City to execute a transfer agreement. If the Agreement is approved, LACMTA would receive a two percent processing and administrative fee. Therefore, the City would receive $108,244 in local STP-L funds that can be used for the Malibu Canyon Road Traffic Study.

WORK PLAN: This item was not included in the Adopted Work Plan for Fiscal Year 2022- 2023. This project is part of normal staff operations.

DISCUSSION: Each year the City is allocated approximately $32,000 in Federal STP-L from the Federal Highway Administration based on the City’s population. The funds are administered by LACMTA can only be used on federally approved transportation projects in accordance with federal regulations. Due to federal regulations and limitations of the use of Federal STP-L funds, LACMTA periodically allows smaller cities, such as Malibu, to exchange Federal STP-L funds for local LACMTA STP-L funds. These funds allow the City the flexibility to fund projects that would not necessarily meet the federal requirements. The Agreement stipulates that any applicable federal regulations and City Council Meeting

standards related to procurement and other project delivery issues may be submitted with applicable state and local regulations, standards and policies.

Staff is recommending that Council authorize the Mayor to execute the Exchange Agreement and Assignment of Federal Surface Transportation Program – Local Highway Infrastructure Programs Funds. This will allow the City to efficiently use these funds on a City project that would not meet the federal requirements. The City currently has a Federal STP-L balance of $110,453. As a result of the transfer agreement, the City would receive $108,244. LACMTA charges a two-percent processing and administrative fee of the total transfer amount to exchange the funds. The City has three years from the date of execution of the agreement to use the funds. It is anticipated that these funds will be used for the Malibu Canyon Road Traffic Study.

1 EXCHANGE AGREEMENT AND ASSIGNMENT OF FEDERAL SURFACE

TRANSPORTATION PROGRAM-LOCAL AND HIGHWAY INFRASTRUCTURE

PROGRAMS FUNDS
This Exchange Agreement and Assignment of Federal Surface Transportation Program-Local and Highway Infrastructure Programs Funds ("AGREEMENT"), is made and entered into as of July 1, 2022, by and between the City of Malibu ("CITY") and the Los Angeles County Metropolitan Transportation Authority ("LACMTA").

RECITALS:

CITY is eligible for and has available Federal Surface Transportation Program-Local ("STP-L Funds") and Highway Infrastructure Programs funds ("HIP Funds").

A. CITY desires to exchange $55,389 of CITY's STP-L Funds ("STP-L Funds Balance") and its total allocation of $55,064 of CITY's HIP Funds ("HIP Funds Balance") that LACMTA approved on April 22, 2021 for a like total amount of $110,453 of LACMTA Local Transportation Funds ("LACMTA Funds").

B. LACMTA is willing to exchange $110,453 in LACMTA Funds for a like total amount of CITY's STP-L Funds and CITY's HIP Funds subject to the terms and conditions contained herein.

C. An exchange of CITY's STP-L Funds and CITY's HIP Funds with LACMTA Funds is beneficial to and in the general interest of CITY and LACMTA.

NOW THEREFORE, in consideration of the mutual benefits to be derived by CITY and LACMTA, and of the promises contained herein, it is hereby agreed as follows:

AGREEMENT:

1. CITY hereby assigns to LACMTA $55,389 of CITY's STP-L Funds and $55,064 of CITY's HIP Funds. LACMTA shall be authorized to deduct such amounts from CITY's STP-L Funds Balance and CITY's HIP Funds Balance, respectively. This assignment shall be automatically effective upon full execution of this AGREEMENT without the necessity of the execution, delivery or recording of any further instrument whatsoever. Notwithstanding the foregoing, at LACMTA's request, CITY shall execute and deliver such documents and instruments as may be required to evidence such assignment of STP-L Funds and HIP Funds.

2. LACMTA hereby accepts CITY's assignment of CITY's STP-L Funds and CITY's HIP Funds for use on federal-aid eligible project(s), to be determined by LACMTA in its sole and absolute discretion.

