-- Testimonials --
X Thank you, Town of Mammoth Lakes, for providing sustainable housing for our long-time professional residents. As a recipient of the Bridge Program’s Down Payment Assistance Program, I can personally attest to the professionalism and genuine dedication of the Town’s Housing Director, Patricia Robertson. She went above and beyond to facilitate the proper documentation to get our new and forever home in our beloved community… which was a huge relief as we were quickly approaching homelessness. This experience reminds us of the true meaning of “community”. The Town recognized a need and took the right steps to address it.

X It’s always been my dream to own a house in
Mammoth and be able to live in it comfortably as in not having two jobs. So I would just say I’m really grateful to the town and Mammoth Lakes Housing for making my dream come true.

X Thank you so much for everything. We are so grateful for this program. Had it not been for this program we would not have been able to become homeowners in this town. I have been with the county for 10 years and now being a homeowner because of this program in this town, I feel as though I can actually retire from the job that I love and continue to serve my community. Thank you again.

The creation of both private and semi-private rooms the North Wing will provide patients, families, and staff with ample room during inpatient stays while offering the flexibility in some rooms to have two patients in times of high census. The capacity for Medical/Surgical and ICU inpatients will go from 15 to 18 to allow for projected modest growth of inpatient care.
6

Page 25 of 153 ends

The creation of the Outpatient Services Center (OSC) provides expanded capacity for outpatient services that are expected to be the area of continued growth for healthcare. The OSC will allow for the centralization of dispersed services occurring in the hospital and clinics and pave the way for future expansion of surgical services with the relocation of the Post-Anesthesia Care Unit.

Endoscopy volume has grown from 197 cases in FY2014 to 637 in FY2024.

Page 26 of 153 ends

The Town of Mammoth Lakes is experiencing a boom in projects underway and planned which will bring more residents and guests to the community:
- The Parcel: 580 new residences per master plan.
- Limelight Mammoth: 15 new residences (condo) and 149 new hotel beds. - Rockspring: 118 new residences (condo)
- Residence Inn Boutique Hotel by Marriott: 101 guestrooms - Mammoth Hotel (Sierra Center Mall): 164 guest rooms
- Main Lodge Redevelopment: 209 resort residential units and up to 250 lodging units distributed between several locations

The size of the building and the services found therein are driven by:
 What is needed to move departments that are required to be in seismically compliant space.
 Create operational adjacencies that optimize patient flow and the interdependency of departments’ staff and supplies.
9

Page 28 of 153 ends

The North Wing will be in compliance with California’s
seismic code and the 2030 deadline for rural hospitals.

It will also be built to well-withstand the winters of
Mammoth Lakes.
10

Page 29 of 153 ends

The exterior finishes and interior palate will be compatible with the existing facilities.
11

Page 30 of 153 ends

The project will use environmentally friendly materials.

Efficient HVAC and lighting systems, more windows, and improved insulation will reduce energy consumption.

Selected materials will reduce or eliminate volatile organic compounds (VOCs) and “red-list” chemicals.

Landscape will be designed with low-water-use native plants. 12

Page 31 of 153 ends

The building will be visually and acoustically appealing to provide a calming and beautiful environment for healing and working. It is also expected to help attract and retain staff who want to work in a modern well-designed and equipped facility. It need not be more than that, and direction has been given to the architects to be modest in design and materials.

Mammoth Lakes Town Council
Agenda Action Sheet
Title: Review of Local Impacts from Federal Actions
Council Meeting Date: 2/19/2025
Prepared by: Rob Patterson, Town Manager
Recommended Motion: Report only – No action
Summary: The Town of Mammoth Lakes does have a vested interest in monitoring the activities of the current administration, at the Federal level, to determine local impacts. The Town is surrounded by federal land and therefore dependent on effective management and staffing of the Forest Service. In addition to these vulnerabilities, the community receives federally funded services through programs administered by Mono County. Town leadership is coordinating with both County and Forest Service leadership on these important vulnerabilities. This presentation is to provide the community with an update on this monitoring process, the collaboration with partners, and how the Town will respond when action is necessary.

1 TOWN COUNCIL STAFF REPORT
Title: Receive and file the 2024 Snowcreek Development Agreement annual review report, finding the Developer in good faith substantial compliance with the terms and conditions of the Development Agreement.

Meeting Date: February 19, 2025
Prepared by: Nolan Bobroff, Community & Economic Development Director RECOMMENDATION:

Receive and file the 2024 Snowcreek Development Agreement annual review report, finding the Developer in good faith substantial compliance with the terms and conditions of the Development Agreement.

BACKGROUND:

Development Agreements
Development Agreements (DAs) are contracts negotiated between project proponents and public agencies that govern the allowable land uses in a particular project and establish the conditions to which a development will be subject. DAs are intended to provide the developer with assurances that it will have a vested right to develop, use, and operate the project site during the term of the agreement, including the vesting of the uses and densities identified in the regulatory documents (e.g., zoning code, master plan). In return for those assurances, DAs provide the public agency (e.g., the Town) with a variety of community benefits that are negotiated between the parties and are required to be shown to be of greater benefit to the community than development under present zoning. DAs are required to be consistent with the General Plan and any applicable specific plan.

