DID YOU KNOW?
• Any mandatory fee or charge passed on to a transient occupant for the right to occupy a rental unit for 30 days or less without the intention of issuing a refund is taxable revenue.
• A security deposit, which is a returnable sum payable when something is rented to cover any possible loss or damage, is not subject to TOT and TBID and does not need to be reported as gross receipts.
• Online advertising platforms, e.g., Airbnb and VRBO, subtract a percentage of the amount paid by the transient occupant generally labeled as a host fee.

This host fee is a taxable item and is to be included with the gross receipts. • Recent audits of transient rental accounts have shown some operators are not reporting the online rental platform host fee.
• Along with online rental platform host fees, mandatory fees such as cleaning, additional occupants, linen/towel services, pet occupancy, resort, security, energy surcharges, mandatory insurance coverage, and “no show” charges are all taxable revenue and must be included in the reported gross receipts. • Line items excluded are generally optional and include room service, food and beverage, fees for movies or video games, key deposits, optional insurance, and parking.
• Under-reported revenues are subject to penalties of 15% for the first and second month as well as 18% annual interest.

If you have questions about taxable revenues for transient rentals, please contact the Finance Department at 760-965-3660. Page 27 of 98 Vacation

Mammoth Lakes Town Council
Agenda Action Sheet
Title: Mammoth Main Base Redevelopment Project Update (“Evolving Main”) (Mammoth Mountain Main Lodge Area).

Council Meeting Date: 1/17/2024
Prepared by: Jen Murillo, Contract Planner
Recommended Motion: No recommendation or action is needed on this item.

Summary: [changes from 12/20/23 update are highlighted] The Mammoth Main Base Redevelopment Project is a major private development application being processed by the Town. Below is a high-level update on this application:
 Environmental Review (CEQA/NEPA) – The Town is the lead agency for CEQA and the US Forest Service is the federal lead agency for NEPA. Scopes of work for technical studies (e.g., biological, cultural, traffic, etc.) are being refined based on scoping comments received in late 2022 and fieldwork completed in late 2023. After technical studies are completed, the Draft Environmental Impact Report/Environment Impact Statement (EIR/EIS) will be prepared.
 Outreach – On January 10, 2024, a Planning and Economic Development Commission workshop was held to discuss the project. Future public meetings are anticipated to be topic focused as discussions with the project’s “Working Group” (i.e., Town staff, the applicant, and various stakeholders (e.g., Mammoth Lakes Fire Protection District, Mammoth Lakes Police Department, etc.)) proceed.
 State Route (SR) 203 Potential Relinquishment Analysis – The first step in analysis of a potential relinquishment of any portion of SR 203 is Caltrans’ preparation of a Relinquishment Assessment Report (RAR). On December 6, 2023, the Council approved a letter requesting Caltrans evaluate the entirety of SR 203 within the Town’s boundary in logical segments. The Town and Caltrans will continue to coordinate as work on the RAR begins.
 Target Schedule
Ongoing Additional outreach meetings/events
Late 2024 Draft EIR/EIS available for review

1 TOWN COUNCIL STAFF REPORT
Title: Authorize the Contract for the Design of the Airport Parking Lot Reconstruction Project to Brandley Engineering Inc.

Meeting Date: January 17, 2024
Prepared by: Sierra Shultz, Deputy Airport Manager
RECOMMENDATION:

Staff recommends that Town Council authorize the agreement with Brandley Engineering, Inc. for the engineering design services for the General Aviation (GA) and Terminal Area Parking Lot Reconstruction project at Mammoth Yosemite Airport (MMH) in an amount not to exceed $116,900.

BACKGROUND:

In May 2022, the Airport parking lot asphalt was surveyed to determine the asphalt quality.

The asphalt was found to be extremely deteriorated, with a Pavement Condition Index (PCI) ranging from 7 to 64. PCI ranges from 0 to 100 and therefore our pavement class is considered to be very poor and failed.

On September 12, 2023, staff executed an Airport Infrastructure Grant (AIG) agreement with the Federal Aviation Administration (FAA) for the purposes of funding the design of the GA and Terminal Area Parking Lot Reconstruction. The design will include a full depth pavement removal and replacement, drainage, lighting, and Americans with Disabilities Act (ADA) improvements.

