A RESOLUTION AUTHORIZING ENTERING INTO A
FUNDING AGREEMENT WITH THE STATE WATER
RESOURCES CONTROL BOARD AND AUTHORIZING AND
DESIGNATING REPRESENTATIVE S FOR THE BEACH
INFILTRATION PROJECT AT THE 26TH STREET PARKING
FACILITY
Whereas, the City of Manhattan Beach has submitted an application to the State Water Resources Control Board for funding for the Beach Infiltration Project at the 26 th Street Parking Facility (Project), which includes a diversion from the storm drain on 28 th Street and installation of a series of drywells beneath the 26th Street Parking Facility to support stormwater capture and improved water quality; and
Whereas, prior to the State Water Res ources Control Board's executing a funding agreement, the City of Manhattan Beach is required to adopt a resolution authorizing an agent, or representative, to sign the funding agreement, amendments, and requests for disbursement on behalf of the City of Manhattan Beach, and to carry out other necessary Project-related activities;
Now, therefore, be it resolved and ordered, that the City of Manhattan Beach is hereby authorized to carry out the Project, enter into a funding agreement with the State Water Resources Control Board, and accept and expend State funds for the Project; and
Be it further resolved and ordered, that the Public Works Director, or designee, is hereby authorized and designated to sign, for and on behalf of the City of Manhattan Beach , the funding agreement for the Project and any amendments thereto; and
Be it further resolved and ordered, that the Public Works Director, or designee, is hereby authorized and designated to represent the City of Manhattan Beach in carrying out the City of Manhattan Beach’s responsibilities under the funding agreement, including certifying invoices and disbursement requests for Project costs on behalf of the City of Manhattan Beach and compliance with applicable state and federal laws.
Be it further resolve d and ordered, that any and all actions, whether previously or subsequently taken by the City of Manhattan Beach , which are consistent with the intent and purposes of the foregoing resolution, shall be, and hereby are, in all respects, ratified, approved and confirmed.