Agreement Number 9200000000HIP2120
2 3. Upon receipt of (i) a fully executed AGREEMENT, (ii) CITY's written certification of the amounts of CITY's STP-L Funds Balance and CITY's HIP Funds Balance, as defined herein, which CITY's STP-L Funds Balance and CITY’s HIP Funds Balance show that CITY has sufficient STP-L Funds and HIP Funds to meet its obligations hereunder, and (iii) LACMTA's deduction of CITY's STP-L Funds and CITY's HIP Funds as provided in paragraph 1 above, LACMTA shall pay CITY $108,244 of LACMTA Funds which includes the deduction for the processing fee described in paragraph 5 below. For purposes of this AGREEMENT, CITY's "STP-L Funds Balance" and CITY's "HIP Funds Balance" shall mean the amounts of funds contained in CITY's STP-L Funds and CITY's HIP Funds accounts as of the date that this AGREEMENT is fully executed, which include CITY's apportionment share of FY22 STP-L Funds and share of HIP Funds from the federal Coronavirus Response and Relief Supplemental Appropriations Act (CRRSAA) that was enacted on December 27, 2020. If the STP-L Funds Balance and HIP Funds Balance become insufficient to satisfy CITY's exchange obligations hereunder, CITY hereby authorizes LACMTA to deduct from CITY's future balance of STP-L funds until LACMTA has in the aggregate received the amount of CITY's STP-L Funds and CITY's HIP Funds specified in paragraph 1 above.

4. CITY must complete and submit an Automated Clearing House (ACH) form (Exhibit A) through LACMTA's website to allow LACMTA to make disbursements electronically.

Disbursements via ACH will be made at no cost to CITY. If electronic disbursements are not the preferred method of disbursement, CITY may request an exception in writing.

5. CITY shall pay LACMTA a two-percent (2%) processing and administrative fee (the "Processing Fee") in connection with the exchange contemplated by this AGREEMENT. The Processing Fee shall be assessed against the total amount of LACMTA Funds payable to CITY. CITY hereby authorizes LACMTA to deduct the Processing Fee from the amount LACMTA is to pay CITY hereunder.

6. CITY shall expend the LACMTA Funds on an STP-L and HIP Eligible Project and by the Lapsing Date, consistent with the Statement of Work, Schedule and Budget provided in Exhibit B. For the purposes of this AGREEMENT, the "Lapsing Date" shall mean the date that is three (3) years from the date that this AGREEMENT is fully executed. Any LACMTA Funds not expended by the Lapsing Date shall lapse and be returned to LACMTA within thirty (30) days of the Lapsing Date for further programming to third parties as LACMTA determines in its sole discretion.

A. For the purposes of this AGREEMENT, the term "Eligible Project" shall mean the transportation activities described in Exhibit B that: i) would normally qualify under Section 133(b) of Title 23, U.S.C: or ii) are for costs related to preventive maintenance, routine maintenance, debt service payments, availability payments, operations, personnel (including salaries of employees and those employees who have been placed on administrative leave, or contractors), and coverage for other revenue losses due to the coronavirus pandemic. Any other applicable federal regulations and standards related to procurement and project delivery issues may be substituted with applicable state and local regulations, standards, and policies.

B. The term "expend" as used in Section 6 shall mean "encumbered by an awarded Agreement Number 9200000000HIP2120
3 contract or paid for an eligible transportation activity".

C. If the LACMTA Funds have lapsed and CITY has not returned all or a portion of the lapsed LACMTA Funds to LACMTA, then CITY shall be considered to be in default and agrees that such outstanding payments shall be paid from CITY funds in the following priority: first, from any of CITY's unobligated HIP Funds Balance, then from CITY's STP-L Funds Balance, then from CITY's Proposition A local return funds, then from CITY's Proposition C local return funds, then from CITY's Measure R local return funds, and then from CITY's Measure M local return funds. If CITY is in default hereunder, in addition to all rights and remedies available to LACMTA at law or in equity and without further notice or ability to cure by CITY, CITY hereby authorizes LACMTA to withhold the applicable HIP, STP-L or local return funds in the amount needed to satisfy the outstanding amount of lapsed LACMTA Funds due and owing to LACMTA prior to LACMTA transferring the balance of such funds to the CITY in accordance with the applicable state laws or ordinances.

