B. Malibu Schools Centralized Fundraising & Athletics Pathways Recommended Action: Provide a recommendation to the City Council regarding a Special Funding Request for Malibu Centralized Fundraising & Athletics Pathways.
Assistant City Manager Toney provided background information on the item and introduced Karin Al-Hardan from the Malibu Schools Leadership Council 2023 to provide a presentation.
Ms. Al-Hardan provided a presentation on the Malibu Centralized Fundraising and Athletics Pathway fund request. She went over the goals of the project, current state of the fundraising program, recommendations, timelines, and budget. She explained that the reason for the monetary request from the City of Malibu is due to preparation efforts for the district separation, to serve young members beginning at the elementary level, and to provide athletic support for all. A three-year plan was presented along with a benchmark report and fundraising goals, which reflected the need for a consultant, executive director, and other operational resources.
Mayor Pro Tem Stewart opened the floor for public comment. At this time, there were no members of the public in this meeting.
Councilmember Silverstein asked a clarifying question whether the money was for an entity creation or for actual programing for the schools and asked what the projected fundraising levels will be over the next 3-5 years once established.
Ms. Al-Hardan explained that it would primarily be to create an entity with the guidance of a consultant and that the athletic pathway portion is funding the actual schools. She estimated a goal of offsetting half of the cost by the first year and full cost by the second year with the goal of establishing endowments, an alumni program, and pursuing corporate donations.
Mayor Pro Tem Stewart commended everyone who worked on this request. He inquired about the possibility of using the library fund. He also asked for clarification on exactly how much they are requesting, and if it was annual or total over two years.
Ms. Al-Hardan provided an update on the library fund request, stating that she has not heard back from the library team. She reviewed the budget attachment and clarified that they are requesting closer to half a million dollars each year and Malibu Administration and Finance Subcommittee

explained the columns where the City of Malibu money would fit versus the funds provided by the Santa Monica Malibu School District, reviewing both a break down of centralized funding and an athletic program.
Mayor Pro Tem Stewart requested to hear more about benchmarks and more about the breakdown between the centralized fundraising entity funding and the athletics pathway funding. He emphasized that these funds are meant to be temporary seed money and after time less funds would be needed from the city. He also inquired what the total amount needed from the city would be.
Ms. Al-Hardan explained that the school district was unable to provide all requested funds and explained the budget attachment breakdown and where the city funds would be allocated to. She stated that once the entity is self-funding, they would stop requesting city funds and added that they have a three-year goal. She added that the total amount requested from the city over the years would be $2,085,500.
Councilmember Silverstein requested more information regarding how benchmarks would be measured and what would constitute success. He inquired about the ratio between what is being spent and what would be fundraised.
Ms. Al-Hardan explained that currently benchmarks have not been established and goals are based on hiring the needed staff to carry out this project. She added that with a consultant they would be able to have a better understanding of what the benchmarks would be within three months. She also explained that there would be a goal of establishing a three-million-dollar endowment similar to the model of the Santa Monica Education Foundation (SMEF).
Councilmember Silverstein requested more information on how SMEF was funding their entity, how it was initially funded, and what their operating budget is.
He inquired if there were any efforts to get seen money from the community.
Ms. Al-Hardan elaborated that SMEF was funded the same way, with an 80/20 model where 80% goes to the endowment and 20% goes to the schools. She added that they are currently self-funded from an initial seed money that came from the City of Santa Monica. She did not have the budget information along with the total amount of seed money provided by Santa Monica readily available and said she would provide it at a later date. She stated that there have been no efforts to get this seed money from the community because it is a lot of money to request from parents.
Councilmember Silverstein proposed providing the initial funding for the next six months to cover a consultant in order to get more details about the benchmarks and plans.

