Date prepared: November 16, 2023 Meeting date: December 18, 2023 Subject: Funding For Bluffs Park South Walkway Repair Project RECOMMENDED ACTION: Provide a recommendation to the City Council to consider appropriating $50,800 from the General Fund Undesignated Reserve for the repair of the Bluff’s Park South Walkway for a total revised budget of $180,800.

FISCAL IMPACT: Funding for the Bluff’s Park South Walkway Project was included in the Adopted Budget for FY 2023-24, for a total amount of $130,000. Based upon the construction bids for this project, an additional appropriation of $50,800 from the General Fund Undesignated Reserve to Account No. 310-9097-5100 (Malibu Bluff’s Park South Walkway) is needed to perform these repairs. The projected General Fund Undesignated Reserve at June 30, 2024, is $64,232,575.

being presented to the City Council. The proposed appropriation item will be presented to the Council at its Regular meeting on January 22, 2024.

Over the past several years, staff have repaired or replaced several different sections of the Bluff’s Park South Walkway, but it was determined a more in-depth repair was required. In February 2023, Staff conducted a site visit to evaluate the existing condition of the walkway and it was discovered the base of the walkway had experienced erosion and had also been undermined by rodents. (Attachment 1). Staff discovered the natural erosion of the grade and base, caused by our coastal nature, resulted in an approximate 1-foot drop off the walkway raising much concern over the safety of parkgoers.

This project consists of earthwork to build up the natural grade, the construction of a new concrete deepened curb that will run alongside the walkway where erosion is most likely to occur, and repair of damaged concrete panels. The project is intended to address safety, erosion, and undermining of the walkway. The proposed deepened curb will only be exposed approximately 4-inches and will act as a means to protect the base of the walkway from erosion, as well as safeguard against rodents burrowing and undermining the walkway. (Attachment 2).

On November 9, 2023, six contractors submitted construction bids for this project. The lowest bid was $132,900 which, including the design costs and contingency, becomes more than the approved budget for this project ($130,000). Additional appropriation is needed to complete this project and repair the Bluff’s Park South Walkway. Staff recommends that an additional $50,800 be allocated from the General Fund Undesignated Reserve to execute a construction contract with the low bidder (Ardalan Construction Company Inc.) and allow for potential change orders up to 15% of the contract.

Subcommittee Agenda Report
To: Mayor Pro Tem Stewart and Councilmember Silverstein Prepared by: Kristin Riesgo, Community Services Director Reviewed by: Joseph Toney, Assistant City Manager
Approved by: Steve McClary, City Manager
Date prepared: December 13, 2023 Meeting date: December 18, 2023 Subject: Funding for Skate Park Design and Civil Engineering Elements RECOMMENDED ACTION: Provide a recommendation to the City Council on the appropriation of $68,400 from the Designated Reserve for the Case/Crummer Parcel for an Amendment to the Agreement with California Skateparks.

FISCAL IMPACT: An appropriation of $68,400 from the Designated Reserve for the Case/Crummer Parcel to Account Number 310-9090-5100-00 (CIP – Skate Park) is needed for the proposed amendment. The projected Designated Reserve for the Case/Crummer Parcel on June 30, 2023, is $347,479.

STRATEGIC PRIORITY: This item supports the Permanent Skate Park priority identified in the Adopted FY 2023-24 Strategic Priority Project List.

DISCUSSION: On February 24, 2020, the Council approved a Professional Services Agreement (Agreement) with California Skateparks (Consultant) to provide design services and construction documents for the Permanent Skate Park (Skate Park). The Agreement included work related to the public design process, design engineering, and construction documents.

On May 24, 2021, the Council approved Amendment No. 1 with the Consultant to prepare architectural design plans for drainage, grading, erosion control, stormwater control, landscaping, and project coordination and administration. The Civil Engineering and Landscape Architect collaborating with the Consultant is RRM Design Group (Subconsultant). design documents for the Coastal Development Permit, Environmental Review Board (ERB), and Planning Commission Meetings.

The original landscape plan excluded an irrigation system and included a mixture of hydroseed and native plants, requiring staff to hand water landscaped areas for over a year until plant establishment. Following an analysis of the design, staff proposes adding an irrigation system to the Skate Park landscape plan. Native landscaped areas take up to a year to establish, and regularly scheduled irrigation would increase the likelihood of successful plantings and less plant dieback. A consistent watering schedule will ensure plants will be robust and aesthetically pleasing throughout the year. Additionally, it would eliminate the need for maintenance staff to complete daily to weekly hand watering. The City will use recycled water to irrigate native vegetation and trees along the perimeter of the Skate Park and planters.

On August 15, 2023, the Parks and Recreation Commission approved a recommendation to add a permanent restroom facility to the Skate Park. This amenity will improve access to restrooms at the Skate Park and adjacent baseball fields. The closest permanent restroom facility is located at the Michael Landon Center, approximately 700 feet from the Skate Park. The Consultant will prepare Civil Engineering and schematics for domestic and recycled water services.

Additional services provided by the Consultant and Subconsultant that were not included in the original Scope of Work include the coordination and attendance at public meetings such as ERB and Planning Commission.

Staff worked with the Consultant to prepare a proposal for the additional work (Attachment). The proposed cost for the work is $53,800, which includes:
• Design and construction management
• Preparation of architecture design plans for City Council review • Irrigation plans and system layout, main line, automatic controller, piping, and locations of hydro zones for non-potable water sources
• Landscape construction plans
• Civil engineering for areas of the project not included in the Agreement • Project coordination and administration, where needed The proposal also includes $14,600 in variable costs for landscape and skatepark construction administration, which would be reduced if staff could assist in those areas.

If the Subcommittee recommends the appropriation of $68,400 from the Designated Reserve for the Case/Crummer Parcel, the appropriation and an Amendment to the Agreement with California Skateparks will be brought to Council in January 2024.

DESCRIPTION OF WORK TO BE PERFORMED
RRM Design Group, a California Corporation (“RRM Design Group”), has entered into an agreement with California Skate Parks (the “Client”) with an effective date of May 24, 2021 (the “Prime Agreement”) for the project: Malibu Skate Park Civil Engineering and Landscape Architecture (the “Project”). Additional Services Authorized by the Client are subject to the Terms and Conditions of the Prime Agreement.

In addition to the RRM Civil Engineering and Landscape Architecture services provided in the Prime Agreement (dated July 12, 2021), RRM Design Group is proposing the following tasks to develop a complete set of construction documents as required to obtain building permits for the construction of the Malibu Bluffs Skate Park.

Landscape Construction Documents
The existing authorized Task C.2 includes the scope and fee for landscape construction documents and specifications related to planting only. Excluded from the previous agreement are the following supplemental documents needed for building permit issuance and final approvals.

Irrigation Plans and Details
The irrigation plans will detail items such as irrigation system layout, main line, automatic controller, head layout, piping, valve quantities, and locations indicating hydrozones for nonpotable water sources. In support of the irrigation plans, we will prepare irrigation details that specify the method of construction and proper irrigation system component procedures. This task includes water-use budgeting and calculations where needed to satisfy the requirements of California’s Model Water Efficient Landscape Ordinance (MWELO) and the City of Malibu’s development requirements.

Landscape Construction Plans and Details
