Agenda Item # 1.B.5.

This report provides a comprehensive, solutions-driven roadmap to accelerate recovery and strengthen long-term resilience. It offers in-depth technical analysis, case studies, and best practices designed to help Los Angeles rebuild faster, more affordably, and with greater climate adaptation strategies in place.

To build on the findings of this report, staff propose an agreement with ULI Los Angeles to conduct a Technical Assistance Panel (TAP) that will focus on improving the permitting and inspection process to fast-track rebuilding efforts in Malibu.

TAP’s have been utilized across Southern California to provide strategic advice to public agencies and nonprofit organizations on complex land use and real estate development issues. The program provides a panel of multidisciplinary professionals, in fields relevant to the issue being studied, to analyze and develop recommendations to address the defined scope and questions of the assignment within a 90-day period.

ULI will be tasked with finding ways to streamline and accelerate the production of highquality, safe housing in rebuild areas for both staff and customers. Their analysis aims to identify major pain points in the permitting and regulatory process, including delays, inefficiencies, and regulatory barriers. The program also seeks to evaluate current digital tools, compare timelines to best practices, and understand how legal risks or outdated policies may be contributing to systemic slowdowns.

6.1.1 In the event of such termination, all finished or unfinished documents, reports, photographs, films, charts, data, studies, surveys, drawings, models, maps, or other documentation prepared by or in the possession of the Consultant under this Agreement shall be returned to the City. If the City terminates this Agreement without cause, the Consultant shall prepare and shall be entitled to receive compensation pursuant to a close-out bill for services rendered and fees incurred pursuant to this Agreement through the notice of termination. If the Consultant terminates this Agreement without cause, the Consultant shall be paid only for those services completed in a manner satisfactory to the City.

6.1.2 If the Consultant or the City fail to fulfill in a timely and proper manner its obligations under this Agreement, or if the Consultant or the City violate any of the covenants, agreements, or stipulations of this Agreement, the Consultant or the City shall have the right to terminate this Agreement by giving written notice to the other party of such termination and specifying the effective date of such termination. The Consultant shall be entitled to receive compensation in accordance with the terms of this Agreement for any work satisfactorily completed hereunder. Notwithstanding the foregoing, the Consultants shall not be relieved of liability for damage sustained by virtue of any breach of this Agreement and any payments due under this Agreement may be withheld to off-set anticipated damages.

6.2 Non-Assignability. The Consultant shall not assign or transfer any interest in this Agreement without the express prior written consent of the City.

6.3 Non-Discrimination. The Consultant shall not discriminate as to race, creed, gender, color, national origin, or sexual orientation in the performance of its services and duties pursuant to this Agreement, and will comply with all applicable laws, ordinances and codes of the Federal, State, County and City governments.

6.4 Insurance. The Consultant shall submit to the City certificates indicating compliance with the following minimum insurance requirements no less than one (1) day prior to beginning of performance under this Agreement. Consultant further agrees to comply with all provisions in the attached Exhibit B which is incorporated herein.

6.5 Indemnification.

To the fullest extent permitted by law, Consultant shall indemnify and hold harmless City and any and all of its officials, employees, agents, and/or volunteers (“Indemnified Parties”) from and against any and all losses, liabilities, damages, costs, and expenses, including attorney’s fees and costs, caused in whole or in part by the negligent or wrongful act, error or omission of Consultant, its officers, agents, employees or subconsultants (or any agency or individual that Consultant shall bear the legal liability thereof) in the performance of services under this Agreement. Consultant’s duty to indemnify and hold harmless City shall not extend to the City’s sole or active negligence or willful misconduct. 5 Agreement for Professional Services

6.5.1. Duty to defend:

In the event the Indemnified Parties, individually or collectively, are made a party to any action, lawsuit, or other adversarial proceeding arising from the performance of the services encompassed by this Agreement, and upon demand by City, Consultant shall defend the Indemnified Parties at Consultant’s cost or at City’s option, to reimburse City for its costs of defense, including reasonable attorney’s fees and costs incurred in the defense of such matters to the extent the matters arise from, relate to or are caused by Consultant’s negligent acts, errors or omissions. Payment by City is not a condition precedent to enforcement of this provision. In the event of any dispute between Consultant and City, as to whether liability arises from the sole or active negligence or willful misconduct of the City or its officers, employees, or agents, Consultant will be obligated to pay for City’s defense until such time as a final judgment has been entered adjudicating the Indemnified Parties as solely or actively negligent or to have acted with willful misconduct. Consultant will not be entitled in the absence of such a determination to any reimbursement of defense costs including but not limited to attorney’s fees, expert fees, and costs of litigation.

OR FOR AGREEMENTS WITH DESIGN PROFESSIONALS (architect, landscape architect, professional engineer, or land surveyor – See Civil Code Section 2782.8) USE THE FOLLOWING:

6.5 Indemnification.

To the fullest extent permitted by law, Consultant shall indemnify, defend, and hold harmless City and any and all of its officials, employees, agents, and volunteers (“Indemnified Parties”) from and against any and all claims, losses, liabilities, damages, costs, and expenses, including attorney’s fees and costs, to the extent they arise out of, pertain to or relate to the negligence, recklessness, or willful misconduct of the Consultant.