Mayor Pro Tem Stewart clarified that the request is close to $500,000 each year for three years and recommended a model where the funds will be rolled out based on annual approval. He recommended a commitment for one year with quarterly updates back to the city. He requested numerical metrics and key performance indicators (KPIs).
Councilmember Silverstein shared a concern regarding hiring an athletics director who knows they have a job in the long term. He recommended committing to funding the first step of this project, which would be the $25,000 needed for the consultant portion to have a more detailed proposal. He noted that $50,000 was given through the grants program ($25,000 per each school) to be used for the arts.
He mentioned that not everyone in the city uses the school system and they are being asked to use the tax base of the city. He stated that when this item is proposed he would like to see a commitment from the council to explore other things we can be spending tax dollars on, that would benefit a portion of the population that does not benefit from the schools, such as a new senior center.
Mayor Pro Tem Stewart shared that there are community pockets throughout Malibu, such as parks and the pool. He stated he is prepared to make a recommendation to the council to fund the first calendar year with quarterly reviews and subject to performance reviews.
Councilmember Silverstein proposed funding per school year as opposed to calendar year.
Ms. Al-Hardan clarified that the first two quarters in the budget sheet are reflective of the second half of the 2023-2024 school year and the second two quarters are the first half of the 2024-2025 school year. She also mentioned that the athletic coordinator for Santa Monica is hired on an annual basis.
Councilmember Silverstein indicated support for providing the money necessary for a consultant, money to get the athletics program running, work through the beginning of next year, and funding the arts. He stated he would want to see another presentation in July for a proposal to fund the school year.
Mayor Pro Tem Stewart reviewed the proposed recommended commitments which would be $22,000 for the consultant, $175,000 for the arts and instructional aids, and the first three rows of the budget sheet for athletics, and a portion of the fourth row for the athletics coordinator. He requested comments from city staff.
City Manager McClary stated that if this recommendation from the subcommittee was supported by the City Council, staff would incorporate these funds as part of the mid-year budget adjustment which would fund through the end of June 2024.
He shared that if the City Council desired, the funds could be programmed as a Malibu Administration and Finance Subcommittee

placeholder through the budget discussions with the caveat of having an annual approval in future budget years. He agreed with Councilmember Silverstein that the proposal is premature and would like to hear a little bit more. He cautioned that there is 200k in the general fund grant program and he understands that the committee and the City Council struggle with trying to allocate and balance out all the requests. He reminded the committee to keep that in mind as they consider this request, stated that it may be harder to say no in the future to other requests. He shared that at the staff level they could reach out to the grant consultant to see if they had ideas that may assist in this effort.
Councilmember Silverstein requested more information on how much the City of Santa Monica funded to get the Santa Monica Education Foundation up and running and what the numbers are for the other Las Virgenes-Malibu Council of Governments cities.
Assistant City Manager Toney echoed City Manager McClary’s statement and cautioned against funding special interest items because this will set a new precedent for future requests made outside of the budget process. He stated that this request has not been vetted by city staff. He shared that this could be a larger project long term that has not been considered as part of the strategic priorities. He shared that they could figure it out and come up with strategies but there is still some sticker shock to the high price tag.
Ms. Al-Hardan shared that she appreciates the feedback and mentioned that according to the last Census 20% of the population is under 18 and about 1000 of them go to Malibu schools.
Mayor Pro Tem Stewart reopened public comment.
Joe Drummond spoke in favor of the city helping fund the schools through this project.
Mayor Pro Tem Stewart closed public comment.
Councilmember Silverstein inquired how the money would be dispersed.
Assistant City Manager Toney stated that this would need to be reviewed by the City Attorney’s office and would likely need an MOU in place.
Ms. Al-Hardan shared that the already established Shark Fund could potentially serve as a temporary solution while they work with the consultant to get established.
MOTION Mayor Pro Tem Stewart moved, and Councilmember Silverstein seconded a motion to recommend the City Council approve two quarters for the consultant, three quarters plus $25,000 for the athletics portion, and for the arts programs for a total Malibu Administration and Finance Subcommittee

Mayor Pro Tem Stewart cautioned the applicant that this is always subject to future funding and the city will need to see performance numbers that indicate results as opposed to hiring benchmarks, subject to the details being worked out by the City Council if approved.
The question was called, and the motion carried unanimously.