ANALYSIS:

Brandley Engineering Inc. has been conducting engineering and architectural services for the Airport for many years. Staff issued a Request for Qualifications for engineering and architectural services at the Airport in June of 2023 and after reviewing Statement of Qualifications and conducting interviews. Brandley Engineering, Inc., along with one other firm, was selected to provide on-call engineering services as needed.

The proposed contract scope of work for this project includes four phases: project scoping, preliminary engineering, engineering design and preparation of plans and specifications, engineering support during bidding and contract award. The preliminary engineering phase includes environmental studies, geotechnical studies, and topographic surveys. A record of negotiation and independent fee estimate was completed by staff to ensure a reasonable fee and scope of work.

Page 63 of 98 ends

2 FINANCIAL CONSIDERATIONS:

The amount of funding received through the Federal Aviation Administration (FAA) Airport Infrastructure Grant (AIG), number 3-09-0146-052-2023, was $108,701. The grant requires a sponsor match of $11,199, bringing the total funds available for this project design to $119,900. The available funds are sufficient to cover the cost of the design consultant and Town administrative expenses.

ENVIRONMENTAL CONSIDERATIONS:

On February 27, 2023, the Federal Aviation Administration approved the project’s Categorical Exclusion, fulfilling the National Environmental Policy Act (NEPA) requirements.

Title: Authorize the Contract for Construction Management During the AWOS Relocation and Upgrade Project to Brandley Engineering Inc.

Meeting Date: January 17, 2024
Prepared by: Sierra Shultz, Deputy Airport Manager
RECOMMENDATION:

Staff recommends that Town Council authorize the agreement with Brandley Engineering, Inc. for construction management services for the Upgrade and Relocate Automated Weather Observation System (AWOS) project at Mammoth Yosemite Airport (MMH) in an amount not to exceed $80,000.

BACKGROUND:

Over the last couple of years, staff have been working on the design of a multipurpose building including Aircraft Rescue and Firefighting (ARFF) and snow removal equipment bays at the airport. The building is planned to be located too close to our existing AWOS.

Therefore, it was decided to relocate the AWOS to allow for enough clearance around it.

Since the AWOS needed to be relocated, staff took the opportunity to update and install new AWOS equipment since the old equipment is very old.

On September 7, 2022, staff executed an Airport Improvement Program (AIP) grant agreement with the Federal Aviation Administration (FAA) for the purposes of funding the construction of the AWOS Relocation and Upgrade project and the construction management and administrative support needed. On July 20, 2022, Pacific Underground Services was awarded to complete the construction and therefore construction management support is needed.

ANALYSIS:

Brandley Engineering Inc. has performed construction management services and grant assistance for the airport for many years. Staff issued a Request for Qualifications for engineering and architectural services, to include construction management support, at the airport in June of 2023 and after reviewing Statement of Qualifications and conducting interviews. Brandley Engineering, Inc., along with one other firm, was selected to provide on-call engineering services as needed.

The purposed contract scope of work for this project includes two phases: engineering design services during construction including project closeout and construction management. The construction management portion of work includes that they furnish a

Page 66 of 98 ends

2 qualified Resident Engineer to review and monitor construction activities, conduct inspections and testing, provide traffic safety inspections, and implement the project safety plan. A record of negotiation and independent fee estimate was completed by staff to ensure a reasonable fee and scope of work.

FINANCIAL CONSIDERATIONS:

The amount of funding received through the Federal Aviation Administration (FAA) Airport Improvement Program (AIP) grant, number 3-06-0146-048-2022, was $490,215.

The grant required a sponsor match of $50,503, bringing the total funds available for this project to $540,718. The funds available are sufficient to cover the cost of this proposed construction management contract, as well as the original project design, construction, and town administrative expenses.

ENVIRONMENTAL CONSIDERATIONS:

An Environmental Impact Report (EIR) was completed and certified for the Terminal Area Development Plan (TADP) at the Town Council meeting on October 6, 2021 to fulfill California Environmental Quality Act (CEQA) requirements. An Environmental Assessment (EA) was also completed and approved by the FAA for the TADP on November 15, 2021 to fulfill National Environmental Policy Act (NEPA) requirements.