Consultant’s duty to defend shall consist of reimbursement of defense costs incurred by City in direct proportion to the Consultant’s proportionate percentage of fault.

Consultant’s percentage of fault, for both indemnity and defense, shall be determined, as applicable, by a court of law, jury, or arbitrator. In the event any loss, liability, or damage is incurred by way of settlement or resolution without a court, jury or arbitrator having made a determination of the Consultant’s percentage of fault, and the parties cannot mutually agree on Consultant’s percentage of fault, the parties agree to mediation with a neutral third-party to determine the Consultant’s proportionate percentage of fault for purposes of determining the amount of indemnity and defense cost reimbursement owed to the City.

6.6 Compliance with Applicable Law. The Consultant and the City shall comply with all applicable laws, ordinances, and codes of the federal, state, county, and city governments, including, without limitation, Malibu Municipal Code Chapter 5.36 Minimum Wage and the California Public Records Act.

6.7 Independent Contractor. This Agreement is by and between the City and the Consultant and is not intended, and shall not be construed, to create the relationship of agency, servant, employee, partnership, joint venture, or association, as between the City and 6 Agreement for Professional Services

the Consultant.

6.7.1. The Consultant shall be an independent contractor and shall have no power to incur any debt or obligation for or on behalf of the City. Neither the City nor any of its officers or employees shall have any control over the conduct of the Consultant, or any of the Consultant’s employees, except as herein set forth, and the Consultant expressly warrants not to, at any time or in any manner, represent that it, or any of its agents, servants or employees are in any manner employees of the City, it being distinctly understood that the Consultant is and shall at all times remain to the City a wholly independent contractor and the Consultant's obligations to the City are solely such as are prescribed by this Agreement.

6.8 Copyright. No reports, maps or other documents produced in whole or in part under this Agreement shall be the subject of an application for copyright by or on behalf of the Consultant.

6.9 Legal Construction.
(a) This Agreement is made and entered into in the State of California and shall in all respects be interpreted, enforced, and governed under the laws of the State of California.
(b) This Agreement shall be construed without regard to the identity of the persons who drafted its various provisions. Each and every provision of this Agreement shall be construed as though each of the parties participated equally in the drafting of same, and any rule of construction that a document is to be construed against the drafting party shall not be applicable to this Agreement.
(c) The article and section, captions and headings herein have been inserted for convenience only and shall not be considered or referred to in resolving questions of interpretation or construction.
(d) Whenever in this Agreement the context may so require, the masculine gender shall be deemed to refer to and include the feminine and neuter, and the singular shall refer to and include the plural.

6.10 Counterparts. This Agreement may be executed in counterparts and as so executed shall constitute an agreement which shall be binding upon all parties hereto.

6.11 Final Payment Acceptance Constitutes Release. The acceptance by the Consultant of the final payment made under this Agreement shall operate as and be a release of the City from all claims and liabilities for compensation to the Consultant for anything done, furnished or relating to the Consultant’s work or services. Acceptance of payment shall be any negotiation of the City’s check or the failure to make a written extra compensation claim within ten (10) calendar days of the receipt of that check. However, approval or payment by the City shall not constitute, nor be deemed, a release of the responsibility and liability of the Consultant, its employees, sub-consultants and agents for the accuracy and competency of the information provided and/or work performed; nor shall such approval or payment be deemed to be an 7 Agreement for Professional Services

assumption of such responsibility or liability by the City for any defect or error in the work prepared by the Consultant, its employees, sub-consultants and agents.

6.12 Corrections. In addition to the above indemnification obligations, the Consultant shall correct, at its expense, all errors in the work which may be disclosed during the City’s review of the Consultant’s report or plans. Should the Consultant fail to make such correction in a reasonably timely manner, such correction shall be made by the City, and the cost thereof shall be charged to the Consultant.

6.13 Files. All files of the Consultant pertaining to the City shall be and remain the property of the City. The Consultant will control the physical location of such files during the term of this Agreement and shall be entitled to retain copies of such files upon termination of this Agreement.

6.14 Waiver; Remedies Cumulative. Failure by a party to insist upon the performance of any of the provisions of this Agreement by the other party, irrespective of the length of time for which such failure continues, shall not constitute a waiver of such party's right to demand compliance by such other party in the future. No waiver by a party of a default or breach of the other party shall be effective or binding upon such party unless made in writing by such party, and no such waiver shall be implied from any omissions by a party to take any action with respect to such default or breach. No express written waiver of a specified default or breach shall affect any other default or breach, or cover any other period of time, other than any default or breach and/or period of time specified. All of the remedies permitted or available to a party under this Agreement, or at law or in equity, shall be cumulative and alternative, and invocation of any such right or remedy shall not constitute a waiver or election of remedies with respect to any other permitted or available right of remedy.

6.15 Mitigation of Damages. In all such situations arising out of this Agreement, the parties shall attempt to avoid and minimize the damages resulting from the conduct of the other party.

6.16 Partial Invalidity. If any provision in this Agreement is held by a court of competent jurisdiction to be invalid, void or unenforceable, the remaining provisions will nevertheless continue in full force without being impaired or invalidated in any way.