7. CITY must use the LACMTA Funds in the most cost-effective manner. If CITY intends to use a consultant or contractor to implement all or part of the STP-L and HIP Eligible Project, LACMTA requires that such activities be procured in accordance with CITY's contracting procedures and be consistent with State law as appropriate. CITY will also use the LACMTA Funds in the most cost-effective manner when the LACMTA Funds are used to pay "in-house" staff time. CITY staff or consultants with project oversight roles may not award work to companies in which they have a financial or personal interest. This effective use of funds provision will be verified by LACMTA through on-going project monitoring and through any LACMTA interim and final audits.

8. LACMTA, and/or its designee, shall have the right to conduct audits of CITY's use of the LACMTA Funds, as deemed appropriate, such as financial and compliance audits; interim audits; pre-award audits, performance audits, and final audits. CITY agrees to establish and maintain proper accounting procedures and cash management records and documents in accordance with Generally Accepted Accounting Principles (GAAP). CITY's records shall include, without limitation, any supporting evidence deemed necessary by LACMTA to substantiate CITY's use of LACMTA Funds. These records must be retained by CITY for five years following CITY's last use of the LACMTA Funds. CITY shall reimburse LACMTA for any expenditure not in compliance with the Scope of Work and/or not in compliance with other terms and conditions of this AGREEMENT. The eligibility of costs for CITY's own expenditures submitted to LACMTA for the Eligible Project shall be in compliance with Office of Management and Budget (OMB) Circular A-87 (relocated to Title 2 in the Code of Federal Regulations, Subtitle A, Chapter II, part 225). The eligibility of costs for CITY's contractors, consultants, and suppliers expenditures submitted to LACMTA through CITY's Monthly Progress Reports and Quarterly Expenditures shall be in compliance with OMB Circular A-87 (as relocated) or Federal Acquisition Regulation (FAR) Subpart 31 (whichever is applicable). Findings of the LACMTA audit are final. When LACMTA audit findings require CITY to return monies to LACMTA, CITY agrees to return the monies within thirty (30) days after the final audit is sent to CITY.

Agreement Number 9200000000HIP2120
4 9. The terms of this AGREEMENT shall commence on the date that this AGREEMENT is fully executed and shall terminate once CITY has expended all the LACMTA Funds and all LACMTA audit and reporting requirements have been satisfied.

10. CITY shall fully indemnify, defend and hold LACMTA and its officers, agents, and employees harmless from and against any liability and expenses, including, without limitation, defend costs, any costs or liability on account of bodily injury, death or personal injury of any person, or for damages of any nature whatsoever arising out of (i) a breach of CITY's obligations under this AGREEMENT; or (ii) any act or omission of CITY or its officers, agents, employees, contractors, or subcontractors in the use of the LACMTA Funds.

11. LACMTA shall fully indemnify, defend and hold CITY and its officers, agents, and employees harmless from and against any liability and expenses, including, without limitation, defend costs, any costs or liability on account of bodily injury, death or personal injury of any person, or for damages to or loss of risk of property, any environmental obligations, any legal fees and any claims for damages of any nature whatsoever arising out of (i) a breach of LACMTA's obligations under this AGREEMENT; or (ii) any act or omission of LACMTA or its officers, agents, employees, contractors, or subcontractors in the use of CITY's STP-L Funds and CITY's HIP Funds.

Agenda Item # 3.B.4.

Council Agenda Report
To: Mayor Silverstein and the Honorable Members of the City Council Prepared by: Steve McClary, City Manager
Kelsey Pettijohn, City Clerk
Trevor Rusin, Interim City Attorney
Date prepared: March 15, 2023 Meeting date: March 27, 2023 Subject: Findings to Hold Virtual City Council, Commission, Committee, Board and Other City Bodies, Meetings Under AB 361
RECOMMENDED ACTION: Consider a motion to adopt Resolution No. 23-14, reauthorizing remote teleconferencing/virtual meetings pursuant to AB 361.

FISCAL IMPACT: There is no fiscal impact associated with the recommended action.

WORK PLAN: This item was not included in the Adopted Work Plan for Fiscal Year 2021-2022.