Neither an applicant nor a public agency is required to enter into a DA; DAs are voluntary agreements of both parties. The terms and conditions of DAs are negotiated between the parties and subject to the ultimate approval of the public agency after following a specifically required process.

State law, Government Code 65864 et seq., and Municipal Code Chapter 17.104 outline the requirements for Town of Mammoth Lakes DAs. DAs are recorded, which binds future owners to the requirements and obligations contained in the DA. The Snowcreek DA was adopted consistent with these requirements.

Snowcreek DA
The Snowcreek DA (SDA) (Attachment 3) was approved by Town Council via Ordinance 10-08 and became effective on July 23, 2010 and applies to the Snowcreek Master Plan Update (Snowcreek VIII) and Snowcreek VII projects, which total approximately 260 acres within the Snowcreek Master Plan area. The term of the SDA is for 20 years covering the period of July 23, 2010 – July 23, 2030; however, starting in July 2020, the term of the SDA is reduced one day for each day that construction of the hotel and expanded golf course has not commenced. Construction of these elements has not commenced and

Page 67 of 153 ends

2 therefore, the term is currently being reduced and will expire in July 2025, unless construction of the golf course and hotel has commenced or unless an amendment to the 2010 SDA is approved that extends the term.

The SDA is intended to:
 Increase the likelihood the subject development projects are built as intended in the long-term;
 Ensure the provision of needed facilities, improvements, or services; and  Provide assurance to the developer regarding the rules, regulations, and policies applicable to future development.

Both the Town and the Developer share mutual interest in implementation of the Snowcreek VII and Snowcreek VIII projects and the improvements that would result.

As negotiated through the SDA, the greater community benefits provided through the SDA include:
 Allowing egress of backcountry skiers, snowboarders, and snowshoers from the Sherwin Range earlier than required (DA Section 2.2.1.a).  Permanent preservation of the Mammoth Creek open space corridor (DA Section

2.2.1.b).
 Additional Financial Contribution (“AFC”) paid per unit at building permit issuance. This cash flow could result in up to $10 million to use for purposes beneficial to the community and intended to be applied to various projects located within a surrounding geographic nexus (DA Section 2.2.2).  Fiscal benefits that will accrue to the Town and community through the implementation of the Project as intended that would not occur without the DA, including transient occupancy taxes.
 Secondary access for both Snowcreek V and VIII and the emergency vehicle access road, which is in addition to the Fire District requirements.  Establishment of public access across certain points of the project to surrounding public lands prior to project construction and after completion, which would provide access to an enhanced network of publicly accessible multi-use paths that is connected to the Town’s trail system.

Additional community benefits provided by the Project are identified in the Recitals of the SDA. The full Development Agreement can be found online HERE.

ANALYSIS:

Snowcreek DA - Annual Review
Because of economic conditions and the significant impacts caused by the recession, a determinate phasing schedule of development was not practical and was not approved with the SDA. Rather, basic performance milestones were provided, which are listed in the attached annual review report (Attachment 1). The SDA allows for a finding that it is acceptable for milestones to have not been met due to unavoidable delays or events as described in Section 11.15 of the SDA.

Page 68 of 153 ends

3 Attachment 1 is the 2024 annual review report for the SDA and Attachment 2 is the written statement from the developer initiating the annual review. This report finds that the Developer is in good faith substantial compliance with the terms and conditions of the SDA.

The Developer has submitted a request for an amendment to the SDA to extend the term for an additional 20 years; however, the amendment is separate from this annual review.

The annual review is simply reviewing the progress towards the milestones listed in the current SDA, which is still in effect until July 2025, or the effective date of an amended DA if one is approved prior to July 2025.

Snowcreek VII Progress
Development of the Snowcreek VII project was completed in 2024, with the final eight (8) units (3 buildings) receiving certificates of occupancy. A total of 118 units within 39 multiunit buildings have been constructed and the associated benefits of the project have been provided, including, but not limited to the completion of the bike path, and the provision of recreational trail public easement, adjacent to Minaret Road between the Athletic Club and Minaret Road, the provision of a 40-foot wide public access easement for fishing and hiking along Mammoth Creek, and the preservation and restoration of the historic Wildasinn Cabin and Pelton Wheel.

Snowcreek VIII Progress
In August 2023, the final map for TTM 09-002 (Snowcreek VIII) was recorded, thereby legally creating 18 development lots, six lettered lots for road purposes, and 1 lettered lot for open space purposes within the Snowcreek VIII area.

In September 2024, the “Snowcreek VIII Phase I” condominium subdivision project was approved by the PEDC allowing for: (1) the creation of 172 “airspace” condominium units; (2) construction of the road and multi-use path network for Phase I; and (3) completion of all required subdivision improvements (i.e., mass grading, installation of utilities, drainage infrastructure, stormwater management) for Phase I. The proposed subdivision does not authorize the physical construction of the residential units and a subsequent use permit and design review approval is required prior to the commencement of construction.

Grading and infrastructure improvement plans were submitted for Engineering review in summer 2024 and grading may begin in spring 2025.

OPTIONS ANALYSIS
Option 1: Receive and file the Snowcreek Development Agreement annual review report, finding the Developer in good faith substantial compliance with the terms and conditions of the Development Agreement.