6.17 Attorneys' Fees. The parties hereto acknowledge and agree that each will bear his/her or its own costs, expenses and attorneys' fees arising out of and/or connected with the negotiation, drafting and execution of the Agreement, and all matters arising out of or connected therewith except that, in the event any action is brought by any party hereto to enforce this Agreement, the prevailing party in such action shall be entitled to reasonable attorneys' fees and costs in addition to all other relief to which that party or those parties may be entitled.

6.18 Entire Agreement. This Agreement constitutes the whole agreement between the City and the Consultant, and neither party has made any representations to the other except as expressly contained herein. Agenda Item # 1.B.7.

In Phase 1, the City sought general community feedback on potential uses for the lands through a combination of in-person meetings, pop-up events, emails, online forms, and a FlashVote survey. The feedback was comprehensive and provided a clear sense of the community’s priorities and vision for the land’s future use. Based on the responses, the City identified 10 potential land-use categories, which included commercial use, community centers, open space, sports fields, and other recreational amenities. These categories, while reflective of the community's input, were presented in alphabetical order without any implied ranking.

Phase 2, conducted between August and September 2024, requested community members to prioritize the identified categories for each parcel. The feedback collected during phase 2 provided future land development preferences and will be critical information when determining final land use.

The detailed outcomes of these two phases are compiled in the final report (Attachment 2), and provide a foundation for the City to move forward with plans for these lands. Staff will proceed based on the Council’s direction, ensuring that the project remains aligned with Malibu’s long-term vision.

On October 28, 2024 the City Council received and filed the Community Lands Outreach and Engagement Report (Attachment 2). Based on the input received throughout the program, Council authorized staff to begin a phased approach for developing the lands, prioritizing community needs. The approved next steps include:
• Heathercliff and Ioki (Chili Cook-Off Lot) Lots: The City will explore options for new soccer, baseball and softball fields as well as a multigenerational community center, including a pool, gymnasium, senior center and expanded library services. • Triangle and Trancas lots: The Council has not set direction for these lands at this time.
• La Paz Lot: The Council tasked staff and the Malibu Arts Commission in preparing a draft design recommendation of the La Paz Performing Arts Center in partnership with Cross Creek Ranch Malibu, LLC not to exceed $10,000 in planning services.

In December 2024, the Malibu Arts Commission Ad Hoc Committee reviewed the Parcel C (La Paz) site, met with developers from the Cross Creek Ranch, and provided design feedback, which resulted in a conceptual design of the Malibu Performing Arts Center. At the April 22, 2025 Regular Malibu Arts Commission meeting, community members reviewed the conceptual design and the Commission re-affirmed Vice Chair Peter Jones and Commissioner Lotte Cherin to the La Paz Ad Performing Arts Center Ad Hoc Committee.

As part of this community engagement effort, the Malibu Arts Commission will host a Community Workshop on the La Paz Performing Arts Center on July 30, 2025, at Malibu City Hall.

On February 10, 2025, the Council authorized the Mayor to execute Amendment No. 1 to the Professional Services Agreement with Tripepi Smith in the amount of $120,000 for a total not to exceed $250,000. This amendment included on-call communication services to support communication needs pertaining to the Franklin Fire 2024 and Palisades Fire 2025. Tripepi Smith provided 24-hour support to the City during the EOC activations for both Palisades Fire and Franklin Fire. The EOC was tasked with tracking, communicating, and addressing ongoing emergency conditions such as upcoming rain events and including regained access to power, gas, electricity, safe drinking water, internet, and reliable cell phone reception. The Council also approved of a separate agreement with Tripepi Smith focusing solely on fire recovery efforts.

Continuing services with Tripepi Smith under the Community Lands Agreement would support a consistent and effective community outreach effort to gather and synthesize public input for the next steps for MCLP. Including working with the Malibu Arts Commission to gather input and assist in the preparation of a recommendation to the City Council.

City of Malibu – Community Lands Outreach and Engagement Report Executive Summary
In February 2024, the City of Malibu engaged Tripepi Smith to provide a robust community outreach and engagement program to identify community priorities for the 5 parcels of City-owned land spanning just over 9 acres. As part of the program, Tripepi Smith has developed a Community Outreach and Engagement Report summarizing engagement with the community and the feedback received.

The program aimed to facilitate meaningful dialogue among community members and collect insightful feedback that will help ensure the future of these lands aligns with the long-term needs and aspirations of the entire Malibu community.

The program was divided into 2 distinct phases:

Phase 1 - Late April to Mid-June: The City gathered broad feedback on the types of uses the community would like to see in Malibu.

Phase 2 - August to Late September: Based on the input received during Phase 1, the City gathered more narrow feedback on which category of uses the community envisioned for the future of each of the lands.

The 10 categories were based on the most frequent suggestions received throughout Phase 1.

Tripepi Smith collaborated with the City Council, Arts and Culture Commission, Parks and Recreation Commission, Planning Commission and City staff to develop an Outreach and Engagement Plan to reach a diverse cross-section of the community. Based on feedback received, the City implemented a summer break during the outreach and engagement program (Mid-June through July) to account for summer travels and increased tourism. The City used this timeframe to analyze the feedback received in Phase 1 and prepare for Phase 2.