The relocation and upgrade of the AWOS was included in that TADP EIR and EA.

1 TOWN COUNCIL STAFF REPORT
Title: Consider Adoption of the Second Amendment to the Solid Waste Services Agreement between the Town of Mammoth Lakes and Mammoth Disposal Company related to rate adjustments.

Meeting Date: January 17, 2024
Prepared by: Pam Kobylarz, Assistant to Town Manager
Daniel C. Holler, Town Manager
RECOMMENDATION:

Adopt the Second Amendment to the Solid Waste Services Agreement between the Town of Mammoth Lakes and Mammoth Disposal Company related to rate adjustments.

BACKGROUND AND ANALYSIS:

Background
In October 2020, the Town of Mammoth Lakes entered into a 20-year Solid Waste Franchise Agreement (Solid Waste Services Agreement) with Mammoth Disposal. The Town is required to provide solid waste services for its residents and visitors, including compliance with recycling and diversion mandates. The Franchise Agreement allows for Mammoth Disposal to provide these services on behalf of the Town; however, compliance with State mandates is still ultimately the Town’s responsibility.

The Franchise Agreement governs all aspects of solid waste services, including collection, processing, hauling, and how the rate structure may be approved and modified. The existing rate structure through 2027 was approved by the Town Council and sets a base rate that incorporates a 5.6% increase each year through 2026 to fund the costs of new capital investments, increased operational and processing costs, and enhanced service levels, with a focus on increased recycling programs. On January 1, 2027, the current Franchise Agreement rate structure allows for the rates to increase between 1-4% each year based on the defined Consumer Price Index (CPI).

Analysis
The adopted rates are intended to cover the costs of services, infrastructure investment (including construction of the new transfer station), new operating costs, and ongoing expenses. The Franchise Agreement allows for Mammoth Disposal to request an increase to rates in the event that unforeseen circumstances arise “which are caused by no fault of Contractor and are outside Contractor’s control and materially affect Contractor’s costs or revenues under this Agreement.”
Benton Crossing Landfill closed on December 31, 2022, and per the Franchise Agreement, Mammoth Disposal started hauling all municipal solid waste from Mammoth Lakes to

Page 78 of 98 ends

2 Russell Pass Landfill in Fallon, Nevada, effective January 1, 2023. Mammoth Disposal hired Cherokee Trucking to haul the waste (also known as the transfer brokerage) pursuant to a one-year agreement. On October 24, 2023, Cherokee Trucking provided Mammoth Disposal notice that it will no longer provide hauling services beginning on January 1, 2024, so Mammoth Disposal solicited new bids for the transfer brokerage work and selected SRT as the most responsive bidder. SRT’s rates for brokerage are higher than those charged by Cherokee Trucking and became effective January 1, 2024. Cherokee Trucking also charges an additional fuel surcharge (FSC) to cover the fluctuating costs of fuel.

To cover this brokerage rate increase, Mammoth Disposal has formally requested an amendment to the Franchise Agreement to permit a one-time adjustment of 2.94% to Mammoth Disposal’s rates as well as the addition of a pass-through FSC that would be a separate line item on customer billings. To address this, the following changes to the Franchise Agreement are proposed:
 Amend Section 22 to state that Exhibit B (Rates) reflects rates from February 1, 2024 - December 31, 2027.
 Amend Section 22.B to include the one-time 2.94% base rate increase to cover the increased hauling costs.
 Amend Section 22.B to allow for a fuel surcharge to be added to billings, based on a published index used by the brokerage provider
(https://www.eia.gov/petroleum/gasdiesel/). The FSC will be based on actual fuel costs over a 6-month period and will be capped at 6.1%. Town staff will review the request twice a year to ensure it is reasonable.

Town staff have reviewed the request and information provided by Mammoth Disposal and agree that the allowance for a one-time increase to address the hauling costs as well is appropriate to ensure that Mammoth Disposal is able to provide efficient and effective solid waste services on the Town’s behalf. The addition of the FSC is also a reasonable passthrough cost given how fuel prices have increased over the past few years and the distance travelled to dispose of waste generated within the Town.

