Mammoth Lakes Town Council
Agenda Action Sheet
Title: Approve the resolution re-authorizing the Town Council to meet virtually during the COVID-19 pandemic declared emergency.

Council Meeting Date: 1/5/2022
Prepared by: Daniel C. Holler, Town Manager
Recommended Motion: Approve the resolution re-authorizing the Town Council to meet virtually during the COVID-19 pandemic declared emergency.

Summary: The passage of AB 361 amended the Brown Act to allow local legislative bodies to meet by teleconference (virtually) and modified the conditions for virtual meetings. Government Code Section 54953(e) is the provision of the Brown Act establishing special rules that apply under specific circumstances to meetings of local government legislative bodies that are conducted remotely via teleconference. On October 6, 2021, the Town Council adopted a resolution finding that pursuant to Government Code Section 54953(e), the legislative bodies of the Town of Mammoth Lakes shall conduct their meetings without compliance with paragraph (3) of subdivision (b) of Government Code Section 54953, as authorized by subdivision (e) of Section 54953, and that such legislative bodies shall comply with the requirements to provide the public with access to the meetings as prescribed in paragraph (2) of subdivision (e) of Section 54953.

As a condition of extending the use of the provisions found in Section 54953(e), the Town Council must reconsider the circumstances of the state of emergency that exists in the Town of Mammoth Lakes and take affirmative action to continue to meet virtually.

The declared state of emergency by the Governor and Mono County continues to exist.

The Mono County Health Department continues to recommend the practice of social distancing. The amended Brown Act requires the Council to review these conditions every 30 days and act on whether to continue virtual meetings. Finding that these conditions still exist, it is recommended the Town Council adopt the provided resolution re-authorizing the Town Council to meet virtually.

Mammoth Lakes Town Council
Agenda Action Sheet
Title: Approve and adopt Resolution No. 22-XX establishing the 2022 compensation schedule and benefits for limited-term employees and repeal Resolution No. 19-69.

Council Meeting Date: Wednesday, January 5, 2022
Prepared by: Amanda Pelham, Human Resources Manager
Recommended Motion: Approve the Resolution establishing the 2022 compensation schedule and benefits for limited-term employees.

Summary: The Town continues to have a need to provide public services through the use of limited-term employees who are not subject to, nor have employment rights under, the Town’s Personnel System. It is therefore necessary to establish and continue to review the compensation and benefits afforded to such employees.

California minimum wage will increase effective January 1, 2022. Therefore, the compensation schedule for limited-term employees needs to be adjusted to accommodate the new requirements.

Other changes, primarily consolidation and re-classification of certain positions, are necessary to better reflect the requirements of those positions.

In addition, and to promote recruitment and retention of the Town’s limited-term employees and to contribute to their health and safety, it is appropriate to provide certain classifications with benefits above and beyond what is required by state and federal law. Given the nature of work performed by Temporary Airport Maintenance Workers and Temporary Snow Removal Operators, particularly during the winter months, it is considered appropriate to provide them with a $15 meal allowance for shifts worked of 12 hours or more. Additionally, given the safetysensitive nature of work performed by various limited-term classifications, it is appropriate to provide incumbents with a boot/sunglasses reimbursement of up to $200 per year. These two benefits are comparable to, but slightly less generous than, what is offered to regular employees in similar classifications.

RESOLUTION NO. 22--XX

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF MAMMOTH LAKES, STATE OF CALIFORNIA, ESTABLISHING 2022 COMPENSATION

WHEREAS, the Town of Mammoth Lakes has previously established pay rates for limited-term employees and these employees are not subject to, nor do they have employment rights under, the Town’s Personnel System as provided for in Chapter 2.44 of the Town of Mammoth Lakes Municipal Code, and the Town’s adopted Personnel System Rules; and WHEREAS, the Town has a need to meet the requirements of the Town to provide public services through the use of limited-term employees, and must establish compensation schedules and appropriate benefits for such employees; and
WHEREAS, rates of pay and conditions of employment for limited-term employees have been set in a previous Resolution No. 19-69; and
WHEREAS, California minimum wage will increase effective January 1, 2022, and the compensation schedule for limited-term employees must be adjusted to accommodate the new requirements; and
WHEREAS, other changes need to be made to the compensation schedule including the consolidation of positions at our recreation facilities to Recreation Facilities Staff I and Recreation Facilities Staff II, renaming of our camp counselor positions to Recreation Leader I and Recreation Leader II for consistency, removal of the Assistant Program and Facilities Coordinator position, consolidation of temporary maintenance worker positions across all departments to Temporary Maintenance Worker I and Temporary Maintenance Worker II, reclassification of the Assistant Site Coordinator position, the addition of a new position, Lodging Support and Enforcement, and adjusting pay to an hourly rate for our Sports Officials to better reflect the position requirements.

NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF MAMMOTH LAKES AS FOLLOWS:

Section 1. Limited-term employees for the purposes of this resolution are those defined in Chapter 2.44.040 of the Town’s Municipal Code as being excluded from the Town’s Personnel System Rules.

Section 2. Limited-term employees are covered by the Town’s workers’ compensation and liability insurance provisions while performing assigned duties.

Limited-term employees in the classification of Temporary Airport Maintenance Worker and Temporary Snow Removal Operator shall be eligible to receive a fifteen-dollar ($15.00) meal allowance for each shift worked of twelve (12) hours or more. OMICRON (B.1.1.259)
SURGE
• 95% of cases in the USA
and CA are Omicron
• U.S. 7-day average of new
cases: 400,000+
• People hospitalized: 82,898
• People in ICU: 17,562
• Pediatric hospitalizations
up 66% in a week
• Deaths remain low

Page 64 of 67 ends

OMICRON VARIANT IS 95% DOMINANT
• The rapid growth rate in Omicron infections is
believed to result from a combination of
increased transmissibility and the ability to
evade immunity conferred by past infection or
vaccination (i.e., immune evasion)
• At present, early data suggest Omicron
infection might be less severe than infection
with prior variants; however, reliable data on
clinical severity remain limited.
• Data from South Africa and the United
Kingdom demonstrate that vaccine
effectiveness against infection for two doses
of an mRNA vaccine is approximately 35%.
• A COVID-19 vaccine booster dose restores
vaccine effectiveness against infection to 75%.
