At 3:02 PM, Mayor Stern announced that the City Council would recess into Closed Session.
A point has been reached where, in the opinion of the City Council on the advice of its City Attorney, based on existing facts and circumstances, there is a significant exposure to litigation against the City.

At 3:49 PM, the City Council reconvened into Open Session with all Councilmembers present.
IV. CLOSED SESSION ANNOUNCEMENT IN OPEN SESSION
City Attorney Barrow announced that the City Council went into Closed Session to discuss the three items identified on the agenda. In respect to Keen v City of Manhattan Beach, by a 5-0 vote, the City Council authorized the City Attorney to seek California Supreme Court review of the Court of Appeals decision. With respect to the other two items, the City Council gave direction. There was no other reportable action.
F. ADJOURNMENT
At 3:51 PM, Mayor Stern adjourned the special meeting.