Option 2: Receive and file the Snowcreek Development Agreement annual review report, finding the Developer in good faith substantial compliance with the terms and conditions of the Development Agreement, and comment on the report or request further information or public discussion at a future regular public meeting or closed session, as legally permitted.

Page 69 of 153 ends

4 Both options allow the Snowcreek DA annual report to be filed consistent with the requirements of the Snowcreek DA.

MAMMOTH LAKES TOWN COUNCIL

STAFF REPORT
1 Title: 2025/26 Parks and Recreation Department Fee Schedule Amendments.

Council Meeting Date: February 19, 2025
Prepared by: Stuart Brown, Parks and Recreation Director Katrina Kelly, Recreation Manager
Douglas Gebhart, Recreation Supervisor
Andrew McEachron, Recreation Supervisor
Sydney Schulz, Recreation Supervisor
RECOMMENDATION:

Conduct a Public Hearing and approve by resolution the 2025/26 Parks and Recreation Department fee schedule amendments as presented in Exhibit D.

BACKGROUND INFORMATION:

It is well documented that having access to quality parks and recreation services improves physical and mental health, reduces crime and violence, increases access to healthy foods, builds community and boosts economic activity. The fundamental purpose of the Parks and Recreation Department is to deliver on these community values and provide multi-purpose, year-round, indoor, and outdoor recreation opportunities accessible to all residents and visitors.

Combined with the 2025 Annual Programming Menu and the Department’s Draft 2025 Strategic Priorities and Key Objectives Statement, the 2025/26 Fee Schedule completes the administrative framework necessary to deliver high-quality, innovative, and affordable recreation programming for our residents and visitors of Mammoth Lakes.

ANALYSIS AND DISCUSSION:

The Parks and Recreation Department annually reviews and recommends appropriate fees for the many adult and youth camps programs, including the establishment of fees for facility reservations.

These fees are presented to the Parks and Recreation Commission, whose powers and duties as stated in section 2.36.050 (Powers and Duties) of the Municipal Code, empower this advisory body to “advise the Town Council and the Town Manager in all matters pertaining to all Town-owned or managed parks, recreation, facilities, trails, special events and all other associated activities as prescribed by ordinances or by town council action.” Municipal Code Section 3.40.040 (Schedule of fees and service charges) requires an annual review by the Town Council of Town fees and service charges. In addition, Ordinance No. 08-11 states that Town Council by resolution may annually set a subsidy for certain fees or charges, thereby not requiring that one hundred percent of costs reasonably borne are recovered by that certain fee or charge. Based on historical Town Council adopted subsidies (Ord. 91-08 & Ord. 95-07) for recreation programs, and the philosophy of the Parks and Recreation Department to provide broad and considerable community benefit and enhanced quality of life, the Department applies a high subsidy (approx. 70-80%) for youth programs and facility operations and a lower subsidy (approx. 10-20%) for adult programming.

Page 90 of 153 ends

2 The Parks and Recreation Department has conducted an extensive and exhaustive analysis of its services, the costs reasonably borne of providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for these services. In accordance with the Municipal Code, staff presented the 2025/26 Parks and Recreation Department Fee Schedule (Exhibit D) amendments to the Parks and Recreation Commission that was unanimously approved (3-0) at the regular meeting on February 4, 2025.

Proposed 2025/26 Fee Amendments
An overview of the proposed 2025/26 fee schedule amendments is listed below. The Department typically reviews and amends facility rental fees and admission fees every two years and adjusts recreation/instructional program fees annually. Reasonable fee recovery is based on a number of factors including the annual Consumer Price Index (CPI) which was approximately 3.3% for 2024, along with direct costs reasonably borne of providing parks and recreation services. Direct costs include seasonal staff wages, cost of contract or skilled instructor(s), excursion/overnight costs, and equipment/supply/food and transportation expenses. Many of these expenses have increased significantly over the past two years from inflationary pressure. Indirect costs, such as Department full-time employee salaries, healthcare, and workers compensation expenses, are not included in the cost recovery evaluation.

The Parks and Recreation Department Master Fee Schedule is attached for Town Council’s consideration (Exhibit D). A summary of the fee amendments is listed below.

Summary of 2025/26 Fee Amendments:

STAFFING CONSIDERATIONS:

The 2025 annual programming menu and associated fees and service charges were developed from an extensive analysis of 2024 products and services that are aligned with the existing and planned staffing levels within the Parks and Recreation Department.

LEGAL CONSIDERATIONS:

Municipal Code Section 3.40.040 (Schedule of fees and service charges) requires an annual review by Town Council of town fees and service charges. In accordance with the Municipal Code, staff presented the amended 2025/26 Parks and Recreation Department Fee Schedule to the Parks and Recreation Commission on February 4, 2025 that was unanimously approved by motion.

FINANCIAL CONSIDERATIONS:

Each year the Town of Mammoth Lakes conducts an extensive and exhaustive analysis of its services, the costs incurred by the Town in providing those services, the beneficiaries of those services, and the revenues produced by those paying fees and charges for special services. Based on historical Town Council adopted subsidies (Ord. 91-08 & Ord. 95-07) for recreation programs, and the philosophy of the Parks and Recreation Department to provide broad and considerable community benefit and enhanced quality of life, the Town applies a high subsidy (approx. 70- 80%) for youth programs and facility operations and a lower subsidy (approx. 10-20%) for adult programming. It should be noted that actual subsidies may vary based on several factors including program content, required staff, direct expenses (food, transport, and activities) and participation.