Subcommittee Agenda Report
To: Mayor Pro Tem Stewart and Councilmember Silverstien Prepared by: Alexis Brown, Deputy City Manager
Reviewed by: Joseph D. Toney, Assistant City Manager
Approved by: Steve McClary, City Manager
Date prepared: January 10, 2024 Meeting date: January 17, 2024 Subject: Funding for City Owned Vacant Lot Outreach & Education RECOMMENDED ACTION: Provide a recommendation to the City Council on appropriation of an additional $55,000 from the General Fund Undesignated Reserve for City Owned Vacant Lot Outreach and Education.
FISCAL IMPACT: Not to exceed $130,000, the Public Works Engineering – Professional Services budget was approved by the City Council on June 21, 2023, includes the cost to hire a firm to conduct outreach and education related to city-owned vacant lots in the City of Malibu. Initial funding for this project is included in the Adopted Budget for FY 2023-24 in Account No. 100-3008-5100 (Professional Services) in the amount of $75,000 (see pg. 114 of approved budget). The additional appropriation of $55,000 will provide a total of $130,000 for the selected firm to perform the services defined in the scope of work.
The General Fund Undesignated Reserve as of June 30, 2023, is $70.3 million.
WORK PLAN: This item supports the Master Plan for City Owned Vacant Lots priority identified in the Adopted FY 2023-24 Strategic Priority Project List.
DISCUSSION: At the September 27, 2023, City Council meeting, the City Council approved the City’s first Strategic Plan list to help focus and prioritize staff efforts on the most important projects that City staff need to work on. As part of that plan, the City Council identified the need for a comprehensive outreach and education program to engage the Malibu community and stakeholders regarding vacant lots owned by the City.
Item # 3.B
The City initiated a competitive RFP process on October 5, 2024, to identify a qualified consultant for the project. Nine proposals were received, and after a detailed evaluation, four consultants were invited to participate in interviews. The proposed consultant emerged as the preferred choice based on their expertise, experience, innovative approach, and understanding of the project’s objectives.
The initial budget for the professional services related to this project was estimated at $75,000. However, after careful review and discussions among staff, it was determined that an additional appropriation of $55,000 is necessary to ensure the successful implementation of the outreach and education initiatives. The recommended not-toexceed amount of $130,000 has been deemed sufficient to accomplish the project’s deliverables while ensuring fiscal responsibility.

Subcommittee Agenda Report

Date prepared: January 08, 2024 Meeting date: January 17, 2024 Subject: FY 2022-23 Fourth Quarter Financial Report
RECOMMENDED ACTION: Review FY 2022-23 Fourth Quarter financial information.
FISCAL IMPACT: As of June 30, 2023, the budget General Fund Undesignated Reserve at June 30, 2023, is $70.3 million.
DISCUSSION: The attached report provides revenue, expenditure, and fund balance totals for the fourth quarter of FY 2022-23.
The Adopted Budget is approved by City Council, typically in June, via resolution, and the Amended Budget includes the ongoing appropriation revisions that occur throughout the fiscal year, including the Mid-Year Budget Adjustments.
Revenues
As the Revenues by Fund Report (pages A 1-5) shows, the General Fund revenues have exceeded budget estimates. Specifically, the report reflects General Fund revenues received of $55.02 million or 101.0% of the amended budget amount and 118.0% of the adopted budget for the fiscal year. The General Fund revenue sources were conservatively budgeted, as is the best practice, and were based on review of information available from the State and County. Total revenue of all funds received during the fiscal year is $67.43 million or 72.0% of the amended budgeted amount for the fiscal year.
Many of the City’s tax revenues outperformed the projected budget. Property Tax revenues overall came in at $17.86 million, which is $352,000 more than the amended budget amount. The City received $3.06 million in Utility User’s Tax which is $858,000 Administration &

