Agenda Report
To: Councilmembers Riggins and Conrad
Prepared by: Angela Loera, Senior Management Analyst
Reviewed by: Christopher Smith, Assistant City Manager
Approved by: Joseph D. Irvin, City Manager
Date prepared: August 24, 2026 Meeting date: September 2, 2026 Subject: Malibu Library Set Aside Funds for Fiscal Years 2026-27 and 2027-28 RECOMMENDED ACTION:
Recommend to the City Council that they approve the use of Malibu Library Set Aside Funds for Fiscal Year 2026-27 and authorize expenditures through Fiscal Year 2027-28.
FISCAL IMPACT:
There is no direct fiscal impact on the General Fund. Malibu Public Library services are paid from a designated portion of property tax. Every year, the County of Los Angeles sets aside the difference between the property tax dollars apportioned to the County Library from property within the City and Malibu Library expenses into a designated fund to solely improve Malibu Library facilities and services. The ending balance for Set Aside Funds as of Fiscal Year 2024-25 totaled approximately $28,453,723; this includes a surplus of $3.4 million. Currently, there is $28,453,723 available in the Set Aside Funds for the Library revitalization project, but additional funding may be required. Financials for Fiscal Year 2025-26 have not been released by the County of Los Angeles. Staff anticipate receiving the related financial documents later this year, when the County completes their fiscal year-end closeout.
DISCUSSION:
The Malibu Library Set Aside Funds are a joint effort on the part of the County of Los Angeles Library and the City of Malibu to dedicate unused revenues paid by Malibu taxpayers for library related programs and services within the City. On December 8, 2025, Council reviewed and established priorities for these funds for the current 2026-27 fiscal year. These recommendations are used by the library to inform its funding decisions.
Agenda Item #3.A.
On March 31, 2026, staff presented potential projects requesting Set Aside Funds for the current fiscal year:
• Malibu Monarch Project ($83,750)
• Malibu Boys & Girls Club Youth Resilience and Preparedness Initiative ($200,000) • Santa Monica Mountains (SAMO) Fund ($85,000)
• Malibu Film Society ($85,000) *funds are rolled over from the previous Fiscal Year 2025- 26 Historically, Library set aside funds would be approved in the spring. However, due to both staff turnover and extended time working with community partners to ensure their funding requests met the Library-nexus standard, approval of funding for Fiscal Year 2026-27 has been delayed.
As a result, the timeline to expend Set Aside Fund dollars is unusually compressed. To allow sufficient time for the Library and the community partners to develop and host their programs and events, Library and City staff recommend that the Council authorize approval of the funds for Fiscal Years 2026-27 and 2027-28. This authorization will assist with streamlining approval for the subsequent fiscal year as well as provide an adequate timeline for grantees to fulfill their funding requirements. This approach would also allow staff sufficient time to conduct the assessment and associated engagement for the future of the library and establish an estimate for funding the re-envisioning of the library. To account for potential cost increases and ensure sufficient funding for annual maintenance and security costs, staff increased the Fiscal Year 2027- 28 budget proposal by a 5% CPI adjustment across both Salaries & Benefits and Operations & Maintenance.
If approved by the Library Subcommittee, staff will present the recommendations for Library Set Aside Funds to Council on September 28, 2026. From there, the recommendations will be submitted to the County Library for approval. To help streamline this process, City and Library staff have worked closely to develop this recommended budget.
Background on Library Set Aside Funds
The Malibu Library was established in 1970 by the County of Los Angeles and is located on the county-owned civic center property. On September 2008, the city and county executed a Memorandum of Understanding (MOU) that governs the use of the Set Aside Funds. The MOU established a structure in which the expenditure of the excess funds generated from the taxes that Malibu residents pay could be spent on the Malibu Library. On March 26, 2018, the City and the County amended the MOU extending the term to 2044, with two possible five-year extensions.
This report provided an update on those recommendations and on the Library Needs Assessment requested by Council.
The MOU sets a clear annual Library Set Aside Fund review timeline for council and staff meetings with the purpose of reaching an agreement on an proposed expenditures for the Set Aside Funds in the next fiscal year. Typically, funding requests are sought in the fall, reviewed and refined in the winter, and approved by the Council in the spring. As noted in the MOU, these meetings are advisory in nature and not intended to divest the County Library, or the County of Los Angeles, of any authority to control or use Set Aside Funds.