City of Malibu – Community Lands Outreach and Engagement Report Phase 1 Purpose and Goals
Phase 1 of the Malibu Community Lands Outreach and Engagement Program was an initial, broad-based outreach effort to share information about the project and gather preliminary feedback on the types of future land uses the community would like to see in Malibu. The goals of Phase 1 were to:

1. Educate the community: Inform the public about the 5 lands and the purpose of the outreach and engagement program.

2. Identify community priorities: Understand community needs and broad preferences for the lands.

3. Achieve broad participation and engagement: Gather open-ended feedback from a diverse cross-section of the Malibu community, ensuring that all demographic groups had the opportunity to participate.

4. Build community interest: Generate excitement and ongoing interest in the program to ensure continued participation throughout the process.

Outreach Tactics
Malibu Community Lands’ Website
A dedicated website, MalibuCommunityLands.org, was created as the central hub for information about the program. In addition to general information about the program and its goals, the website provided the following:
• Community Lands Information: The website provided comprehensive information on the 5 Cityowned lands, including their locations, sizes and any special zoning requirements. • Calendar of Events: A calendar featuring information on upcoming pop-up events and community meetings.
• Public Input Archive: The website housed an archive of all written public comments received throughout the process, organized by date and event. Personal contact information was redacted to maintain anonymity throughout the process.
• Resource Repository: All resources and print materials distributed throughout Phase 1 were posted to the website, including the Outreach and Engagement Plan, flyer, educational video, press releases and mailers.
• FAQs: Frequently asked questions about the program, timeline, participation methods and more. • Contact Form: The dedicated webform allowed users to share their feedback. It asked respondents to identify whether they are residents and whether they live in East or West Malibu. • Email Sign-up: Visitors could sign up for NotifyMe email updates via the City’s website.

From April 16 through June 30, 2,348 users visited the MalibuCommunityLands.org website for a total of 5,867 views. The top 10 most frequently viewed pages were:
• Home Page: 2,920 views

Mailer
The City distributed a mailer to all residents via Every Door Direct Mail (EDDM) with background information on the project and how community members can participate.

Email Blasts
The City distributed a series of email blasts to subscribers through NotifyMe. Throughout the project, email addresses were collected and added to the NotifyMe list as community members submitted feedback via the website, email, community meetings and pop-up events. Upon being added, subscribers received a notification confirming their subscription along with an option to unsubscribe if desired. Throughout Phase 1, the City distributed 8 emails related to project updates, community event reminders, participation opportunities and more. Email content is outlined in Appendix I.

Radio Ads
The City ran a radio advertisement on KBU FM 99.1 from May 21 through June 13, hourly from 9 a.m. to 9 p.m., except Sundays where it ran hourly until 4 p.m.

Cable TV Slides
The City ran 1 TV cable slide containing project information that was part of the rotation during City meetings that were broadcasted.

Community Survey via FlashVote
The City distributed a community survey via FlashVote to gather scientifically valid feedback on the preferred uses of the 5 community lands. The survey had 201 total participants, of which 142 identified themselves as Malibu residents. The survey was distributed to those who had signed up via email, text or phone call, based on their chosen preferences.

The survey asked respondents whether they were aware of the community lands, what the greatest community needs are, what the greatest outdoor recreation needs are and to what extent the lands should be developed. Respondents were also given the opportunity to provide open-ended comments or suggestions.

To encourage FlashVote participation, 31 total social media posts were distributed across Facebook, Instagram, X and Nextdoor. Post performance details, including impressions and engagements per post, are outlined in Appendix J. In addition, the City distributed 1 NotifyMe email blast, 2 News Flash items and issued a press release inviting the community to sign up to receive FlashVote surveys.

The City ran 2 digital advertisements to promote FlashVote across Facebook and Instagram:
13 10
City of Malibu – Community Lands Outreach and Engagement Report Platform Asset Ad Budget Total Reach/Impressions
Facebook/Instagram FlashVote Sign-Up Post $500 for 14 days 10,540 reach Facebook/Instagram 2nd FlashVote Sign-Up Post $100 for 20 days 6,367 reach This multi-channel outreach strategy was designed to gather extensive input from different crosssections of the Malibu community through the community meetings, pop-up events, community survey, webform and email. The input gathered through these mechanisms was then reconciled to develop the categories that were used in Phase 2.

Phase 1 Data Reconciliation
The City gathered the following feedback throughout Phase 1:

1. Email and Webform Feedback (259 suggestions):

1. Open spaces (15.6%)

2. Community pools/splash pads (14.3%)

3. Community centers (13.1%)

4. Grass sports fields (12.0%)

5. Sports courts (11.6%)
The most common suggestions through the email and webform were for additional open spaces, community pools and splash pads and community centers. Since the email and webform were open-ended means of input, there was no limitation on the number of suggestions an individual could make and all distinct suggestions from an individual were included in the aggregate data reconciliation.

2. Community Meetings and Pop-up Events (322 suggestions):

1. Grass sports fields (16.2%)

2. Community centers (15.8%)

3. Commercial uses (13.4%)

4. Community pools or splash pads (11.8%)

5. Open spaces (11.2%)
The most common suggestions from the community meetings and pop-up events were for grass sports fields, community centers and a wide array of commercial uses. Since the community meetings and pop-up events allowed open-ended input, there was no limitation on the number of suggestions an individual could make and all distinct suggestions from an individual were included in the aggregate data reconciliation.

The feedback received via email, webform, community meetings and pop-up events were reviewed and categorized by the project team to adequately quantify the data.