DISCUSSION: On March 17, 2020, in the face of the COVID-19 pandemic, Governor Gavin Newsom issued Executive Order N-29-20 suspending certain provisions of the Ralph M. Brown Act in order to allow for local legislative bodies to conduct their meetings completely telephonically or by other electronic means, including allowing councilmembers to not have to post an agenda at their teleconference location, not have to identify their location on the meeting agenda, not have to ensure public accessibility at the teleconference location, and the legislative body did not need a quorum in the jurisdiction. The suspension of certain provisions of the Brown Act was further extended by the Governor on June 11, 2021 by the issuance of Executive Order N-08-21, which continued to allow for complete virtual meetings until September 30, 2021.

On September 16, 2021, the Governor signed AB 361, which allows legislative bodies to meet virtually provided there is a state of emergency declared by the Governor, and either (1) state or local officials have imposed or recommended measures to promote social distancing; or (2) the legislative body determines by majority vote that meeting in person would present imminent risks to the health and safety of attendees. Although the states COVID-19 state of emergency ended on February 28, 2023, AB 361 will remain in City Council Meeting

effect until January 1, 2024. As noted above, AB 361 authorizes public meetings to be held virtually if specified conditions are met. These conditions include when state or local officials have imposed or recommended measures to promote social distancing.

Research by staff indicates that officials continue to recommend social distancing.

Specifically, California Division of Occupational Safety and Health (“Cal/OSHA”) regulations—at Title 8 Section 3205—recommend physical distancing in the workplace as precautions against the spread of COVID-19 and impose certain restrictions and requirements due to a “close contact” which occurs when individuals are within six feet of another in certain circumstances. Relatedly, the Centers for Disease Control and Prevention continue to recommend avoiding contact and keeping a safe distance from a person who has a suspected or confirmed case of COVID-19.

In order to continue to qualify for the waiver of in-person meeting requirements under AB 361, the Council must, every 30 days, make the required findings. Thus, this item will continue to appear on the agenda to satisfy this requirement during the duration the City Council can make the required findings.

SECTION 4. The City Council and all other City bodies shall conduct public meetings in accordance with Government Code section 54953(e) and other applicable provisions of the Brown Act for remote only meetings.

SECTION 5. This Resolution shall take effect immediately upon its adoption and remain in effect for 30 days or until such time as the City Council reaffirms this resolution in accordance with Government Code section 54953(e)(3) to extend the time during which the City Council and all other legislative bodies of the City of Malibu may continue to teleconference without compliance with Government Code §54953(b)(3).

SECTION 6. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other provisions or applications of the Resolution which can be given effect without the invalid provision or application, and to this end the provisions of this Resolution are severable. The City Council hereby declares that it would have adopted this Resolution irrespective of the invalidity of any particular portion thereof.

Council Agenda Report
To: Mayor Silverstein and the Honorable Members of the City Council Prepared by: Jorge Rubalcava, Senior Civil Engineer
Reviewed by: Rob DuBoux, Public Works Director/City Engineer Approved by: Steve McClary, City Manager
Date prepared: March 1, 2023 Meeting date: March 27, 2023 Subject: Amendment to Professional Services Agreement with Michael Baker International, Inc.

RECOMMENDED ACTION: Authorize the Mayor to execute Amendment No. 3 to Professional Services Agreement with Michael Baker International, Inc. (Michael Baker) to extend the term of the existing Professional Services Agreement through March 23, 2024 and to modify the scope of work.

FISCAL IMPACT: No appropriation is required. Funding for this project is included in the Adopted Budget for Fiscal Year 2022-2023 in Account No. 310-9059-5100.00 (PCH Median Improvements). The funds identified for this project were Los Angeles County Metropolitan (Metro) Measure R Transportation Funds. The total agreement is $869,777.50. This amendment does not increase the total compensation for this agreement.

WORK PLAN: This item was included as item #8.u in the Adopted Work Plan for Fiscal Year 2022-2023.

DISCUSSION: On July 10, 2017 the City entered into an agreement with Michael Baker to provide engineering consultant services for the Pacific Coast Highway (PCH) Raised Median Channelization Improvements Project. The project objective is to improve safety and operations on PCH by upgrading the raised medians on PCH between Webb Way and Puerco Canyon Road.

