RESOLUTION NO. 23-0010
A RESOLUTION OF THE MANHATTAN BEACH CITY
COUNCIL AUTHORIZING DEVIATIONS FROM THE
MANHATTAN BEACH LOCAL COASTAL PROGRAM AND
TITLE 10 OF THE MANHATTAN BEACH MUNICIPAL CODE
DURING THE LOCAL EMERGENCY PROCLAIMED ON
MARCH 13, 2020
THE MANHATTAN BEACH CITY COUNCIL HEREBY RESOLVES AS
FOLLOWS:
Section 1. The City Council hereby authorizes deviations from the provisions of the City’s Local Coastal Program and Title 10 of the Municipal Code to the extent such provisions affect actions related to the provision of housing, including but not limited to the implementation of Ordinance Nos. 23-0001 and 23- 0001-U, during the local emergency proclaimed on March 13, 2020.
Section 2. If any section, subsection, sentence, clause, or phrase of this Resolution is for any reason held to be invalid or unconstitutional by a decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining portions of this Resolution. The City Council hereby declares that it would have passed this Resolution and each and every section, subsection, sentence, clause, or phrase not declared invalid or unconstitutional without regard to whether any portion of such Resolution would be subsequently declared invalid or unconstitutional.
Section 3. The City Clerk shall certify to the passage and adoption of this Resolution.
