Administration and Finance
Subcommittee Agenda Report
To: Mayor Pro Tem Stewart and Councilmember Silverstein Prepared by: Renée Neermann, Finance Manager
Approved by: Joseph D. Toney, Assistant City Manager
Date prepared: April 3, 2024 Meeting date: April 10, 2024 Subject: Proposed Schedule of Fees Fiscal Year 2024-25
RECOMMENDED ACTION: Provide a recommendation to the City Council concerning adoption of the Fiscal Year 2024-25 Schedule of Fees.

FISCAL IMPACT: The Schedule of Fees establishes the amount the City can charge for fees for service. The City’s annual budget typically includes approximately $5.0 million in revenue from Service Charges and approximately $4.0 million in revenue from Licenses and Permits.

DISCUSSION: A fee study is currently underway as referenced later in this staff report.

The current fee schedule proposal allows for a schedule to be in place until the fee study and an updated schedule is ready for Council adoption and subsequent implementation.

It is anticipated that a new fee schedule will be provided to Council for consideration and possible adoption early in FY 2024-25.

State law mandates that agencies such as the City of Malibu charge customers only the fees necessary to recover costs for the services provided and prohibits charging fees beyond the services rendered. If the FY 2024-25 fee schedule is approved, the revised fees will not generate funds that exceed this standard.

In FY 2015-16, the City completed a comprehensive fee study that analyzed all fees and charges for services. The rates established in the fee study have been used as a base amount that have been increased annually with a cost-of-living adjustment.

Due to the annual increase based on inflation only, and changes in operations and staffing since FY 2015-16, the City was overdue for conducting a study to ensure fees are in alignment with full cost recovery; such studies typically result in some fees being updated,

Agenda Item # 3A
removed, or new ones added. To initiate a review of the City’s existing fee structure, a Request for Proposals (RFP) was issued on August 3, 2023, and closed on August 29, 2023. The City chose and entered into an agreement with Matrix Consulting Group, Ltd. (Matrix) in November 2023, with initiation in January 2024.

The project is underway, and Matrix is conducting a comprehensive study that will include, data collection, interviews, production of a cost allocation plan (for internal and indirect costs), an updated Schedule of Fees, presentation of results, and a new fee workbook for updating annually. Their work is anticipated to be completed in April 2024. A revised fee schedule will be provided to Council for consideration early in FY 2024-25, and if adopted, will replace this proposed fee schedule.

Pending completion of the study, staff have applied a cost-of-living adjustment to the established Schedule of Fees and currently propose no additional changes for FY 2024-

25. The cost-of-living adjustment is derived from the Consumer Price Index (CPI) using an annual percentage from February. The percentage change of CPI was 4.3% in February 2024, and this adjustment has been included in the interim Schedule of Fees for FY 2024-

25. The proposed Schedule of Fees for FY 2024-25 is attached for review and will be presented to Council on April 22, 2024.