This is not a request to increase solid waste rates. This item is a request to amend the Franchise Agreement, which allows Mammoth Disposal to come forward with a request to modify the rates. The request for a proposed rate increase is a public hearing scheduled as a separate item on the January 17, 2024 meeting agenda.

OPTIONS ANALYSIS
Option 1: Adopt the Second Amendment to the Solid Waste Services Agreement between the Town of Mammoth Lakes and Mammoth Disposal Company. This would allow Mammoth Disposal to come forward with its request to modify solid waste rates.

Option 2: Do not Adopt the Second Amendment to the Solid Waste Services Agreement between the Town of Mammoth Lakes and Mammoth Disposal Company. A decision not

Page 79 of 98 ends

3 to adopt the proposed amendment would result in the existing solid waste rate structure staying in place.

1 TOWN COUNCIL STAFF REPORT
Title: Consider Adoption of a Resolution Approving the Solid Waste Disposal Charges and Rates for January 1, 2024 through December 31, 2027.

Meeting Date: January 17, 2024
Prepared by: Pam Kobylarz, Assistant to the Town Manager Daniel C. Holler, Town Manager
RECOMMENDATION:

Adopt a Resolution Approving the Solid Waste Disposal Charges and Rates for January 1, 2024 through December 31, 2027.

BACKGROUND:

In October 2020, the Town of Mammoth Lakes entered into a 20-year Solid Waste Franchise Agreement with Mammoth Disposal. The Town is required to provide solid waste services for its residents and visitors, including compliance with State mandates for recycling and diversion of waste from landfills. The Franchise Agreement allows for Mammoth Disposal to provide these services on behalf of the Town; however, compliance with State mandates is ultimately the Town’s responsibility.

As part of the Franchise negotiations, the rate structure for solid waste services was approved and is tied to a variety of increased service offerings, infrastructure investment, new operating costs, and ongoing expenses. In December 2022, the Town Council approved an updated rate structure through 2027 to reflect significant, unanticipated operational costs.

The Franchise Agreement allows Mammoth Disposal to request an adjustment to rates for services under the following extraordinary circumstances: in the event that unforeseen circumstances arise which are caused by no fault of Contractor and are outside Contractor’s control and materially affect Contractor’s costs or revenues under this Agreement. This rate request meets these criteria.

ANALYSIS:

Current Rates
The existing fee structure includes the following service and cost assumptions:
 Transportation and disposal of solid waste (~20%). This includes contracting the transportation of solid waste as well as the disposal of waste at a Russell Pass Landfill in Fallon, Nevada.
 Collection and processing of solid waste (~65%), including administration, collection services for residential and commercial customers, equipment (vehicles, bins, and other containers), and operations at the transfer station.

Page 85 of 98 ends

2  Recycling services and processing of other solid waste related materials (~15%), including handling of Household Hazardous Waste (HHW) and recyclable materials dropped off and collected, processing of construction and debris material, and the handling of green waste and miscellaneous items.

The rate structure allows for increased rates each January 1st for the calendar year. The base rate incorporates a 5.6% increase each year through 2026. The rate and annual increase were based on the estimated $9.3 million in capital expenditures as well as anticipated operational costs. In addition to the new facility, capital costs over the life of the Agreement include vehicles, bins/containers, sorting equipment, storage containers, and operational items related to replacement and upgrades. Operational costs include operation of programs and services, solid waste collection, disposal, recycling, and implementation of new State mandates.

From 2024 through 2026, rates and charges will increase a minimum 6.6% and a maximum of 9.6%. The rate includes the 5.6% base increase to the base rate, plus a 1% to 4% increase based on the Consumer Price Index (CPI). The solid waste rates use the Consumer Price Index, series CPI-U for the Los Angeles-Long Beach-Anaheim area published by the Bureau of Labor Statistics of the U.S, Department of Labor to determine the CPI impact each year. The 5.6% increase to the base rate will continue through 2026. The August CPI is used to determine the rates for the following calendar year. In 2027, the increase to the base rate will only include the CPI increase, with the base rates increase set at a minimum of 1% and maximum 4%. The initial rate notice did show the 5.6% increase continuing through 2027. This was corrected and the attached recommended rate increase for 2027 only includes the base CPI increase of 1% - 4% and the FSC charge.

