RESOLUTION NO. 22-0079
A RESOLUTION OF THE MANHATTAN BEACH CITY
COUNCIL ADOPTING WATER RATES AND CHARGES FOR
THE PERIOD OF NOVEMBER 1, 2022 THROUGH
NOVEMBER 1, 2027
WHEREAS, on April 5, 2022, the Manhattan Beach City Council adopted Resolution Nos. 22-0043 and 22-0044 initiating the Proposition 218 process, setting the Public Hearing date and establishing the procedures in connection with the proposed changes to the water rates and charges (“rates”);
WHEREAS, the City of Manhattan Beach postmarked Proposition 218 notices on April 15, 2022 , for all property owners and rate payers and complied with the required protest period;
WHEREAS, on May 3, 2022, the Manhattan Beach City Council adopted Resolution Nunc Pro Tunc No. 22 -0061, correcting a clerical error in Resolution No. 22-0043;
WHEREAS, it is now appropriate to approve water rates for the period beginning November 1, 2022, with adjustments on November 1 in the years 2023, 2024, 2025, and 2026;
WHEREAS, the City Council set June 7, 2022, as the date of a public hearing to consider the proposed changes to the water rates;
WHEREAS, the City Clerk provided notice of the time and place of the public hearing in accordance with law; and
WHEREAS, the City Council has held a full and fair duly noticed public hearing on the proposed changes to the water rates where all interested persons were afforded the opportunity to hear and be heard thereon, and the City Council considered all objections and protests thereto.
NOW, THEREFORE, THE MANHATTAN BEACH CITY COUNCIL
HEREBY RESOLVES, FINDS AND DETERMINES AS FOLLOWS:
SECTION 1. No Majority Protest. Written protests with respect to the proposed changes to the water rates have not been presented by a majority of owners of the parcels subject to the proposed rate increases or tenants of such parcels directly responsible for the payment of the charges, and therefore no majority protest exists.
All protests and objections to the proposed changes to th e water rates are hereby overruled.
SECTION 2. Rates. The City Council hereby adopts the water rates for water services, as set forth in the rate schedule attached hereto as Exhibit A and incorporated by reference herein. The new rates are effective November 1, 2022, and will be adjusted each November 1 thereafter through November 1, 2026. The attached schedule shows the rates, subject to potential pass-through adjustments.
SECTION 3. If any subsection, sentence, clause, phrase or word of this Resolution is for any reason held to be invalid by a court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of the Resolution. The City Council hereby declares that it would have passed and adopted this Resolution and each and all of the provisions thereof irrespective of the fact that any one or more of said provisions may be declared invalid.
SECTION 4. The City Clerk shall certify to the passage and adoption of this resolution.