more than the amended budget. Most of the revenues came in at budget, or close to it, of what was projected and amended as part of the FY 2022-23 Mid-Year Budget.
Transient Occupancy Tax (TOT) – Hotels and Motels and Private Rentals, collectively, came in at the Amended Budget amount of $9.50 million. This is less than the $10.34 million the City received in the prior fiscal year, likely due to a regression from the spike of demand in FY 2021-22 coming out of the pandemic. The $9 million to $10 million range is likely the basis of TOT revenue going forward.
Licenses and Permits - Building and renovations in the community continue to be active as Planning, Environmental Sustainability, and Public Works are still experiencing a greater-than-average number of applications, reviewing projects, and processing permits.
Revenue from Licenses and Permits ($4.13 million) exceeded the adopted budget ($3.52 million) by nearly $611,000, and $223,000 over the amended budget ($3.91 million).
Service Charges - Revenue from Service Charges of $4.96 million resulted in more than the adopted budget ($4.7 million) by $260,000, but shortfall from the amended budget ($5.76 million) of -$806,000. The amended budget shortfall is due primarily to permits/fees being generated less than projected at Mid-Year for Dark Sky, Building Plan Check, and Geo Soils Engineering.
Overall, the total General Fund Revenues of $55.02 million resulted in $528,000 more than the amended budget ($54.49 million) and $8.83 million more than was anticipated at adoption ($46.19 million).
Expenditures
The Expenditure by Fund Report (pages A 6-9) reflects any budget carryovers from FY 2021-22, as well as the appropriations approved by the City Council for the current fiscal year in the Amended Budget column. Budget Adjustments, Carryovers and Council Appropriations total $3.68 million as of June 30, 2023. General Fund expenditures for the fiscal year total $40.41 million or 84.5% of the amended budgeted amount. Expenditures for all funds total $52.4 million or 56.1% of the amended budgeted amount. The low expenditure amount of all funds in relation to the budget is primarily due to pauses in progress on capital projects, the most significant of which is the $16.5 million for the Civic Center Water Treatment Facility (CCWTF) Phase Two. In addition, staffing vacancies are the main reason for savings across the departments.
Fund Balances
Projected Fund Balances for the fiscal year end are reflected on page A-10. The Undesignated Fund Balance at June 30, 2023, reflects all expenses appropriated by the Council as of June 30, 2023. The City ended FY 2021-22 with $56.45 million in the Undesignated General Fund Reserve. As of June 30, 2023, the budget General Fund Undesignated Reserve is $70.30 million, this will be approximately 120.9% of the $58.17

million FY 2023-24 operating budget and will exceed the 65% targeted reserve amount.
Of note, about $11.7 million of these funds have been identified for capital projects, as is seen in the FY 2023-24 budget. The Council also maintains a $6.5 million General Fund Designated Reserve for Contingencies.
The FY 2022-23 Fourth Quarter Financial Report will be presented to the City Council on February 12, 2024.

Date prepared: January 08, 2024 Meeting date: January 17, 2024 Subject: FY 2023-24 First Quarter Financial Report
RECOMMENDED ACTION: Review FY 2023-24 First Quarter financial information.
FISCAL IMPACT: As of September 30, 2023, the projected budget General Fund Undesignated Reserve at June 30, 2024, is $58.6 million (unaudited).
DISCUSSION: The attached report provides revenue, expenditure, and fund balance totals for the first quarter of FY 2023-24.
The Adopted Budget for FY 2023-24 maintained conservative budgeting principles. The first quarter of the fiscal year does not provide significant trends for projections. Therefore, staff kept the projections at the budgeted amounts. The second quarter/mid-year report will provide more insight into how the fiscal year is tracking.
Revenues
The Revenues by Fund Report (pages A 1-5) reflects General Fund revenues Received of $4.8 million or 8.4% of the annual budgeted amount for the fiscal year. Total revenue of all funds received during the first quarter is $5.7 million or 6.9% of the annual budgeted amount for the fiscal year. Many revenue sources are received on a quarterly or annual basis and, as such, will be reflected when the year-end report is presented.
Expenditures
The Expenditure by Fund Report (pages A 6-9) does not yet reflect any budget carryovers from FY 2022-23 as these will be included at mid-year. General Fund expenditures for the first quarter total $7.8 million or 11.3% of the annual budgeted amount. Several large Administration &