Proposed Rate Increase
For its first year of hauling municipal solid waste from the Town of Mammoth Lakes to Russell Pass Landfill in Fallon, Nevada, Mammoth Disposal contracted with Cherokee Trucking to provide this service. This was a one-year agreement between the parties and Cherokee Trucking has provided notice that they will no longer be providing the service in 2024. Mammoth Disposal solicited new bids and based on quality of service and price; Mammoth Disposal selected Sierra Rental & Transport (SRT) to provide hauling service beginning January 1, 2024. The increase in trucking costs reflects overall higher rates, in part due to impacts of winter hauling and fees assessed on trucks hauling material between California and Nevada.

Due to increased hauling costs as a result of this change, the base rate proposed for 2024 will increase by an additional 2.94%, for a total increase in 2024 of 11.87% (5.6% base increase + 3.3% actual CPI + 2.94%).

Due to volatility in diesel fuel costs, the trucking company (STR) incorporates a separate fuel surcharge (FSC) in the hauling charge. The FSC is based on the weekly price of diesel fuel as published by the US Energy Information Administration (https://www.eia.gov/petroleum/gasdiesel/) for California. The current FSC increase of

4.48% is included in the proposed rates. The fuel surcharge will be averaged over a 6-

Page 86 of 98 ends

3 month period each February and August, using the noted index, providing time for Town staff to review submitted information and implementation on July 1 and January 1, respectively (adjusted every 6 months). The FSC will be added to all billing to cover the increased cost of hauling with SRT. The FSC will be shown as a separate pass through cost on billings and it is recommended that the FSC be exempt from the 9.5% franchise fee.

The rate proposal sets the FSC charges at a minimum increase of 0% and a maximum of

6.1%. The FSC charges would be on a review of information submitted and approval by Town staff, with approval not unreasonably denied, prior to going into effect every six months.

The proposed rate increase requires a public hearing and allows for customers to lodge a protest to the rates as provided for under Proposition 218. This process is often referred as to a Prop 218 hearing. A copy of the Prop 218 hearing notice including the proposed new rates is attached.

Minor modifications to the Solid Waste Franchise Agreement are also required to accommodate this request. The Franchise Agreement amendment is a separate agenda item.

If adopted by Town Council the rates provided herein will replace Exhibit B of the Franchise Agreement (Solid Waste Services Agreement) setting the updated rates.

OPTIONS ANALYSIS
Option 1: Adopt a Resolution Approving the Solid Waste Disposal Charges and Rates for January 1, 2024 through December 31, 2027.

Option 2: Do not approve the Solid Waste Disposal Charges and Rates for January 1, 2024 through December 31, 2027 and provide direction to staff.

TOWN OF MAMMOTH LAKES NOTICE OF PUBLIC HEARING

ON SOLID WASTE DISPOSAL CHARGES AND RATES
Notice is hereby given that the Mammoth Lakes Town Council will hold a public hearing on proposed increases in rates and charges for solid waste disposal, recycling, and related services. The hearing will be held on January 17, 2024 at 4:00 pm or as soon thereafter as the matter may be heard, in the Mammoth Lakes Town Council Chamber, located upstairs in Suite Z at 437 Old Mammoth Road, Mammoth Lakes, CA 93546, and/or virtually online. Interested parties are invited to attend the public hearing. Any protest of the proposed fees must be presented in writing at, or before, the hearing.

The proposed rates are calculated to cover the current actual and estimated costs of solid waste disposal, recycling, and related services for the Town of Mammoth Lakes. Costs to be recovered are those for ongoing operations, new and replacement capital equipment, and disposal fees. The Town entered into a solid waste Franchise Agreement with Mammoth Disposal in October 2020, which established a base rate and rate increases of 5.6% per year from 2022 through 2026. In October 2022, Town Council adopted an updated rate structure to address actual costs that have increased at levels above the initially estimated amounts for operation of programs and services, solid waste collection, disposal, new facility construction, recycling, and implementation of new state mandates. From 2024 through 2026 rates and charges will increase a minimum 6.6% and a maximum of 9.6%, which includes the base increase of 5.6% plus a 1% to 4% increase based on the Consumer Price Index (CPI) as defined, for August of each year, effective the following January 1st. In 2027 new base rates will increase a minimum 1% and maximum 4% based on CPI.