1 TOWN COUNCIL STAFF REPORT
Title: Resolution to Purchase Two TruNarc Devices in Partnership with the Mono County Sheriff and District Attorney’s Offices
Meeting Date: February 19, 2025
Prepared by: Dan Casabian, Chief of Police
RECOMMENDATION:

Adopt Resolution 2025-xx, authorizing the Town Manager to expend general funds, in partnership with the Mono County Sheriff and District Attorney’s Offices, to purchase two (2) Thermo Fisher Scientific TruNarc handheld narcotics analyzers with two-year warranties and training in the amount not to exceed $65,000, with expected reimbursement from Mono County Sheriff’s Office and Mono County District Attorney’s Office of $42,135.96 in total.

BACKGROUND:

Law enforcement officers face a real threat of potential drug exposure on the job while encountering dangerous substances like fentanyl during investigations. To protect against this exposure, the Mammoth Lakes Police Department (MLPD) would like to purchase and utilize a handheld narcotics analyzer, called TruNarc. Officers and the District Attorney’s Office previously used NIK testing kits, which required the officer to open any safety packaging the drugs are in, handle the drug in order to mix it with a solution, and then produce a positive or negative presumptive result.

However, the risk to Officers using NIK kits is now too high and they are no longer being used. There have been incidents of narcotic investigators being harmfully exposed to the substance fentanyl during evidence testing. Fentanyl is sometimes used as a cutting agent in commonly encountered drugs. Because law enforcement personnel can come in contact with these drugs during the normal course of duty, substances should remain packaged and be sent to a laboratory for analysis. Exposure via inhalation or skin absorption can be deadly.

The TruNarc device works by scanning through any clear packaging by simply holding the device up to the package and can identify more than 530 narcotics and drugs. Officers do not have to handle any type of drug, they just have to operate the scanner, then the drugs can be booked or re-booked just as they were seized. Items can be scanned multiple times for confirmation and scans are recorded and uploaded into a program that all users who are granted access can view.

In California, a defendant has the right to a preliminary hearing within 10 days of arraignment. For preliminary hearing purposes, presumptive results are allowed as

2 evidence. With constantly evolving changes in drug charges and laws, drug cases have increased in volume. Currently, all confirmatory testing for drugs occurs at the Bureau of Forensic Sciences in Fresno since NIK kits are no longer being used due to dangerous exposure to Officers. Turnaround time for results from the lab can take several weeks, which is often too late for preliminary court hearings. However, TruNarc scan results can be instantly used for the purpose of evidentiary value in preliminary and other court hearings, both protecting officers and preventing the loss of any case due to missing evidence.

ANALYSIS/DISCUSSION:

Staff research found that Thermo Fisher Scientific has developed a narcotics analyzer named TruNarc. The TruNarc handheld analyzer identifies dozens of narcotics, stimulants, depressants, hallucinogens, and analgesics using lab proven Raman spectroscopy. The TruNarc provides clear, definitive results for presumptive identification with no user interpretation.

TruNarc is currently being used by several Agencies throughout the country. MLPD has provided demonstrations with a loaner device to local partners. As a result of this, the Mono County District Attorney’s Office and the Mono County Sheriff’s Office (MCSO) have decided to share the cost of two (2) devices, with one residing at MLPD and the other at MCSO in Bridgeport.

FINANCIAL CONSIDERATIONS:

The cost of two TruNarc devices is $63,203.93 with all tax and shipping costs included.

This cost is based on government pricing and also includes a 2-year warranty. The amount is being split three ways between the Police Department, Mono County Sheriff’s Office, and the Mono County District Attorney’s Office with each Agency paying $21,067.98.

RESOLUTION NO. 25 -___

A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF MAMMOTH LAKES,

STATE OF CALIFORNIA, AUTHORIZING THE TOWN MANAGER TO EXPEND

GENERAL FUNDS, IN PARTNERSHIP WITH THE MONO COUNTY SHERIFF AND DISTRICT ATTORNEY’S OFFICES, TO PURCHASE TWO (2) THERMO FISHER

SCIENTIFIC TRUNARC HANDHELD NARCOTICS ANALYZERS WITH TWO-YEAR WARRANTIES AND TRAINING IN THE AMOUNT NOT TO EXCEED $65,000.00 WHEREAS, field testing of unknown substances for the presence of contraband drugs has become impossible due to dangerous potential exposure to persons; and WHEREAS, technology has advanced to safely allow for the accurate analysis of substances using lasers, thus greatly reducing the need for physical contact or manipulation; and WHEREAS, sending substances to the Bureau of Forensic Sciences for safe testing does not usually allow ample time for presumptive results for preliminary hearing purposes; and WHEREAS, Thermo Fisher Scientific is a sole source provider of the TruNarc analyzer, which has been evaluated and determined by the Chief of Police to be the best option for safely and expediently testing illicit substances.

NOW, THEREFORE, BE IT RESOLVED that the Mammoth Lakes Town Council hereby authorizes the Town Manager to expend General Funds to enter into an agreement with Thermo Fisher Scientific for the purchase of two (2) TruNarc handheld narcotics analyzers, with two-year warranties and training, in the amount of $63,203.93.