On June 10, 2019, Council approved Amendment No.1 for additional services to prepare new documentation required by Caltrans. In addition, Caltrans requested a Project City Council Meeting
03-27-23
Item

Specific Quality Management Plan to be developed by the City and implemented during the construction phase. Caltrans also required a Natural Environmental Study-Minimal Impacts Biology Study Report as part of the environmental review process. These items were not included in the original scope of work.

On June 28, 2021, Council approved Amendment No. 2 for additional design support services during construction. This work included the construction documentation reviews, responding to specific design related questions during construction, and any other design related assistance during the construction phase of the project.

On June 30, 2022, the project was released for public bidding and bids were received on September 22, 2022. On November 14, 2022, Council rejected bids for this project because the bids received exceeded the available budget. The total funds available for this project is $6,950,000, which includes project design, construction, and construction management costs. The project construction costs were estimated to be $5,000,000.

The apparent low bid amount from Sully Miller Contracting Company in the amount of $9,200,471.50 was approximately $4,200,271.50 over budget for this project. Due to the insufficient funds, Council rejected the construction bids and directed staff to look at design alternatives for this project.

This amendment with Michael Baker is to extend the term of the agreement and to modify the design scope of work to develop project alternatives and potential phasing the project that will fit within the project budget and no additional compensation will be needed. The scope of work modification will be performed within the existing agreement amount and no additional compensation will be needed.

Staff recommends Council approve Amendment No. 3 Agreement with Michael Baker.

SUBJECT: PCH MEDIAN CHANNELIZATION PROJECT:

AMENDMENT REQUEST #4: RE-SCOPING OF PROJECT
Dear Mr. Rubalcava,
The City has requested that Michael Baker International assist to re-scope the PCH Median Channelization Project to a lower construction budget that fits within the Metro Measure R/M allocation.

Michael Baker will use the $33,841.06 of the current contract amount remaining on a Time and Materials basis to prepare a Geometric Approval Drawing (GAD) to re-scope the project to fit within a target $2 to $4 million construction value. Michael Baker will look for ways to still improve the corridor, but will reduce the scope of the project to the target budget amount. The priorities of the new GAD design will be to implement the City-requested stamped concrete (paver-design) within the curbed median, and provide bike refuge lanes at signalized intersections.

The construction industry has experienced dramatic inflation in construction unit costs in the last few years. Michael Baker will use current construction unit costs to prepare a preliminary cost estimate for the updated GAD design. Michael Baker will present the updated GAD and preliminary cost estimate to the City for consideration and discussion of next steps.

Agenda Item # 6.A.

Council Agenda Report
To: Mayor Silverstein and the Honorable Members of the City Council Prepared by: Richard Mollica, Planning Director
Kristin Riesgo, Acting Community Services Director
Approved by: Steve McClary, City Manager
Date prepared: March 16, 2023 Meeting date: March 27, 2023 Subject: Malibu Bluffs Park Snack Shack
RECOMMENDED ACTION: Review and provide feedback regarding the options for replacement of the snack shack at Malibu Bluffs Park.

FISCAL IMPACT: There is no fiscal impact associated with the recommended action.

Should the Council determine an immediate or permanent solution for the Malibu Bluffs Park Snack Shack requiring the appropriation of funds, staff will return to Council with a subsequent item for that action.

WORK PLAN: This item was included in the Adopted Work Plan for Fiscal Year 2022- 2023 as item 8.gg (Malibu Bluffs Park Facility Improvements) DISCUSSION: At the February 27, 2023, Regular meeting, the Council requested options for replacement of the snack shack at Malibu Bluffs Park (Snack Shack), including temporary solutions and options for upgrades or replacement.

Background
The Snack Shack has been located between the ballfields and parallel to Winter Mesa Drive since the City gained control of the park in 2006. As part of the approval for the ballfields, Coastal Development Permit No. 5-82-780A2 issued by the California Coastal Commission included an approval for a concession stand. The permit for the concession stand did not include a connection to the previously existing onsite wastewater treatment system or water service. The existing water connection appears to have been completed without the benefit of a permit. The concession stand consists of a metal shipping container with a built-in service window and a covered patio. The dimensions of the existing structure City Council Meeting

are 20 feet long by 8 feet wide by 9 feet tall, with the covered patio area measuring 10 feet long by 8 feet wide.