DISCUSSION: The attached report provides revenue, expenditure and fund balance totals for the Second Quarter of FY 2023-24 and the proposed mid-year budget amendments (Attachment 1).
Revenues
The Revenues by Fund Report (pages A-1 through A-5) reflects General Fund revenues received of $21.3 million or 37% of the amended budgeted amount for the fiscal year. Total revenue for all funds received through the second quarter is $25.65 million or 31.1% of the Amended Budget amount for the fiscal year. Many revenue sources are received on a quarterly or annual basis and, as such, will be reflected when the year-end report is presented. For example, property taxes are remitted by the County after they are paid by property owners in December and April; Property Tax - In Lieu payments typically come at the end of the year; and Transient Occupancy Tax - Private Rentals is remitted quarterly.
Therefore, this report only reflects payments made in October for the period of July through September. The second quarter payments will be received by the end of January and are not included in this report. Sales Tax is remitted quarterly to the State and then passed along to the City, so there is some lag in those receipts as well. Additionally, total City revenue includes grant reimbursements for Capital Improvement Projects (CIP) expenditures that are typically received at the end of the fiscal year.
Expenditures
The Expenditure by Fund Report (pages A-6 through A-9) reflects budget carryovers from FY 2022-23, as well as the appropriations approved by the City Council for the current fiscal year in the Amended Budget column. Budget Adjustments, Carryovers, Corrections and Council Appropriations total $2,035,817 through December 31, 2023. General Fund expenditures for the second quarter total $19.95 million or 28.3% of the Amended Budget amount. Reducing for the General Fund CIP and Disaster Response amounts, the total is $19.93 million or 35.7% of the Amended Budget. Expenditures for all funds total $25.0 million or 26.3% of the Amended Budget amount.
Fund Balances
Projected Fund Balances for the fiscal year-end are reflected on page A-11. The projected Undesignated Fund Balance at June 30, 2024, includes all expenses appropriated by the Council as of December 31, 2023. The City ended FY 2022-23 with $70.3 million in the Undesignated General Fund Reserve. As of December 31, 2023, the projected General Fund Undesignated Reserve at June 30, 2024, is $67.9 million. In addition, $6.5 million remains in contingency.
Agenda Item # 3.E.
Mid-Year Budget Amendments
The Mid-Year Budget Amendments are detailed on pages A-10.
General Fund Revenue Amendments
The following amendment to the adopted revenue budget is a recommended total of $50,000.
• $50,000 General Fund - Grant Proceeds for Building Safety & Sustainability - SCG Grant - Coastal Vulnerability
General Fund Expenditure Amendment
The following amendments to the adopted expenditure budget are recommended. The General Fund expenditures total an increase of $1.05 million. Special Revenue increases $0.4 million. The General Fund Amendments are summarized below.
Personnel
The Community Services Department is requesting to transition four part-time positions into permanent part-time, thus providing benefits. The intent is to improve retention of seasonal staff, which has been growing more and more difficult to recruit and retain. The change is expected to be neutral on the FTE count as the hours worked per post for CSD programs will remain the same. The number of staff required to fill those posts will be reduced to permanent staff members, requiring less recruitment and seasonal hires. The estimated impact of this change is $200,000, included as an amendment in this report.
The change will require the Council to adopt an updated Salary Resolution for FY 2023-
24. The resolution will be included with the Mid-Year Report to Council.

Agenda Item # 3.E.
Anticipated Future Revenue Impacts
The City’s revenues have continued to see steady growth in the major tax revenue categories post-pandemic and are anticipated to continue to grow in the major tax revenue categories. The voter-approved Transactions and Use Tax (TUT) went into effect on April 1, 2023, and was estimated to bring in $3.0 million per year. The current projection for FY 2023-24 is $3.6 million.
Anticipated Unfunded Expenditures
The Sheriff substation was intended to be open during FY 2023-24, but has yet to open primarily due to Sheriff staffing shortages. While this was originally thought to be a potential fiscal issue, the current status has created expenditure savings. Nevertheless, the ongoing efforts to improve Pacific Coast Highway safety could have significant financial impacts.
The State of California released the budget proposal on January 10, 2024, initially projecting a $38 billion deficit. Furthermore, the Federal Reserve continues to strive for a “soft landing” on the economy. These headwinds could signal economic turbulence in the future, and staff will monitor if any impacts will be felt at the local level.
The FY 2023-24 Second Quarter Mid-Year Financial Report and Salary Resolution will be presented to the City Council on February 12, 2024.