BE IT FURTHER RESOLVED that the Mono County Sheriff’s Office and the Mono County District Attorney’s Office will share in the cost of the TruNarc handheld narcotics analyzers, with each Agency contributing $21,067.98 of the purchase amount so that the devices can be shared with one residing in Mammoth Lakes, CA, and the other residing in Bridgeport, CA.

APPROVED AND ADOPTED this 19th day of February 2025.

Thermo Scientific Portable Analytical Instruments Inc (“Seller”) hereby offers for sale to the buyer named on the face hereof ("Buyer") the products listed on the face hereof (the "Products") on the express condition that Buyer agrees to accept and be bound by the terms and conditions set forth herein. Any provisions contained in any document issued by Buyer are expressly rejected and if the terms and conditions in this agreement (the “Agreement”) differ from the terms of Buyer’s offer, this document shall be construed as a counter offer and shall not be effective as an acceptance of Buyer’s document. Buyer’s receipt of Products or Seller’s commencement of the services provided hereunder will constitute Buyer’s acceptance of this Agreement. This is the complete and exclusive statement of the contract between Seller and Buyer with respect to Buyer's purchase of the Products. No waiver, consent, modification, amendment or change of the terms contained herein shall be binding unless in writing and signed by Seller and Buyer. Seller's failure to object to terms contained in any subsequent communication from Buyer will not be a waiver or modification of the terms set forth herein. All orders are subject to acceptance in writing by an authorized representative of Seller.

2. PRICE. All prices published by Seller or quoted by Seller’s representatives may be changed at any time without notice. All prices quoted by Seller or Seller’s representatives are valid for thirty (30) days, unless otherwise stated in writing. All prices for the Products will be as specified by Seller or, if no price has been specified or quoted, will be Seller's price in effect at the time of shipment. All prices are subject to adjustment on account of specifications, quantities, raw materials, cost of production, shipment arrangements or other terms or conditions, which are not part of Seller's original price quotation.

3. TAXES AND OTHER CHARGES. Prices for the Products exclude all sales, value added and other taxes and duties imposed with respect to the sale, delivery, or use of any Products covered hereby, all of which taxes and duties must be paid by Buyer. If Buyer claims any exemption, Buyer must provide a valid, signed certificate or letter of exemption for each respective jurisdiction. Buyer shall be solely responsible for obtaining any and all necessary licenses, registrations, certificates, permits, approvals or other authorizations required by federal, state or local statute, law or regulation pertaining to the use or possession of the products contemplated herein that include radioactive isotopes, or x-ray tubes if any.

Buyer shall pay Seller such surcharges, or other fees, in respect of the sale of Products hereunder as Seller deems necessary and appropriate (in Seller’s sole, good-faith, reasonable discretion) to account for changes in the cost to product, develop, market, or sell the Products to Buyer hereunder (whether as the result of the imposition of tariffs or otherwise). All such surcharges must be paid by Buyer in accordance with the payment terms set forth herein. Buyer agrees that such surcharges, or other fees, or any termination thereof, shall take effect immediately upon written notice thereof by Seller to Buyer. In the event that Seller’s quote and/or order acknowledgement set forth surcharges, those documents shall be considered adequate written notice to Buyer that said surcharges are Buyer’s responsibility. Any such surcharges shall not constitute an increase in the Price(s) of any Products or Services sold under this Agreement

4. TERMS OF PAYMENT. Seller may invoice Buyer upon shipment for the price and all other charges payable by Buyer in accordance with the terms on the face hereof. If no payment terms are stated on the face hereof, payment shall be net thirty (30) days from the date of invoice. If Buyer fails to pay any amounts when due, Buyer shall pay Seller interest thereon at a periodic rate of one and one-half percent (1.5%) per month (or, if lower, the highest rate permitted by law), together with all costs and expenses (including without limitation reasonable attorneys' fees and disbursements and court costs) incurred by Seller in collecting such overdue amounts or otherwise enforcing Seller's rights hereunder.

Seller reserves the right to require from Buyer full or partial payment in advance, or other security that is satisfactory to Seller, at any time that Seller believes in good faith that Buyer's financial condition does not justify the terms of payment specified. All payments shall be made in U.S.

Dollars.

5. DELIVERY CANCELLATION OR CHANGES BY BUYER. The Products will be shipped to the destination specified by Buyer, F.O.B. shipping point. Seller will have the right, at its election, to make partial shipments of the Products and to invoice each shipment separately. Seller reserves the right to stop delivery of Products in transit and to withhold shipments in whole or in part if Buyer fails to make any payment to Seller when due or otherwise fails to perform its obligations hereunder. All shipping dates are approximate only, and Seller will not be liable for any loss or damage resulting from any delay in delivery or failure to deliver which is due to any cause beyond Seller's reasonable control. In the event of a delay due to any cause beyond Seller's reasonable control, Seller reserves the right to terminate the order or to reschedule the shipment within a reasonable period of time, and Buyer will not be entitled to refuse delivery or otherwise be relieved of any obligations as the result of such delay. Products as to which delivery is delayed due to any cause within Buyer's control may be placed in storage by Seller at Buyer's risk and expense and for Buyer's account. Orders in process may be canceled only with Seller's written consent and upon payment of Seller's cancellation charges. 7. TITLE AND RISK OF LOSS. Notwithstanding the trade terms indicated above and subject to Seller’s right to stop delivery of Products in transit, title to and risk of loss of the Products will pass to Buyer upon delivery of possession of the Products by Seller to the carrier irrespective of which Party’s carrier is used for the transport or the manner of payment ascribed to the transport; provided, however, that title to any software incorporated within or forming a part of the Products shall at all times remain with Seller or the licensor(s) thereof, as the case may be.