3. Community Survey (201 total participants, 142 local participants).

Of the 142 local participants, 134 respondents identified the greatest community needs as:

1. More outdoor recreation options (64.9%)

2. Community pool and water play area (59.7%)

3. Indoor theater/arts center (42.5%)

4. Indoor community center (38.1%)

5. Other (36.6%)
14 11
City of Malibu – Community Lands Outreach and Engagement Report Of these 142 local participants, 132 respondents identified the greatest outdoor recreation needs as:

1. Outdoor amphitheater space (54.1%)

2. Multipurpose grass sports fields (47.4%)

3. Full-size multipurpose sports courts (45.2%)

4. Pathways/nature trails (38.5%)

5. Manicured grass park for casual uses (37.0%)
The community survey allowed respondents to select up to 4 choices for each of these 2 questions. The full FlashVote survey results with various toggles for all responses, locals only, owners/non-owners and type of residency are provided in Appendix C.

Based on this feedback, the City identified the most frequent suggestions to develop 10 categories for Phase 2:
• Commercial use (parking, business development)
• Community center (senior center, youth center, library, visitor center) • Community pool/splash pad
• Grass sports fields (soccer, football, baseball, softball) • Housing (workforce and senior)
• Indoor theatre/arts center
• Open space (pathways and trails, community garden)
• Outdoor amphitheater
• Sports courts (basketball, pickleball, tennis, bocci) • Other (dog park, skate park, bike trails, bike parks) Zoning Requirements
Throughout Phase 1, the City informed the public that 3 of the 5 community lands were purchased with specific requirements related to parking spaces, in accordance with the City's agreement with LA Metro:
• Triangle Lot: Approximately 100 spaces are required
• Heathercliff Lot: Approximately 200 spaces are required • Chili Cook-Off Lot: Approximately 100 spaces are required This information was shared during community meetings, pop-up events and posted to the Community Lands webpage.

Preliminary Feasibility Review of the Lands
Following Phase 1, the City performed a preliminary feasibility review of each of the lands based on planning, biology, environmental health, geology and public works considerations. This review aimed to identify any special requirements for each land.

Though the Chili Cook-Off, Heathercliff and Trancas may require additional steps such as seismic evaluation, biological assessment and zoning changes, all of the potential uses identified as the categories for Phase 2 are preliminarily feasible on these lands.

Chili Cook-Off (9.29 acres)
Preliminarily Feasible:
• Commercial use (parking, business development)

Phase 2 Purpose and Goals
Phase 2 of the Malibu Community Lands Outreach and Engagement Program took a more targeted approach to gathering feedback on what community members envisioned for the future of each of the 5 lands. Building on input received during Phase 1, the City identified the most frequent suggestions and developed 10 categories of potential land uses:
• Commercial Use (parking, business development, etc.)
• Community center (senior center, youth center, visitor center, library) • Community pool/splash pad
• Grass sports fields (soccer, football, baseball, softball) • Housing (workforce and senior)
• Indoor theatre/arts center
• Open space (pathways and trails, community garden)
• Outdoor amphitheater
• Sports courts (basketball, pickleball, tennis, bocci) • Other (dog park, skate park, bike trail, bike park)
The primary objectives of Phase 2 were to:

1. Share Phase 1 feedback and educate the community on the environmental considerations for each land: Discuss the feedback received during Phase 1 and provide information about the environmental considerations for each land. The City identified the preliminary feasibility of each category for each of the lands for the community to make informed decisions.

2. Maintain community interest and broad participation: Build on the interest generated throughout Phase 1 to gather more narrow feedback from a diverse cross-section of the Malibu community. 17 14

3. Identify the most frequent suggestions for each community land: Provide quantitative data that showcases the types of uses the Malibu community envisions for each of the 5 lands.

Outreach Tactics
Malibu Community Lands Website
In Phase 2, the Malibu Community Lands website continued to serve as a central hub for information and updates, evolving to reflect the project's progress and ongoing community engagement efforts. Several key enhancements were made to ensure transparency, accessibility and engagement with the community:
• Homepage: The homepage was refreshed with a summary from Phase 1 and the ten categories that were identified for Phase 2. This provided a clear understanding of the framework developed in Phase 1 that set the stage for narrower discussions in Phase 2. • Contact Page: The City updated the Contact Us page to facilitate more targeted and relevant community input during Phase 2. To align with the focused goals of this phase, the form was enhanced with several new questions that asked for specific feedback for each land. • Expanded FAQs: Based on questions that arose during Phase 1, the City added additional Frequently Asked Questions (FAQs) to the FAQ page. The City also added new FAQs in anticipation of community questions related to Phase 2 and the next steps. These new entries helped address common community concerns and provided clarifications on the project’s goals, timeline and decision-making process.
• Ongoing Calendar Updates: The website's calendar was regularly updated with details about community meetings and pop-up events, allowing residents to stay informed about upcoming engagements.
• Public Input Received: The City continued its practice in sharing all feedback received via email and webforms on a weekly basis. The City also posted feedback received following a community meeting and pop-up event.
• Additional Resources: To further inform and educate the public, the City added several key documents to the website. These included the Preliminary Feasibility Report, which provided insights into the viability of proposed uses for land based on environmental considerations, the press release regarding the transition to Phase 2 and handouts provided at the community meetings.

