RESOLUTION NO. 23-0120
A RESOLUTION OF THE MANHATTAN BEACH CITY COUNCIL
SETTING FORTH FINES AND PENALTIES FOR
ADMINISTRATIVE CITATIONS FOR VIOLATIONS OF BICYCLE ,
ELECTRIC BICYCLE, AND MOTORIZED BICYCLE
REGULATIONS
THE MANHATTAN BEACH CITY COUNCIL HEREBY RE SOLVES AS
FOLLOWS:
SECTION 1. Resolution No. 16 -0057 is hereby amended to add a new paragraph (D) to read as follows:
“(D) Notwithstanding any other provision of law, violations of Urgency Ordinance No. 23 -0008-U, or any subsequently ad opted regulation of bicycles, electric bicycles, or motorized bicycles, shall be treated as a misdemeanor punishable by: (1) a fine not exceeding $500 for the first violation; (2) a fine not exceeding $750 for the second violation within one year; and (3) a fine not exceeding $1,000 for each additional violation within one year of the first violation.”
SECTION 2. The adoption of this Resolution approves and sets forth a procedure for establishing fines and penalties for administrative citations for violations of Urgency Ordin ance No. 23 -0008-U, or any subsequently adopted regulation of bicycles, electric bicycles, or motorized bicycles , and is, therefore, exempt from the California Environmental Quality Act pursuant to Public Resources Code Section 21080(b)(8)(A).
SECTION 3. The City Clerk shall certify to th e passage and adoption of this Resolution.