8. WARRANTY. Seller warrants that the Products will operate or perform substantially in conformance with Seller's published specifications and be free from defects in material and workmanship, when subjected to normal, proper and intended usage by properly trained personnel, for the period of time set forth in the product documentation, published specifications or package inserts. If a period of time is not specified in Seller’s product documentation, published specifications or package inserts, the warranty period shall be one (1) year from the date of shipment to Buyer for equipment and ninety (90) days for all other products (the "Warranty Period"). During the Warranty Period, Seller agrees, in its sole discretion, to repair or replace, Products and/or provide additional parts or services as reasonably necessary to cause the same to perform in substantial conformance with said published specifications; provided that Buyer shall (a) promptly notify Seller in writing upon the discovery of any defect, which notice shall include the product model and serial number (if applicable) and details of the warranty claim; and (b) after Seller’s review, Seller will provide Buyer with service data and /or a Return Material Authorization (“RMA), which may include biohazard decontamination procedures and other product-specific handling instructions, then, if applicable, Buyer may return the defective Products to Seller with all costs prepaid by Buyer. Replacement parts may be new or refurbished, at the election of Seller. All replaced parts shall become the property of Seller. Shipment to Buyer of repaired or replacement Products shall be made in accordance with the Delivery provisions of the Rev October 2024 Seller’s Terms and Conditions of Sale. Consumables are expressly excluded from this warranty. If Seller elects to repair defective device instruments, Seller may, in its sole discretion, provide a replacement loaner instrument to Buyer as necessary for use while the instruments are being repaired. Notwithstanding the foregoing, Products supplied by Seller that are obtained by Seller from an original manufacturer or third party supplier are not warranted by Seller, but Seller agrees to assign to Buyer any warranty rights in such Product that Seller may have from the original manufacturer or third party supplier, to the extent such assignment is allowed by such original manufacturer or third party supplier. In no event shall Seller have any obligation to make repairs, replacements or corrections required, in whole or in part, as the result of (i) normal wear and tear, (ii) accident, disaster or event of force majeure, (iii) misuse, fault or negligence of or by Buyer, (iv) use of the Products in a manner for which they were not designed, (v) causes external to the Products such as, but not limited to, power failure or electrical power surges, (vi) improper storage and handling of the Products or (vii) use of the Products in combination with equipment or software not supplied by Seller. If Seller determines that Products for which Buyer has requested warranty services are not covered by the warranty hereunder, Buyer shall pay or reimburse Seller for all costs of investigating and responding to such request at Seller's then prevailing time and materials rates. If Seller provides repair services or replacement parts that are not covered by this Warranty shall pay Seller therefor at Seller's then prevailing time and materials rates.

Seller hereby grants to Buyer a royalty-free, non-exclusive, nontransferable license, without power to sublicense, to use software provided hereunder solely for Buyer's own internal business purposes on the hardware products provided hereunder and to use the related documentation solely for Buyer's own internal business purposes. This license terminates when Buyer's lawful possession of the hardware products provided hereunder ceases, unless earlier terminated as provided herein. Buyer agrees to hold in confidence and not to sell, transfer, license, loan or otherwise make available in any form to third parties the software products and related documentation provided hereunder. Buyer may not disassemble, decompile or reverse engineer, copy, modify, enhance or otherwise change or supplement the software products provided hereunder without Seller's prior written consent. Seller will be entitled to terminate this license if Buyer fails to comply with any term or condition herein. Buyer agrees, upon termination of this license, immediately to return to Seller all software products and related documentation provided hereunder and all copies and portions thereof

A well-established technique for identifying chemicals, Raman spectroscopy has been used in forensic laboratory analysis for decades. It is widely accepted by the scientific community and has a proven track record in the United States court system.

Point and Shoot Simplicity
A handheld Raman analyzer can ID hundreds
of narcotics, precursors or cutting agents in
seconds-right at the scene. With high
specificity,the analyzer is non-destructive,
non-contact and easy to use.

Court-admissible ResuIts
Handheld Raman analysis is allowed in early
court proceedings. Law enforcement gains
probable cause and the ability to charge
suspects while rapidly moving cases through
the system.

Lower Costs
Given the cost per sample at the crime lab,
drug testing can run tens of thousands of
dollars per month. By deploying a handheld
Raman analyzer, law enforcement can realize
substantial savings over the life of the instrument.

Early Warning Sign
Handheld Raman analysis helps discover novel
synthetic compounds. When these new
substances are understood at the lab level, the
informationis quickly passedback to the analyzer
for positive field ID.