City of Malibu – Community Lands Outreach and Engagement Report Community Survey
The scientifically valid community survey conducted by FlashVote had 201 participants, of which 143 identified themselves as local. The survey asked participants to select the type of uses they envision for the future of each of the lands based on both the 10 categories identified by the City and the environmental limitations based on the Preliminary Feasibility Report. For each of the questions, respondents were permitted to select up to 3 options. For the lands with technical limitations (Triangle and La Paz), more specific options were provided to gather more detailed feedback on community preferences.

Next Steps
The Malibu Community Lands Outreach and Engagement Program aimed to facilitate meaningful dialogue among community members and collect feedback from a diverse cross-section of the community. The program sought to identify community priorities and preferences for each land to help guide City Council in their decision-making process. The feedback collected intends to help align the future of these lands with the long-term needs of the entire Malibu community.

Malibu City Council, Parks and Recreation Commission and Arts and Culture Commission will review and discuss this report to determine the next steps in the process in October 2024.

Following their review and direction, the City may release another focused survey via FlashVote to narrow down the feedback even further to help determine the exact uses for each land based on acreage and preliminary feasibility requirements.

If City Council decides to move forward with any development, all projects would be subject to approval from the California Coastal Commission and the City’s standard planning and development processes. The City would need to issue a Request for Proposals (RFP) for a landscape architect and conduct a development assessment for the proposed uses.

Any development plans will be prioritized based on community needs identified by City Council. 26

Agenda Item # 1.B.8.

Council Agenda Report
To: Mayor Riggins and the Honorable Members of the City Council Prepared by: Susan Dueñas, Public Safety Director
Approved by: Candace Bond, Interim City Manager
Date prepared: June 20, 2025 Meeting date: July 14, 2025 Subject: Amendment to a Professional Services Agreement with Capstone City Planning
RECOMMENDED ACTION: Authorize the Mayor to execute an Amendment to a Professional Services Agreement with Capstone City Planning to assist Public Safety staff with the update to the Safety Element of the General Plan.

FISCAL IMPACT: No additional appropriation is required. Funding for this agreement is included in the Adopted Budget for FY 2025-26 in Account No. 100-7021-5100-00 (Professional Services).

STRATEGIC PRIORITY: This item is part of the day-to-day operations identified in the Adopted FY 2024-25 Strategic Priority Project List.

DISCUSSION: At the August 12, 2024, Regular City Council Meeting, the Council authorized the Mayor to execute a Professional Services Agreement with Capstone City Planning (Capstone) to assist Public Safety staff with securing and managing a consultant to update the Safety Element of the General Plan (Safety Element).

With the assistance of Capstone, staff issued a Request for Proposals in September 2024 for contract planning services to update the Safety Element. Based on the proposals received and interviews with prospective consultants, Atlas Planning Solutions was chosen as a better fit for the project. However, due to multiple emergencies between November 2024 and February 2025, the project was temporarily paused and a Professional Services Agreement with Atlas Planning Solutions was not authorized until the February 24, 2025, Regular City Council Meeting.

Agenda Item # 1.B.8.

The current Agreement with Capstone is set to expire on August 12, 2025. While significant progress is being made on the Safety Element, staff still require assistance from Capstone and request an amendment to the Agreement to extend the term to June 30, 2026.

Background
The Safety Element of the General Plan is designed to reduce the potential short and longterm risk of death, injuries, property damage, and economic and social dislocation resulting from fires, floods, droughts, earthquakes, landslides, climate change, and other hazards. The City’s current Safety Element has not been updated since its adoption as part of the original General Plan in 1995.

California Government Code § 65302 (Code) mandates that the Safety Element be updated after the next revision of the Local Hazard Mitigation Plan (LHMP) and the Housing Element. The City Council adopted an updated LHMP on August 26, 2024, and a revised Housing Element on September 23, 2024. In addition, the Code requires the Safety Element to include evacuation routes, their capacity, safety, and viability across various emergency scenarios and it needs to address the fire risk for areas classified in a Very High Fire Hazard Severity Zone (VHFHSZ). CAL FIRE has designated the entire City of Malibu as being within a VHFHSZ. Therefore, the Safety Element must be updated to comply with this Code.

Finally, updating the Safety Element will help the City qualify for the 2026 Fire Risk Reduction Community List. The benefit of being on the List is that CAL FIRE must prioritize local agencies on the Fire Risk Reduction Community List for local assistance grant funding. Another benefit is that under the California Insurance Commissioner's Safer from Wildfire program, becoming certified as a Fire Risk Reduction community is listed as one of the steps that can possibly lead to insurance discounts.

7, 2025, until Memorial Day weekend. The PCH closure inhibited visitors coming from the greater Los Angeles area to Malibu. The only way for people to get to Malibu coming from the greater Los Angeles area was generally through US Route 101 and then via Malibu Canyon Road or Kanan Dume Road, adding significantly more travel time and traffic delays. As a result, businesses throughout the city have been severely impacted by the lack of visitors. Business owners have publicly stated that they have seen losses of as much as 80 percent year over year. Although PCH is now open to the general public, Malibu businesses still continue to suffer, and likely will continue to do so due to the greater difficulty in reaching Malibu, and that the homes of many of their customers—both in Malibu and Pacific Palisades—were damaged or destroyed by the fire.

