A RESOLUTION OF THE MANHATTAN BEACH CITY
COUNCIL APPROVING AMENDMENT NO. 5 TO THE
AGREEMENT BETWEEN THE CITY OF MANHATTAN
BEACH AND MERCHANTS LANDSCAPING SERVICES
FOR CITYWIDE LANDSCAPING TO INCREASE
COMPENSATION BY $325,000 FOR FIS CAL YEAR 2021 -
22 THE MANHATTAN BEACH CITY COUNCIL HEREBY RESOLVES AS
FOLLOWS:
SECTION 1. The City Council hereby approves Amendment N o. 5 (“Amendment”) to the Agreement between the City of Manhattan Beach and Merchants Landscaping Services for citywide lan dscaping services extras outside the base agreement in the amount of $325,000 and authorizes the City Manager to execute the Amendment.
SECTION 2. The City Clerk shall certify to the passage and adoption of this resolution.

Commented [A1]: Is extras defined in the agreement? Are the new services “extras”?
Commented [A2R1]: In speaking with Lindsay, it was
most appropriate to list this amount as an increase in extras so that it does not muddle the core contract scope. Erick added in the staff report that the extras are “outside the base agreement.”
The contract defines extras as “Extra work is that work not included under the various bid items nor the result of the Contractor's negligence. Extra work shall include but not be limited to: new and/or replacement planting of various plant material. The City will pay for all extra work at a price approved by the City prior to completion of the work.”