1 TOWN COUNCIL STAFF REPORT
Title: Approve official Town of Mammoth Lakes logo.

Meeting Date: February 19, 2025
Prepared by: Pam Kobylarz, Assistant to the Town Manager Rob Patterson, Town Manager
RECOMMENDATION:

Approve official Town of Mammoth Lakes logo.

BACKGROUND:

The Town of Mammoth Lakes has been using its current logo since 2011 both in the capacity of marketing the Town and to represent the Town of Mammoth Lakes as a municipal entity. Prior to 2011, the Town used a different logo that looked more like an official seal, pictured below.

Current Mammoth Lakes and Town logo
since 2011.

Previous Town logo.

The current logo has been very successful at marketing and branding Mammoth Lakes and is widely distributed. The Town’s Municipal Code has very specific requirements for the use and distribution of the Town name and logo, and the current Mammoth Lakes logo doesn’t meet those requirements since it’s so publicly accessible.

Municipal Code 1.24.010 states: “The Town logo is a design used for the purpose of symbolically representing the authority of the Town and the capacity of its officers, employees, and agents as representatives of the Town.”
M.C. Section 1.24.030 (a) states: “No person other than an officer or employee of the Town, shall use the Town logo or any representation thereof or the words “Town of Mammoth Lakes” for any purpose except to the extent authorized to do so.” ANALYSIS:

On September 6, 2023, the Town Council authorized staff to “develop a new logo for the Town of Mammoth Lakes using an iteration of the current Town logo that clearly defines

Page 138 of 153 ends

2 the Town of Mammoth. Direct staff to work with Mammoth Lakes Tourism (MLT) and bring the item back to Council for implementation.”
Since that time, staff has been working with our contract graphic design team, Mammoth Lakes Creative, to design a new logo for the Town of Mammoth Lakes. The Town has been working with Mammoth Lakes Creative since 2019, and over the years they have developed informal “branding” for the Town, including font types and a color scheme, which were used on the Town’s website redesign as well as on numerous collateral that is published by the Town. It made sense to build on these branding efforts to develop a logo that is both consistent with existing Town branding and complimentary to the existing Mammoth Lakes marketing logo.

Staff provided the following design direction to Mammoth Lakes Creative:
 Include “Town of Mammoth Lakes” and “Incorporated 1984”.  Limited color palette to reflect current logo relationship (Town Blue) and other TOML branding done by MLC to date. Use same or similar color palette as used for website redesign.
 “Iteration” of current Mammoth Lakes logo.
 Able to have several layouts of the logo for different uses/placement.  Ability to include department name in at least one version of the logo.  Color and black and white versions.
 Easy-to-read font.
 Adjectives: timeless, official, distinguishable.
 Uses: Print, web, embroidery on uniforms, signage, vehicle decals.  Include the following elements: water, trees, sky, snow, and mountains.

A design committee was established that consisted of the following members:

Councilmembers Chris Bubser and Amanda Rice, John Urdi representing Mammoth Lakes Tourism, and staff members Stu Brown, Pam Kobylarz, and Rob Patterson. Through the process, the committee was presented with several initial design concepts and worked through approximately nine revisions to get to the final product. Today staff is requesting that Town Council approve the “primary” version of the logo. The committee has approved the proposed logo.

Proposed Town of Mammoth Lakes official logo.

Page 139 of 153 ends

3 Next steps: Once the primary logo is approved, staff will work with Mammoth Lakes Creative on the following implementation process:
 Work to design and approve 1-2 supplemental logo designs (horizontal and/or other formats)
 Determine whether departmental color schemes will be used and develop as appropriate.
 Develop use and branding guidelines.
 Develop and start using new business cards, letterhead, etc. Develop and install signage as and where appropriate.

The existing Mammoth Lakes marketing logo will continue to be used by the Town for a variety of reasons including on public-facing signage and at the CRC. The Mammoth Lakes logo will continue to serve as the marketing logo for the entire Town. The new Town of Mammoth Lakes logo will be limited in its use and distribution only for official Town purposes including on vehicles, Town Council chamber signage, staff uniforms when out in the field, and on official correspondence from the Town.

OPTIONS ANALYSIS
Option 1: Approve the official Town of Mammoth Lakes logo.

Option 2: Do not approve the official Town of Mammoth Lakes logo and provide staff with direction.

FINANCIAL CONSIDERATIONS:

There will be some costs associated with implementing the new logo, including purchasing signage, vehicle decals, and other items. For some items, such as envelopes, we will use up current stock prior to purchasing new ones. Staff will work to develop a full plan for implementation.

LEGAL CONSIDERATIONS:

The current Town logo does not give Town staff any authority as “officers of the Town” and there is nothing prohibiting members of the public from wearing the logo or using the logo for any number of purposes. Therefore, the Town is not able to comply with its own Municipal Code with the current logo.

Mammoth Lakes Town Council
Agenda Action Sheet
Title: 2025 Town Council Strategic Planning Series – Final Review of Key Objectives Council Meeting Date: 2/19/2025
Prepared by: Rob Patterson, Town Manager
Pam Kobylarz, Assistant to the Town Manager
Haislip Hayes, Public Works Director
Stu Brown, Parks & Recreation Director
Recommended Motion: Receive a presentation from staff and provide consensus comments on final categories and elements, including vision statement for a final document for adoption on March 5, 2025.