Aerial View, Red X identifies the Snack Shack Snack Shack Exterior From 2006 to 2018, the City allowed Malibu Little League (MLL) to use the facility as a concession stand without obtaining the required permits through the Los Angeles County Department of Public Health (DPH) to cook onsite and serve food to league participants. MLL served food and refreshments on game days, such as hot dogs, hamburgers, popcorn, pizza, and prepackaged snacks.

Following the Woolsey Fire in 2018, the Snack Shack was closed for more than a year and that closure left the structure unfit for food service. As league play resumed in late 2019, staff discovered an infestation of pests within the Snack Shack, which resulted in removal of the flooring, shelving, and food preparation equipment. Staff reviewed DPH permitting requirements and determined that significant upgrades, as well as new expanded facilities, such as water service and a sewer connection were required to reopen the Snack Shack.

Given the limited amount of annual use, high costs, and permitting requirements associated with the required upgrades, the Snack Shack remained closed.

Allowable Uses at Malibu Bluffs Park
Malibu Bluffs Park is located in the Public Open Space zoning district, and per the City's Municipal Code and Local Coastal Program use tables, refreshment stands, ice cream stands, and other fixed location outdoor food vending stands are not allowable uses in the Public Open Space zoning district. Due to the use limitations placed on the site by the City's Municipal Code and Local Coastal Program, replacing or remodeling the existing structure to expand the concession stand beyond what was initially permitted (inclusion of plumbing and sewer service) would not be consistent with the applicable City ordinances.

While the operation of the Snack Shack was not consistent with the City's zoning ordinances, the Snack Shack operated under the nonconforming section of the City's zoning ordinances as it was permitted prior to cityhood and had operated continually.

However, the City's zoning ordinances identify that a nonconforming structure or use cannot be replaced or intensified, and therefore, replacing the structure or adding

Page 3 of 6 ends

Agenda Item # 6.A.
additional development, such as water and sewer connections which intensify the use, cannot be permitted under the Code.

Immediate Snack Shack Options
Staff reviewed several options for upgrading or replacing the Snack Shack after receiving feedback from the Parks and Recreation Commission, American Youth Soccer Organization (AYSO), and MLL.
• Remodel the Existing Structure
o Remodeling the structure in a manner consistent with the City’s Remodel Policy and Malibu Municipal Code (MMC) Section 17.60.020(A), would allow for the existing nonconforming use to be maintained per MMC Section

17.60.040(A). The City's Remodel Policy establishes a limit on the amount of work that can take place before a structure meets the definition of a new or replacement structure. New or replacement structures are required to comply with applicable zoning ordinances and allowed uses.
o The City's Building Official inspected the existing structure, and the result of that inspection was that the current structure does not have adequate flooring, and there are several concerns related to the facility's structural integrity due to rust and corrosion. Remodeling the structure would also require compliance with all of the provisions set by the California Building Standards and our local ordinance, including but not limited to Los Angeles County Building Code (LACBC) Section 3114 – Intermodal Shipping Containers, involving several upgrades to the foundation, anchorage, and openings to the windows and door. The structure must also meet certification labeling requirements verified by a Certified Inspection and Testing Agency as per LACBC which has been adopted by the City of Malibu.

Snack Shack Interior

Page 4 of 6 ends

Agenda Item # 6.A.

There are three immediate known options for hot food service at Malibu Bluffs Park, including a non-permanent concession stand, a temporary food trailer, or food trucks. • Non-Permanent Concession Stand
o For the 2023 season, MLL can sell prepackaged snacks and canned or bottled beverages in a non-permanent space at Malibu Bluffs Park. MLL will be required to comply with DPH permitting requirements. In addition, the stand would be set-up and taken down daily. This activity could continue indefinitely, provided DPH permits are maintained.
o Anticipated Cost: $0
• Food Service Trailer (non-permanent)
o A trailer or concession stand that is California Health and Fire code compatible and allows for hot and cold food service onsite would have to remain movable (no fixed location). The trailer would contain a full-service kitchen, including a 3-compartment sink, food preparation sink, grill, refrigerator, freezer, hot water heater, wastewater tank, ventilation, and laminate flooring. This option requires temporary external utility connections for water and electricity, as well as a wastewater removal service contract. o Anticipated Cost: The initial cost for the trailer is approximately $90,000, plus weekly wastewater removal fees.
• Food Trucks
o AYSO and MLL could work with food truck vendors to supply hot food options.

