AMENDMENT NO. 1 TO THE DESIGN SERVICES AGREEMENT BETWEEN
THE CITY OF MANHATTAN BEACH AND DAVID VOLZ DESIGN LANDSCAPE ARCHITECTS, INC.
This First Amendment (“Amendment No. 1”) to that certain agreement by and between the City of Manhattan Beach, a California municipal corporation (“City”) and David Volz Design Landscape Architects, Inc. , a California corporation (“Consultant”) (collectively, the “Parties”) is hereby entered into as of September 5, 2023 (“Effective Date”).
RECITALS
A. On April 14, 2023, the City and Consultant entered into an agreement for design services for the Consultant to provide landscape design services (“Agreement”).
B. T he Parties now desire to amend the Agreement to i ncrease the Maximum Compensation and modify the Scope of Services.
NOW, THEREFORE, in consideration of the Parties’ performance of the promises, covenants, and conditions stated herein, the Parties hereby agree as follows:
Section 1. Section 3.A of the Agreement is hereby revised to increase the Maximum Compensation amount by $144,700.00, for a total Maximum Compensation of $193,690.
Section 2. E xhibit A, Scope of Services and Approved Fee Schedule of the Agreement is hereby modifi ed by the Scope of Services and Approved Fee Schedule A-1 attached to this Amendment.
Section 3. E xcept as specifically amended by this Amendment No. 1, all other provisions of the Agreement shall remain in full force and effect.

SCOPE OF SERVICES AND APPROVED FEE SCHEDULE
AMENDMENT NO. 1:
The Scope of Work described below in this Amendment No. 1, shall be considered additional work to the original Scope of Work in the Agreement.
INDIVIDUAL PROJECT ORDER NO. 4 – SAND DUNE PARK
Consultant shall provide conceptual design services for planning park improvements at Sand Dune Park. Consultant shall provide the following services and deliverables as proposed.
Task 1 – Project Initialization
a. Initial kickoff meeting with City project staff
• Review project criteria and program objectives
• Review procedures and design schedule
• Assign calendar dates to each milestone
b. Background Research
• Collect available data and maps
• Meet with City project personnel
• Review preliminary project program
• Review plans and documents of the site
• Review initial opportunities
o Identify opportunities and constraints
o Identify surrounding uses and connections
c. Prepare planning map
• Review schematic layouts with City staff
• Obtain direction to prepare initial program graphic
Task 2 – Community Engagement
a. Prepare maps and graphics based on initial program with style pictures
b. Attend community outreach meetings
c. Document input received
• Prepare summary of input from community
• Work with City to update project program
*For tasks 1 and 2, Consultant shall attend one (1) community meeting and provide community outreach exhibits.

Task 3 – Engineering Services
a. Site Plan
• Site topographic survey
• Provide site layout plan
• Review City staff
• Provide final site plan colored rendering
b. Preliminary Engineering Studies
• Geotechnical soils and report
• Grading and drainage plan
• Utilities review
• Parking schematic plan
• Construction cost budget estimates
*For task 3, the Consultant shall provide site layout plans and exhibits, topographic survey, geotechnical report, and preliminary engineering plans.
Task 4 – Concept Plans
a. Review input received from previous commu nity outreach with City project team
b. Prepare two (2) preliminary concept plan
• Develop maps and renderings
• Prepare initial concept plans for City staff review
a. Construction cost budget estimates
• Prepare analysis of construction cost for each plan options
b. Final Engineering Studies
• Prepare preliminary grading and drainage schematic
• Utilities review
• Parking schematic plan
• Provide final concept plan rendering
• Update construction budget estimate
*For task 4, the Consultant shall attend one (1) review meeting with City staff and provide two (2) concept plans, construction cost budget, proposal for construction documents, and present to City Council and Commission.