Summary: The Town Council and staff have been working on the development of these key objectives for 2025 for the last three months, through a series of meetings designed to analyze important adjustments to core services, development of Town Council vision, and community engagement. The intent of this document is to provide both staff and the Town Council with a road map to achieve critical goals for our community. After this final review of the key objectives, with specific input requested below on content, vision statement, and format, staff will produce the final version for adoption at the March 5th Town Council meeting.

Staff have made adjustments to the document based on feedback received at the February 5th Town Council meeting. The final draft document, while high level, reflects a simple, and condensed approach to our planning efforts. Previous documents used more visionary statements, while this version has a directed, task-orientated theme, designed to provide clear direction to maximize accomplishments. Staff are seeking a review and confirmation of these summarization efforts for the final document.

With the visionary elements removed from specific line items, an overall vision statement is important to set the context of the document. Through this extended process, the Town Council has been sharing their desired direction for our organization in serving our community. The shortterm vision statement included in this document is a summarization of staff notes and the cumulative theme of the key objectives. Staff are seeking a review and edit of the short-term vision statement for the final document.

Staff have also focused on the format of the document, seeking a more visually appealing form, reducing the number of words, providing visual elements and presentation layout. Staff are seeking a review of this layout for the final document.

MAMMOTH LAKES TOWN COUNCIL

STAFF REPORT
1 Title: 2025 Youth Sports Funding Award
Council Meeting Date: February 19, 2025
Prepared by: Stuart Brown, Parks and Recreation Director Katrina Kelly, Recreation Manager
RECOMMENDATION: Award Town funds to eight local youth sports organizations.

BACKGROUND INFORMATION:

The Town of Mammoth Lakes and Mono Country provide funding to supplement organized, nonprofit, and self-sustaining youth sports programs that may be in need of additional funding to provide enhanced programing or to foster greater participation from low-income residents.

At the regular meeting of the Parks and Recreation Commission on February 4, 2025, the Commission unanimously (3-0) approved the funding recommendations as presented by Town staff in Table 1.

ANALYSIS AND DISCUSSION:

The application period for the 2025 award opened on Monday, January 6 and closed on Friday, January 24, 2025.

A total of eight (8) Youth Sports Funding applications were filed and received by the Parks and Recreation Department. Staff reviewed each application and confirmed their eligibility for funding, with the exception of Mammoth High School (MHS) Boosters. Staff determined that MHS Boosters does not meet the application criteria of being an ‘organized, non-profit youth sports program’. Rather, the MHS Boosters is a ‘parent-teacher-community organization… [that] promotes success in academics, athletics, and the arts’ by providing financial support to MHS programs. The Town broadly supports MHS programs through the extensive TOML/MUSD Joint Use Agreement, providing fully maintained and game-ready athletic fields and facilities at no charge to school students. It is a partnership that provides tremendous value for the youth of Mammoth Lakes and surrounding communities.

Staff would also like to make the Commission aware that Mono County Little League chose not to submit an application this year as they work to regain their non-profit status. They plan to meet all eligibility criteria and apply for funding in 2026. In addition, Mammoth Track Club notified the Department that they will not be hosting a youth camp this summer.

A summary of 2025 funding applications can be viewed in Table 1 and in detail in Attachment A.

Complete funding applications are posted for public review on the dedicated Youth Sports Funding page.

2 Tony Colasardo Scholarship Fund
The Tony Colasardo Scholarship Fund provides full and partial scholarships for recreation programs provided, and supported, by the Mammoth Lakes Parks and Recreation Department.

Scholarships are awarded on an annual, calendar-year basis, and provide either a 50%, 75%, or 90% discount. During 2023, the Tony Colasardo Scholarship Fund was extended to youth sports participants to help with registration fees. Staff plan to continue working with each Youth Sports Organization during their registration periods to raise awareness of the scholarship program. The purpose is to further promote youth participation and inclusivity throughout Mono County.

Funding Methodology
Based on the fluctuating available funds year over year, the different operating environments that each youth sporting organization experiences, the disparate number of participants that each organization serves and the different types of non-profits and their missions, staff utilize a tiered funding methodology. Each organization is categorized and placed in one of four tiers. Based on the average cost per participant of the varying sports and the associated expenses (i.e. swimming/hockey has a higher facility cost versus soccer or baseball based on Town facility use agreements), staff assigned a set revenue amount per participant.

The Funding Tiers and revenue amount per participant are as follows:

Tier Definition Revenue/Participant
One Youth Sports Organizations that use Town facilities and pay <$1/year $40 Two Youth Sports Organizations that have facility fees OR staff costs $46 Three Youth Sports Organizations that have facility fees AND staff costs $66 Four A non-profit organization that provides and delivers valuable community youth programming

3 STAFFING CONSIDERATIONS:

The youth sports funding program is part of the department’s annual work program.

FINANCIAL CONSIDERATIONS:

Funds are approved by the Town Council every year as part of the annual Town Budget process.

A total of $47,000 is available for award, but due to the absence of Mono County Little League and the Mammoth Track Club, $45,000 is recommended for award with a balance of $2,000 remaining to supplement an existing eligible youth sports organization’s request for additional funding or for a new organized, non-profit, and self-sustaining youth sports program.