Due to increased hauling costs, the base rate proposed for 2024 will increase by an additional 2.94%, for a total increase in 2024 of 11.87%. A separate fuel surcharge (FSC) of 4.48% (adjusted every 6 months) will be added to all billing. The residential rate for single-family home transfer station users will increase from $77.30 quarterly in 2023 to $86.50 in 2024 (rates are rounded to nearest 10 cents). The rates for duplexes and triplexes will increase from $157.70 and 230.30, respectively, to $176.40 and $257.60. The monthly charge for 2-cubic yard bin service collected two times a week will increase from $417.50 to $467.00. All other residential and commercial services will also increase at the rate of 11.87%, plus the additional FSC. The enclosed rate sheet provides details on the proposed rates for 2024 and the minimum and maximum rates per year through 2027. A report describing the cost and operational details is available for public inspection in the Town Clerk’s office at Town Hall, 437 Old Mammoth Road, Suite 230, Mammoth Lakes, CA 93546. For questions, please call (760) 965-3603.

Members of the public are welcome to discuss the proposed rates and are encouraged to do so at the public hearing. Any property owner whose property is subject to the proposed increases to the rates for the solid waste services and any tenant directly responsible for the payment of such fees (i.e., a customer of record) may submit a written protest to the proposed rate increases; provided, however, only one protest will be counted per identified parcel. Any written protest must: (1) state that the identified property owner or tenant is in opposition to the proposed rate increases; (2) provide the location of the identified parcel (by assessor’s parcel number or street address); and (3) include the name and signature of the property owner or tenant submitting the protest. If the person submitting the written protest is the owner of record but was not shown on Mono County’s last equalized assessment roll as the property owner, that person must provide written evidence that the person is the property owner. Written protests may be submitted by mail or in person to the Town Clerk at the address shown above, at the public hearing (date and time noted above), or by email to [email protected] provided they are received prior to the conclusion of the public comment portion of the public hearing. If submitting a protest by mail, please provide sufficient time for it to arrive prior to the close of the public comment portion of the public hearing. Identify on the front of the envelope for any protest, mailed or submitted in person to the Town Clerk, Attn: Public Hearing on Solid Waste Rate Increases.

The Town Council will consider all written protests and hear and consider all oral comments to the proposed rate increases and annual rate adjustments at the public hearing. Oral comments at the public hearing will not qualify as formal protests unless accompanied by a written protest. Upon the conclusion of the public hearing, the Town Council will consider adoption of the rate increases to the Town’s solid waste service fees as described herein. If written protests against the proposed rate increases are not presented by a majority of the property owners, or tenants directly responsible for the payment of the solid waste service fees, of the identified parcels upon which the rates are proposed to be imposed, the Town Council will be authorized to impose the rate increases as outlined above. If adopted, the proposed rate increases will take effect beginning February 1, 2024.

AGENDA BILL
Subject: Councilmember Reports
Initiated by: Jamie Gray
______________________________________________________________________ BACKGROUND:

Each member of the Town Council is appointed to serve as a Town representative to a number of committees, commissions, and organizations.

These groups meet infrequently and from time to time the representatives will report to the rest of the Council at a regularly scheduled meeting.

In addition, Councilmembers on occasion participate in meetings, conferences and seminars, and their reports on these educational opportunities are of benefit to the rest of the Council.

ANALYSIS/DISCUSSION:

California Government Code requirements pertaining to the open meeting act stipulate that all items for discussion must be listed on the agenda before the matter can be discussed and/or acted upon. To meet this requirement, and the intent of the Brown Act, Councilmember Reports are listed on each agenda to allow representatives to report to the rest of the Council at these meetings.

The following is a list of the commission/committees on which members of the Council serve:

Land Use:

Local Agency Formation Commission (LAFCO) – Rea, Rice, and Bubser as alternate
Airport Land Use Commission – Rea, Rice, and Bubser as the alternate Mono County Collaborative Planning Team (CPT) – Senior Planner Kim Cooke and Rice as alternate