Sports Leagues can sell pre-packed snacks and drinks from a temporary structure such as a canopy. The vendors and sports leagues are required to obtain a valid DPH permit and insurance.
o Anticipated Cost: $0
Permanent Snack Shack Options
• Permanent Pre-cast Concession Stand, Restrooms, and Storage o Under this option a pre-cast concrete structure that comes equipped with a water heater, a 3-compartment sink, and ventilation would be installed onsite.

Additional upgrades are required for this option; these additions include installation of a full-service kitchen, such as a grill, refrigeration, and shelving.

This option would require permanent external utility connections for water, electricity, and wastewater. Following the approval of the design and permit issuance, the anticipated timeline to install a pre-cast concession stand is approximately six months. The facility would upgrade the area between the baseball fields by combining all storage into one location and would allow for the removal of all temporary storage containers and portable toilets. o Anticipated Cost: $400,000 and higher

Page 5 of 6 ends

Agenda Item # 6.A.
• Like-for-like Metal Shipping Container Upgrade
o At the August 16, 2022, Parks and Recreation Commission Regular meeting, the commission recommended the installation of a like-for-like metal shipping container with an option to grill.
o It was discussed that the City would purchase the like-for-like metal shipping container and complete several upgrades, including installation of a fullservice kitchen, such as sinks, a grill, ventilation, refrigeration, shelving, and plumbing for potable water and wastewater. This option would require permanent external utility connections for water and electricity and a wastewater connection.
o Anticipated Cost: $150,000 and higher
All estimated costs do not account for foundation work, external utility connections, or permits. Additionally, it is anticipated that it will cost approximately $8,000 to demolish and remove the current Snack Shack.

Los Angeles County Department of Public Health Permitting Requirements DPH classifies the Snack Shack as a Temporary Food Facility and has two permitting options for food service: Prepackaged or Food Preparation.

Prepackaged ($82 annually)
Allows for the sale of commercially prepackaged food items, such as chips, candy, popsicles, and non-alcoholic drinks. AYSO and MLL must apply for this permit annually.

Food Preparation ($184 annually)
Allows the sale of hot and cold food items made onsite, such as hamburgers and hot dogs on a grill, burritos cooked in a microwave, and hand-scooped ice cream sundaes. • 3-compartment sink for dishwashing with water heated to a minimum of 120 degrees • Food prep sink
• Potable water access
• Wastewater connection
Both permits are valid for 25 days of food service within 90 days. Additionally, both permits require the following amenities:
• Restroom facility with handwashing within 200 feet of the food service area; • Water for handwashing heated to a minimum of 100 degrees, and • Designated restrooms for food handlers that are not available to the public.

Page 6 of 6 ends

Agenda Item # 6.A.

City of Malibu Permitting and Zoning Requirements
The City of Malibu Planning and Building and Safety Departments would review and approve any non-food truck or mobile trailer replacement options for consistency with applicable zoning requirements.

Should the City decide to pursue the option of a new Snack Shack that is the same size or larger to include restroom facilities, kitchen facilities that meet health code requirements, and expanded storage areas, the inconsistency with the City's Permitted Uses Table must be addressed. The zoning inconsistency can be addressed by processing a Zone Text Amendment and Local Coastal Program Amendment (LCPA) to identify the operation of Snack Shack in the Public Open Space as an allowable use. If code amendments are initiated by the Council, the amendments would then be considered by the Zoning Ordinance Revisions and Code Enforcement Subcommittee, followed by consideration by the Planning Commission and then review for adoption by the City Council. The LCPA, once approved by the Council is then submitted to the California Coastal Commission for certification.

In addition, if a sink or restroom facilities are added as part of this project, the additional wastewater generated will exceed the current wastewater allocation for Bluffs Park. An application to modify the existing wastewater allocation for Malibu Bluffs Park would require Council approval.

Budget
The costs associated with replacing the Snack Shack were not included in the Adopted Budget for Fiscal Year 2022-2023. If the Council recommends moving forward with one of the non-food truck options, a funding source would need to be identified.