The City Council has been seeking ways to help impacted businesses and directed staff to bring forward a plan to temporarily lessen TUP and Sign Permit requirements, in order to make it easier for businesses to have temporary events. Current TUP requirements require an applicant to submit their application 35 days prior to an event, with noticing to the public 32 days before the event is held. The current TUP ordinance (MMC Chapter

17.68) also does not differentiate between a small or large event, with each requiring the same application and public noticing deadlines. Each parcel is limited to only six (6) TUPs per year, regardless of size. With the summer months in flux, the reduction in TUP and SP requirements will make it easier for businesses to hold events, spur economic activity, and help those impacted businesses recover from losses incurred by the fire.

On May 21, 2025, the City Council initiated the ZTA and on June 2, 2025, the Planning Commission analyzed the proposed zoning amendments and proposed changes as described below.

PLANNING COMMISSION RECOMMENDATION
The proposed amendments to the MMC are summarized below. The full text of the proposed amendments can be found in the attached Ordinances (Attachments 1 and 2).

Attachment 3 shows the Planning Commission recommendation in underline and redline format for ease of identifying the proposed changes from existing language. Following the Planning Commission recommendation, the City Attorney included additional language to strengthen and better organize the ordinance. Nothing substantive was added or removed from the Planning Commission recommendation. Those inclusions are added in underline and blueline text.

ZONING TEXT AMENDMENT
MMC Chapter 17.02.060 – Definitions
Since the Planning Commission recommendation on June 2, the Planning Department has been merged into the Community Development Department. The Community Development Director now oversees the department. In order to codify the change, the

Page 3 of 5 ends

following definition is proposed to be amended so it is clear who is authorized as the director in charge of Title 17 of the MMC.
"Director" refers to the Community Development Director of the city of Malibu or his or her designated appointee.

MMC Chapter 17.68 – Temporary Use Permits
MMC Section 17.68.090 is proposed to be added to help facilitate economic recovery and spur business activity within the City. The following temporary uses are proposed to be allowed only for commercially and institutionally zoned parcels to aid economic recovery resulting from the 2025 Palisades Fire subject to appropriate event-specific conditions in each permit. This ordinance will be in effect from June 23, 2025 through January 31, 2026.

Events must first be reviewed for compliance with the Malibu Local Coastal Program (LCP). The LCP requires that events lasting more than one day and held between Memorial Day weekend and Labor Day require a Coastal Development Permit, and thus these changes would not apply to these types of multi-day events.

Events with 99 attendees or less are proposed to be allowed with a planning clearance approved by the Community Development Department. The application will need to be submitted at least two (2) days prior to the event, and no public noticing is required. The Community Development Director’s decision will not be appealable as there would not be time to have one heard given the time frames involved. There are no limits to the number of these events so long as a planning clearance is obtained.

The City may deny an application for such an event for reasons including, but not limited to:
• The property has received a citation for violation of the City’s noise ordinance or other public nuisance violation in the past year.
• An event has been held on the property without the required permit in the past year. • The property has outstanding code enforcement violations, unless a compliance agreement between the City and the owner of the property exists that addresses a resolution to the violation, and the owner is in compliance with the requirements of the agreement.
• The proposed event would create a public nuisance or violate any City, County, State, or Federal regulation.
• The owner has knowingly made any false, misleading or fraudulent statement of material fact in the application, or in any report or statement required to be filed that is related to the application.

Events with 100-250 attendees will be required to obtain a TUP pursuant to MMC Chapter

17.68 but the following requirements will replace those in Section 17.68.050.

Page 4 of 5 ends

• An application for a temporary use permit shall be filed with the planning department seven (7) days prior to the proposed use.
• A notice shall be mailed, postage pre-paid, to any organization or homeowners associations that requests such notice in writing and to all property owners and tenants within a 500 foot radius of the subject property, and in no event less than the 10 closest developed properties.
• The public notice shall state the nature of the event, the location and zoning designation of the property, the name of the project proponent, and the time and specific place of the proposed temporary use.
• Public notices shall be mailed not less than five (5) days prior to the proposed event. • The planning director shall render a decision at least three (3) days prior to the proposed use. The planning director’s decision is not appealable.

As is the case for events with 99 or fewer attendees, the City may deny an application for an event under this section for the same reasons listed above. These events will also appear on the City’s weekly Event Report. The events under this section will be limited to 20 per parcel, per year.

Events with 251 or more attendees will be required to obtain a TUP pursuant to the current regulations listed in MMC Chapter 17.68. These events will be limited to six per parcel, per year.

Temporary signage is proposed to be allowed replacing the requirements of MMC Chapter

17.52 temporarily, so long as the businesses or property owners obtain a temporary sign permit from the City and meet the following requirements. All other signs will still be subject to MMC Chapter 17.52.
- Six (6) signs per shopping center as defined by the Malibu Municipal Code or two (2) signs per parcel for all other commercial businesses that shall not exceed 16 square feet in size each.
- Signs must be temporary and not have any permanent foundations or footings. - Signs shall not be illuminated unless authorized by the Community Development Director.

ENVIRONMENTAL REVIEW: The California Environmental Quality Act (CEQA) applies only to projects which have the potential for causing a significant effect on the environment. Pursuant to CEQA Guidelines Section 15061(b)(3), where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. The City Council has determined that there is no possibility the amendment will have a significant effect on the environment and accordingly, the exemption set forth in Section 15061(b)(3) applies. The amendments to the MMC will not to have a significant effect on the environment as they provide only temporary relief from some current permitting requirements, and still require individual review, conditions, and CEQA review for all events. In addition, the changes do not excuse compliance with the Coastal Act which provides additional protection of the

Page 5 of 5 ends

environment and sensitive coastal resources. All of the temporary uses allowed by the proposed ordinance will be required to be restored to its existing state and each event will still require compliance with CEQA individually, as well as the California Coastal Act.

SUMMARY: Staff recommends that the City Council adopt an Urgency Ordinance (Attachment 1) and follow up Ordinance (Attachment 2) to amend Title 17 (Zoning) of the MMC to modify standards and procedures to stimulate economic recovery for local businesses as a result of Impacts from the 2025 Palisades Fire, specifically related to Temporary Use Permits and Sign Permits.

ENVIRONMENTAL QUALITY ACT
The City Council of the City of Malibu does find and ordain as follows:

SECTION 1. Findings.

A. On January 7, 2025, the Palisades Fire broke out affecting close to one-third of Malibu geographically and closing Pacific Coast Highway (PCH), the main throughfare and entrance to the City, to the general public from the eastern City limit to the Carbon Beach area for months drastically reducing the number of visitors coming from the greater Los Angeles area. The Governor of California has declared the event a disaster and the President of the United States has declared the event a major disaster under federal law.

B. On February 13, 2025, Governor Newsom issued Executive Order N-20-25, which suspended requirements of the California Environmental Quality Act and California Coastal Act for Palisades Fire rebuilds and related issues.

C. Over 750 homes have been destroyed in the City, concentrated in Eastern Malibu along PCH and in the Big Rock area, leaving many property owners and constituents without a place to live and work. Many more were damaged and cannot be occupied by their owners.

D. In addition, hundreds homes have been destroyed in the Pacific Palisades, with many more damaged as well. Residents of these properties frequented businesses in Malibu, and most are no longer doing so as a result of the fire.

E. Some Malibu businesses have reported up to 80 percent losses year over year since the start on the Palisades Fire, and many have already failed and are no longer operating. The failure of local businesses poses an immediate threat to the public health, safety and peace of the City by limiting the ability of residents to obtain essential items, food, and work.

F. Current regulations within Malibu regarding temporary events can be complicated and pose a hurdle to businesses conducting such events, which can help sustain local businesses and prevent them from failing or limiting the time and extent of their operations.

G. The Malibu City Council finds that this ordinance is necessary for the preservation of the public peace, health, and safety of residents living and working within the City and finds urgency to approve this ordinance immediately based on the facts described above and below.

SECTION 2. Environmental Review.

The City Council has analyzed the project proposal described herein. The California Environmental Quality Act (CEQA) applies only to projects which have the potential for causing a significant effect on the environment. In addition, the changes do not excuse compliance with the Coastal Act which provides additional protection of the environment and sensitive coastal resources. All of the temporary uses allowed by the proposed ordinance will be required to be restored to its existing state and each event will still require compliance with CEQA individually, as well as the California Coastal Act.

SECTION 4. Urgency Finding.

The City Council finds and declares that the adoption of this Urgency Ordinance is necessary for the immediate preservation of the public peace, health, and safety. The 2025 Palisades Fire, 2024 Franklin Fire and 2024 Broad Fire destroyed hundreds of properties causing a declaration of emergency and disaster declaration from the President of the United States as well as the Governor of California and the City of Malibu. Business owners within Malibu have been left with limited resources and many do not have the financial means to survive without economic activity being brought to the City. The failure of local businesses poses an immediate threat to the public health, safety and peace of the City by limiting the ability of residents to obtain essential items, food, and work. The Council therefore finds and determines that the immediate preservation of the public peace, health and safety requires that this Ordinance be enacted as an urgency ordinance pursuant to Government Code section 36937 and take effect immediately upon adoption by four-fifths of the City Council.

SECTION 5. Effective Date.

This Ordinance shall be effective immediately upon its adoption by four-fifths of the City Council, but shall be removed from the City’s municipal code and no longer be in effect as of February 1, 2026.

SECTION 6. Severability.

Should any section, subsection, clause, or provision of this Ordinance for any reason be held to be invalid or unconstitutional, such invalidity or unconstitutionality shall not affect the validity or constitutionality or the remaining portions of this Ordinance; it being hereby expressly declared and this Ordinance, and each section, subsection, sentence, clause, and phrase hereof would have been prepared, proposed, approved, and ratified irrespective of the fact that any one or more sections, subsections, sentences, clauses, or phases be declared invalid or unconstitutional.

SECTION 2. Environmental Review.

The City Council has analyzed the project proposal described herein. The California Environmental Quality Act (CEQA) applies only to projects which have the potential for causing a significant effect on the environment.

SECTION 3. Zoning Text Amendment Findings.

Pursuant to Malibu Municipal Code Section 17.74.040, the City Council hereby makes the following findings:

A. The subject zoning text amendment is consistent with the objectives, policies, general land uses and programs specified in the General Plan. The proposed amendment serves to enhance the Malibu General Plan Mission Statement, protect public safety and preserve Malibu’s natural and cultural resources.
